Maxeiner"" ABSTRACT The United States, it is said, is a common law country. The genius of American common law, according to American jurists, is its flexibility in adapting to change and in developing new causes of action. Courts make law even as they apply it. This permits them better to do justice and effectuate public policy in individual cases, say American jurists. Not all Americans are convinced of the virtues of this American common law method. Many in the public protest, we want judges that apply and do not make law. American jurists discount these protests as criticisms of naive laymen. They see calls for legal certainty through statutes as unwise and unattainable. But not all American jurists agree. Some American jurists believe that times have changed. The golden era of com­ mon law is past, they say. It passed in the early 20th century. Today Americans live in an "age of statutes"; courts apply statutory texts and not common law precedents. Some American jurists conclude that the United States needs a new common law for an age of statutes. Others believe that the United States should have a textual approach that deals with statutes. The near religious reverence that Americans have for their legal institutions in­ hibits reform. What most Americans do not know, however, is that the United States has always lived with statutes. Contemporary American common law methods, and not statutes, are the intruder of the 20th century. Statutes and statutory methods are the normal way that modern states govern their people * Common law myth in this article refers only to the United States and not to England or elsewhere. Apology: Although in this article I call attention to legal history, I do not intend it to be a work oflegal history. In working on a book tentatively titled Failures ofAmerican Lawmaking in International Perspective, I realized that even if I show that present American statutory methods do not work well and that foreign statutory methods do, some readers will respond by saying: so what? America is exceptional: America has always eschewed statutes and preferred judge-made law. The point of this article is to disestablish common law myth rather than to establish any particular competing history. It is an invitation to others to do legal history. For the first century of the Republic Americans expected to adopt modern methods. Until only a few years ago, the literature of earlier American ages of statutes was lost to view. The digitization of American legal history by Google and oth­ ers now makes that history available to all. INTRODUCTION In 1876, as part of the national celebration of the Centennial of the inde­ pendence of the United States of America, Americans commemorated a century of American law. They celebrated progress wrought through statutes, i.e., through written laws. In other words, they commemorated a government of laws. They saw what one would call today American exceptionalism in "written constitutions and codification." They feted freedom from the "atrocities" of common law. They looked forward to a world where legislation would improve society and bring law home to all Americans. How strange

For the past two decades, researchers consistently have reported that law-related curricula and instruction make a positive impact on youth when compared to traditional approaches to teaching and learning law, civics, and government. The overall conclusion is that LRE programs have a positive effect on student knowledgeabout law and legal processes, and individual rights and responsibilities. Inaddition, there is evidence that LRE programs have a positive influence on student attitudes and behavior. The most positive changes in student behavior often are associated with LRE programs where the following elements are present: instruction is of high quality and promotes higher order thinking; students are actively involved in the instructional process; teachers thoughtfully mediate the curriculum through wise selection of materials and outside resource persons; administrators actively support the program; and instructors have a network of professional peer support. This review incorporates an analysis of the major databases that yielded 9 technical reports, 6 scholarly papers, and 25 dissertations directly linked to law-related education.

    Magna Carta and the Development of the Common Law Professor Paul Brand, FBA Emeritus Fellow All Souls College, Oxford Paper related to a presentation given for the High Court Public Lecture series, at the High Court of Australia, Canberra, Courtroom 1, 13 May 2015 Magna Carta and the Development of the Common Law I We are about to commemorate the eight hundredth anniversary of the granting by King John on 15 June 1215 of a ‘charter of liberties’ in favour of all the free men of his kingdom [of England] and their heirs. That charter was not initially called Magna Carta (or ‘the Great Charter’, in English). It only acquired that name after it had been revised and reissued twice and after the second reissue had been accompanied by the issuing of a separate, but related, Charter of the Forest. The revised version of 1217 was called ‘The Great Charter’ simply to distinguish it from the shorter, and therefore smaller, Forest Charter, but the name stuck. To call it a ‘charter of liberties’ granted by king John to ‘all the free men of his kingdom’ of England is, however, in certain respects misleading. The term ‘liberty’ or ‘liberties’, particularly in the context of a royal grant, did not in 1215 bear the modern meaning of a recognised human right or human rights. ‘Liberty’ in the singular could mean something closer to that, in the general sense of the ‘freedom’ or the ‘free status’ of a free man, as opposed to the ‘unfreedom’ of a villein. ‘Liberties’, though, were something different (otherwise known as ‘franchises’), generally specific privileges granted by the king, particular rights such as the right to hold a fair or a market or a particular kind of private court, the right to have a park or a rabbit warren which excluded others from hunting or an exemption such as freedom from tolls at markets or fairs.

    EQUITY IN THE AMERICAN COURTS AND IN THE WORLD COURT: DOES THE END JUSTIFY THE MEANS? I. INTRODUCTION Equity, as a legal concept, has enjoyed sustained acceptance by lawyers throughout history. It has been present in the law of ancient civilizations' and continues to exist in modem legal systems.2 But equity is no longer a concept confined exclusively to local or national adjudication. Today, equity shows itself to be a vital part of international law.' The International Court of Justice--"the most visible, and perhaps hegemonic, tribunal in the sphere of public international law" 4-has made a significant contribution to the delimitation,5 development of equity. Particularly in cases involving maritime 6 equity has frequently been applied by the Court to adjudicate disputes. Equity is prominent in national legal systems and has become increas- ingly important in international law. It is useful, perhaps essential, for the international lawyer to have a proper understanding of it. Yet the meaning of equity remains elusive. "A lawyer asked to define 'equity' will not have an easy time of it; the defimition of equity, let alone the term's application in the field of international law, is notoriously uncertain, though its use is rife."7 Through a comparative analysis, this note seeks to provide a more precise understanding of the legal concept of equity as it relates to two distinct systems oflaw: the American and the international. IT has been no part of my intention in compiling these lists entitled "The Bench and Bar of Philadelphia," to give a history of the organization of the Courts, but merely names of Judges, with dates of their commissions; Lawyers and dates of their ad- mission, and lists of other persons connected with the administra- tion of the Laws in this City and County, and in the Province and Commonwealth. Some necessary information and notes have been added to a few of the lists. And in addition it may not be out of place here to state that Courts of Justice, in what is now the Com- monwealth of Pennsylvania, were first established by the Swedes, in 1642, at New Gottenburg, nowTinicum, by Governor John Printz, who was instructed to decide all controversies according to the laws, customs and usages of Sweden. What Courts he established and what the modes of procedure therein, can only be conjectur- ed by what subsequently occurred, and by the record of Upland Court.
