Pierwotnie miał by ć przeznaczony dla osób, których dotycz ą dane przechowywane w SIS, jako pomoc w korzystaniu z prawa dost ępu. Mo że by ć jednak źródłem praktycznych informacji tak że dla wszystkich, którzy ze wzgl ędów zawodowych zainteresowani s ą prawem dost ępu (organy ochrony danych, słu żby policji, wydziały ds. cudzoziemców, prawnicy itd.). Na przewodnik składaj ą si ę trzy cz ęś ci: przegl ąd zasad ogólnych i najwa żniejszych definicji zwi ązanych z SIS, opis post ępowania wzgl ędem prawa dost ępu w ka żdym z odno śnych pa ństw oraz opis niektórych sytuacji szczególnych wymagaj ących specjalnego post ępowania. I. PRZEGL ĄD ZASAD OGÓLNYCH I.A System informacyjny Schengen (SIS) Układ schenge ński z dnia 14 czerwca 1985 r. oraz odno śna konwencja wykonawcza z dnia 19 czerwca 1990 r. zlikwidowały odprawy na granicach wewn ętrznych mi ędzy pa ństwami członkowskimi i wprowadziły zasad ę dokonywania kontroli na granicy całej strefy Schengen. Dzi ęki temu powstał obszar, po którym osoby fizyczne mog ą si ę swobodnie przemiesza ć. Aby utrzyma ć zadowalaj ący poziom bezpiecze ństwa, postanowiono oprócz stosowania innych środków (zacie śnienie współpracy organów policji i współpracy organów wymiaru sprawiedliwo ści, harmonizacja polityki wizowej i azylowej) utworzy ć system informacyjny Schengen (SIS). Zawarte w systemie dane s ą dost ępne dla wszystkich pa ństw członkowskich nale żą cych do strefy Schengen. Jest on scentralizowan ą baz ą z informacjami nale żą cymi do dwóch kategorii: po pierwsze – z danymi osób poszukiwanych, zaginionych lub obserwowanych, a po drugie – z danymi skradzionych lub zagubionych pojazdów i przedmiotów, zwłaszcza np. dowodów to żsamo ści, dowodów rejestracyjnych czy tablic rejestracyjnych pojazdu. Data Protection Secretary - A Guide for exercising the right of access - 13 October 2009 4 Oto co przykładowo mo żna znale źć w SIS: • informacje o osobach poszukiwanych lub obserwowanych przez policj ę • informacje o osobach zaginionych lub wymagaj ących ochrony, zwłaszcza o nieletnich • informacje o osobach, które nie s ą obywatelami pa ństwa strefy Schengen i podlegaj ą zakazowi wjazdu do niej. Wykonanie czynno ści żą danej we wpisie zale ży od prawa pa ństwa strefy Schengen, które t ę czynno ść wykonuje. Je żeli prawo krajowe zakazuje odno śnej czynno ści, dane pa ństwo strefy Schengen musi natychmiast poinformowa ć o tym pa ństwo, które dokonało wpisu. Zgodnie z zasadami ochrony danych konwencja schengeńska przyznaje konkretne prawa wszystkim osobom fizycznym. Zasadniczo chodzi o: • prawo dost ępu do własnych danych przechowywanych w SIS • prawo do za żą dania sprostowania, je żeli dane s ą nie ścisłe, lub usuni ęcia, je żeli dane s ą przechowywane wbrew prawu • prawo, by wyst ąpi ć do krajowych organów ochrony danych o skontrolowanie indywidualnych danych zawartych w SIS i sposobu, w jaki te dane s ą wykorzystywane • prawo, by wszcz ąć przed s ądem lub wła ściwym organem post ępowanie skutkuj ące sprostowaniem lub usuni ęciem nie ścisłych danych albo wypłat ą odszkodowania. I.B Prawo dost ępu Prawo dost ępu oznacza, że ka żdy zainteresowany mo że zgodnie z prawem krajowym uzyska ć wgl ąd do informacji o sobie przechowywanych w zbiorze danych. Jest to fundamentalna zasada ochrony danych pozwalaj ąca osobom, których dotycz ą dane, sprawowa ć kontrol ę nad swoimi danymi osobowymi przechowywanymi przez strony trzecie. Data Protection Secretary - A Guide for exercising the right of access - 13 October 2009 5 Prawo to jest jednoznacznie przewidziane w konwencji schenge ńskiej z dnia 19 czerwca 1990 r. W my śl art. 109 konwencji ka żdy ma prawo dost ępu do swoich danych wprowadzonych do systemu informacyjnego Schengen. Prawu temu towarzyszy prawo do za żą dania sprostowania, je żeli dane s ą nie ścisłe, lub usuni ęcia, je żeli dane s ą przechowywane wbrew prawu (art. 110). Dost ępu odmawia si ę, je żeli przyznanie go mo że utrudni ć wykonanie legalnej czynno ści wskazanej we wpisie lub je żeli jest to konieczne do ochrony praw i swobód osób trzecich. Dost ępu odmawia si ę zawsze w okresie wa żno ści wpisu, który zawiera żą danie prowadzenia niejawnej obserwacji (art. 109 ust. 2 konwencji). Kto pragnie skorzysta ć z prawa dost ępu, mo że si ę zwróci ć do wła ściwych organów w dowolnym pa ństwie schenge ńskim 1. Dowolno ść ta jest mo żliwa, gdy ż wszystkie krajowe bazy danych (N.SIS) są takie same jak system centralny (C.SIS) w Strasburgu (zob. art. 92 ust. 2 konwencji). Zatem prawo dost ępu dotyczy zawsze tych samych danych, bez wzgl ędu na to, do którego pa ństwa si ę wyst ępuje. Jednak od przepisów pa ństwa, do którego si ę wyst ępuje, zale ży sposób wykonywania tego prawa. Otó ż pa ństwa ró żni ą si ę pod wzgl ędem trybu post ępowania: istniej ą dwa systemy rz ądz ące prawem dost ępu do policyjnych zbiorów danych, a zatem i do SIS.

