MUNICIPAL 1989 Municipal Assistance Grant ASSISTANCE GRANT Mr. Eriksson summarized with Council a report regarding the above. 153/89 Moved by J. Coombes that the Minister of Municipal Affairs be requested to utilize IP 1989 population, equalized assessment and road mileage for calculation of the M.D.'s Municipal Assistance Grant for 1989.

SUBDIVISION Mr. Wardlow reported to Council the situation regarding APPLICATION the Culshaw Subdivision. Discussion was held regarding the possibility of having the building sites restricted P as well as have a lift station for sewage. 154/89 Moved by B. Booth that with regards to the subdivision application - NW 3-49-7 W5M - P Douglas John Culshaw:

(1) the subdivision application be refused in the present form and should the applicants pi provide an Area Structure Plan which would include River Ridge, or standing on its own, at that time it would receive further consideration; and

(2) should the applicant wish to bring the matter back before Council, they seriously consider the cost benefits of a lift station, or as an alternative, a pump station.

RENEWAL OF Mr. Eriksson informed Council that certain road allowance LEASES leases which have been passed on from the County of Leduc and County of Parkland No. 31 should have Council's endorsement for renewal for the 1989 year.

REQUEST FOR Road Allowance - Coyote Lake Ranch Ltd. - SE 19/SW LEASE 20-49-4 W5M pi Mr. Wardlow reviewed the request for lease with Council.

157/89 Moved by W. Tweedle that:

(1) the request for lease of a road allowance from Coyote Lake Ranch Ltd. - SE 19/SW 20-49-4 W5M be refused; and

(2) a letter be sent to Mr. Secord informing him that he cannot use the road allowance for cattle grazing.

Mr. Coombes requested information regarding sanctuaries. p REQUEST FOR NW 33-49-7 W5M - Terrill Nelson TREE BARRIER Mr. Wardlow presented Council with a map showing the area in which the trees are requested to be planted. He informed Council that this particular request is not P eligible under the Shelter Belt Program.

158/89 Moved by N. Norton that a letter be sent to Terrill Nelson informing her that we do not SI have a program which would provide for a tree barrier at NW 33-49-7 W5M.

Mr. Rick Flikkema attended the meeting at 10:05 a.m.

Mr. Eriksson introduced Mr. Flikkema to Council as the new Utility Coordinator. Mr. Rondeau welcomed Mr. Flikkema to the M.D.

APPROVAL OF Mr. Eriksson informed Council that due to the Public VEHICLE USE Safety Officer and Utility Coordinator being on call, they should have approval to use their vehicles coming to and from the workplace.

159/89 Moved by B. Booth that the following positions be required to utilize municipal vehicles in travelling to and from the work place in view of their responsibilities to the municipality:

Mr. Tatro and Mr. Joe Schlaut, Alberta Transportation, attended the meeting at 10:07 a.m. 1 S.R. 620 Mr. Tatro introduced Mr. Joe Schlaut from Alberta Transportation.

Mr. Schlaut informed Council that a Newsletter will be coming shortly regarding the surfacing of Elk River Road to Lodgepole.

He also indicated that with regards to the passing lanes on S.R. 620, it looks like they may fit right into the existing right-of-way. He mentioned that he has requested that 3,000 tons of paving material be provided for patching and that he will attempt to have Alberta Transportation provide the contracting for this purpose.

Discussion was held with regards to the road from Lodgepole m to Cynthia as well as the possibility of having an agreement with Pelican Mills to pick up logs which have fallen off and are lying in the ditches.

The Goliad Road was also discussed (slippage).

Mr. Tatro and Mr. Schlaut left the meeting at 10:30 a.m.

1988 CRC Mr. Eriksson reviewed the report and recommendation regarding GRANTS 1988 CRC Funding.

160/89 Moved by B. Booth that:

(1) The amount of $7,037.00 be paid to the D.V. Library as a contribution to 1988 operations.

(2) The amount of $15,581.00 be held in reserve until an agreement is completed with the Town of Drayton Valley covering cost sharing on the new library facility.

(3) The amount of $2,000.00 be held in reserve and utilized in 1989 for the preparation of a Recreation Master Plan.

(2) Bill Fleming be authorized to attend the North American Conference of the Government Finance Officers' Association to be held PI in Seattle, Washington - June 4-7, 1989.

(3) Bill Fleming be authorized to attend the Western Canada Conference of the Government Finance Officers' Association to be held in Edmonton in September, 1989.

TAX OVER Mr. Fleming informed Council that Amoco has over paid their PAYMENT - taxes by an amount of $6,660.23 and that they should be AMOCO reimbursed for this amount.

Discussions were held regarding the Meridian Foundation split. 1

HODGSON Mr. Wardlow presented Council with an article that appeared GRAVEL PIT in the 89 02 07 Western Review regarding the Hodgson Gravel Pit. 1 Mr. Wardlow read a letter which was sent to Heather Gerling, Alberta Forestry Lands and Wildlife (dated 89 01 20) regarding preservation of land for recreational use.

Mr. Ryan, Western Review, requested a copy of this letter so that he may provide follow-up.

