I am writing on behalf of my wife and I to express our opposition for the proposed cross dock facility on Camelback Road at the site of the Falcon Golf course. We live less than 1/4 mile from the intersection of Camelback and W 152nd Ave. in the Palm Valley Phase V community. This new facility will lead to a significant increase in traffic, air pollution, and noise pollution within 800 feet of a very beautiful residential area. We purchased our home here just 3 years ago and I can assure you that we will lose value with the addition of this new facility in such close proximity. This is not what we bargained for such a short time ago. It simply isn't necessary to turn the green landscape of Falcon Golf course into a busy hub of truck traffic in this area. There are numerous plots of land in the area adjacent to Loop 303 that would be much more suitable for the cross dock facility. We are asking you to consider the residents of this area and not the opportunistic owner of this property in question.

We are writing to voice our complete opposition to the proposed cross dock facility at the Falcon Golf Course north of Camelback Road.

We live in Litchfield Park and my number one concern is the safety of travel via Camelback road with the potential increase in 1000s of semi truck-trips per day.

I also understand that there will be multiple challenges in widening Camelback Road west of Litchfield Road due to Sun Health owning the property to the North and minimal space to expand south towards Litchfield Greens neighborhood. This expansion is already needed with the current traffic load and the additional traffic will make travel extremely difficult/dangerous.

The road conditions on Camelback Road, approaching Sarival from the east are also in need of repair. Adding additional semi-truck traffic to the road will only exacerbate the deteriorating condition of the asphalt on Camelback.

The noise issues of operating a 24/7 trucking facility are also not conducive to maintaining property values in the surrounding residential areas.

Thanks for your consideration and I hope that you will listen to the residents and city leadership of the areas that will be negatively impacted by approving the construction of the FedEx Cross Dock Facility.

I am not sure if you are aware of our situation. You may have been contacted by a number of residents in both Litchfield Park and Goodyear regarding the proposal for a cross dock facility off Camelback road and the rezoning request to accommodate said proposal.

I want to share with you a story of intrigue.

It has a conflict of interest involving a former appointed official who is alsi a property owner/developer who used his former appointed position to skirt the law and residents who could be impacted as a result of his misdeeds.

On May 28, 2020 the Planning and Zoning Commission’s hearing recommendation for the above referenced case, ended with the 7-2 recommendation from the committee. The only interest that was being served at this hearing was the applicants. Not the homeowners or other impacted subdivisions that include thousands of homes. All whom will be negatively impacted if the rezoning and special use permit is approved.

The opposition came from the Cities of Litchfield Park, Goodyear and .

The seven yes votes have no retort for those opposed " Some homeowners have expressed frustration."

The real story here is that the applicant, Mike Crowley was, until March of 2020, part of the appointed Zoning Commission.

What does this say about the integrity of our zoning commission?

Mr. Crowley used his position to manipulate loopholes in the military zoning regulations and his relationship with other appointed members of the commission to exploit the regulations.

At the end of the day, this is no different than insider trading, which is illegal, but somehow isn't being investigated in this instance because the former commissioner recused himself after the request was submitted.

The very fact that these positions are appointed as opposed to elected is cause for great concern. Appointed positions do not represent a constituancy and the appointed members may not have aligned interest with the impacted communities to protect the land

They are instead, influenced by their relationship with the applicant (one of their own) whose desire is to gain approval without regard to the communites at large.

The communities requests for help from the commission have fallen on deaf ears.

How the former commissioner and owner of the property in question was appointed to the commission is likely a story in itself.

As a developer/owner desiring to rezone the land in question. What could be a better way of achieving your goal get than being appointed to the very the commisson that decides on such requests?

You can leverage your relationships with the other members to get their approval all the while recusing yourself from voting process. This is not a conflict of interest if I ever saw one.

If the proposed endeavor is succesful, It could endanger Luke AFB's mission, drasticslly increase truck traffic on that section of camelback road, impact access to the new Jackie Robinson little league field and a negatively the homeowners in the developments adjacent to the proposed project in both Goodyear and Litchfield Park

The board of supervisors has not thus far represented our interests. The city of Glendale is also appears to be involved in some questionable operations through land annexation in same vicinity of this propsed project. Curious, this land is no where near their city limits. Possibly another great story of intrigue for a later date I am sure.

I am requesting that your shed some light on this story and help our voices be heard.

Events such as this can happen anywhere at anytime. When these events go unreported, the cycle continues. It could transpire next time in a neighborhood near and dear to you.

If the media won't hold bad players accountable for misdeeds, who will?

I would like to express my opposition to the cross dock facility going in at 156the and Camelback road. I live in Palm Valley North the first development to the east of the site. I want to point out that the residential was there BEFORE he purchased this site. He knew the houses were there and did not care if he ruined their lives and their property values for his own benefit. He purchased the site knowing this and always intended to lease it to FEDEX. That is what he does. I just wanted to point out that during the hearing the attorney for the applicant made several statements that misrepresented the facts. First was we would not hear back up beepers all night because the forklifts are inside, and they use a Yard Bully to move the trailers. According to OSHA rules Yard Bullys also require back up beepers. Therefore, we will in fact be subject to back up beepers. This noise is very disturbing at night. The pictures he shows are not what they are building. The pictures are about ¼ of the size of the actual facility they are building. He tries to downplay the amount of traffic by not using the total traffic figures in his report but only using partial figures as if they are the total traffic. He misrepresents what is planned for the PV 303 across the street from his site. PV 303 plan has that site as office/light industrial. He shows pictures of huge warehouses to minimize what he is building. This is deceitful and that is being kind. He shows pictures of how wonderful Camelback will be but he fails to state that is only adjacent to his site and does nothing to upgrade Camelback between Litchfield and the 303 where it is two lane. He states there are no other uses for this site which is untrue. This could be storage facilities. Light industrial, Office and many other uses. It could even remain a golf course. Like it was when he bought it.

The light and noise will be constant. This business will operate 24/7 and will need to lit up like daylight in order to operate safely at night. This is not security light this is reading light. It is impossible to shield this from surrounding properties no matter how much you try. This site has only one access which is Camelback Road. All the traffic will be dumped on Camelback unlike other industrial sites in the corridor. This will cause a huge traffic issue at 156th and to Camelback and to the west. I know they say street improvements follow development but that may take years. It would be far better if the site south of Camelback developed first so the two- lane portion would be improved when the traffic occurred. His site is being built for far more trucks and traffic than he shows in the study. The size of the building will accommodate twice the truck traffic he shows. This needs to be located adjacent to the 303 like UPS and in a planned industrial park not in a one off site. The Planning Commission stated they had never had this much opposition to a project in recent memory. There valid reasons Litchfield Park, Goodyear and Luke all oppose this project. Our HOA VP put together and sent this email and it was so well done I wanted to make sure to send it over myself to show my opposition and issues with the new Cross Dock Facility right next door to where I live.

May 28, 2020 marked the Planning and Zoning Commission’s hearing recommendation for the above referenced case. I am writing to ask when this case will appear on the agenda for an upcoming meeting. I live in the Palm Valley North subdivision, one directly impacted with the decision toward permitting the rezoning, and I was beyond disappointed with the 7-2 recommendation from the committee, as the only interest that was being served was the applicant and not the homeowners. Other impacted subdivisions include thousands of homes, all that would be negatively affected if the rezoning and special use permit is approved.

There was opposition from the City of Litchfield Park, the City of Goodyear, as well as Luke Air Force Base, and the only comments the 7 ‘yes’ votes could focus on were that the homeowners have expressed frustration, as the applicant, Mike Crowley was, up until March of 2020, part of that appointed Zoning Commission. Your constituents have every right to feel the way they do about the Zoning Commission and that Mr. Crowley used his position to manipulate loopholes in the Military Zoning regulations is not an unreasonable assumption by any resident. Considering the fact the positions are appointed creates a significant concern, as these members may not have a clear direction toward protecting the existing area, and instead, are driven by the applicant’s desire to gain approval without regard to the community at large.

We are asking our elected board of supervisors to VOTE NO for this FedEx cross dock operation, and the residents of the area would like to speak at the next meeting regarding this case. The residents have attended not one, but two meetings on this case, spending over 12 hours of their time as their homes, community, and quality of life are about to be dramatically disenfranchised by allowing this case to move forward. These are life-savings investments in property that should not be adversely impacted by the capricious intents of unscrupulous investors and the reckless nature of these preliminary committees. To ignore the concerns of thousands of residents in favor of a single project seems unfair, as the arguments presented by the homeowners, along with the Air Force base, Goodyear, and Litchfield Park seems rushed and predetermined to favor development without the prerequisite studies that should have been done, including drainage, light pollution, excessive noise, infrastructure requirements, but most of all, the impact on property values and quality of life that this project will ultimately diminish, if it is allowed to proceed.

The recommendation of the committee was that Litchfield Park has a truck ordinance and only local travel, but there is not an effective way to enforce the 6000 trips a day that are expected to be on a road that already cannot handle more traffic. We were told today of the 120-foot-high lights to operate the facility 24 hours a day, with absolutely no idea of the impact these lights will have the community, nor any of the other possible impacts outlined above. We are solely concerned regarding safety, as this additional heavy truck traffic on Camelback Road is not able to be accommodated, even if that road were fully expanded to three lanes in each direction, and given the footprint of the area, that is simply not possible.

I could go on with further complaint as to how these hearings were conducted, but in short, there was little consideration toward the preservation of the community, and instead, that development would be approved, regardless of the consequences. There were petty issues presented, such as the small signage announcing the intention toward rezoning, the fact that there was a general release of liability presented to SOME, but not all, of the homeowners in the area of being in proximity of and industrial area, and that development of the unused land is inevitable.

The key point here is that the land in question HAS ALREADY BEEN DEVELOPED. It exists as a golf course, and it has been such for 18 years. It is not reasonable to have expected the homeowners in the area to anticipate the demolition of that operation in favor of an industrial cross-dock for FedEx. Had that have been explicitly stated, as homeowners, we would not have purchased homes in this area, nor would we have invested our life’s savings in property that would suddenly be devalued in the light of an operation that could certainly use more direction in the consideration of site placement and logistics. This is simply not a good site for the proposed operation, and for Maricopa County to disregard the valid concerns of homeowners is not consistent with the higher expectations of elected officials.

Please vote NO on the approval in allowing this abhorrent project to move forward. There will be a significant amount of media attention toward this matter, as the residents of this Valley should be considered at a more substantive level than that of newcomers looking to make a quick land deal that causes so much destruction toward our quality of life.

I understand that there is a zoning application coming up for the Falcon Golf Course property to become a trucking facility.

As you know there had been a lot of controversy regarding the racetrack next door and the amount of noise it caused. That was mostly resolved by putting in noise limits similar to Laguna Seca in northern California.

What hadn't ever been resolved is the noise from drag racing late at night on Camelback road. And I believe that traffic, safety and noise will increase substantially if this change goes through.

There will be trucks idling, some with refers, all night. There will be trucks using jakebrakes to slow down potentially at all hours. This is not the appropriate location for such a facility. There are a lot of locations on the303 that are further away from residential areas, in fact there may not be any locations that have as much nearby residential as this one has.

So please consider the people living close to Camelback when reviewing this application and not approve it.