    SWITZERLAND 2017 HUMAN RIGHTS REPORT EXECUTIVE SUMMARY The Swiss Confederation is a constitutional republic with a federal structure. Legislative authority resides in a bicameral parliament (Federal Assembly) consisting of the 46-member Council of States and the 200-member National Council. Federal elections in 2015 were generally considered free and fair. Parliament elects the executive leadership (the seven-member Federal Council) every four years, and did so in 2015. A four-party coalition made up the Federal Council. Civilian authorities maintained effective control over the security forces. There were no reports of egregious human rights abuses. The government took steps to prosecute and punish officials who committed violations, whether in the security services or elsewhere in the government. Section 1. Respect for the Integrity of the Person, Including Freedom from: a. Arbitrary Deprivation of Life and Other Unlawful or Politically Motivated Killings There were no reports that the government or its agents committed arbitrary or unlawful killings. b. Disappearance There were no reports of disappearances by or on behalf of government authorities. c. Torture and Other Cruel, Inhuman, or Degrading Treatment or Punishment The constitution prohibits such practices. There were isolated reports that individual police officers used excessive force and engaged in degrading treatment while making arrests. In March the district court of Buelach in the canton of Zurich sentenced two police officers to suspended fines for abuse of authority after they used excessive force SWITZERLAND 2 against a motorist during a road patrol check. The officers reportedly handcuffed the driver and forced him to the ground, injuring his head, spine, ribcage, and larynx, after the driver insisted on retrieving his license from the officers.

    2007364E 1 Translated from French Request from the Secretary-General of the United Nations for information concerning measures to eliminate international terrorism Input from Switzerland for the 2019 report (submitted in 2020) (1) Law (a) Status and implementation of multilateral and regional agreements Switzerland is a party to the 18 United Nations conventions and protocols related to counter- terrorism. Switzerland is also a party to the European Convention on the Suppression of Terrorism of 1977. On 11 September 2012, Switzerland signed the Council of Europe Convention on the Prevention of Terrorism of 16 May 2005 and, on 22 October 2015, the additional Protocol thereto. Work towards the ratification of the two instruments is under way. Parliamentary discussions in that regard are in progress. Switzerland also cooperates with foreign States in combating terrorism on the basis of the United Nations Convention against Transnational Organized Crime of 15 November 2000. In the area of police cooperation, on 27 June 2019 Switzerland signed the agreement on its participation in the Prüm regime, along with the Eurodac Protocol. The agreement will allow the Swiss criminal prosecution authorities to ascertain as quickly as possible which foreign authorities have relevant information. It will help with the conduct of inquiries into and the identification of wanted, missing or deceased persons and in obtaining information concerning them. The Protocol will give the criminal prosecution authorities access to all data contained in the Eurodac database. They will thus have access to information that could prove essential in combating terrorism and prosecuting other serious criminal offences. The two instruments are in the process of being ratified.

GRETA considers that stating explicitly in the definition of trafficking in human beings, as contained in the Criminal Code, the notions of forced labour or services, slavery, practices similar to slavery, and servitude as types of exploitation could improve the implementation of this provision. The Swiss authorities have duly noted GRETA's position. They wish to point out that the preparatory work, published in the Federal Gazette (FF no. 17 of 3 May 2015, FF 2005 2639, p. 2667), specifies that the term “exploitation through labour” encompasses the notions of forced labour or services, practices similar to slavery, and servitude, which is already clear from the broad nature of the notion of exploitation through labour. Current criminal legislation is accurately reflected in the first evaluation report. Although there are no plans to revise the Swiss Criminal Code regarding this point, the notion is fully explained in training.