SUBJECT: Proposed subdivision U% NE 21-49-8-W5 Donald & Terrill Nelson p RECOMMENDATION: That the subdivision be approved subject to the following conditions: pi 1. Taxes to be paid. 2. Access to all parcels to be to the satisfaction of the Director of Public Works and Alberta m Transportation and Utilities. 3. That proposed Lot 6 West boundary line extend Southerly to South boundary creating a parcel of similar size as lots 3-5 and thus creating a larger parcel C of T 872-251-805. 4. Provide groundwater availability and percolation tests and water table elevations. 5. Cash-in-lieu of Municipal Reserves to be paid on the created parcel 1 and deferred reserve to the remaining 6 parcels.

REPORT: The lands are in an agricultural land use district iip North West of Drayton Valley at the corner of Range Road 83 and Twp. Road 494. There is a residence in parcel and C of T 872-251-805. p Though the proposal will subdivide the land further which is not really in keeping with the intent of the Planning Act, it appears these lands are not being used for agricultural purposes and lend them selves well to a proposed Country Residential p Development. Alberta Transportation has no objection to the proposal as they will not impact roads under pi their jurisdiction. A new agreement requires discussion and signatures of the Municipal District of Brazeau and Village of Breton. The terms with the County of Leduc were basically $ 100 rental per month and the County being responsible for all maintenance necessary to enable rural 5J5| residents to use the site.

The A.S.B. was unable to consider this request at the Provincial A.S.B. Conference in Calgary, as not all members were able to <* attend, because of the weather. The A.S.B. at the February 14, 1989 meeting considered the request for an appointment, after hearing from Rick Ostertag who is the Alberta Environment Provincial repre sentative of the Land Conservation and Reclamation Council. A genera] discussion followed, concerning appointing our Assistant Agricultural Fieldman as the Reclamation Officer in order that some of the wages is on a seasonal year round basis could be reimbursed to the r municipality. It was also thought to be important once the summer season hits, there may well be a need for a second alternate, that would be used on a regular basis. Accordingly, the motion was made «• by C. " Are you aware that the Minister of Career Development, the Honourable has publicly stated that the STEP and PEP programs may see cuts of up to 50 percent in 1989 ? Does your municipality use these programs to benefit your community? If so can you afford to give the same service without the program and without increasing tax payers' dollars? If your answer to the last question is 'no' then you have a similar problem to what I do and many other municipalities in the Province. r I believe there are three ways we can solve this problem: 1) Cut back services 2) Increase municipal tax dollars 3) Inform the Honourable Minister Kowalski that we feel there is a great need for the STEP and PEP program. If anything, he should be increasing the Programs.

My concerns are as follows:

1) Mr. Kowalski states that there is no ongoing need for these programs due to the fact that there is very little unemployment. My comment to that is: Two years ago when i the STEP application far exceeded the STEP funds the government put in another million dollars. Has it improved « that much over one year? |

2) Mr. Kowalski states that there is going to be economic growth in the province in 1989. Maybe in the ^ private sector, but in municipalities the economic situation J will be the same as the last few years. If Mr. Kowalski is right about the boom in the private sector how are rs municipalities going to be able to compete with $12.00 per hour and more which students will be able to get in the oil patch ?

As a Municipal Recreation Administrator I will also be writing a similar letter and will be asking the Mayor and Reeve in my area to do so as well. °*

We are all aware that it takes public opinion to show our Government that we as Albertans have a concern with the „» direction they sometimes take.

I truly believe that Mr. Kowalski and the Government are going in the wrong direction if they cut back the STEP "1 and PEP programs.

If you feel the same way PLEASE write a letter to Mr. « Kowalski stating your concerns. Also please cc. the letter to Premier Getty and your local M. L. A. and Alberta Recreation and Parks Association. Remember the Budget comes down at the end of March so please write today.

The Municipal Taxation Act Ch M-31 of the statutes of Alberta under Section 24(x) states as follows: (x) land and improvements owned and operated by a non-profit organization while used chiefly for the purpose of providing living acconirodation for senior citizens or persons suffering from a physical or mental disability; p The Municipal Tax Exemption Act Chapter M-30 of the Alberta Statutes states the following:

I have also enclosed letters from the Town of Drayton Valley and from the County of Parkland indicating their exemptions to show historically we have been exempt from property taxes as a non-profit association providing services for the mentally handicapped. I have also included an excerpt from the Draft Report of the Legislative and Regulatory Study of December, 1988. I have also been in contact with Alberta Social Services through contract negotiations, and was informed that other Associations in Alberta have received this exemption from their various counties or municipalities. At present we are paying our taxes as part of our mortgage payment through the Toronto Dominion Bank. If the Municipal District of Brazeau would grant us an exemption, I would have this changed. RECOMMENDATION: That the tenders for the vehicles be awarded to the companies as follows:

REPORT: The purpose of this memorandum is to present the results of the vehicle tenders and make a recommendation on the purchase of the vehicles.

Vehicle tenders were requested from 12 companies. Ten companies made submission which are summarized on Schedule A. 1 Schedule B, which is attached, lists what the Administration feels is the most suitable three submissions for each type of vehicle. The Schedule indicates the amount that was bid plus 1 indicates a cost which adjusts for the differences in the 1 1 (o\

tenders. The adjusted comparison should be treated as a magnitude cost in an effort to compare "apples to apples". The first company that is listed is Administrations recommendation for award. The reasoning for our recommendation is a combination of what we feel is the best unit for the cost, as well as consideration for dealing with local firms and the personal preference of the individual who is going to operate the vehicle.