We live in the Village at Litchfield Park, in fact our home backs to Camelback. We knew when we purchased here that we would have traffic to contend with, however, never in our wildest dreams would we have ever thought we would someday look out our view fence to see a very busy, noisy and large cross dock facility with thousands of trucks going by 24/7. Who would have ever thought a developed golf course could be rezoned to allow for a facility like this? The intersection at Camelback is already a very busy, dangerous intersection, and the neighborhood is already experiencing more traffic because people are cutting through to avoid the back-ups caused by the increased traffic from UPS and the additional commercial spaces along the 303.

I agree with the other residents that the purchase of the Golf Course could be considered a conflict of interest, while the owner was a part of the zoning commity.

Please consider that this area is further inside than the previous commercial corridor, and does butt up against residential areas that it will directly affect. We oppose this development, and want our voice to be heard.

Clint, Have the new owners provided any plans/details on the access/egress for the trucks into the facility? I believe that information is vital for a considered decision by the Board. Anyway you look at it from my perspective, there’s going to be one helluva bottleneck around the Sarival-Camelback 4-way stop – especially as Camelback is only a 2-lane road there. If trucks are going to be coming from the east through Litchfield Park it’s going to be a mess at the Litchfield-Camelback intersection as well. Unless there are immediate plans to widen Camelback to 4-lanes all the way from 303 to Litchfield- Camelback intersection before the Cross Dock facility is in operation, congestion becomes an untenable situation. I would hope the Board has “done their homework” regarding mitigating the potential problems before signing off in approval of the project. I request that you oppose the Cross Dock proposal (Case MCP2019005).

The fact that the Luke Air Force Base (LAFB) has stated that the project will not negatively impact LAFB flight operations should not be taken as a basis that this project is appropriate for an area that is heavily residential.

Amongst reasons that I ask you to oppose the proposal:

1) Safety concerns due to the high volume of traffic. (6048 daily trips generated as per page 2 of the Executive Summary of the Traffic Impact Study performed by United Civil Group as retained by the proposed developer). This same study assumes that between 10% and 20% of the heavy vehicles along with 50% of the passenger cars associated with the operation will arrive and depart from the east (heavily residential). Although a portion of Camelback to the west of the proposed project has been widened and improved, Camelback to the east reduces to one lane. The intersection of Camelback and N. Litchfield is well known for motor vehicle crashes.

2) Pollution: noise, dust and light. Beyond the noise and dust that would accompany the increased traffic, there will be significant light pollution. The project proposes exterior lighting with maximum pole height of 110 feet. There will be additional noise pollution due to the 24 hour per day operational noise of the facility.

3) Decreased quality of life and property values. The Palm Valley neighborhood is directly across Camelback Rd from the proposed facility. The Village at Litchfield Park is within a quarter mile of the facility. There are additional extensive residential areas further east and south that will be negatively impacted. It was frankly outrageous to read the comments from Mike Cowley, former vice chairman of the Planning and Zoning Commission and present owner of the subject property, in the May 6 edition of the West Valley View: “Notifying nearby residents was the easy part. There are no residences within 300 feet”. The fact that the county has chosen 300’ as a minimum distance for community engagement does not mean that your constituents beyond a 300’ radius are not impacted.

On a related topic, I was saddened to read the views presented by Sean Watkins County Planner (and reviewed by Darren Gerard, Planning Manager), in the Report to the Planning and Zoning Commission (MCP2019005-Falcon, Hearing Date April 23, 2020), which seek to disregard the opposition web page and associated comments from your constituents because “it is not possible to validate the property location of the commenters in relation to the subject property” (page 9 of 12, item 17 regarding Public Participation Summary). Who else but the residents being negatively impacted would be voicing their concerns, frustration and anger?

We have lived in the beautiful Litchfield Park area for about 14 years. I was very impressed by the neighborhood feel and safety, impressed enough to buy a home and set up roots and raise a family.

This cross dock facility therefore is causing me great distress. There is already a lot of fast moving traffic on Camelback and car accidents are not uncommon. Adding 6000 more vehicles to a road that is already stretched to the max is going to make that dangerous situation even worse. Goodyear and Litchfield Park are beautiful cities to live in but the addition of large scale manufacturing and the trucks inherent to that business is going to make our property values plummet. I would not be interested in buying a home next to an industrial park and I don't know anyone who would be. Trucks are noisy, dirty, and hard on the roads

Do we really want to contribute to making our beautiful neighborhoods look like central Phoenix? Looking like central Phoenix is one thing but crime follows the filth and our safe, family oriented neighborhood is in danger of being destroyed.

Please help us maintain our beautiful community.

My name is Ginny Solis-Wright and I am reaching out with my concern on the Crossdock. I have been a resident of the Park since I was young girl. My mother had the dress shop called the Cotton Patch where Old Pueblo is and the boutique in the Wigwam for many years. I have known your sister and family for many many years. I love the beauty of our small town and am very concerned on what this will do to our community.

My mother lives in La Loma and is in the independent living section and still drives. I can't even begin to imagine what this will do to that area with traffic coming and going. I am extremely concerned for her safety with driving and for the pollution it will cause. There are many other areas near the 303 where this type of business could reside, but the current location is not the location. You of all people who reside in the park and raise your family in the park would not want this.

I also feel the residents of Litchfield Park were blindsided on this development and it has not been handled correctly along the way.

I would be happy to speak to you personally regarding this matter and happy to answer any questions you may have

I would hope you would consider our town and all of the residents of Litchfield Park and Goodyear that will be impacted by this facility when you consider your vote.

Litchfield Park, the most affected community was not told of the project nor were the homeowners that will have to live with the huge traffic issues, noise, and safety concerns for the children. Dear Rusty and Christopher, Thank you again for meeting with us and for the opportunity to continue a dialogue regarding the above project (the “Project”) and the associated Military Compatibility Permit (“MCP”) with Plan of Development (“POD”) application that we are currently processing through Maricopa County for the property located north of the 152nd Avenue and Camelback Road intersection. We appreciate your time and would like to take the opportunity to address your concerns about traffic, as we understand that—within the broader community—there has been some misstatement of facts and misperceptions about traffic and the impacts of traffic on the surrounding area. For example, see Attachment A, which: (i) is based on an initial version of the Traffic Impact Study, of which the majority of misperceptions and recommendations have been addressed with the second, revised TIA dated April 10, 2020; and, (ii) has been reviewed and commented on by United Civil Group (“UCG”), the Traffic Engineering firm engaged on this project, as an attempt to resolve inaccuracies. In order to ensure that we are dealing with correct information, we would like to offer—in addition to the clarifications by UCG—the pertinent information below regarding traffic related to the Project.

A. Current Application Applicability

The Falcon Golf Course—which has announced its closure—is a total of 180- acres. It is bifurcated into two (2) separate parcels (APNs); a northern parcel (“Northern Site”), which is comprised of 79 +/- acres; and, a southern parcel (“Southern Site”), which is comprised of 78 +/- acres. For reference, please see Attachment B for an illustration of the site locations.

The Military Compatibility Permit application applies to both the Northern Site and the Southern Site; however, the POD is limited to the Northern Site. A future POD will be required prior to development of the Southern Site. This is important because the only trip generation that is imminent and part of the pending POD is for the Northern Site.

B. Trip Generation

The most recent version of the traffic study, dated and sealed by UCG on April 10, 2020, includes—at the request of the City of Goodyear—a trip generation analysis for both the Northern Site and the Southern Site. Therefore, while development of the Northern Site is imminent, the trip generation totals account for the Southern Site as well. In order to better communicate the impacts of the proposed project, UCG extracted the vehicular trip generation data for the Project from the overall traffic study data. Please see Attachment C for a copy of the pertinent trip generation data that is applicable for the Project. To summarize, the total trip generation for the Project—for all vehicle types— is 3,418 daily trips. Peak hour trips include 140 trips in the AM peak hour and 212 trips in the PM peak hour. It is important to note that a vehicle trip is defined as a single or one- direction vehicle movement. So, a vehicle entering the site is one trip and a vehicle exiting the site is an additional or second trip. Because of our client’s experience, we have been able to further establish that only 10% of the total trip generation for the Project traveling to/from east of the site on Camelback Road will consist of heavy vehicles (trucks). Therefore, as it relates to truck traffic traveling east of the Project on Camelback Road, approximately 4 of the morning peak hour trips will be truck trips. Similarly, approximately 8 of the PM peak hour trips will be truck trips traveling east of the Project. Please see Attachment D for a copy of the heavy vehicle data. It should be noted that, in an effort to be as transparent as possible, our client provided real-world traffic data based on its other facilities and real-world operational experience. The standard ITE data would otherwise be lower than what has been provided and reviewed by pertinent jurisdictions. In other words, the TIA is conservative compared to the ITE data for the same type of use and is thus more representative of actual anticipated traffic generation.

C. Trip Distribution

We understand that there are local stakeholder concerns regarding the impacts— both real and perceived—of truck traffic on Camelback Road, particularly travelling east of the Project. In an effort to address these concerns, we provided a breakdown of the trip distribution for both passenger cars and heavy vehicles to/from the Project. In summary, 90% of heavy vehicles (trucks) will travel west of the Project, with 10% travelling east of the Project. For passenger cars, we anticipate an equal 50/50% split, which is reflective of the locations of the local employment base. D. Roadway Improvements

As development occurs along Camelback Road, the City of Goodyear will require developers—including of this Project—to construct their proportionate share of the roadway to accommodate projected traffic growth. Enclosed as Attachment E is a conceptual off-site improvement exhibit which identifies the improvements that will be required for development of the Project, including widening of Camelback Road adjacent to the property; and, installation of a traffic signal at 152nd Avenue and Camelback Road.

These improvements are consistent with the improvement requirements for Camelback Center at PV303 as detailed in its respective TIA dated April 2019. Specifically, the TIA recommends half-street improvements, as well as two (2) signals along that property’s frontage. Note that the City of Goodyear also has plans to improve the intersection of Sarival Avenue/Camelback Road within their Capital Improvement Projects (Project Number: 42007).

Ultimately, once Camelback Road is improved to its ultimate configuration as a 6- lane section with raised medians and controlled access, Camelback Road will be able to accommodate upwards of 55,000 vehicles per day.

E. Jurisdiction Outreach

In an effort to resolve concerns regarding traffic with local jurisdictional stakeholders, we have met with both the City of Litchfield Park and the City of Goodyear to discuss concerns pertaining to traffic. As a result of our dialogue with Litchfield Park, we have committed to providing several stipulations for the Project to address the City’s concerns. Please see Attachment F for the stipulations that we have negotiated with Litchfield Park, and which we will present to the County Board of Supervisors for approval. In addition, it should be noted that—in order to address concerns about truck traffic and access, including by the City of Goodyear—we agreed to a stipulation of approval at the Planning and Zoning Commission hearing to segregate truck access to the Project. Further, we are taking the necessary steps to design and ultimately build improvements for a westerly driveway access. Please refer again to Attachment E, which illustrates our improvement plans. The specific stipulation is as follows: “EXCEPT FOR LOCAL DELIVERIES, DEVELOPMENT OF THE SITE SHALL INCLUDE DRIVEWAY DESIGN AND/OR SIGNS THAT DIRECT TRAFFIC (VEHICLES GREATER THAN 10,000 POUNDS) TO AND FROM THE SITE, WEST ALONG CAMELBACK ROAD” We believe that—with these stipulations—many of the concerns related to traffic should be alleviated. Further, it is our understanding that with the incorporation of these stipulations, the City of Litchfield Park will not actively oppose the Project. F. Enforcement

Approval of the Project would be subject to stipulations. Compliance with the stipulations of approval will be required, and violation of the stipulations would be considered a zoning violation, subject to penalties under the Maricopa County Zoning Ordinance (Section 1503). Therefore, the property owner and operator will be obligated to comply with the stipulations. In addition, both the City of Goodyear and City of Litchfield Park restrict truck traffic on city streets (see Attachment G and Attachment H, respectively). In particular, the City of Litchfield Park limits truck traffic (with exceptions as enumerated in its Code, including for local delivery) to Dysart Road. Ultimately, the Project end-user understands these codes and will willfully comply. We hope that this information satisfies your concerns and are happy to continue to have a dialogue with you, if desired. Thank you again for your time and attention to this project. INTRODUCTION Good afternoon Mayor Schoaf. My name is Jack Lorbeer and I contacted you on April 8th about the proposed truck/industrial facility site under consideration by the County. The project is located on the northside of 152nd Avenue and Camelback Road overlaying the existing Falcon Golf Club. I have spent the last several days researching the project and visiting the site. Here are my observations at this time.

