Gray’s activities in the Anchorage DMA have fully complied with the Commission’s announced rules and unquestionably have improved broadcast television service to Anchorage television viewers. The NAL seeks to enforce against Gray a rule that, quite literally, does not apply to the transaction under review and proposes an unprecedented penalty for a transaction that was completely lawful.