Additional background is a follows:

A. 1/2 ton extended cab Sunshine Ford submitted the lowest cost for the unit. The cost that is indicated in the schedule is for a unit that would be ordered from the factory. Delivery time of 8-10 weeks for the unit may not be suitable in the case of the Public Safety Officer. Sunshine Ford did submit an alternative choice of purchasing a unit that is presently on order. The unit is essentially the same as speced except that it is a two-tone blue color. The cost for the unit r would be an additional $350.00 to the factory cost plus the cost to repaint which is estimated to be $900.00. Therefore, this alternative would cost $20,941.00 (an additional $1,250.00).

B. 1 ton 4X4 The Chev/GMC units are not available with a 350 size of engine and come only with a 454 engine. The Dodge unit comes with the 350 size engine. The larger motor is over what we need and would have higher operating costs (more fuel use). For this reason we recommend that the Dodge be purchased. pi C. 1/2 tons L The submission from Grove is an excellent price for this unit.

D. 3/4 ton 4X4 Woodland Chrysler's submission is the lowest. P E. Ram Charger Woodland Chrysler is the better submission.

This Exploration permit is subject to the following terms and conditions:

General Terms and Conditions

1. The applicant shall do as little damage as possible and shall fully compensate all persons sustaining damage as a result of the examinations and surveys.

2. The applicant shall hold harmless the Minister of the Environment or any other agent of the Government of Alberta for damage or damage claims arising out of examinations and surveys hereby permitted.

3. When a test well, completed well or other hole is abandoned, it shall be effectively sealed in such a manner as to prevent the entry of surface water and the inter-mixing of ground water from the aquifers penetrated by the wel1.

4. Non-potable water produced during the testing program shall be disposed of in accordance with pertinent regulations under the Clean Water Act.

5. Under the Ground Water Development Act, a licence to drill water wells 1s required for drilling any water well or ground water test hole. Such a licence is available from the Director of the Technical Services Division of Alberta Environment. The condition of journeyman driller may be waived for: (a) Water well installations deeper than 450 metres and producing T non-potable water for non-domestic purposes; (b) Ground water test holes deeper than 450 metres. ^r \

The applicant shall carry out a field-verified survey of all the wells, F springs and dugouts within two (2) mile(s) of the proposed production well I and ascertain where possible the location, ownership, water level, pump intake depth and open intervals of these wells. pi I 2. The applicant shall conduct a pumping test on the proposed production well(s) meeting the following criteria: (a) At least one water sample for chemical analysis shall be taken during the pumping test and analysed for the following constituents: Total dissolved solids, Ca, Mg, Na+K, CO3, HCO3, SO4, CI, NO3, F, 1 Fe, pH, hardness and alkalinity. Time of sampling shall be recorded. (b) The pumping test on each production well shall be conducted at not P less than its anticipated maximum production rate. (c) During the pumping test(s) the maximum variation in pump rate shall be +5%. (d) (1) The pumping test(s) shall continue for a period of time sufficient to identify any limiting boundary conditions but r shall in no case be of less than 24 hours in duration. (2) The applicant is hereby authorized to use ground water produced during the pump testing period outlined in this exploration permit. Should the applicant wish to continue the pump test beyond the duration specified in this exploration permit and continue to use the ground water diverted, separate approval must be obtained from the Controller of Water Resources. (e) Recovery measurements are to be taken for at least the same length of time as the well was pumped. (f) During the pumping test, the applicant shall endeavor to take water P level readings in P. Rybak neighboring well(s) located in NW i 30-50-8-W5, approximately 1,500 feet east of the proposed production well(s). F 3. The applicant shall submit an aquifer evaluation report in triplicate outlining the conclusions derived from the program complete with all •details of test results including, but not limited to, the following items: (a) General plan showing quarter-section lines and the location of the proposed production well(s) and works related to the diversion and use of water along with physical features such as roads, rivers, creeks, etc., and location and ownership of any existing wells, springs and dugouts within two (2) mile(s) of the proposed production well(s).

(d) Lithologic and where available, geophysical logs, with aquifer zones indicated, of all holes drilled along with copies of any maps drawn showing the extent and thickness of the aquifer being tested and other aquifers.

(e) Copies of all chemical analyses performed on samples taken. (f) Names of drilling contractors involved in data acquisition.

(g) Details of drawdown and recovery in all pumped wells and observation wells together with an interpretation of the results including graphs of time drawdown and distance drawdown, and all calculations performed. Copies of raw data should be included.

AMOCO CANADA PETROLEUM COMPANY LIMITED ROCKY RAPIDS WATER SOURCE WELL

Amoco Canada Petroleum Company Limited currently operates a waterflood oil recovery program in the area around Rocky Rapids (Attachment 1). As oil and gas are removed from the reservoir, fresh water is injected into the reservoir to maintain the reservoir pressure. This increases the amount of hydrocarbons that can be recovered thus conserving more of our natural resources. This waterflood recovery scheme has been in effect since 1964 and as per Energy Resources Conservation Board regulations, must remain active today.

Water supply for this area was originally from a river pumping station located on the North Saskatchewan River at 09-06-50-06 W5M. In July of 1986, the river station was extensively damaged/washed away when the North Saskatchewan River flooded. These same facilities had also been extensively damaged in July of 1972 by the North Saskatchewan River. As shifting of the river course is making the existing location more prone to flooding and erosion, Amoco Canada is now reviewing alternate methods of restoring fresh ^ water required for efficient production of the oilfield.

Shallow water source wells were attempted near the North Saskatchewan river at 07-06-50-06 W5M but proved unsuccessful.