As mentioned to you, I have over 30 years of experience in development review on proposals such as this one. I have worked for the Department of Transportation (ADOT), the Maricopa County Department of Transportation (MCDOT), the City of Glendale Arizona, the San Diego Association of Governments (SANDAG), the Regional Transportation Commission (RTC) in Reno Nevada, and was a traffic engineer with the City of San Diego California. I have been requested by several of my neighbors to provide you with my expertise in the review of developments. I reside in the Litchfield Greens subdivision.

PLANNING PROCESS Let me first describe where we are in the planning process pertaining to this proposed project.

The consulting firm of HilgartWilson who represents the developer met with the County Planning and Development on May 28, 2019. This pre-app meeting was to determine the initial course of action for their project proposal. The primary issue was that the project needed two determinations/ permits. This is due to the fact that the site is in proximity to the Luke Air Force Base in a special zoning district called the Military Airport and Auxiliary Military Overlay Zoning District of the Maricopa County Ordinance. The two determinations/ permits needed are an Use Consistency Compatibility Determination (UCCD) and a Military Compatibility Permit (MCP). The UCCD and MCP are basically saying that the proposed land uses are compatible and therefore determined to be allowable in this special zoning area and are agreeable to the Luke Air Force Base and its flight operations. The underlying zoning of RU43 (rural) basically allows many types of land uses.

To secure these permits, HilgartWilson on July 11, 2019 sent a letter to the County and to Luke Air Force Base requesting that they buy off on the proposed industrial/truck project in terms of compatibility. On September 20, 2019, Luke Air Force Base staff (James Mitchell via letter to the project consultant) agreed that the project was compatible with some restrictions (such as storing explosives) as did the County staff (Matt Holm via letter to the project consultant) on September 23, 2019. County staff recommended that the consultant proceed with submitting an application for the MCP but to also include a Precise Plan of Development (POD) to give details on the proposed project and seek approval.

On December 5, 2019, the project (called FALCON by the developer) submitted the MCP and POD application to the County and was assigned case MCP2019005. If you go by the actual site today at 152nd Avenue you can see the posted sign with this number and request. A second follow up submittal was sent on February 14, 2020 but contained no major changes to the site proposal.

With the December 5 application, the consultant also included a presentation called a public participation plan (PPP). The PPP is to describe how the project reached out to the public to seek input on the project proposal. In their distribution lists with information about the project including a site plan, the City of Litchfield Park was not included. Glendale, Goodyear, the air force base and other groups were but not Litchfield Park despite our northern boundary being a short distance east of the proposed project. They quoted County notification requirements of 300 feet but the Bullard Wash would exclude any Litchfield Park residents being on the list. It is a major error to exclude Litchfield Park from the project review process when the City of Litchfield Park is shown on their site map.

This leads to where we are today. The project proposal is scheduled to go before the Planning Commission on April 23, and the Board of Supervisors (BOS) on May 6, for the MCP approval. The county staff report was completed today and recommends approval with some conditions. These are typical conditions and would not impede the development.

PROJECT DESCRIPTION As part of the MCP application, the proposed project (POD) has been described in some detail and some general descriptions. A review of them is important.

The proposed project is made up of two parcels. The back parcel closest to the Base (APN 501- 61-006C) and the front parcel adjacent to Camelback Road (APN 501-61-006B). The back parcel would contain the proposed cross-dock trucking facility and is 79.36 acres in size. The cross-dock facility, however, is proposed to be built in two phases. The first phase to be constructed by 2022 represents 180,000 square feet of buildings, repair, fuel tanks, storage and other industrial uses. The second phase would add another 45,000 square feet of industrial building and shop and would be completed by 2030. Close to 300 loading bays are included in

This page contains no comments the description. In addition, light towers could be as high as 110 feet and building heights of 60 feet. That equates to a five story building.

The front parcel is not yet fully defined but is described as an "industrial park" with 725,000 square feet of planned industrial uses. The size is stated as a typical industrial sized facility in the City of Goodyear and is assumed to be built by 2025.The entire site representing nearly one million square feet of industrial uses is projected to be fully built-out by 2030.

I have had discussions with former colleagues of mine at both the City of Glendale and the City of Goodyear. It should be noted that the City of Glendale has a ten-foot strip annex on the north side of Camelback Road and therefore the site is technically in the City of Glendale Planning Area. However, I was informed that the City of Glendale has shown no interest in annexation at this time. Neither has the City of Goodyear. Thus, it remains for the County to evaluate and move ahead with the project application process.

COMMUNITY IMPACTS - TRAFFIC OVERVIEW I have reviewed the 100+ page traffic report done for the project by the United Civil Group (UCG). There are many traffic issues involved with the proposed project with some that are likely detrimental to Litchfield Park residents.

First we need to look at existing conditions. A good start is to understand the type of infrastructure that is in place today. The best example is to compare Camelback Road with Indian School Road. Both are primarily under the jurisdiction of the City of Goodyear and both are classified as major arterials. Beginning at Litchfield Road traveling west, Indian School Road is a 6 lane divided highway all the way to the Loop 303 freeway. There are sidewalks, bike lanes, and a landscaped median that limits the number of turning movements. This facility is essentially built out, can carry up to about 40,000 trips per day and meets basic standards.

This roadway condition differs substantially from current Camelback Road west of Litchfield Road. The only short section that resembles Indian School is at 146th Avenue. That was required by the City of Goodyear with the Palm Valley North Development. Camelback Road, west of the proposed project, is basically a 2 lane road with no sidewalks, bike lanes or even curb and gutter. A tailwater ditch is adjacent to the northside of the roadway and on the frontage of the proposed project. A stop sign is at Sarival Rd creating a back up especially during peak travel hours.

The City of Goodyear currently has NO1 projects in their CIP to improve Camelback Rd. west of the site to Loop 303. Only future development (probably industrial as well) would be required to improve Camelback Rd. to its ultimate sizing like Indian School Road, capable of handling large amounts of traffic. The timing of future development on Camelback Road is uncertain, so it may be undersized for the foreseeable future. With future traffic levels increasing due to this project and a 2% background traffic growth assumption in the traffic report, there will be more congestion on Camelback Road without the appropriate improvements. The traffic counts that were taken on September 17, 2019 indicate approximately 10,000 daily trips on Camelback

Road at the site location. While not an overly large amount, it is a substantial amount for the two lane section west of the project site to the 303 freeway and will only worsen with time without significant upgrades.

TRAFFIC IMPACTS SITE SPECIFIC Using the proposed project traffic report as the resource, there are several important issues. In reviewing the project site (both parcels) there are nearly 1 million square feet of industrial uses proposed for the project. This is the full development scenario and used for traffic analysis.

TRIP GENERATION The traffic report estimates that there will be nearly 14,000 daily trips (3,898) (1268 trips from the north parcel and 2630 trips from the south parcel) into and out of the project site at full development. During the important morning peak hour, 482 trips are estimated and during the evening peak hour 496 trips. This2 is a total of 978 peak hour trips each day. During the morning peak, 81% of the trips will be entering and 19% exiting. It is almost reversed in the evening with 21% entering and 79% exiting. 3The traffic report used KW data to estimate that morning peak traffic, which is estimated at 22% trucks (heavy vehicles). The evening peak hour is much larger at 62%. Of the 482 morning peak hour trips, 106 will be trucks. In the evening peak hour, the number is much higher with 308 trucks. The total is 414 truck trips during the morning/ evening peak hours or 42% of the daily peak hour truck total. This is a large number that will have significant impacts on the surrounding roadway network and on traffic operations.

TRIP DISTRIBUTION Just as important as to how many vehicles and especially trucks are generated by the proposed project is where they will be coming from and going to. This is especially critical for Litchfield Park. 4The traffic report estimates that of the 106 trucks in the morning peak hour, 27 will be going to/coming from Camelback Road east of the project. The total in the evening peak hour is much higher at 123 trucks going to or coming from on Camelback Road east of the site. The total peak hour truck trips east of the site on Camelback Rd. is 150 trucks every day.

These5 150 trucks will travel through the Litchfield Road/Camelback Road intersection. While the turn movements at this intersection were not identified, it is certain a 6large number of them will cut through Litchfield Park on Litchfield Road. Others will remain on Camelback Road along our northern boundary. With few other options available, Litchfield Park will surely be subjected to increased truck traffic through the city. 7The northbound to westbound turn movement from Litchfield Road onto Camelback Road will be significantly impacted, most likely creating long queues of slow moving truck traffic. Mitigations such as extending the turn bay would be expensive and hard to complete if even possible. There8 is no assessment of project traffic especially truck traffic on nearby arterial/arterial intersections such as Litchfield Road and Camelback Road in the traffic report. This is a significant flaw.

The9 traffic report assumes that the remaining ⅔ of the project’s peak hour truck traffic will go west from the project site to Loop 303, a 2 mile distance. This would only be a reasonable assumption if all the improvements necessary to make Camelback Road a principal arterial to

The industrial (front parcel) is estimated to generate 2,630 trips daily using a FAR of 0.25. This value will be refined when a site plan is developed for the front parcel.

It is important to note that a vehicle trip is defined as a single or one-direction vehicle movement. So a vehicle entering the site is one trip and a vehicle exiting the site is an additional or second trip.

Each peak hour needs to be evaluated individually. The peak hour is defined by the Institute of Transportation Engineer's Trip Generation Manual as the one hour within the morning and evening weekday commuter peak periods when traffic is the highest. This is usually between 7-9am or 4-6pm.

The industrial park is estimated to generate 207 daily heavy vehicle trips with 27 of those trips occurring in the morning peak hour and 8 in the evening peak hour based on the ITE Trip Generation Manual.

The intersection of Camelback Road/Litchfield Road is over 1 1/2 miles from site. Therefore, this TIA conforms to both the City of Goodyear and MCDOT standard TIA guidelines.

Number: 9 Author: ssimpson Subject: Highlight Date: 6/10/2020 12:16:59 PM Based on data obtained from the developer, 90% of the truck traffic will traverse west on Camelback Road to and from SR 303L. the Loop 303 are in place. 1At this time, there are NO planned improvements on Camelback west of the site. Therefore, there is the potential that the traffic distribution may skew further to and from the east side direction where more roadway infrastructure is currently in place. This scenario would further worsen the traffic conditions through Litchfield Park and add even more potential truck traffic through our city.

