Township of Robbinsville Ordinance 2021-9 of Mercer

AN ORDINANCE AMENDING CHAPTER 2 OF THE CODE OF THE OF ROBBINSVILLE ENTITLED “ADMINISTRATION OF GOVERNMENT”, SPECIFICALLY SECTION 2-47 ENTITLED “DIVISION OF POLICE”

BE IT ORDAINED by the Township Council of the Township of Robbinsville in the County of Mercer, State of New Jersey that Chapter 2, Section 2-47 of the Code of the Township of Robbinsville is hereby amended as follows [added portions are underlined, deleted portions are strikethroughs]:

SECTION 1.

Chapter 2 – Administration of Government

Article VII. Administrative Branch

§ 2-47 Division of Police.

A. The Police Division of the Township is hereby established with such number of subordinate police officers and sworn police positions as designated by the Mayor and authorized by the Council, as hereinafter provided. The Police Division shall be headed by a Chief of Police or ranking sworn officer in the absence of a Chief of Police, who shall be appointed by the Director of Public Safety and whose duties and responsibilities shall be those as governed by law, Township Code, where applicable, and the rules and regulations of the Township of Robbinsville Police Division. The Director of Public Safety shall serve as the appropriate authority of the Police Division.

R. Private duty assignment/rate for extra duty. The rate charged by the Township of Robbinsville for quasi-duty performed by officers of the Division of Police or the Chief of Police within the geographical limits of the Township of Robbinsville shall be in accordance with the collective negotiations agreements between the Township and PBA Local 344 and the Township and Robbinsville SOA Local 344, a copycopies of which isare on file in the Municipal Clerk’s office. The performance of quasi-duty by members of PBA Local 344 shall be done in accordance with the provisions of the PBA Local 344 collective negotiations agreement and the performance of quasi-duty by members of Robbinsville SOA Local 344 shall be done in accordance with the provisions of the Robbinsville SOA Local 344 collective negotiations agreement. The performance of quasi-duty by the Chief of Police shall be done in accordance with the provisions of the Robbinsville SOA Local 344 collective negotiations agreement.

SECTION 2.

All ordinances or parts of ordinances inconsistent with or in conflict with this ordinance are hereby repealed to the extent of such inconsistency.

SECTION 3.

If any section, paragraph, , clause or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged and the remainder of the Ordinance shall remain valid and effective.

SECTION 4.

This ordinance shall take effect upon final passage and publication according to law.
