Main results of the Council

The Council adopted conclusions that emphasise the importance of strengthening transport cooperation with neighbouring regions , in particular through the improvement of transport infrastructure and closer integration of transport markets.

In the field of aviation, the Council gave the Commission negotiating mandates for a comprehensive air transport agreement with aimed at market opening in parallel with regulatory harmonisation, and for an agreement with the European Organisation for Safety of Air Navigation ( ) providing a general framework for .

Furthermore, ministers held a debate on the proposed revision of the regulation on the tachograph to be used by professional drivers. The aim of the revision is to make fraud more difficult and to reduce the administrative burden by making full use of new technologies and introducing a number of new regulatory measures.

INTERMODAL QUESTIONS

Transport cooperation with neighbouring regions

TheCounciladoptedconclusions( 14712/11 ) emphasisingtheimportanceofstrengthenedtransport cooperationandbettertransportconnectionswithneighbouringregionscoveredbytheEnlargement andEuropeanNeighbourhoodpolicies,inparticulartheWestern,theMediterranean andtheEasternPartnershipcountries,withaviewtobringingaboutdeepereconomicintegration andcloserpoliticalassociation.

Toachievethesegoals,theCounciladvocatesimprovementoftransportinfrastructure,especially bybetterlinkingoftheinfrastructureofneighbouringcountrieswiththetransEuropeantransport network,andcloserintegrationoftransportmarkets,inparticularbyextendingtheEuropean CommonAviationArea,removingbarriersinmaritimetransport,increasinginteroperabilityof railwaysystemsandstreamliningbordercrossingandadministrativeprocedures.TheCouncilis, however,stressingthatclosermarketintegrationwilldependonneighbouringcountries'readiness todosoandontheirprogressinapplyingsafety,security,environmentalandsocialstandards equivalenttothoseoftheEU.

TheexistingfinancialresourcessuchastheNeighbourhoodInvestmentFacility,whichcanleverage fundingfrominternationalfinancialinstitutions,shouldbeusedtohelpthosecountriesmakethe necessaryreforms.

Moreover,theCouncilwelcomestheestablishmentofanEasternPartnershipTransportPanel,due tobelaunchedattheEasternPartnershipministerialconferenceon2425OctoberinKrakow (Poland).

TheconclusionscomeinresponsetoacommunicationonthistopicpresentedbytheCommission inJuly,outliningshortandlongtermmeasuresforalltransportmodestostrengthentransport connections( 13022/11 ).ThecommunicationisafollowuptotheEU'snewapproachtothe EuropeanNeighbourhoodPolicy,whichisbasedonahigherlevelofdifferentiationdependingon eachcountry'sneeds,ambitionandreadinesstocooperate,assetoutinaCommission communicationadoptedthisMay( 10794/11 )andinCouncilconclusionsadoptedthisJune (11850/11 ).

AVIATION

Enhanced cooperation with Eurocontrol

TheCouncilauthorisedtheCommissiontoconductnegotiationswiththeEuropeanOrganisationfor theSafetyofAirNavigation(Eurocontrol)onahighlevelagreementaimedatestablishinganew andstableframeworkforenhancedcooperation.TheagreementwillconfirmEurocontrolasthe technicalandoperationalarmoftheEUinthedevelopmentandimplementationofitsSingle EuropeanSky(SES)programme,whilepositioningtheEUastheregulatorofthisprogramme.

Eurocontrolisacivilmilitaryintergovernmentalorganisationwith39contractingpartiesfromall over,includingallEUmemberstatesexceptEstonia.Itplaysapivotalroleinairtraffic management(ATM)inEuropeandprovidesexpertiseandtechnicalassistancetotheEUinthis field.IthasrecentlybeennominatedasATMnetworkmanagerfortheSingleEuropeanSky programme,whichisdesignedtoestablishasafeandefficientairtrafficmanagementsystemat Europeanlevelonthebasisofalegalframeworkadoptedin2004(SESI)and2009(SESII).

Air transport agreement with Azerbaijan

TheCouncilgavetheCommissionamandatetoopennegotiationswithAzerbaijanona comprehensiveairtransportagreementaimedatmarketopeninginparallelwithregulatory harmonisationinareassuchasaviationsafetyandsecurity,environmentalprotectionand competitionlaw.