TRIP ASSIGNMENT The traffic reports that Camelback Road will increase significantly from 10,000 daily trips today to nearly 30,000 daily trips by 2035. This would have to assume that the corridor is sized similar to Indian School all the way west to Loop 303. What2 is out there today would in no way be able to carry 30,000 trips per day.

TRAFFIC OPERATIONS There are several operational issues associated with the proposed project that are of concern. The3 first is that the main site access point does not line up with the intersection of 152nd Avenue. This creates two "T"" intersections a mere 500 feet apart. 4As the project claims that a signal will be warranted at the main access street by 2025, this will create a failing level of service for vehicles trying to turn west off of 152nd Avenue onto Camelback Road. This is acknowledged in the traffic report. Due to the proximity of the intersections, it would not be operationally sound to also have a signal at 152nd Avenue. It5 would have made much more sense to align the main access point and 152nd Avenue with one signal; however, this would more than likely conflict with the project's desire to have another access point at the east side of the property as a right in/right out driveway.

DRAINAGE The project also affects the Bullard Wash just to the east of the site. Modifications to the wash are required to get a Conditional Letter of Map Revision (CLOMAR). This is because grading for the site will alter the hydrology of the floodplain/floodway adjacent to the site. In my discussions with City of Goodyear staff, this is a major concern as they have spent a large amount of money to channel the various drainage to get under Camelback Road. The CLOMAR is issued by FEMA in cooperation with the Maricopa County Flood Control District (FCD). I am not sure of where it is in the process, but is one of the conditions of approval, which would further extend the review timeframe.

SUMMARY The proposed FALCON project will have significant impacts for the City of Litchfield Park. These include from the traffic report:

1. 1506 heavy vehicles (trucks) will pass through/turn at the intersection of Litchfield Road and Camelback Road every day. No traffic analysis of this major arterial/arterial intersection was conducted in the traffic report. 2. Northbound7 152nd Avenue left turns will be at a failing level of service by 2025.

To this point, the Camelback Center at PV303 TIA dated April 2019 recommends 1/2 street improvements as well as two signals along the property's frontage. Once Camelback Road is improved to a 6 lane section with raised medians and controlled access, this roaday will be able to accommodate upwards of 55,000 vehicles per day.

This access is proposed as a secondary access for passenger vehicles and a primary access for heavy vehicles. Per the City of Goodyear Engineering Design Standards and Policies Manual and Standard Detail 3230, the minimum distance for driveway spacing is 250 feet. The proposed driveway is 700 feet west of 152nd Avenue, which meets the City's driveways spacing criteria.

3. The1 report assumes a distribution that must assume that Camelback Road is significantly upsized from the site to Loop 303. However, no funding or current development is in the process of doing this and there are no projects in the City of Goodyear CIP. 4. Bicycle2 and Pedestrian infrastructure will be incomplete creating the potential for dangerous situations. 5. The3 access point for the proposed project does not line up with 152nd Avenue, creating two “T” intersections that are in too close proximity to each other to be safe and operationally effective. 6. The4 proposed project calls for a signal at the access point by 2025. Heavy vehicle turn movements would call for lengthy deceleration and acceleration lanes for the large amounts of slow moving trucks.

Other issues such as drainage changes to the Bullard Wash, increased noise, truck exhaust and truck braking, possible 110 feet high light towers, possible 60 foot high truck dock buildings, on-site fuel storage, are all issues that will adversely impact the City of Litchfield Park. Our northern boundary is only a short distance to the east of the proposed site and follows Camelback Road all the way east to Dysart Road.

The County staff report for the Planning Commission is recommending approval with conditions that would not impede the project development or address the needed infrastructure improvements.

These include half street improvements to Camelback Road, an IGA with Goodyear and Glendale, the CLOMAR and eventual hook up to sewer services. The County staff conclusion was that this is an appropriate use for this property with respect to its compatibility with Luke Air Force Base; however, it does not specify that it is compatible with surrounding development and infrastructure. There are other land uses that could be considered that may have much less impacts to surrounding neighborhoods both in Goodyear and Litchfield Park.

The City of Goodyear has recommended a postponement to address traffic concerns.

The City of Avondale has stated no comments.

The City of Litchfield Park in a letter on February 24, 2020 recommended denial. This is true of many citizen opposition letters primarily to Clint Hickman of the BOS.

The improvements shall include additional Camelback Road widening for all required deceleration lanes extending beyond the property frontage. Entry/exit from said access point shall be limited to left-in/right-in/right-out only when the ultimate Camelback Road improvements are constructed. • With the exception of routes for deliveries in the City of Litchfield Park, inbound heavy vehicles will enter the site on Camelback Road from the west. Heavy vehicle egress onto Camelback Road headed eastbound at the 152nd Avenue alignment shall be limited to delivery routes to Litchfield Park only, in compliance with the City of Litchfield Park’s Truck Restriction Ordinance.

§ 13-2-13 TRUCK ROUTES.

(A) Definitions. In this section, unless the context otherwise requires:

LOCAL DELIVERY means the delivery and pick up of merchandise, materials or equipment to or from a specific location not located on a Truck Route.

LOCAL TRUCK TRAFFIC means use of the roads by non-regulated trucks and by Regulated Trucks that are making a Local Delivery.

REGULATED TRUCKS shall mean any of the following:

(1) Semi-trailer when used in combination with a Truck Tractor.

(2) A motor vehicle designed, used or maintained primarily for the carrying of property other than the effects of the driver or passenger and includes a motor vehicle to which has been added a box, a platform or other equipment for such carrying.

(3) Single unit multiple rear axle trucks with a gross vehicle weight rating (GVWR) or gross combination weight rating of 18,001 pounds or more including dump trucks and cement mixers.

(4) Vehicles used in the transportation of hazardous material in an amount requiring hazardous material warning placards under any federal, state or local law or regulation.

RESTRICTED ROUTE means a segment or connected segments of streets, within the City of Goodyear, upon which Regulated Truck traffic is restricted or prohibited by posted signage.

SEMI-TRAILER means a vehicle that is with or without motive power that is designed for carrying persons or property and for being drawn by a motor vehicle and that is constructed so that some part of its weight and that of its load rests on or is carried by another vehicle.

TRUCK ROUTE means a street or connected segments of streets, within the City of Goodyear, upon which Regulated Truck traffic is directed.

TRUCK TRACTOR means a motor vehicle that is designed and used primarily for drawing other vehicles and that is not constructed to carry a load other than a part of the weight of the vehicle and load drawn.

(B) Designated Truck Routes. For the purposes of this subsection, the following roadways within the Goodyear City limits are hereby designated as Truck Routes:

I live in Palm Valley V, south of Camelback. I have followed the Subject issue with great concern. Nowhere have I seen any consideration for the additional commercial vehicles that the light industrial area south of Camelback to Charles Blvd will add to the 6000 trucks per day Cross-Dock is expected to generate.

There already has been a request for a zoning exception to allow direct access to Camelback near the Pebble Creek/Camelback intersection. North of Camelback, the recently annexed parcel by Glendale is proposed for commercial development. Both areas will be traffic generators.

Besides the traffic issue, which should be enough to negate approval of Cross-Dock, no concern has really been given to quality of life issues or general traffic safety, besides the addition of 6000 truck trips per day.

Maricopa County stands to lose real estate tax revenue, also, as property values plummet as a result of a Cross-Dock facility at the golf course site.

Cross-Dock clearly does not need to be in a basically residential area. The property would be better suited as a park for thousands of Maricopa County taxpayers. These residents deserve better than what is under consideration.

Nothing I can say as a homeowner being affected by this travesty, will change your mind. Instead, I'm expressing my dissatisfaction with the Revised truck access plan and encourage you to change it. The Revised access plan has a truck access at the intersection of 152nd Ave. and Camelback. This forces all heavy truck traffic and local resident traffic through the same intersection. I consider this to be a very dangerous proposition for the residential traffic. A family in a car is no match for a semi-truck in an accident. Let's keep these two different types of traffic separated from each other. Go back to the Initial access plan with a dedicated truck access/traffic light west of 152nd Ave. Not only does this keep the residential traffic deconflicted from heavy truck traffic, it also allows an access for truck traffic to the adjoining parcel of land west of Cowley's land. The least you can do in this dispute, and I mean the least, is to keep the residents safe by not allowing truck access at the intersection of 152nd Ave. Keep the Initial Proposed Access & Improvements Plan!!

Keeping this short in hopeful prayer that you read it and take it to heart.

Please think way back when we were young and idealistic. The world was our oyster with dreams of hope and inspiration for our futures. There was so much admiration and faith in our leadership. We were taught integrity and it was demonstrated by our elders.

You are that leadership that we, your constituents voted in to office to protect our safety and the safety of our children.

I still believe the right thing to do is shut down the Cross Docks facility proposed on the defunct golf course site off Camelback in Goodyear. But, I also have grown up to know progress prevails, money talks and you can't fight city hall. Help us get a punch at it, at the very least. Based on the many things you have read from other neighbors already, stop and help mitigate this project to lessen the impact (and stifle the rumor that the owner of the golf course land controls our elected officials) on the Phase V community and proposed multifamily housing on both sides of Camelback and 152nd that would lead south into a 1600 house community (with schools).

The next proposals would be west and north for another Cross Docks but closer to the 330 and away from Phase 5. Zoning a former golf course into a truck facility is a very drastic change that will impact our community safety and health again cited by previous letters.

Please be leaders we can admire and reelect. Let's put your votes in the hands of the people, not the developers of that land parcel.

The noise, pollution, and more importantly the safety of our citizens should be the main interest of the decision. I am vehemently opposed to this development due to many major impacts that have not been addressed.

They have not done their due diligence to identify the negative impacts on pre-existing residentially developed properties.

Caveat Emptor is an axiom often used for disputes between property owners. Frequently this is a situation where a property is developed next to a farm or near an airport, etc. which were in existence long before the new project. But the new people try to impede, change or even stop these uses. New people usually lose since the adjacent projects were in the area before the new projects. This applicant should have investigated the adjacent uses prior to the purchase, and presented mitigation proposals for the impacts. Hence the application of Caveat Emptor.

In the case of the cross dock it seems they have not thoroughly vetted the area to determine impacts and possible mitigation to pre-existing developed properties. They should have investigated the surrounding uses to determine the impacts and submitted potential mitigation to the many neighborhoods in the area.

This seems to be a classic Caveat Emptor situation as they have totally disregarded the major impacts to the pre-existing developments, residents and their safety and lifestyle. Further studies must be made to determine the full impact of the project. At that time an informed decision can be made, which may be NO, if the impacts cannot be acceptably mitigated.

We oppose the development of the Falcon Golf Course property into a cross dock transportation facility for the following reasons: 1. The location is too close to residential development. 2. It will increase the number of trucks driving on Camelback Rd, which is at best a paved former farm road, which already has a backlog of traffic at the Sarival intersection from traffic to and from the 303. 3. It is located near the end of a Luke AFB which also has a munitions shed in the area. Should a fuel heavy F-35 land on or near the proposed facility, it and all its employees would be toast. 4. Luke AFB informed the Zoning Committee that if a fire should happen from a crash, they and fire responders would have difficulty accessing it both from the Luke AFB side and also from the increased traffic on Camelback Rd. 5. Luke AFB also voiced concerns of the impact such a facility would have on the local residents. 6. Impact of increased traffic on Camelback Rd will hinder the Palm Valley Community from traveling on Camelback, including children using it to get to school, some on bicycles. 7. The increased traffic will also lower residential property values and affect resale opportunities. 8. The original property development is for phase 1 with an estimate of 4000 trips/day. When they enlarge later, there can be 6000 or more truck trips per day using Camelback Rd. 9. The south side of Camelback Rd east of the 303 is apparently or will be zoned commercial/industrial by Goodyear. If that develops, the traffic on Camelback will be unbearable.

