THE PROTECTION OF HUMAN RIGHTS IN THE MEXICAN REPUBLICANISM CARLOS ALBERTO AGUILAR BLANCAS1 Abstract: Democracy is not only a procedure of choice and citizen participation, but also a set of values that affirm freedom and citizen’s rights. The reform of 2011 rose to constitutional rank the defence, protection and promotion of human rights, representing an unprecedented historic breakthrough. With these reforms, Mexico seeks to consolidate its constitutional system adapting it to reality, increasing its cultural diversity, values and traditions that have been shaping the Mexican identity. The full knowledge of their rights produces a citizenship aware of them, which, even for Mexico, is a long-term task. INTRODUCTION The constitutional state is characterized by the defence of the fundamental rights of individuals, in contrast to the classic constitutionalism, which sought the political freedom of the citizens against the public abuse of power (SCHMITT, 1992: 138), i.e., in those days it was reflected that there was not a bourgeois rule of law, that there was no individual rights and the separation or division of powers was not established. -

Brian Willson Contents z Foreword z Section I: United States Militarization of Mexico z Section II: Unmasking the Drug War z Section III: Poverty and Misery-Aggravation by NAFTA z Section IV: Militarization and Repression in Mexico Personal Introduction On February 9, 1995, while traveling south on curvy, mountainous Chiapas Highway 173, we encountered a long, heavily supplied Mexican military convoy, carrying hundreds of armed soldiers. Among the new uniforms and equipment, I believed I recognized U.S. material, armored personnel carriers among them. The convoy moved north towards Simojovel, the highland's village we had just left. Later I learned that we had seen the beginning of a major military offensive which ravaged many communities, and whose goal was the capture of Zapatista leaders. Only a few days earlier, on January 31, 1995, U.S. President Bill Clinton had begun orchestrating the controversial $50 billion bailout of the then collapsing Mexico economy. Though Congress opposed the deal, Clinton was adamant. He bypassed Congress and facilitated the fiscal relief package through other channels: loans from discretionary public sources and from the International Monetary Fund (IMF) and other international funds. This unprecedented action suggests the high stakes involved in assuring a "healthy," stable Mexican economy so important under the North American Free Trade Agreement (NAFTA) and the new corporate global economy that NAFTA promotes and requires. I have come to understand that this kind of economy is defined and driven by various international speculators, domestic wealthy interests, and World Bank and IMF theorists and programs. -

Justice Reform in Mexico: Change and Challenges in the Judicial Sector David A. Shirk Working Paper Series on U.S.-Mexico Security Cooperation April 2010 1 Brief Project Description This Working Paper is the product of a joint project on U.S.-Mexico Security Cooperation coordinated by the Mexico Institute at the Woodrow Wilson Center and the Trans-Border Institute at the University of San Diego. As part of the project, a number of research papers have been commissioned that provide background on organized crime in Mexico, the United States, and Central America, and analyze specific challenges for cooperation between the United States and Mexico, including efforts to address the consumption of narcotics, money laundering, arms trafficking, intelligence sharing, police strengthening, judicial reform, and the protection of journalists. This paper is being released in a preliminary form to inform the public about key issues in the public and policy debate about the best way to confront drug trafficking and organized crime. Together the commissioned papers will form the basis of an edited volume to be released later in 2010. All papers, along with other background information and analysis, can be accessed online at the web pages of either the Mexico Institute or the Trans-Border Institute and are copyrighted to the author. Education, building culture of privacy, and protection of citizenship rights, as well as human dignity, are the most important components of a citizenship-oriented judicial officer. In the meantime, forming judicial police as the main judicial officer police in the heart of law enforcement forces can better provide education, building culture, privacy, and protection of citizenship rights through continuous and transparent supervision of judicial authorities and ensure judicial security at higher levels.