MarketopeningisexpectedtoyieldeconomicbenefitstoEUandAzerbajaniairlinesand andhelpdevelopbusinessandforeigninvestmentinAzerbaijan.Thisneedstobeaccompaniedbya regulatoryframeworkconsistentwithEUstandards.

TheagreementwillcreatealegalframeworkforairtransportbetweenAzerbaijanandtheUnionas awhole,thusensuringalevelplayingfieldforallEUcarriers.Itwillreplacetheexistingtwenty onebilateralairservicesagreementsbetweenindividualEUmemberstatesandAzerbaijan,which areratherrestrictiveinparticularasregardscapacityarrangements.Atamoregeneralpolitical level,theestablishmentofsuchanagreementisinlinewiththeEuropeanNeighbourhoodPolicy andtheEasternPartnershipinitiative,inbothofwhichAzerbaijanisinvolved,andwillfurtherthe objectivesofthePartnershipandCooperationAgreementwithAzerbaijan,whichisduetobe succeededbyanAssociationAgreementcurrentlyundernegotiation.

LAND TRANSPORT

Revision of the tachograph regulation

TheCouncilheldapublicdebateonarevisionofthe1985regulationonthetachographtobeused byprofessionaldriverssothatcompliancewiththerulesondrivingtimeandrestperiodscanbe checkedintheinterestofroadsafety,decentworkingconditionsfordriversandfaircompetition betweentransportbusinesses.Theaimoftheproposedrevisionistomakefraudmoredifficultand toreducetheadministrativeburdenbymakingfulluseofnewtechnologiesandintroducinga numberofnewregulatorymeasures.

AsexaminationoftheCommissionproposalintheCouncilworkingpartyisstillatanearlystage (seereportin 14486/11 ),theCouncilfocuseditsdiscussionslessonthedetailsoftheproposalthan onmemberstates'experienceswiththecurrenttachographsystem.Ministersacknowledgedthe crucialroleofthetachographforcheckingcomplianceandtherebyforroadsafety.Whilstgenerally thecurrentsystemseemstowork,ministersemphasizedthatimprovementsarerequired,pointingin particulartovulnerabilitiesofthesystemwhichmakemanipulationandfraudpossible.Theyalso underscoredtheimportanceofreducingcostsfortransportbusinesses.Inthisrespect,itwas stressedthatanynewmeasureshadtobeproportionateandsubjecttoadetailedcostbenefit analysis,withsomememberstatesvoicingconcernsaboutthecoststhemeasuresproposedbythe Commissionmightentail.

TheCouncil'spreparatorybodiesarenowinvitedtocontinueexaminationoftheproposal (13195/11 ),whichcontainsthefollowingkeyelements:

Asregardsuseoftechnology,thecurrentmanualrecordingofthelocationofthevehiclewillbe replacedbyautomatedrecordingthroughsatellitepositioning.Moreover,remotecommunication fromthetachographdeliveringbasicindicationsoncompliancewiththeruleswillenablecontrol officerstobettertargetroadsidechecks,therebyavoidingunnecessarychecks.Inaddition,a standardisedinterfaceofthetachographwillfacilitateitsintegrationintoIntelligentTransport Systemsapplications,suchasthoseforfleetmanagement.

Ontheregulatoryside,therequirementstobemetbyworkshopsentrustedwiththeinstallationand calibrationoftachographswillbestrengthenedandthedrivinglicencewillbemergedwiththe drivercardtobeusedwiththetachograph,whichissupposedtoreducefraudaswellas administrativecosts.Theadministrativeburdenwillalsobecutbyextendingtheexemptionfrom theobligationtousetachographs,whichmemberstatesmaygranttocertainusers,mainlysmalland mediumsizedenterprises:forthoseusers,auniformexemptionfortransportoperationswithina radiusof100kmisproposed,whereashithertothisexemptionhasbeenlimitedto50kmincertain cases.

UndertheCommissionproposal,theregulatorymeasureswillapplyoneyearafterthepublication oftheregulationintheUnion'sOfficialJournal,whilstapplicationofthenewsatellitelinked technologywillbecomemandatoryfouryearslater,thatisprobablyasfrom2017.