Conclusion: No matter how this all turns out, Camelback Rd needs to be converted to a 4 or even a 6 lane road if it’s to be a primary access to and from the 303. And funds for that should be paid for upfront by the Cross Dock and the County as part of the plan approval. And the County should have it done prior to any development. We appreciate that the MC Zoning Committee added language requiring trucks to travel west on Camelback. We don’t want them to travel east from this facility on Camelback Rd to access the 101. We don’t want them using Litchfield Rd or Dysart to access the I-10.

The reason why I am writing to you today is in regards to the Cross Dock Facility that is being approved to go in on Camelback Road in Litchfield Park. I do not live right next to where the proposed Cross Dock Facility is however, my son will be attending Canyon View High school and will be bused down this road to get back and forth to school. Recently the boundaries changed and although we are happy that he will be able to attend Canyon View, being bused on Camelback for 20 minutes each way was a worry. I am now concerned more because if this is approved then there will be more then 6000 trucks up and down Camelback with my son making his commute more then 20 minutes each way and making it more dangerous as well. When my husband and I found out that my Son's boundaries were going to change, we were thinking about moving closer to Canyon View so that our son Conner would not have to make the long and dangerous trip down Camelback road each day. My husband works at Honeywell in Phoenix and I work in Avondale. My husband already has a long commute each day to work. We were actually starting to look into moving into Palm Valley Phase 5 so it wouldn't be that much farther from my husband's job but it would be a little closer to Canyon View,however if the cross dock is built by Palm Valley Phase 5 it would not only cause more traffic for the residents there but there would be issues with noise as well as property values going down. I do understand the need for trucks and I am sure that this development is a great way to help the economy that is truly struggling right now but I am asking for you to vote No on the Cross Dock for the above reasons. I feel that there are other places farther west that it can be built away from houses.

We have accepted that our city continues to grow and that these facilities have been placed there to provide growth to our city. We have appreciated that these businesses have been strategically placed in an area which have been distanced from neighborhoods and that the large trucks have convenient access to the 303 freeway. However, with this new Cross Dock project, we feel as there has been no consideration to the surrounding neighborhoods. The guaranteed uptick in traffic with excessive quantities of traveling trucks entering and exiting all day, everyday and just across from our neighborhoods does not line up with the goals of the neighboring cities. We are aware that there must be changes, that new business will pop up, that owners of these lands can sell their properties to whomever they please. But we are also the people who live and work in this community. We want to maintain the feel of a family neighborhood where our walks with our family can happen without the constant noise and air pollution that will surround our neighborhood.

We ask you, Mr. Hickman, to speak out on behalf of our community and neighbors; who in majority oppose the Cross Dock facility. Ask yourself; if I lived here, would my family benefit from this? Is there a better land option for these large businesses (like along the 303 hwy)? How would this facility affect the everyday lives of my neighbors? Will it affect the property values? I live in the Palm Valley North subdivision, one directly impacted with the decision toward permitting the rezoning, and I was beyond disappointed with the 7-2 recommendation from the committee, as the only interest that was being served was the applicant and not the homeowners. Other impacted subdivisions include thousands of homes, all that would be negatively affected if the rezoning and special use permit is approved. There was opposition from the City of Litchfield Park, the City of Goodyear, as well as Luke Air Force Base, and the only comments the 7 ‘yes’ votes could focus on were that the homeowners have expressed frustration, as the applicant, Mike Crowley was, up until March of 2020, part of that appointed Zoning Commission. Your constituents have every right to feel the way they do about the Zoning Commission and that Mr. Crowley used his position to manipulate loopholes in the Military Zoning regulations is not an unreasonable assumption by any resident. Considering the fact the positions are appointed creates a significant concern, as these members may not have a clear direction toward protecting the existing area, and instead, are driven by the applicant’s desire to gain approval without regard to the community at large. We are asking our elected board of supervisors to VOTE NO for this FedEx cross dock operation, and the residents of the area would like to speak at the next meeting regarding this case. The residents have attended not one, but two meetings on this case, spending over 12 hours of their time as their homes, community, and quality of life are about to be dramatically disenfranchised by allowing this case to move forward. These are life-savings investments in property that should not be adversely impacted by the capricious intents of unscrupulous investors and the reckless nature of these preliminary committees. To ignore the concerns of thousands of residents in favor of a single project seems unfair, as the arguments presented by the homeowners, along with the Air Force base, Goodyear, and Litchfield Park seems rushed and predetermined to favor development without the prerequisite studies that should have been done, including drainage, light pollution, excessive noise, infrastructure requirements, but most of all, the impact on property values and quality of life that this project will ultimately diminish, if it is allowed to proceed. I could go on with further complaint as to how these hearings were conducted, but in short, there was little consideration toward the preservation of the community, and instead, that development would be approved, regardless of the consequences. There were petty issues presented, such as the small signage announcing the intention toward rezoning, the fact that there was a general release of liability presented to SOME, but not all, of the homeowners in the area of being in proximity of and industrial area, and that development of the unused land is inevitable. The key point here is that the land in question HAS ALREADY BEEN DEVELOPED. It exists as a golf course, and it has been such for 18 years. It is not reasonable to have expected the homeowners in the area to anticipate the demolition of that operation in favor of an industrial cross dock for FedEx. This letter was written by the VP of the Palm Valley North HOA. I wish I could convey my disappointment in the recent vote as nicely as he did. His letter hits home for me and I would like to add a few things. Both my wife and I work on Luke AFB as civil service employees, I am retired Air Force. We purchased our house in Palm Valley North due to the close proximity to work. Had we known that Falcon Golf Course would be turned into this cross dock facility, we would have purchased elsewhere. I have already started talks with a realtor to get out of the neighborhood before this takes affect. After today’s meeting I have no faith in the elected officials to do what is right for the families in PVN or any other nearby neighborhoods. Now it’s up to you to put this too a stop. I may not live in PVN much longer but stop this for the ones who stay.

“I read in an article that you were part of the commission reviewing the plans for the Love’s truck stop on Camelback303. If you are not the person, please forward the name (or names) of the people involved in this decision.

I would like to voice my concern over this development. My concern comes from the safety issues it will pose for the youth in our area. I live in Dreaming Summit and have a youthful driver (will be getting his license in June) that attends Canyon View. He is on sports and will need to drive to school using Camelback, driving past this truck depot everyday.

We didn’t choose to be zoned for Canyon View which is approximately 10 miles from our house. In fact, none of would have chosen a school this far having our kids drive such a distance. The only way (or fastest way) is to use Camelback.

That stretch of road has had many accidents and now more traffic? Especially trucks for our kids to contend with. There was an accident 3 years ago on that same road that took the life of a child that was a close friend of my son’s. Do you want to approve this and have more children be put in danger on that road?

I am not coming at this from a property value perspective - although that is certainly a concern for many. I am asking -pleading with you to consider the increased traffic and danger that is imposed on our children. We have no choice but to drive that road to get to the high school but you have a choice to deny that truck depot.

Again, I am pleading with you to consider the danger you are imposing on our youth.“

I take my husband to Chemo treatments frequently from Palm Valley Phase 5 directly across from Falcon Golf Course to the 101. Every single day this stretch of road is very busy with traffic. I cannot even imagine 40% of the proposed truck traffic from the crossdock heading east . They say 60% will go west to the 303 but the other 40 % will go???? Camelback is busy now and the developer says it will be widened to accommodate the increased traffic. Who is paying for that? The developer or the taxpayers of AZ? Also if that road improvement is done, it will not happen quickly, it will take a very long time inconveniencing all that travel that road for a very long time to yet again accommodate something we do no want to start with. The developer keeps touting all the jobs that will be coming to the area. How does anyone really know if the statements are true? There is so much open land down near Yuma and the airport why do so many lives have to be affected and property values go down to cater to this developer? This is a political game I am sure, and I am really sad that so many good hard working people are just pawns in some one else’s game. I truly hope you will stand up for us in whatever way you can and prevent this Crossdock facility from being a blight and nightmare to Camelback.

I attended the Maricopa County Planning and Zoning Commission meetings held on May 14th and continued on May 28th to share my opposition for the zoning change for the KW cross doc facility. I communicated my opposition in email and shared additional concerns at the session on May 28th. The meeting was facilitated well and all community input was shared. All 3 cities (Goodyear, Litchfield Park, and Glendale) effected by the request communicated opposition for the facility as well as Luke Air Force Base rescinding their earlier support due to impacts to traffic that would impede emergency personnel from necessary access to Luke when needed. Each city, multiple HOAs, and community residence all oppose this. The only favorable attendee was the applicant. While the zoning is for light industrial usage, a cross doc facility is HEAVY truck traffic and exceeds this use. The planned use is for a 24 x 7 operation and whether there are 3000 truck trips per day or 6000 truck trips per day, the traffic situation will be extremely overcrowded, dangerous, noisy, add to air pollution from diesel engines and cause adjacent roads to become more heavily used trying to bypass some of the heavy truck traffic. These adjacent roads have ball parks, schools, walking, jogging and bike paths which will all be at risk with increased traffic.

Much to my dismay, 5 of 7 commissioners voted to proceed with a positive recommendation, dismissing input including multiple requests to provide a continuance for the communities to more effectively evaluate the impact of phase I of this proposed facility. The community requested a more in-depth traffic impact on Camelback Road. The applicant provided the minimum required study of 300 ft within the entrance to the facility. Yet, the impacted area will be the entire 3 mile stretch on Camelback Road from route 303 to Dysart Road, including the communities and arteries along Camelback.

The applicant provided 3 sets of changed numbers for anticipated numbers of truck trips and employee car traffic over several weeks as opposition became stronger. This created a lot confusion for all, including the commissioners, yet this didn’t stop the commissioners from voting in favor of the facility.

A facility of that size and commanding that much semi-truck traffic does not belong that close to residential areas. The property is within 500 feet of a residential area. This is a quality of life issue as well as a traffic issue. Travel on Camelback between Litchfield Road and the 303 is already very heavy and exceeds what the road can handle. Additionally the noise and pollution generated by this facilities' vehicles is inappropriate so close to a residential area. I urge you to listen to the outcry of those who travel Camelback daily and live near this location. We are, after all constituents of Maricopa County and request you to not approve the zoning change requested, please stop this land use.

As a Litchfield Park resident for over 30 years, I have seen our little town grow to what it is today. Not all growth is bad for a community. But some is. Cross Dock is really bad news for both Litchfield Park and Goodyear because of its impact on residential communities. It will bring large trucks onto Camelback Road, traffic that this road cannot handle. It will not only cause damage to an already busy road, but it will bring also bring with it noise and pollution to Litchfield Park and Goodyear. Our quality of life will be greatly impacted.

As you know, our family has farmed on the west side north of Luke Air Force Base for over sixty years. There are thousands of acres around the 303 that would not impact residential communities. I have seen it. Wouldn’t those be a much better match for a project of this magnitude?

Litchfield Park has been such a wonderful place for us to raise our children and we would like to see the next generation have the same opportunity that we had. If Cross Dock is built here, it will greatly impact our community. Your community!

