Al-Din al-Qayyim: On Taqlid and Ijtihad A Refutation of Ibn Qayyim al-Jawziyyah‟s Arguments against Taqlid Mawlana Habib Ahmad al-Kiranawi 1 Translator‟s Preface In Allah‟s Name, the Infinitely Merciful, the Beneficent. This book is a translation of the treatise al-Din al-Qayyim by the late Indian scholar, Mawlana Habib Ahmad al-Kiranawi, published with a number of his other writings under the title Fawa‟id fi „Ulum al- Fiqh. Al-Din al-Qayyim was written as a detailed refutation of Shaykh Ibn Qayyim al-Jawziyyah‟s (691 H/1292 CE - 751 H/1349 CE) arguments against taqlid from his I„lam al-Muwaqqi„in which offers the most thorough denunciation of taqlid and its proofs to date. The refutation was written in Arabic by Mawlana Habib Ahmad under the supervision of Hakim al-Ummah Mawlana Ashraf „Ali al-Thanawi (d. 1362 H/ 1943 AD) as part of the general introduction to the 20-volume compendium of hadith- proofs for the Hanafi madhhab, I„la al-Sunan.* Mawlana Habib Ahmad in a rigorous and precise manner shows not only that taqlid, which is the non- mujtahid‟s deference to a mujtahid Imam in rulings of the Shari„ah without asking for detailed proofs, is established from the Qur‟an, Sunnah and the practice of the Salaf, but that it is so fundamental and necessary for Islamic scholarship and practice to function at any level that its detractors have no option but to resort to taqlid, while repackaging it as “adherence to proof.” It is a must-read for anyone wishing to understand the structure of Islamic scholarship and the weakness of the arguments presented by those who wish to deny the legitimacy and necessity of taqlid. -

Johara Berriane When Senegalese Tidjanis Meet in Fez: The Political and Economic Dimensions of a Transnational Sufi Pilgrimage Summary The tomb of Ahmad Al-Tidjani in Fez has progressively become an important pilgrimage centre for the Tidjani Sufi order. Ever since the Tidjani teachings started spreading through- out the sub-Saharan region, this historical town has mainly been attracting Tidjani disciples from Western Africa. Most of them come from Senegal were the pilgrimage to Fez (known as ziyara) has started to become popular during the colonial period and has gradually gained importance with the development of new modes of transportation. This article analyses the transformation of the ziyara concentrating on two main aspects: its present concerns with economic and political issues as well as the impact that the transnationalisation of the Tid- jani Senegalese community has on the Tidjani pilgrims to Morocco. The origins of the shrine cults are outlined, the similarities between traditional Muslim and Christian attitudes to shrines are emphasized and the functions of the shrine and the mosque are contrasted. Iranian and Afghan shrines are classified, firstly in terms of the objects which form their principal attrac tions and the saints associated with them, and secondly in terms of the distances over which they attract pilgrims. The administration and endowments of shrines are described and the relationship between shrines and secular authorities analysed. -

The hot dry climate contri- buted to a street network, which was protected from the sun as much as possible. Climate conditions determined the appe- arance of houses with flat roofs, small windows and white walls. The entire urban planning system had the main centre—the city (town) mosque. There were smaller mosques in the structure of residential areas, densely surrounded by houses. Just as under the influence of climate a certain type of residential building took shape, these same factors formed a characteristic type of mosque in the housing environment. Globalist trends have affected even such a conservative sphere as Islamic religious architecture, as it gradually toned down striking regional features, which is explained by the typicality of modern building materials and structures and the interna- tional activity of various architectural and construction firms in different corners of the world. Over the centuries, two oppo- sing images of the mosque have emerged—the pointedly magnificent Persian and the fortress-type of Maghreb (typical for Algeria) types. This paper reviews how specific climatic conditions and historical processes influenced the use of building materials, structures and decoration in the mosques of Persia’s and Algeria’s different regions. Today we observe an erosion of regional features in the form and layout of modern mosques, which are analysed on the basis of the examples given. -

MIRACLES OF ZIYARAT ASHURA BISMILLAHIR RAHMANIR RAHIM Ziyarat Ashura was sent by Almighty Allah to the Holy Prophet (s.a.) through angel Jibrail to console him on the unique tragedy of Karbala. Prophet Muhammad (s.a.) said: “The difficulties I had to face were unlike anything faced by the earlier prophets (a.s.).” Regarding this tradition, Ayatullah Shaykh Iraqi writes that, here the Prophet (s.a.) apart from his other afflictions, wishes to tell us about a tribulation in particular that was unique in nature, in the sense that none of the previous prophet were subjected to it. And that tribulation was the hostile treatment meted out to the Ahl ul Bayt (a.s.) after the demise of Prophet (s.a.). Among the hardships that the Ahl ul Bayt (a.s.) were made to face, was Karbala. Allah had informed the Prophet (s.a.) about the incident of Karbala through Jibrail. The Prophet (s.a.) was always very grievous and sorrowful about the incidents that were to follow him. So Allah (as to console him) taught the prophet (s.a.) Ziyarat Ashura and enumerated its benefits in the world and the hereafter. And Allah took it up on Himself to grant all the requests and ease all hardships through its recitation. 1 Allah gave this Ziyarat to Jibrail and asked him to present it to the Prophet (s.a.), so as to gladden the Ahl ul Bayt (a.s.) and their Shias, the reciters of this Ziyarat would be contented and pleased with its benefits in the hereafter and gain relief from the adversities of this world. -

Shāh Ni'matullāh wali 's Mausoleum is a magnificent, yet unknown, historic site, which can be considered the main tourist attraction in Mahan, Kerman. The findings of the study suggest the existence of Shiite art in this mausoleum under the impact of different factors such as regional established Shi'a territories in Iran and India. The photofixation of both constructions was made around the perimeter of their buffer zones. The coordinates of the photofixation points were made with the use of the GPS. All the results were put on the aerial image – picture 1. The photo-images show the visual correlation between both constructions.