In September of 1988, Amoco Canada drilled a geologic test hole at 14-03-50-07 W5M. The lithologic log and the drillers estimate of water available are included as Attachment 2. It should be noted that the test hole was drilled to obtain subsurface information only and is incapable of water production. The well was drilled to a total depth of 700 feet (213 m) and "1 located six separate fresh water aquifers. The best water ' aquifers were found at depths of about 134 feet (41 m) and 181 feet (55 m). From the survey that Amoco Canada conducted ^ on residents in the Rocky Rapids area, it was determined that most existing water source wells are completed in these water aquifers.

At a depth of approximately 385 feet (117 m), a less productive water aquifer exists which appears to be sufficient for Amoco Canada's water requirements. This deep I water aquifer is separated from the more productive shallow I aquifers by shale zones.

pi Amoco Canada 14-03-50-07 W5M test hole. As can be determined from the cross-sections, Amoco Canada intends to complete the proposed well significantly deeper than most surrounding existing wells.

Amoco Canada has applied to the Alberta Environment Ground Water Rights Branch for an Exploration Permit to drill and test a production water well at 14-03-50-07 W5M for a maximum water diversion of approximately 50 imperial gallons per minute. The proposed well would be cased and cemented to prevent migration of water from the shallow aquifers to the deep aquifer. A monitoring program would be conducted during

p and after the testing to determine the impact of the pumping on the water aquifers. A report would then be prepared which L would summarize the results of the pumping test. This report would be provided to Alberta Environment to assist in P establishing any terms or conditions required for a permit to divert ground water at the subject location. The report would also be available to any interested resident or

ipi landowner.

As you well understand, groundwater is a crucial item to a landowner. Amoco Canada understands the concern and commits that it will not take groundwater in such a fashion that it would adversely effect our neighbors wells. In addition, Alberta Environment would not grant Amoco Canada approval to use groundwater if the technical information obtained in the test drilling program showed any possibility of adverse effect to neighboring wells. Amoco will comply with the testing and operating conditions specified by Alberta Environment and is looking to determine the level of information that the local residents wish to have as this project develops. Amoco Canada expects to participate in an on-going monitoring program to continually confirm the safe operation of the water source well. WHEREAS, 1t Is necessary to provide representation for the Municipal District of Brazeau No. 77 on the Drayton Valley General and Auxiliary Hospital and Nursing Home District No. 77; and

WHEREAS, the population of the Included municipalities within the Drayton Yalley General and Auxiliary Hospital and Nursing Home District No. 77 have been reviewed to determine equitable

representation.

c) Roadside Seeding - Disturbed Areas T. Fleming was present to outline Public Works procedures m! for roadside seeding. Mr. Fleming indicated once a job has been completed, the Public Works Department only seeds up to the owners property line. T. Fleming indicated that Public Works does not want to become involved in "Custom eSBl Seeding" for farmers, since it is felt the farmers are well compensated by the M.D. for crop damage. 7/89 Moved by C. AGRICULTURAL FIELDMAN'S REPORT R. Woloszyn reviewed his Decmeber, 1988 report for the A.S.B and verbally reported on a Beaver Complaint by Mr. Gordon Duce. Mr. Duce was requesting the M.D. to blow a beaver dam on his property. Mr. Woloszyn advised the Board the dam was not blown due to the water being frozen over. The Board discussed the procedures the M.D. should adopt regarding the blowing of beaver dams int he winter months. 9/89 Moved by W. Tweedle that no beaver dams will be blown between the period of November 1 to April 1 unless approved on a case to case basis by the Agricultural r Fieldman. CARRIED. 10/89 Moved by W. Woloszyn advised the Board of an upcoming Perennial Weed Control Technical Update to be held on January 24, 1989 in Edmonton and requested the Board's approval for the attendance of himself and Barb Shackel. 13/89 Moved by C. VIRULENT BLACKLEG OF CANOLA A letter from Alberta Agriculture, Plant Industry Division, dated December 8, 1988 was discussed regarding the growing problem of Virulent Blackleg of Canola.

C. Andersen reviewed the program Alberta Agriculture has started to control the Virulent Blackleg of Canola problem for the new members of the Board. Mr. Andersen indicated that the disease is not yet a problem within the M.D. 19/89 Moved by W. U OF A Soil Science - Soil Compaction & Ripping Review J. Wardlow reviewed a letter received from the University of Alberta in Edmonton dated December 16, 1988 requesting the M.D. to provide a survey to the Soil Sciences Department regarding any ripping research within the M.D.

C. Andersen mentioned that to date the M.D. area farmers have not been involved in such a program.

WARBURG SEED CLEANING CO-OP B. Flesher reported on the financial and operating situation of the Warburg Seed Cleaning Co-op and noted from the information provided from the financial reports, that the Seed Cleaning plant is operating extremely well, and is basically self supporting.

Discussions occured whether or not the M.D. should contribute funding to the Seed Cleaning Plant, since M.D. residents are using the facility. A suggestion was made that the M.D. should forward a map to the Warburg Seed Cleaning Co-op advising them of the M.D. boundaries, together with a letter outlining the support if needed, by the M.D. for any funding. fip 21/89 Moved by C. B. Flesher also adivsed the Board of a Delegate Meeting occuring on January 30, 1989 at 1:30 p.m. at the Village of Breton office regarding the Breton Grain Elevator and suggested a representative from the M.D. should attend the meeting.