I am writing to you today to express my deepest concerns about this project. There are so many reasons that this is not good for the location identified. It is way too close to a nice quiet residential/family friendly community. The amount of traffic proposed will make the area unsafe for families. It is not uncommon to see families with young children bike riding on 152nd Ave and Camelback and if this project goes through- that activity will end due to safety concerns with so much traffic. Camelback is a small two lane road at the area in question and this project is just too close to residential areas. Something like this would be better suited closer to the industrial buildings by Rte 303 and not near homes and families.

I have lived in Palm Valley Phase 5 for 11+ years. I understand the need for economic improvement but that must be done with more consideration for the families and locations of projects like this.

I understand that this decision is now with you and the members of the board of Supervisors and I wanted you aware that this decision is not supported by the people who live in the area affected. I ask that you vote to stop this project from being done at this location.

I am writing to OPPOSE the Cross Dock Facility proposal to be built on the current site of Falcon Golf Course on Camelback Rd. I am a resident of Palm Valley Phase 5 and I feel it is very irresponsible of the county to place a facility that will create thousands of truck trips per day across from an entrance to a large residential area. Yes, the houses themselves might be more than 300 feet from the facility, but the residents come and go from the entrance to the neighborhood multiple times per day. We already have difficulty turning out of our neighborhood because of the amount of traffic on Camelback and the way the road switches from two to four to two lanes throughout the stretch between the 303 and Litchfield.

In addition, the hours of operation of the facility are not condusive to creating a habitable enviroment for the residents, which should have been considered (but was ignored) when looking at the zoning change. Our government officials, especially you, our elected ones, are supposed to keep the residents' well being in mind. In what I've read of plans for the facility, I have not seen restrictions on hours of operation. Even the F-35s at Luke have hours they cannot fly. Truck traffic, backup warning beepers, horns, brakes- the noise impact of a facility like this is another major factor that is not being addressed as far as impact on residents. The sound of a back-up beeper is around 100 decibals and can travel 1.2 miles. That will impact ALL of Phase 5 residents, whether we live within 300 feet or not. Then there are also air quality concerns, water run-off to Bullard Wash (an area that is constantly flooded already), and light pollution to consider. None of those concerns raised by residents have been addressed in full by the developer.

I personally have also already filed many complaints in the past few years with the City of Goodyear about the amount and speed of traffic on 152nd from cars cutting through our neighborhood to avoid the traffic on Camelback. Can you image how many more people will do that when they are facing a back-up of semis waiting to get on to the 303? There are no planned improvements at Camelback and Sarival. The traffic already backs up all the way to Falcon Golf Course during rush hours, without all of that additional truck traffic. I was told by Goodyear PD that there are only two traffic patrol units for Goodyear north of I-10, so even now they can't have an officer set up traffic stops on 152nd. No concessions have been addressed about stoping traffic from cutting through our neighborhood- not even a "no thru trucks" sign or additional stop signs or speed bumps along 152nd. We have school zones and children crossing, as well as a very active resident population that uses our streets and sidewalks for recreation. A serious, probably fatal, accident in our neighborhood streets is just a matter of time with the increased traffic this project will create.

Camelback Rd is also the only route that families and student drivers going to Canyon View High School can take from the Dreaming Summit community (east of the proposed project). Mingling new/student drivers with all of those semi trucks is again a recipe for distater. They are zoned for that school and have no other option of a route to take because of Luke Air Force Base being between their neighborhood and the school. In addition, many Litchfield School District and Agua Fria School District busses use Camelback to transport children to school- has anyone asked them about the impact of this increased traffic to their bus routes? Will they be able to get students to school on time when they are stuck in truck traffic? And what happens when that first serious accident occurs? Camelback is literally the only access residents of Palm Valley North have to their neighborhood. Will they not be able to reach their homes when stretches of Camelback have to be closed due to traffic accidents?

Finally, I think the fact that the seller (Mike Cowley) was a member of the Planning and Zoning commission when the change to industrial zoning began is a HUGE conflict of interest. He should have been recusing himself from the very beginning not waiting until his term ended in March. Now he's claiming he didn't receive any special treatment for this project. This project began WAY BEFORE his term ended. Most of the Planning and Zoning Committee made it painfully obvious as they "listened" to letter after letter and statement after statement from affected residents that they had made up their minds to approve this facility without hearing our concerns. They were sleeping on camera, painting their nails and pausing their audio/video while residents spoke, yet every one of them came back on camera and gave the developer's council their full attention when he spoke. It made all of them look like they are in these public position for personal gain, hoping that unsuspecting residents don't notice until the commission's own personal projects have made it through the required processes. Really this has all been an unfair and biased process, just because of a "suggested" notification boundary of 300 feet of the property. If the developer really wanted to do their due diligence, they would have been working with residents that live in Palm Valley Phase 5, Villages of Litchfield Park and Palm Valley North. They simply chose not to be cause they knew they would be met with resistence. I strongly believe that the developer knew that because this is a grey area as far as jurisdiction goes between Maricopa County, Goodyear and Litchfield Park, they could get away with this project. Your job, as our represtentatives, is to make sure that thousands of residents' interests are not being ignored for the sake of one developer who himself was on the Planning and Zoning Committee.

I understand that the land along Camelback will eventually be developed and become industrial. We were aware of the PV 303 corridor when we purchased our home. We were not aware that existing buffering green space would be allowed to be turned into a truck parking lot and create such havoc along Camelback Rd. The City of Goodyear has taken proactive actions on the plans for usage for PV 303 to protect the residents and minimize the impact on residential neighborhoods being located near industrial areas. There will be miles of additional roads created to divert PV 303 traffic away from the neighborhood. Lighter usage industrial/office space will be placed closest to the homes to minimize impact. This is NOT the case with this Cross Dock facility- placing a one entrance/exit, high traffic situation directly across from a major neighborhood entrance is not minimizing impact to residents.

I am not opposed to all industrial development- but this specific project brings way too much semi traffic way too close to a residential area. Putting warehouse or manufacturing facility on these parcels of land would have way less impact on residents and community members than what basically amounts to a truck parking lot. This developer has other options of where to place their Cross Dock and this land owner has other options of who to sell the land to.

Thousands of residents have signed petitions against this project. The surrounding cities (Goodyear and Litchfield Park) and Luke Air Force Base have all gone on record as opposing this project. Hundreds of concerned citizens have registered opposition, written letters and spoken at the Planning and Zoning Committee Meetings. Why is one developer's plan being put before all of those other concerns?

Please stop this Cross Dock from proceeding any further.

This is more like, look at me now. Any of the residents would invite anyone that would take up the offer to sit in the back yard in the early evening/and after 10pm to just listen to the quietness of this area. Even with Camelback being a main east/west access to 303/ East into the city. All roads from this location going South is a "SAFETY ISSUE". School age children walking, biking, skate boarding using the crosswalks to school 2 times a day 5 days a week. 152nd Ave. is the quickest way to Indian school Rd. from the cross dock. If even 20% of the 1200/1600 trucks are light duty "used for local deliveries", that's an average of roughly 500 in and out trips per day...PER DAY...ALL DAY...24/7. and that is for non event days. There is all the yearly holidays. The avg. trucks per day for any year going forward will greatly increase. No business goes into business thinking its not going to grow. I watched the Planning Commission meeting today(05-14-20) online and planned on verbally voicing my concerns. This meeting was cut short due to a quorum issue. I’m hoping this email can be added to the minutes since I won’t be able to attend the next online meeting on May 28th.

I wanted to voice my strong opposition to the cross-dock facility that is planned at The Falcon Golf Club. After 22 years in law enforcement, I retired and moved to Goodyear from southern California. My wife and I adopted 3 special needs children, one who has severe asthma. We live on Pierson St, which is the first east/west street south of Camelback. Our backyard faces the empty field south of Camelback, we can literally see the Falcon Golf Club from our backyard. We chose this house because of the location and school district special education programs. This or any cross-dock facility does not belong in a residential or semi-residential area. The sound from diesel engines, Jake brakes, back up alarms, air brakes and idling do not blend well with residential neighborhoods. I’m afraid of how the added noise and pollution will affect my children, especially my 6-year old that already has asthma! As of right now, I can hear the generator running at the cell tower at night. The noise will only get worse with a 24/7trucking operation 600 feet from my house. The design calls for extremely tall lights (120 feet tall) to be constructed on the property. I fear that these lights will be a nuisance and be visible from inside or outside of our home. We already have issues with the Arizona Motorsports Park and noise issues. They are clearly not following the sound ordinance guidelines. There are no repercussions and I fear the same for the cross-dock facility. The traffic will also be a major burden for everyone in the area. Traffic is bad enough now, it will only be worse if this facility is approved. Has anyone thought of how bad traffic gets when Luke Days are held? Or all the extra traffic during spring training. Imagine how bad it will be if this project is approved. I know the developer plans to use the defense that this is the only type of facility that can be built here. That’s wrong! They can build any commercial building that won’t produce a major influx of big rig trucks, noise, and pollution. I’m also aware that the vacant land south of Camelback is designated as light industrial/office space and large warehouses. But the larger warehouses are further west and closer to the 303 freeway, where they should be. This project needs to be moved west, closer to the 303 freeway. As a longtime Litchfield Park resident, I'm worried about the cross dock proposed for Camelback road. I commute into Phoenix every day, and the traffic on Camelback to the 101 is already bad. I don't want to compete with big trucks on my way in or out. Are they really only going to go West? The most direct route to the 101 and I-10 East is right through my neighborhood. I'm not sure if you can ensure that they only go West to the 303, although if that was a forever deal it would be better than nothing.

My neighbors back to Camelback between Litchfield and Dysart. I can hear the traffic and I sure wouldn't buy those houses--let alone if trucks are added to the already busy mix. Their houses are for sale at a discount and sitting on the market as it is.

I know that we've had a lot of development and the West Valley is changing. But, trading a golf course for a trucking facility isn't what I would choose for quality of life or property values. If we're going to get more business out here, let's get some white collar high tech going. Not more service type low paying industrial types.

Do you want this to “have been a good place to live” or “be a good place to live”? Do you want these cities to be crime ridden or safe places to live? Are we living in bedroom communities or industrial areas with some left-over houses?

Look at the zoning in successful, highly coveted areas to live; such as, Greenwich . There has not been any new industrial or commercial development in decades.

Their residential zoning is rigorous preventing high density housing, protecting pre-existing homeowners over ANYTHING new. Look at their tax base and housing prices – it has paid off. It has paid off so well that you all know the name of the city/town immediately and favorably – it is known worldwide. They have a very low crime rate and a very high quality of life in Greenwich Connecticut.

I urge our communities and planning commission to do your research and decide “who you want to be when you grow up”. Read Malcolm Gladwell’s book, “The Tipping Point”. Falcon Golf Course turning industrial is a tipping point. Do you want to be responsible for ruining this area for being a coveted neighborhood and desirable place to call home? Will you be happy that was your claim to fame and reputation?

What happens when this industrial site goes bankrupt? What happens when their tenant goes bankrupt or their lease expires? Then what are we stuck with? What crime will this vacant facility attract? We are at the beginning of an economic downturn, why would this be a safe use of this land? This is a frog in a pot of water with the heat being turned up gradually. I urge you to NOT put the frog nor the pot in our neighborhood.

This is the tipping point bringing to light a much larger issue. Are you protecting Litchfield Park’s and Goodyear’s PRE-EXISTING residents and PRE-EXISTING businesses? The applicant can go anywhere else, we cannot, we are invested here already, and it is OUR COVETED HOME.

