President’s Message In the opening session, you will be introduced to those members that are running for the Board of Directors. The voting will take place on Saturday morning. A member must be present and in good standing thirty days prior to the vote, to be eligible to vote. Your name badge will be marked with a “V” to denote your voting status. This is a great opportunity for you to get to know the nominees for this year’s ballot and to make sure that those you elect represent your interests on the Board. It is with much regret that I announce that Don Kistner of Kistner’s Full Claims Service, Inc. has decided to resign so that he can focus more on his business. Don has been absolutely amazing in his position as the Board’s Treasurer. Don, with the as- sistance of Alan, completely restructured and overhauled the accounting system. He presents the finances at the Board meet- ings with detail and accuracy, always having the answer to any question. I want to take this time to personally thank Don for his service to the Board and most especially for his service on the Executive Board as the Treasurer. I would also like to thank Don for his willingness to work closely with the next Treasurer during the transition. We will update you on the results of the elections on the website and in the June issue of the CPPC Claims Journal. On the schedule for the breakout sessions on Saturday morning we have information on the possibility of obtaining insur- ance coverage for the membership. If you are interested in what this could offer you, please consider attending this session. The co-chairs for this project are Bob Dickson of Furniture Medic by Bluegrass Furniture Restoration, Inc. and Terry Jiminez of Universal Restoration Services. Colin Galloway and Lisa Irvine have taken the surveys that were submitted, as well as having reviewed the policies that are presently in effect for several board members, to create suggestions on how we can help our membership obtain their coverage that hopefully will save them money. The Exhibit Booths will be open from noon to 1:00 pm on Friday, and the auction items will also be displayed at that time. We hope that you will create time in your schedule to visit with our Exhibitors and enjoy what they bring to the Workshop. For our new attendees, there is a meeting scheduled from 12:30 to 12:55 on Friday. We encourage you to use this opportunity to meet with the Board and discover all that the CPPC is about and the events that we sponsor. Lastly, while it is a challenge to meet everyone at these events, I do hope that if we haven’t yet had that privilege, that you will introduce yourself to me. I also hope that everyone enjoys themselves this weekend. We look forward to your feedback on how we did and how we might improve our events for everyone in the future. Nutrition Depot alleged that DHL failed to collect and remit $21,991.72 in collect-on-delivery (COD) payments for shipments DHL delivered to Nutrition Depot customers between April 3, 2006 and January 31, 2007. In the Second Amended Complaint, filed after removal, Nutrition Depot asserted that the Carmack Amendment to the Interstate Commerce Act, 49 U.S.C. § 14706, applied; asserted Texas common-law claims for breach of fiduciary duty, breach of contract, and conversion; and asserted a claim under the Texas Theft Liability Act, TEX. CIV. PRAC. & REM. CODE § 134.001, et seq. In addition to the $21,999.72 in actual damages, Nutrition Depot seeks between $75,375 and $80,775 in attorney’s fees. The following motions are pending: C Nutrition Depot has moved for summary judgment on its state-law claims for breach of fiduciary duty, breach of contract, conversion, and theft of property. MEMORANDUM IN SUPPORT OF THE MOTION OF THE UNITED STATES TO TERMINATE LEGACY ANTITRUST JUDGMENTS The United States respectfully submits this memorandum in support of its motion to terminate two legacy antitrust judgments. The Court entered these judgments in 1951 and 1956, respectively; thus, each of them is more than sixty years old. After examining each judgment- and after soliciting public comments on each proposed termination-the United States has concluded that termination of these judgments is appropriate. Termination will permit the Court to clear its docket, the Department to clear its records, and businesses to clear their books, allowing each to utilize its resources more effectively. I. BACKGROUND From 1890, when the antitrust laws were first enacted, until the late 1970s, the United States frequently sought entry of antitrust judgments whose terms never expired.1 Such perpetual judgments were the norm until 1979, when the Antitrust Division of the United States Department of Justice ("Antitrust Division") adopted the practice of including a term limit of ten years in nearly all of its antitrust judgments. Perpetual judgments entered before the policy change, however, remain in effect indefinitely unless a court terminates them. Although a defendant may move a court to terminate a perpetual judgment, few defendants have done so. There are many possible reasons for this, including that defendants may not have been willing to bear the costs and time resources to seek termination, defendants may have lost track of decades-old judgments, individual defendants may have passed away, or company defendants may have gone out of business.