A question was raised whether a notice would be placed in the local newspaper inviting surrounding residents to attend and support the Breton Grain Elevator to remain open.

B. Flesher indicated as far as he was aware, there was no indication a notice would be placed in the local new- paper .

A suggestion was made that Administration should place a notice in the newspaper advising the M.D. residents of the Delegate Meeting and encouraging their attendance and support.

N. Norton advised the Board that H. Rondeau, representative for the Drayton Valley Regional Landfill Authority would be bringing up the matter to the Landfill Authority requesting a location to dispose of waste pesticides and that a report would be presented to the Board at the next meeting.

FDRP APPLICATIONS A letter received from G. Laarhuis outlining the FDRP program and procedures was discussed. It was noted that any applications after March 1, 1989 would have to follow the new regulations. It was suggested that the M.D. should not receive any applications until after March 1, 1989 so that new regulations can be followed. R. Woloszyn indicated that two (2) applications have been submitted from Anthony Heinrichs and Ben Bustin for the r FDRP, but action would not be taken until after March 1. It was suggested that before the M.D. becomes involved in the program, that representatives from Alberta Agriculture r should be ask to speak on the FDRP and SCAP programs. 27/89 Moved by C. INTRODUCTIONS The Chairman welcomed B. Shackel to her first A.S.B. meeting and introduced all members of the board to R. Macintosh and D. Vanderwel.

DELEGATION Rob Macintosh - Pembina Institute

R. Macintosh, Executive Director of the Pembina Institute thanked the Board for the opportunity to speak on Environmental issues. Mr. Macintosh noted that the Institute is a non-pro L fit organization that provides programs for Federal and Provincial government. Mr. Macintosh's main topic of dis cussion was regarding Environmental Week, which starts the first week in June. \3C\ -2- February 14/89 Mr. Macintosh indicated that Environmental Week is actually carried out through the whole month of June, with four (4) themes, which are:

1st week - Reducing Consumption e.g. - using less water for a same task

2nd week - Trading and Exchanging Goods

3rd week - Recycling 4th week - Disposing of Toxic and Hazardous Wastes J Mr. Macintosh indicated that a number of local businesses, major Oil Companies and other organizations throughout Drayton Valley have endorsed this program and provided funding. Mr. Macintosh indicated that the Pembina Institute is looking for endorsement from the M.D. and requesting some funding for the event, in a range of $500 - $1000 dollars. It was indicated that if the M.D. were to endorse this program, the Institute would require a staff member to help organize the M.D. participation. 33/89 Moved by C. Andersen that the presentation from R. Macintosh of the Pembina Institute be received as information.

DELEGATION Douve Vanderwel - Alberta Conservation & Development Branch

D. Vanderwel discussed the 1989 Program Guidelines for the F.D.R.P. and S.C.A.P. programs and presented a slide pre sentation for the Board. J Mr. Vanderwel indicated to the Board, that any By-Laws passed in relation to Agriculture, that Alberta Environment requires a copy for their records.

A question was raised as to what the percentage would be for cost sharing for these programs.

Mr. Vanderwel indicated the percentage for cost sharing was 60-40, and mentioned that no additional funding was available for F.D.R.P. but was available for S.C.A.P. if required.

DELEGATION Rick Ostertag - Land Surface Conservation & Reclamation

R. Ostertag reviewed the history of the Conservation and Reclamation Council, and indicated that the Council for Crown land was Forestry, Lands & Wildlife, and for private land, Alberta Environment was the Council.

Mr. Ostertag then reviewed areas which the Council is involved with and the procedures taken if a complaint is received.

Mr. Ostertag indicated that the M.D. needed to provide a representative as soon as possible, plus an alternative.

PESTICIDE CON TAINER COL LECTION SITE Update

B. Shackel updated the Board on the progress of the Pesticide Container Collection Site, and reviewed various collection sites the Board may be interested in pursuing.

LB. Shackel indicated that at the regular Council meeting of 89 01 26, Council approved the go ahead to submit a grant application for the Collection Site to Alberta Environment.

L 35/89 Moved by G. Laarhuis that the Head Agricultural Fieldman be authorized to pursue the concept of a quonset as the Pesticide Container Collection Site with a report back to the Board at the next meeting of costs of construction, without including the ikl cost of the ground work.

F.D.R.P. required from the farmer would be 40% of the projected project cost, and that anything over lit would be the applicants responsibility and the program deposit for S.C.A.P. required by the farmer would be 20% with the balance of 80% of the projected project cost by the A.S.B. up to a maximum of $2000. u CARRIED.

Rental Policy

1. The Breton Golf Club is dedicated to the preservation of the working-man's golf course. We are determined to maintain low yearly passes (1989 is $60.00/yr), and reasonable greens fees (1989 is $6.00/day) so everyone can play.

2. Golf is the number one sport for our aging population. According to a report in the March 1989 issue of Golf Digest, it is estimated that in order to keep up with the demand, 300 golf courses will need to be built every year for the next ten years in North America; actual construction will be only 100. Where will all of the new golfers play? City courses are badly over-used; established courses are packed to capacity. The extra leisure time of the aging population will seek out the rural courses like the Breton Golf Course because of the lack of strain and the pressures of the mob.