It occurred to me, perhaps Litchfield Park needs to look at prior successes such as Greenwich, Connecticut. No need to guess what serves a community best when we have such a successful example!

I am writing to express my opposition to the proposed cross-dock facility located at the former Falcon Golf Course location on Camelback Road, Goodyear, AZ.

I have lived in The Greens in Litchfield Park for 18 years, having retired here from California for a slower paced life. I enjoyed the rural feel of the area, with it's cotton fields, rose fields and other agriculture. I've watched all that slowly disappear, making way for more and more housing, retail and commercial development, as the Valley continues to experience growth. The traffic noise has increased, I am now awakened at 4:30 am by the sound of commuter traffic on both Camelback Road and Litchfield Road. Crime has risen, and traffic accidents have also increased. I have a substantial investment in my home, as do many others in the area that will be adversely affected by this new development.

The proposed development is unique from other planned business developments. If this plan is approved, the residents of Palm Valley North and other neighboring communities, myself included, will hear the resulting noise 24 hours a day, 7 days a week, 365 days a year. This noise includes 120db backup alarm beepers every one of the 1100+ trucks are required to have, which will be incessant as trucks backing up will be the sole purpose of these trucks at this facility. Additionally, the Yard Bullys are also required by law to have these beepers for safety. The residents in the surrounding neighborhoods will not have a moments' peace. The 120 foot light standards that will illuminate the facility 24 hours a day will undoubtedly create an additional negative atmosphere. The noise generated by the thousands of additional vehicles, both trucks and cars, traveling down Camelback Road will create noise pollution, further driving down the value of the residential areas in the vicinity, and negatively impacting quality of life.

The life savings investments of the residents of this area will be adversely impacted by this development, a consideration which has been ignored thus far by the capricious intents of unscrupulous investors and the reckless nature of the preliminary committees whose only consideration has been for Mr. Mike Crowley and not of the residents affected. There are far better suited areas to build this cross-dock to the West, closer to the Loop 303. Camelback Road at the proposed site is not able to handle the increase of 6,000 vehicles a day, and expansion to accommodate that amount of traffic, given the current footprint of the area, is not possible.

The previous hearings were conducted with little consideration towards the preservation of our communities, and instead with the mindset that this development would be approved regardless of the consequences. The people who purchased homes in these communities had a reasonable expectation that their communities would be developed in the future with thoughtfulness, and industrial complexes built within residential communities is NOT thoughtful planning. You are hearing the public and personal outcry against this development. What will be used for profit for one entity, will be cause for loss for so many.

The Planning and Zoning Commission is an appointed Board, but our County Board of Supervisors are elected, and as such, we expect them to vote on our behalf on these matters. Hopefully you will keep that in mind when you cast your vote.

Dear Supervisor Hickman, I was listening intently Thursday, June 28th through the webinar from 9:30am until 2:09pm when the Planning and Zoning Commission voted to recommend approval of the Cross Dock Facility where Falcon Golf Course currently is. I caught most of the webinar on the 14th that ended when the quorum was lost. I live at 15236 W. Pierson Street and my home is directly south of the golf course. I am not a golfer so I don’t care if the golf course is there or not but I am not, at all, in favor of a facility that, when built out, would cause another estimated 6,000 vehicles a day to traverse Camelback. In the first webinar, I learned that Luke had concerns about the traffic after initially saying the facility would not disrupt their operations and that Litchfield Park and Goodyear both opposed this use for the property and that many individuals had sent letters or emails opposing it. I couldn’t understand how the staff could recommend approval in light of the opposition and I feel this is where the allegations of impropriety arose. Sometimes the appearance of impropriety can be just as damning as an actual impropriety itself. And when the applicant did the bare minimum posting requirement and notification of anyone within 300 feet (oh wait, there is no one within 300 feet), it appears that the applicant is trying to slip one by without anyone finding out and with his prior affiliation with P&Z, there is the appearance of impropriety. I just knew that after hearing all of the opposition arguments, the commission would not vote to recommend approval. Some of the opposition arguments were very compelling regarding noise and air pollution, traffic and safety and the engineer for Litchfield Park had a very compelling argument about forcing 6,000 vehicles a day through a property with that narrow of frontage on Camelback. The attorney for the applicant was allowed to rebut the objections and when he stated that they had a good meeting with Litchfield Park a couple of days prior, that seemed to satisfy the commissioners. If it was such a good meeting, why did the Mayor, City Engineer and Attorney for Litchfield Park still need to speak in opposition? The applicants attorney did a good job of presenting the facility in a good light twisting numbers in the traffic study to minimize the impact and basically saying “we are not the bad guy here, when PV303 (EAST III) is developed it will be much larger with a 1.2 million square foot warehouse and we are just 200,000 square feet”. I still don’t know where he got the slide he put up showing the 1.2 million square foot warehouse fronting on Pebble Creek since none of the current plans for PV303 (EAST III) available online show this as the plan for that area. But hey, it’s alright if that slide wasn’t current. Who knows when or if PV303 (EAST III) will be developed or if it will be developed as his slide 21 portrayed but the development of Falcon Golf Course is staring us in the face right now. The attorney kept harping on “this is practically the only thing this property can be used for” and yet, I believe it was one of the staff members who responded that there were almost 4 pages of permissible uses listed in the statutes when they were asked about permissible uses. When commissioner Montoya asked about the noise, the attorney started talking about electric forklifts and bay doors staying closed when no truck was at them and never addressed the noise from the vehicles running up and down Camelback. This is the same attorney, who in the May 14th session, said he didn’t know where the 6,000 vehicle number came from and it was from his own client’s traffic study. The applicant’s attorney said that if they met the requirements, P&Z must approve the application. Litchfield Parks attorney interpreted the statute to say that if the requirements were met, P&Z could approve the application but if there were other overriding considerations they could deny it. I suppose it was the staff attorney that piped in and said that neither one of them was totally correct. So there is still that question that remains to be resolved. When it came down to the voting, Commissioner Montoya stated that “just because we can do something, it doesn’t mean that we should do it” before her nay vote. Then Chairman Scholsser gave his speech that his former dentist was opposed as was the preacher that did his father’s funeral and a number of his personal acquaintances but that he was voting for approval and then he took an unwarranted and totally unprofessional cheap shot at the City of Goodyear saying basically that they would not have opposed if they were getting the tax revenue from this project. And maybe it does come down to just financial considerations. I don’t know if there were any improprieties or not but it certainly appears like it with the staff recommending approval in spite of all the opposition and then seven of the commissioners rubber stamping their approval even though they “understood” the concerns of the residents. Supervisor Hickman, I don’t know what your charge or mission or job is serving on the Board of Supervisors but I pray it is to consider the health and welfare of the residents of Maricopa County and not to make it easy for a developer to the detriment of the residents. If you lived in this area would you be in favor of a project that would bring an additional 6,000 vehicles a day down Camelback when there are other permissible uses for this property? I am a resident of Litchfield Park in the Village since 2014. I moved to this area since it is a nice peaceful community in the West Valley. I own my home and I had planned on staying here for a long time.

However, with the cross-dock facility proposal, I am now having to rethink and possibly make a decision on my investment. I am still in the workforce but I am close to retirement and I bought here with the hopes of not having to relocate. This move here was a very emotional one as I made it after my husband passed. I hope that you will reconsider your decision on the cross-deck facility in the proposed location off Camelback Road at the Falcon Golf Course area. A facility like this needs to be in an area far from any type of residential area. The biggest investment one makes in life is a home. People invest in homes to have a certain quality of life. Having a facility such as this is not conducive to the quality of life that one is seeking. This facility will create noise, traffic, accidents, etc. My first question to any of you on the Board, would you like to have this facility in your backyard? Would you want the value of your home to decrease substantially due to a poor zoning decision? Do you want to hear trucks day and night? Would you like your children or grandchildren to cross the street with the traffic that this facility will create? I know what the answer is - “NO.” I grew up in the Valley (63 years) and I have seen a lot of growth. I am not opposed to growth but I am opposed to poor decision-making when it comes to zoning. I am also opposed to decision makers who do not take into consideration the investment people have made to live in a nice community to raise their families, to live out their retirement or begin a new life. This proposed location is not a location to have this cross-dock facility. I hope you will not approve this type of business at that location. The best rule of making this decision is by asking yourself, “Would I want that in my neighborhood?” There are plenty of areas that this facility could be built especially right off the freeway and not close to a residential area. I am writing as a concerned citizen and resident of the Palm Valley Phase V subdivision. We moved here from Mississippi about 18 months ago and bought here in Goodyear due to all that this area has to offer. We liked the PV area because of the HOA and that it stated it was surrounded by agricultural areas and we didn’t see where any other types of developments were being done in the area. With Luke AFB to the north, we “figured” (wrongly now I guess) that nothing would or could be going in over there.

As you can see below, I run a rather large operation over in Glendale. I’ve worked for NPC for over 14 years. So, I’ve been coming out here for some time. I have always noticed how Phoenix is very different from most other cities I have operations. Zoning seems to be slightly out of control here. Traveling up and down Glendale avenue you can pass a restaurant, then a mall, then a goat farm, next to a gas station, next to an agricultural field, then a neighborhood, then a power plant and it goes on….in no other city I have traveled is zoning so out of control. I understand things getting grandfathered in, sure, but once they are gone, it should be turned into what the area is best suited for. What works for the citizens and make the most sense for the area. We are even facing having to relocate our operations due to zooming and building heights.

I have been following this project ever since it was announced earlier this year. I have attended the last two online meetings where the Commissioners heard from the developer’s attorney on their application for getting approval to move forward. I also understand that there is a process and that the City of Glendale approved this area for Industrial back in 2000. And that Goodyear had passed the order stating that Camelback would be a Truck route. Luke AFB has been on and off with their decision and now seems to not favor this development. But the process has been steamrolled by Crowley and the developers. All stating these old facts that this is what the property was intended for. Whether we use Morris’s analogy of the movie theater and Disneyland or not (which I think is comical at best) Again, the information he was showing about the PV3030 was misleading and out of date. That is all zoned commercial now as was presented by other concerned citizens. But, I also understand that the 4-2 vote to approve put them in a rather precarious position, one where they didn’t really have much choice in. Based on all of the old information, they actually didn’t have much choice – I get that. But, the city officials now need to step in and do what’s right for the citizens.

If, in fact, the operator will be FedEx, know this. I’ve worked in Memphis my whole career. I know FedEx very well. The information Mr. Morris presented was nothing less than totally misleading. There is NO WAY to control the fleet of semi’s coming and going from this facility. They definitely use Owner/Operators for over the road freight movement. They are NOT company drivers. They will NOT follow company directions on ingress or egress from the facility. Then comes all of these trucks coming and going from a 1.300 foot frontage on to Camelback. It’s just insane to think how this is going to make the travel up and down Camelback be nothing anyone will want to confront. Not to mention, the brand new junior league baseball diamond that was just built – hasn’t even had one game played on it yet! How are people going to get in and out of there? And, more importantly, what happens on Phase II or what happens when FedEx has outgrown the facility. And here’s something else no one mentioned yesterday – when will a Flying J be built at the 303 exit? Because when you bring all of those trucks through there, guess what follows? All the other supporting industries – fuel, tires, trailer/truck repair and guess what else, drugs, prostitutes and other low life activities. Do we want all of that in Goodyear?