The1985regulation,whichhasalreadybeenadaptedtentimestotakeaccountoftechnological progress,setstechnicalstandardsandestablishestherulesontheuse,typeapproval,installationand inspectionoftachographs.Atpresent,twotypesoftachographsareusedbysome900000transport businessesand6milliondrivers:thedigitaltachographintroducedinvehiclesregisteredafter 1May2006,andtheanaloguetachograph,whichisstillusedinoldervehicles.

Informal meeting of transport ministers on private financing for transport infrastructure

ThepresidencybriefedtheCouncilontheinformalmeetingoftransportministersinSopot(Poland) on5and6September2011,devotedtotheissueofmobilizingprivatefinancingfortransport infrastructureandfocusedinparticularonmemberstates'experienceswithpublicprivate partnerships.Thepresidencysummarisedtheresultsofthemeetinginasetofconclusions (14119/11 )highlightingpublicprivatepartnershipsasausefultoolfortransportfinancing,while stressingthekeyroleofpublicfundsininfrastructuredevelopment.

Eastern Partnership ministerial conference on transport

ThepresidencygaveinformationabouttheconferenceoftransportministersofEUmemberstates, thesixEasternPartnershipcountries(,,,,and Azerbaijan)andwhichistotakeplaceinKrakow(Poland)on24and25October2011 (14884/11 ).Theaimwillbetostrengthentransportcooperationwiththesecountries,onthebasisof theprinciplessetoutintheconclusionsonrelationswithneighbouringregionsadoptedatthis Councilmeeting.TheconferenceisalsoduetolaunchanEasternPartnershipTransportPanel.

Emissions Trading in the aviation sector

TheCommissionbriefedministersonthestateofplay,andinparticularonconsultationswiththird countries,regardingtheapplicationoftheEU'sgreenhousegasemissionstradingscheme(ETS)to aviation,duetostarton1January2012.

AnumberofmemberstatescalledupontheCommissiontostepuptalkswithnonEUcountries opposedtotheinclusionofinternationalaviationintheUnion'sETS,inordertofindasolution.

Russian visa requirement for Czech aircraft crews

TheCzechdelegationbriefedtheCouncilonavisarequirementrecentlyintroducedbyRussiafor CzechcivilaircraftcrewmembersandaskedthepresidencyandtheCommissiontoraisethisissue withtheRussianauthorities.TheCzechRepublicdoesnothaveabilateralagreementwithRussia onvisawaivers.

Blue Belt pilot project

TheCommissionbriefedministersontheimplementationanddevelopmentofthe"BlueBelt"pilot projectendorsedbythe2010DecemberTransportCouncil,whichenteredits6monthoperational phaseinMaythisyear( 14934/11 ).TheCommissionconsidersthefirstresultsoftheproject promisingandintendstocontinueitin2012.TheBlueBeltconceptaimsatfacilitatingmaritime transportwithintheEUbyreducingadministrativeformalitiesforshipoperators,whilstensuring safety,securityandenvironmentalprotectionaswellascustomsandtaxrevenues,throughoptimal useofmaritimemonitoringtechnology.

Event on piracy within the context of World Maritime Day

TheItaliandelegationbriefedtheCouncilonthe"WorldMaritimeDayParallelEvent"hostedthis yearbyItalyinRomeon13and14October( 14889/11 ).Thefocusofthismeetingofexpertsand institutionalrepresentativeswillbeoncombatingpiracy.The"ParallelEvent"takesplacewithin thecontextoftheWorldMaritimeDaycelebratedeachyearbytheInternationalMaritime Organisation(IMO).

EU-Russia Permanent Partnership Council (PPC)

TheCounciladoptedanEUpositionwithaviewtothefifteenthEURussiaPermanentPartnership Council(PPC)intheareaofjusticeandhomeaffairswhichwilltakeplaceinWarsawon1011 October2011.Italsoapprovedasetofdraftcommonstepstowardsvisafreeshorttermtravelof RussianandEUcitizens,whichwillbesubmittedtothePPCforendorsement.

Mobile satellite services

TheCouncildecidednottoopposetheadoptionbytheCommissionofadecisiononmodalitiesfor coordinatedapplicationoftherulesonenforcementwithregardtomobilesatelliteservicespursuant toArticle9(3)ofDecision626/2008/EC.

Thedraftdecisionissubjecttotheregulatoryprocedurewithscrutiny;nowthattheCouncilhas givenitsconsent,theCommissionmayadoptit,unlesstheEuropeanParliamentobjects.