3. The Breton Golf Club has completed Phase I of a long-range plan to bring the course up to acceptable golf standards. 600 man-hours of work have been donated 250 hours of heavy equipment have been donated dirt, sand, and topsoil have been donated As a result of these donations 5 new fairways were either constructed new, modified, or re-routed; grass greens were built on the fairways as an inter mediate step to properly-designed greens; a trailer was purchased to serve as our club house, complete with full utilities; a greens mower was purchased; other necessary pieces of equipment and tools were also purchased and paid for from income generated by greens fees and memberships since July, 1987.

4. As a result of the increased playability of the course due to the com pletion of Phase I, the course has seen tremendous increase in users over the past 2 years. Greens fee players have totalled over 1200 in 1988, coming from 61 rural and urban municipalities within the province as well as most of the Canadian provinces and as far away as the United States, and even Zaire, Africa!

a. construct water-retention reservoir for irrigation b. install semi-automated irrigation system to all greens and tees c. construct properly-planned and contoured greens and tee areas d. install pipe fence from donated steel tubing e. install hydro power to water source f. drill water well for back-up water reserve for reservoir g. engineering and drafting technical help (Sid Puddicombe & Assoc.)

We are proud to say that the funding for Phase II is inplace, and we will proceed on schedule when the frost comes out this spring. Here are the sources of our funds:

a. Recreation, Parks and Wildlife Foundation $5000.00 b. Community Facility Enhancement Program $26500.00 c. Donated Labour $12400.00 d. Donated Equipment $7300.00 e. Fund-raising by the Club $17500.00

total: $68700.00

6. We are excited to be included in the Battle River Tourist Association golf brochure, along with the Drayton Valley and Alder Flat«s golf courses. The brochure has been commissioned for distribution by the various tourist promotion groups in the entire area. A person who picks up the brochure will see that by playing on any 10 of the possible 15 golf courses included on the brochure will be eligible to receive several cash and merchandise awards The philosophy is much similar to the Stamp Around Alberta project some years ago. This alone ought to increase traffic on the course.

7. We are greatly encouraged by the prospect of considerably more money being made available for recreation grants since we have formed the M.D. of Brazeau. The following quotation from an election advertisement appearing in the Western Review on September 9, 1986 states, "... recreation grants will triple and the fire department grants will at least double. (Ref. Ian White, author of the feasibility study)." We anticipate fair and equitable treatment from the new M.D. As a point of interest, the Breton Golf Club received $3000.00 in 1987 and $4500.00 in 1988 from the Breton and District Regional Recreation Board. 8. We of the Breton Golf Club have a vision for our future golf course! We project a membership of 200 by the year 1990, with over 2500 walk-on golfers. We expect to be self-sufficient for operational purposes.

Our vision also includes capital projects which will require the continuing cooperation and assistance of the M.D. of Brazeau.

Currently, the golf course needs a 40 H.P. tractor with front end loader, 3 point hitch, and turf tires. We have secured quotations from 3 implement dealers and all seem to indicate that we will need to spend from $13000.00 to $17000.00 to get a reliable diesel tractor to cut our grass, move earth, repair the roughs, roto-till, spray, fertilize, aerate, etc. Our old tractor finally turned its last corner. It is nearly 40 years old, and the motor seized last fall; the verdict - it is too expensive to fix such a decrepit relic. With inexperienced operators, we feel we require a new, or near-new tractor which is easy to maintain. Can you help us in this regard?

To conclude, our vision will be complete with the acquisition of the land on which the course is situated. This land forms part of the land bank for the Village of Breton. The provincial government has recently completed a review of all their land banking agreements and are prepared to devise a solution to ease the indebtedness of municipalities. The government is now prepared to accept current market value as of April 1, 1989, plus 25% of the shortfall betweenactual costs incurred and the market value.

Breton owes Alberta Mortgage and Housing Corporation $292,678.94 for the 123 acres now occupied by the golf course.

True market value of this land is (less) $32,210.00

Definitions

1(1) In this Regulation,

(a) "airport" means the Drayton Valley Airport within.the protection area;

(b) "airport runway" means the area of land within the airport that is used or intended to be used for the take-off and landing of aircraft;

(c) "airport zoning reference point elevation" means the airport zoning reference point elevation of the runway as described in Schedule 4;

(d) "basic strip" means a basic strip as described in Schedule 4;

(e) "Department" means the Executive Director of the Planning Branch in the Planning Services Division of the Department of Municipal Affairs;

(f) "development" includes a proposed development;

(g) "land use by-law" means the land use by-law of the Municipal District of Brazeau No. 77, as amended from time to time;

63-392 (h) "municipal corporation" means the Municipal District of Brazeau No. 77;

(i) "NEF" means noise exposure forecast;

(j) "NEF Contour" means a numbered contour as shown in Schedule 2;

(k) "outer surface" means the outer surface as described in Schedule 4;

(I) "protection area" means the Drayton Valley Airport Vicinity Protection Area described in Schedule 1 and shown in Schedule 2;

(m) "take-off/approach surface" means a take-off and approach surface as described in Schedule 4;

(n) "transitional surface" means a transitional surface as described in Schedule 4.

(2) For the purposes of this Regulation, "accessory land use, structure or development" means a land use, structure or development that is subordinate or incidental to the major land use, structure or development, as the case may be.

(3) For the purposes of this Regulation, a reference to a land use, structure or development may include an accessory land use, structure or development, as the case may be.

General provisions

2(1) This Regulation applies to a development wholly or partly within the boundary of the protection area.

(2) All developments within the protection area require a development permit.