The problems associated to this proposed facility far outweigh the benefits. Back to the zoning, put this operation on the other side of the 303, where it belongs, with ALL the other warehouses and industrial parks. Not in a neighborhood. We need another golf course there or some other commercial operation – not a major trucking operation.

We currently have over 2,000 signatures that are opposing this installation. We have a Go Fund Me account, a webpage and a large community on Facebook. I am saying all of this to let you know there are a lot of people out here in PV, LP and others that will be greatly disappointed in the recent process. We need our City officials to get involved and get this project overturned at the Board of Supervisor’s meeting. This simply cannot go forward.

There is no plan to limit traffic for Palm Valley Phase V residents to access 152nd Avenue when the overwhelming traffic begins created by the cross dock. There are no plans to limit cut-thru traffic on 152nd Avenue from other streets to get on Camelback Rd. The proposed stoplight at Camelback and 152nd Avenue will only compound the problem. How many accidents and related deaths caused by this and other proposed industrial traffic on Camelback and 152nd Avenue intersection will be acceptable? I ask that until Camelback Rd. is improved that this cross dock and other projects be denied. It is the responsible thing to do as someone who values the livelihood of the residents that will be devastated by approving this project. How can anyone approve this with knowledge of the tragedy of their approval? It is totally irresponsible to approve the cross dock and not require Camelback be completely improved to handle the problem that their approval will create. To say that over time the road will be partially improved and the residents will just have to deal with it until it’s fixed sometime in the years ahead is not an acceptable solution for your approval vote. How can one conscientiously say that this is for the good of the residents? I have lived here and have raised my family for over 13 years and it was a great place to raise a family, until now. I commute on Camelback to Luke Elementary to get to work 5 days a week. Through the years traffic has become more difficult and congested. So, my question is why would anyone think, it is okay, to put a major FedEx truck facility in the golf course area on Camelback. This is beyond me. When I found out about this in April, I became a member of Say No to Cross Dock on FB. Kerrie Zakaras wrote an e-mail representing all of us on case number MCP20190005. I agree with every statement that she represented. I hope that you take the time to read it. It explains a lot of what happened from April to June. Since most of the homeowners were kept in the dark, about this development.

Needless to say, the Zoning Commission and Mr. Crowley have done everything but to undermine the citizens of this community. Not only did the 7 who voted against our recommendation had their minds made up before the meeting, but the citizens that spoke had little time to defend themselves. The attorney representing FedEx during the quorum had at least 1 1/2 hours to talk and state his case. The citizens of Goodyear had 2 minutes, with "you have 30 seconds interruptions" It was ridiculous and demeaning. We are taxpayers and deserve more respect. I am really ashamed for my City/Commission and I have never felt that way before. If you vote yes, shame on you!!!!!!!

Mark my word! There is going to be a major accident and it will probably end up costing the State of Arizona law suits in the long run. We are asking that you vote No for the Cross Dock. It is dangerous to have that many trucks close to Palm valley phase 5. We have parks and schools, family and communities close by. Please listen to your community. Please vote NO!

We have UPS on one end and now FedEx on the other, great for our home values. I work at Perryville Prison and it used to take me 8 minutes to get to work. Now with UPS it takes me 15-20 minutes and probably going to be about 30 minutes once FedEx is up and running.

Time to start looking for a realtor and moving on before I lose the value.

Mr. Hickman, we emailed you in early April about our concerns with the Cross-Doc facility being proposed at the Falcon Golf Course on Camelback Road, assigned the above case number. We live in Palm Valley Phase V subdivision, and our back yard is directly across from the planned site. In our original email, we explained of our concerns with the traffic that this type of facility would create on Camelback Road and how this will tremendously hinder, not only our neighborhood, but also those to the east and southwest of this site. Camelback Road is already over crowed, and with the addition of 3000 vehicles a day in the first stage and another 3000 a day in the second stage, it will only send more traffic into our subdivision down 152nd Avenue. If you take the time to look, you would discover that this road is a crossing point for many elementary students to get to school. Many people already use it to get away from the line of cars that are backed up from Sarival Ave. Also, the noise and lights from a 24-hour operation of this type will affect the well-being and quality of life of many people in the area.

Mr. Hickman, you suggested we participate with the Planning and Zoning Commission, which was scheduled on April 23rd; which we did. But we were very disappointed with this scheduled commission. On this day, we first heard 3 other cases that went fairly fast because none of them had any oppositions to them; and we state that fact because of a point we will make later on. We then heard opposition letters from the towns of Goodyear and Litchfield Park, and also from Luke AFB; approximately 75 opposition emails were also read from the many community members that opposed this facility. About three hours into the meeting, and 20 minutes of the applicant’s lawyer's presentation, one of the committee members had to leave for another scheduled meeting (another one left earlier), which left it without a quorum. Now, why would you schedule a meeting when you already have one scheduled until 2:30 pm? This demonstrated poor leadership and poor time management. The meeting was adjourned and rescheduled for May 28th, while the chair stated he would allow the applicant's lawyer to continue from where he left off; another point I will make later.

At the May 28th meeting, the applicant's lawyer was allowed to restart his presentation; and that is correct! Restart from the beginning, slides and all; and not only did he get his full 30 minutes again, but he actually went approximately 45 minutes, because now he had changed some of the slides to refute all of the opposition emails that he had heard at the last meeting. While he presented his case, the members of the commission were very attentive, listening to his case. But that changed once he was done. When the opposition stated their concerns, the members seemed as if they were bored and actually muted their face screens leaving those watching wondering if they were even listening anymore. And we only state this because after the cities and base oppositions, several hundred opposition emails, 43 community members speak in opposition, and over 2000 community members in opposition on the petitions, the commission members seemed to already have made their minds up to recommend acceptance of this application to the county. Remember when we stated the other cases had no opposition; this case has over 2000 community members opposing it; so, shouldn’t the commission take into account the members that live in this community concerns? Isn't the county supposed to be here for its citizens? Maybe, this has something to do with the fact that the owner of this property was the vice chair of the Maricopa Planning and Zoning Commission until March of this year. That is just the way it appears to many of us that were on-line during this meeting. If you would like, you can have your ombudsman send us a copy of the laws again, but that does not change what this looks like.

We understand that this property is a military compatible property, but there are many other options that can go here instead of a facility that will create such an increase in traffic along with light and air pollution. One option that we heard was a city or county park where people can go and enjoy the beauty of the land, while watching the aircraft do their touch and goes while practicing. We are not opposed to the commercial build that can go in this location; we are opposed to an operation that will totally destroy the beauty of this property, and induce this amount of traffic, while running a 24-hour operation that will produce this amount of noise and light disturbance. Luke AFB doesn’t even produce noise 24 hours; but as a military retiree, we are glad to hear the sounds of our military pilots getting in their practice flights to maintain our freedom; freedom that allows us to voice our concerns to elected members like you.

We are asking that you, our elected board of supervisors, VOTE NO for this FedEx cross dock operation, and allow us, the residents of the area to speak at the next meeting regarding this case. We spent several hours in attendance of the two Planning and Zoning Commission meetings to show our concern and disappointment with this facility being planned at this location. Please take the time to listen to our concerns. Another point, we just learned today; to the west of the mentioned property, the city of Glendale is considering a request to concurrently annex and zone the property industrial. The conceptual site plan proposes two industrial / cross-dock warehouse distribution buildings that are 731,305 and 432,350 square feet. Nearly 400 parking spaces are being proposed for trailers, and close to 700 spaces for cars. Where will all of the vehicles go? How will the community members get around this area? You all have long histories in Arizona, but Mr. Hickman, you are from the west valley, and you know and understand the culture here. Many of us did not grow up here in the west valley; but we all came here for the openness and outdoor nature that Arizona brings. The land at this site preserves that nature. Let us allow you to read something; "I have always been a growth enthusiast, but growth in the right way. With growth comes social, environmental and sustainability needs. I am aware of these needs and will work to help Maricopa County grow smarter for our current population and future generations." That is from your bio Mr. Hickman. I am new to the West Valley having only lived here for a couple of years. I was very impressed by the neighborhood feel and safety, impressed enough to buy a home and set up roots. This cross dock facility therefore is causing me great distress. There is already a lot of fast moving traffic on Camelback and car accidents are not uncommon. Adding 6000 more vehicles to a road that is already stretched to the max is going to make that dangerous situation even worse. Goodyear and Litchfield Park are beautiful cities to live in but the addition of large scale manufacturing and the trucks inherent to that business is going to make our property values plummet. I would not be interested in buying a home next to an industrial park and I don't know anyone who would be. Trucks are noisy, dirty, and hard on the roads. Do we really want to contribute to making our beautiful neighborhoods look like central Phoenix? Looking like central Phoenix is one thing but crime follows the filth and our safe, family oriented neighborhood is in danger of being destroyed.

Chairman Hickman, I’m writing this letter in response to your pending hearing regarding the proposal for the KW Cross Dock Facility on the current Falcon Golf Club site, 15152 W Camelback Road, Litchfield Park, AZ. 85340. I am a homeowner/resident living nearby in Litchfield Park. Because this proposed site sits on unincorporated land, this proposal will be decided by the Maricopa County Board of Supervisors. The Cities of Litchfield Park and Goodyear have already submitted formal and strong opposition to this proposal. This site is adjacent to some sizeable residential developments on both sides of Camelback Road and is also near the newly completed Jackie Robinson Little League Baseball fields. The residential developments bring a substantial number of resident vehicles on Camelback Road daily and there is also a good number of youths who, in better times, will be using the ballpark. I worry for their safety if they have to cross Camelback Road in its current configuration, as there are only two stoplights or crosswalks nearby. Although Camelback Road has a 40 MPH speed limit, I’m sure you could find that a large number of vehicles travelling on Camelback are going 50 MPH or more. This road is unsafe for those driving and those crossing. Camelback Road is a single lane road from the proposed site to SR 303. The Traffic Impact Study prepared by the United CMI Group for this proposed site indicates nearly 4,000 additional vehicle trips per day will be added to Camelback Road when construction is completed. I would assume that a majority, if not all of these vehicles, will be tractor/trailer combinations. If you averaged that over a ten-hour workday, that would add 400 vehicles per hour. However, with facilities of this type, the majority of traffic would be added during the earlier and later part of the workday. If your heading west on Camelback Road, the road is single lane and would require significant improvements to handle additional traffic. One cannot assume that all traffic from this facility will head west to SR 303, nor can this be legally controlled to my knowledge. Additional traffic heading east on Camelback Road and possibly north or south on Litchfield Road, could/would have additional negative impact on the current traffic flow to the whole area. I ask that you personally visit this site and the adjacent areas so you can see that the KW Cross Dock facility would definitely not be a good addition to this area. I am strongly opposed to the proposed Cross Dock facility in Goodyear. I have been a resident for nearly 10years and have pulled for you in past elections. There are numerous concerns regarding the land owner and his conflicts of interest participating on the zoning board.

Aside from that, my main concerns involve safety noting the 6,000 trucks that would be added on a daily basis to Camelback which is two lanes. We have already witnessed a fatality near the proposed site.

In addition, having a 24/7 operation with extremely tall lighting will add noise and pollution to the area further degrading our community and home value. There is no reason why this facility should be built closer to the 303 where industrial and distribution centers seem to thrive.

I am amazed that the zoning committee approved this initiative given the opposition by both Litchfield and Goodyear councils. Please do the right thing and oppose this proposition.

If it goes through, I will be forced to uproot my family from our forever home and will certainly give pause on upcoming elections.
