As can be expected, the federative organisation of such states as Germany, Switzerland, the USA, India and Russia will be reflected in their police organisation, though the extremely decentralised approach of Switzerland with hardly any central man- agement structures can hardly serve as a paradigm of ‘the’ federal police organisation. We have enclosed a description of the Spanish police as an example of a ‘federal police system in the making,’ as we thought readers from prospective federal states might find it in- teresting to look into the management of change from a centralised unitary system to a more decentralised one. The editors of the book find it appropriate to add at this point a word of caution. The political and security arrangements of most federal states are an expression of, and reflection on, their history of state- and nation-building. They were not first centralised states (or if, only briefly so) whose governments then decided to ‘federal- ise’ in the hope of solving pressing social, ethnic, caste, etc. prob- lems, but rather: they were confederate conglomerates of quasi-in- dependent subjects which historically grew together but wished to maintain much of their previous sovereignty. And equality before the law for each and every citizen was an important building element in this process. The editors hope that these handy studies will help readers to understand how and why federal police organisations came into being, and function according to decentralised legislative and deci- sion-making frameworks. The articles also seek to highlight the in- creased demand for coordination and harmonisation of the policing approaches in federal states. Joshi Introduction Political Profile India, with an area of 3,287,782 km² and a population of about 1.15 bil- lion, is a sovereign, secular, democratic republic, following a parliamen- tary system of governance. The Indian parliament is a bicameral legislature consisting of a lower house (the Lok Sabha or House of the People) and an upper house (the Rajya Sabha or Council of States). State legislatures are mostly unicam- eral with a legislative assembly (Vidhan Sabha) composed of members elected for five-year terms. The state has a federal structure. India is a union of 28 states and seven union territories,1 including the National Capital Territory of Delhi. The government at the centre is composed of a council of ministers headed by the Prime Minister. Collectively, they are responsible to the Lok Sabha (House of the People in the Parliament). In states, the council of ministers headed by the Chief Minister is responsible to the Vidhan Sabha of the state. Direct elections are held on the basis of adult franchise to elect mem- bers both to the Lok Sabha as well as Vidhan Sabhas. The political party winning the majority of seats forms the government. Legislatures Powers, functions and responsibilities of the union and states are defined in the Constitution of India. The Constitution distributes the legislative powers between the Parliament and the State Legislatures.2 It prescribes three lists of subjects, which are spelt out in the Seventh Schedule of the Constitution. 1 Union territories are areas that do not form part of states’ jurisdiction and are governed by the central government. 2 The Constitution of India (1949), Article 246. 1 2 Policing in Federal States List I is the Union List that contains the subjects over which the Parlia- ment has the sole power to make laws. List II is the State List that speci- fies the items over which the state legislature has the exclusive power to make laws. Finally, List III is the Concurrent List that documents subjects on which both the Parliament and the State Legislatures have concurrent powers to make laws. The Parliament has the power to make laws for the whole or any part of the country, while the State legislature can make laws for the whole or any part of the state only.3 The Parliament is also empowered to make any law with respect to any subject not enumerated in the State or Concurrent List.4 If any provision of a law passed by the State legislature is incompatible with any provision of a law made by the Parliament, the latter prevails.5 The parliament has the power to legislate in respect of any matter in the State List if there is a Proclamation of Emergency.6 Even when the Proclamation of Emergency is not in operation, the Par- liament can legislate with respect to a matter in the State List provided the Upper House

    The AFP is well informed of the criminal practices and illicit trading taking place on the dark web. We are working with our partners to combat all forms of technology-enabled crime. In recent years there has been a steady increase in the number of seizures of all drug types via the mail system detected at the Australian border. High frequency-low volume importations such as ones through our mail system pose a considerable cumulative threat. These shipments contribute towards supplying the Australian market and exacerbate social problems within Australia associated with drug harm. Seizing these smaller importations can impact on disrupting the drug trade. The AFP and other Australian law enforcement agencies are well aware of this method of drug importation and are committed to targeting and combating it. The AFP works alongside its partner agencies on this matter, including Border Force and state and territory police. While it is not an offence to access websites that provide access to sellers of illegal substances, it is an offence to import or attempt to import a border controlled drug including synthetic drugs into Australia purchased from such a website. Offenders should be aware that if they seek to import illicit and synthetic drugs they will be subject of law enforcement scrutiny and investigation. Recently, a national co-ordinated policing campaign focused on detecting drugs being distributed via the Australian postal service saw a total of 62 illicit drugs or illegally obtained prescription medications seized by police. Operation Vitreus was co-ordinated by the National Methylamphetamine Strategy Group, which is currently lead by SA Police (SAPOL), but involved all State and Territory police agencies, working in conjunction with the Australian Federal Police, Australian Border Force (ABF), the Australian Criminal Intelligence Commission and AUSTRAC.

    Border Violence Prevention Council FACT SHEET Building on the principles of co-responsibility for and co-management of our shared border espoused in coordination mechanisms like the 21st Century Border Management Initiative and the High Level Economic Dialogue, the United States and Mexico created the Border Violence Prevention Council. The Council is co- led by U.S. Customs and Border Protection (CBP), the Secretariat of Foreign Relations (SRE) of Mexico, and the Federal Police of Mexico, and includes the participation of other U.S. Department of Homeland Security components, the U.S. Department of State, and the Secretariat of Governance of Mexico. The Border Violence Prevention Council is a policy-level decision making body that promotes initiatives aimed at preventing incidents of border violence through collaborative efforts, joint public engagement campaigns, increased transparency and information exchange, and the sharing of best practices. The Council has met four times, most recently on November 3, 2016, where we noted significant past accomplishments, including: Undertaking actions to increase the U.S. Department of Homeland Security’s and CBP’s accountability, transparency, and notification regarding use of force cases.     Conflict Studies Research Centre D62 Manpower Problems of The Russian Armed Forces M J Orr Introduction On 15 January Lt Gen Vasiliy Smirnov, deputy head of the main organization- mobilization directorate of the Russian general staff, announced the preliminary results of the autumn 2001 conscription period. "The plan of the autumn call-up as laid down in the Russian Federation's President's decree No. 148 has been carried out. Between October and December 2001 more than 194,000 Russian citizens, aged from 18 to 27, were sent to the army and fleet … (T)he quality of the conscript contingent is getting worse. Out of every 100 potential conscripts last year the military commissariats were only able to draft 12 young men; the remainder had legal reasons for being excused military service. Today in Russia every third potential conscript proves unfit for service on health grounds … more than 50% of the conscripts sent to the forces have health limitations on their fitness for service."1 Such statements emerge from the organization-mobilization department twice a year, as a sort of ritual bringing the conscription campaign to a close. Each time the decreed quantity of recruits has been found and each time their quality has declined. Within these standardized announcements there is no suggestion that the whole system for recruiting the Russian armed forces is steadily collapsing. Last autumn, however, there were indications that, at long last, the Russian government has accepted that the system must be changed. Programmes to phase out conscription are being considered although it is not clear that the general staff has accepted that a professional army is desirable or practical.