(3) The development officer for the municipal corporation shall administer this Regulation.

(4) The development officer may issue a development permit for a development if the development conforms with this Regulation and the land use by-law of the municipal corporation.

63-392 (5) A decision of the development appeal board shall conform with this Regulation.

(6) The development officer and development appeal board are not precluded by this Regulation from attaching to a development permit, in accordance with the land use by-law of the municipal corporation, any conditions that do not conflict with this Regulation.

Establishment of protection area

3(1) The area described in Schedule 1 is established as the Drayton Valley Airport Vicinity Protection Area.

(2) If any discrepancy exists between the description of the protection area in Schedule 1 and the location of the protection area as shown in Schedule 2, the description in Schedule 1 prevails.

Land use

4(1) For the purposes of this section and Schedule 3, the protection area is divided into the following land use districts, namely,*

(a) the Airport Property District, designated A-P,

(b) the Airport Rural District, designated A-R, and

as shown in Schedule 2.

(2) For the purposes of this section, one land use is substantially similar to another if, in the opinion of the development officer,

(a) ts intention is the same as that of the other,

(b) t is no more sensitive to external noise than the other,

(c) t does not attract birds,

(d) t does not generate a large amount of smoke or dust, and

(e) t does not exceed the height limitations in section 5.

(3) The development officer may issue a development permit for a development that involves a land use that is designated "P" in Table 1of Schedule 3 or is substantially similar to such a land use.

63-392 (4) The development officer may issue a development permit for a development that involves a land use that is designated "C" followed by a number in Table 1 of Schedule 3 or is substantially similar to such a land use, and the appropriate condition specified in Table 2 of Schedule 3 is deemed to be part of the land use for the purposes of this Regulation.

(5) The development officer shall not issue a development permit for a development that involves a land use that

(a) is designated "NA" in Table 1 of Schedule 3 or is substantially similar to such a land use, or

(b) is neither listed in Table 1 of Schedule 3 nor authorized under subsection (3) or (4).

(6) If the development officer is uncertain whether a land use is substantially similar to another land use for the purposes of subsection (3), (4) or (5), the development officer shall send a copy of the development permit application to the Department for comment.

(7) If a development permit application is made for a development that involves a land use that, in the opinion of the development officer, may attract birds or generate large amounts of smoke or dust, the development officer shall send a copy of the application to the Department for comment.

Height Iimitations

5(1) The development officer may issue a development permit for a development if no point of the development will exceed the height of any of the following surfaces:

(a) the take-off/approach surfaces;

(b) the transitional surfaces.

(2) For the purposes of this section,

(a) if the development is a railway, the highest point of the development shall be deemed to be 6 metres higher than the actual height of the raiIs, and

(b) if the development is a highway or public roadway, the highest point of the development shall be deemed to be 4.5 metres

63-392 higher than the actual height of the part of the highway or public roadway on wh ich veh icIes trave I.

(3) If a development permit application is made for a development whose highest point will penetrate the outer surface, the development officer shall send a copy of the application to the Department for comment.

Electronic Facilities

6 If a development permit application is made for a development whose location is wholly or partly within an electronic facilities restricted area, the development officer shall send a copy of the application to the Department for comment.

(2) If a development permit application is made

(a) for a development whose location is wholly or partly within the contour lines shown in Schedule 6, and

(b) the development officer is satisfied that the highest point of the development will exceed the maximum height limitations indicated in Schedule 6, the development officer shall send a copy of the application to the Department for comment.

(3) In subsection (1), "electronic facilities restricted area" means the restricted area around each electronic facility as shown in Schedule 6.

(4) For the purposes of subsection (2Kb),

(a) if the location of a development lies between 2 numbered contours shown in Schedule 6, the maximum height limitation applicable to the development is the height limitation represented by the lower of the 2 numbered contours, and

(b) if the location of a development lies between a numbered contour and the boundary of the protection area shown in Schedule 6, the maximum height limitation applicable to the development is the height limitation represented by the numbered contour.

Accessory land use

7 If a development permit application is made for a development that involves an accessory land use, structure or development that

(a) is more sensitive, in the opinion of the development officer, to external noise than the major land use, structure or development,

63-392 (b) attracts birds,

(c) generates a large amount of smoke and dust, in the opinion of the development officer, or

(d) exceeds the height limitations in section 5, the development officer shall send a copy of the development permit application to the Department for comment.

Referral for comment

8(1) If a copy of an application is sent to the Department for comment, the development officer or the development appeal board may issue a development permit only if

(a) a comment has been received from the Department, or

(b) no response is received by the end of the 30-day period following the date on which the copy was acknowledged as having been received by the Department.

(2) If a copy of an application is sent to the Department for comment, the development officer or the development appeal board shall consider the response, if any.

(3) If the development officer is required under this Regulation to send a copy of an application for a development permit to the Department and has not done so, the development appeal board, on receipt of an appeal on the matter, shall send a copy of the application to the Department not later than 14 days prior to the board's holding a public hearing respecting the appeal.

Amendment

9 If a municipality applies to the Minister for an amendent to this Regulation, the Minister may refer the matter to the Board and the Board, after any public hearing or meetings that it considers necessary, shall report to the Minister with respect to the application.

Application

10(1) This Regulation does not apply to

(a) a development in respect of which a development permit application was submitted before, or

LAND USE IN RELATION TO NOISE EXPOSURE

FORECAST AREAS

1 In this Schedule,

(a) "C" followed by a number, where it appears in one of the NEF area columns in Table 1 opposite a particular land use, means that the land use is subject to the conditions set out in Table 2 bearing the same letter and number;

(b) "NA", where it appears in one of the NEF area columns in Table 1 opposite a particular land use, means that the land use is not allowed in that NEF area;

(c) "NEF 25- Area" means the NEF area that lies between the 25 NEF Contour and the boundary of the protection area;

(d) "NEF 25-30 Area" means the NEF area that lies between the 25 NEF Contour and the 30 NEF Contour;

(e) "NEF 30-35 Area" means the NEF area that lies between the 30 NEF Contour and the 35 NEF Contour;

(f) "NEF 35-40 Area" means the NEF area that lies between the 35 NEF Contour and the 40 NEF Contour;

(g) "NEF 40+ Area" means the NEF area enclosed by the 40 NEF Contour;

(h) "P", where it appears in one of the NEF area columns in Table 1 opposite a particular land use, means that the land use in that NEF area is unconditionally permitted by this Regulation;

(i) "residential replacement or infill" means any new residential development that

(i) will replace a residential development that has been demolished or destroyed, or

(ii) is to be built on a lot that is

(A) registered under the Land Titles Act, and

63-392 (B) designated for residential development in an statutory plan,

before the coming into force of this Regulation, and

(iii) does not exceed the intensity of use designated for the site in the land use by-law of the municipal corporation before the coming into force of this Regulation.

2 Developments existing before the coming into force of this Regulation shall be deemed to comply with the exterior acoustic insulation requirements set out in this Schedule.

FORECAST AREAS

The performance criteria utilized to determine permitted and conditional land uses are as follows:

1 uses that involve continuous human occupancy (e.g. residential use) - conditional approval (CD above the 25 NEF Contour - not permitted above the 30 NEF Contour

2 uses that involve continuous human occupancy but comprise residential replacement or infill - conditional approval (CD above the 25 NEF Contour

3 uses that involve temporary medium term human occupancy where the majority of people occupy the space for an 8 hour work period (employee oriented) (e.g. commercial/office uses, restaurants and hotels) - conditional approval (CD above the 30 NEF Contour - not permitted above the 40 NEF Contour

4 uses that involve temporary short term human occupancy where the majority of people occupy the space temporarily (customer oriented) (e.g. drive-in restaurants, vehicle and equipment sales) - not permitted above the 40 NEF Contour

5 uses that involve the indoor assembly of people (e.g. clubs, fraternal organizations) - conditional approval (CD above the 30 NEF Contour - not permitted above the 40 NEF Contour

6 uses that involve outdoor recreation - conditional approval (C3) above the 30 NEF Contour

7 uses that involve outdoor accommodation (e.g. camping, R.V. trailer park) - not permitted above the 35 NEF Contour

9 uses that, because of their nature, are not adversely affected by external noise due to limited or no human occupancy or sufficient internal noise generation - permitted

LAND USE CONDITIONS

C1 Construction shall conform to the exterior acoustic insulation requirements of Part 11 of the Alberta Building Regulation, 1985 (Alta. Reg. 186/85) for those NEF areas other than the NEF 25- Area unless otherwise stated in this Regulation. Where this condition is specified, the development officer shall indicate on the development permit which noise contours the proposed development site would be located between for reference of the building inspector at the time of the building permit application.

C2 The application must be referred to the Department for comment prior to the determination of whether to issue a development permit.

03 The development shall not include structures for the seating of spectators except as varied to allow seating that, in the opinion of the development officer, is of a minor nature.

HEIGHT LIMITATIONS

DRAYTON VALLEY AIRPORT VICINITY PROTECTION AREA

Basic Strip

1 The basic strip is a rectangular area measured 60 metres out from each end of the runway, 30 metres on each side of the centre line of the runway and with a total length of 1320.0 metres.

Take-off/approach surfaces

2 There are take-off/approach surfaces abutting and extending out from each end of the basic strip and in each case the surface is an imaginary surface consisting of an inclined plane

(a) the commencement of which coincides with the end of the basic strip,

(b) that rises at a slope ratio of 1:40 measured from the end of the basic strip,

(c) that diverges outward on each side as it rises, at a rate of 15% measured from the respective projected sides of the basic strip,

and

(d) that ends at its intersection with the outer surface.

Transitional surfaces

3 There is a transitional surface associated with each side of the basic strip, and in each case the transitional surface is an imaginary surface consisting of an inclined plan that

(a) commences at and abuts the sides of the basic strip,

(b) rises at a slope ratio of 1:7 from an elevation at the center point of the runway opposite the proposed development, and measured from the sides of the basic strip, and

(c) ends at its intersection with the outer surface and the take-off/approach surfaces.

63-392 Airport zoning reference point elevation

4 The airport zoning reference point elevation is the elevation used to establish the height of the outer surface and for the purpose of this Regulation is deemed to be 838.5 metres above sea level.

Outer surface

5 The outer surface of the protection area is an imaginary common plane established at a constant elevation of 45 metres above the airport zoning reference point elevation and extending to the boundary of the protection area.

General

6 The area locations of the take-off/approach surfaces and transitional surfaces are represented on the map shown in Schedule 5, but if any discrepancy exists between the description of the take-off/approach surfaces or transitional surfaces in this Schedule and their location on the map in Schedule 5, the description in this Schedule prevaiIs.
