Presiding Judge in Superior Court District and Limited Jurisdiction Court District
GR 29 PRESIDING JUDGE IN SUPERIOR COURT DISTRICT AND LIMITED JURISDICTION COURT DISTRICT (a) Election, Term, Vacancies, Removal and Selection Criteria--Multiple Judge Courts. (1) Election . Each superior court district and each limited jurisdiction court district (including municipalities operating municipal courts) having more than one judge shall establish a procedure, by local court rule, for election, by the judges of the district, of a Presiding Judge, who shall supervise the judicial business of the district. In the same manner, the judges shall elect an Assistant Presiding Judge of the district who shall serve as Acting Presiding Judge during the absence or upon the request of the Presiding Judge and who shall perform such further duties as the Presiding Judge, the Executive Committee, if any, or the majority of the judges shall direct. If the judges of a district fail or refuse to elect a Presiding Judge, the Supreme Court shall appoint the Presiding Judge and Assistant Presiding Judge. (2) Term . The Presiding Judge shall be elected for a term of not less than two years, subject to reelection. The term of the Presiding Judge shall commence on January 1 of the year in which the Presiding Judge’s term begins. (3) Vacancies . Interim vacancies of the office of Presiding Judge or Acting Presiding Judge shall be filled as provided in the local court rule in (a)(1). (4) Removal . The Presiding Judge may be removed by a majority vote of the judges of the district unless otherwise provided by local court rule. (5) Selection Criteria . Selection of a Presiding Judge should be based on the judge’s 1) management and administrative ability, 2) interest in serving in the position, 3) experience and familiarity with a variety of trial court assignments, and 4) ability to motivate and educate other judicial officers and court personnel. -

In other words, `Judicial Precedent' means a judgment of a Court of law cited as an authority for deciding a similar set of facts, a case which serves as authority for the legal principle embodied in its decision. A judicial precedent is a decision of the Court used as a source for future decision making. Meaning :- A precedent is a statement of law found in decision of a Superior Court. (A procurement process is commenced at the earliest of the making of a request for qualifications, request for quotation, request for proposals, or a call for tenders.2 )The Act provides for adjudication as a cost effective, flexible, and swift means of enforcing the prompt payment regime set out in the Act, which will take effect as of the same date as interim adjudication. Magna Carta and the Development of the Common Law Professor Paul Brand, FBA Emeritus Fellow All Souls College, Oxford Paper related to a presentation given for the High Court Public Lecture series, at the High Court of Australia, Canberra, Courtroom 1, 13 May 2015 Magna Carta and the Development of the Common Law I We are about to commemorate the eight hundredth anniversary of the granting by King John on 15 June 1215 of a ‘charter of liberties’ in favour of all the free men of his kingdom [of England] and their heirs. That charter was not initially called Magna Carta (or ‘the Great Charter’, in English). It only acquired that name after it had been revised and reissued twice and after the second reissue had been accompanied by the issuing of a separate, but related, Charter of the Forest. The revised version of 1217 was called ‘The Great Charter’ simply to distinguish it from the shorter, and therefore smaller, Forest Charter, but the name stuck. To call it a ‘charter of liberties’ granted by king John to ‘all the free men of his kingdom’ of England is, however, in certain respects misleading. The term ‘liberty’ or ‘liberties’, particularly in the context of a royal grant, did not in 1215 bear the modern meaning of a recognised human right or human rights. ‘Liberty’ in the singular could mean something closer to that, in the general sense of the ‘freedom’ or the ‘free status’ of a free man, as opposed to the ‘unfreedom’ of a villein. ‘Liberties’, though, were something different (otherwise known as ‘franchises’), generally specific privileges granted by the king, particular rights such as the right to hold a fair or a market or a particular kind of private court, the right to have a park or a rabbit warren which excluded others from hunting or an exemption such as freedom from tolls at markets or fairs. -

Fragility, weak institutions and conflicts provide an attractive environment and breeding ground for illicit networks and extremist organizations and these connected groups can seriously impede peace-building efforts and threaten human security. SUMMARY › Organized crime, conflict, and violent extremism all thrive when any state is weak or its structure is absent. Where there is a lack of security, a want of access to justice, and poor service provision, then organized crime often fills the void by taking over certain functions of the state. › Traditionally, crime and violent extremism have not formed a part of the peace-building agenda but instead have been treated as separate matters for law enforcement strategies. › Dealing with organized crime and violent extremism in countries and societies emerging from conflict requires a multidimen- sional peace-building approach that includes the perpetrators of organized crime and those involved in armed conflict and violent extremism. UN Security Council mandates for peacekeeping operations must be so arranged that they include the fight against organized crime. › Strengthening social cohesion and inclusiveness, trust and legitimacy of the government concerned and its institutions must be at the centre of peace-building strategies, together with realizable peace dividends. › The UN, the EU and other actors must meet such challenges with comprehensive policies and approaches because military, diplomatic or police methods alone will not suffice. -

Argued October 14, 2020—Decided March 25, 2021 Respondents Janice Madrid and Richard Williamson, officers with the New Mexico State Police, arrived at an Albuquerque apartment com- plex to execute an arrest warrant and approached petitioner Roxanne Torres, then standing near a Toyota FJ Cruiser. The officers at- tempted to speak with her as she got into the driver’s seat. Believing the officers to be carjackers, Torres hit the gas to escape. The officers fired their service pistols 13 times to stop Torres, striking her twice. Torres managed to escape and drove to a hospital 75 miles away, only to be airlifted back to a hospital in Albuquerque, where the police ar- rested her the next day. Torres later sought damages from the officers under 42 U. S. C. §1983. She claimed that the officers used excessive force against her and that the shooting constituted an unreasonable seizure under the Fourth Amendment. Affirming the District Court’s grant of summary judgment to the officers, the Tenth Circuit held that “a suspect’s continued flight after being shot by police negates a Fourth Amendment excessive-force claim.” 769 Fed. -

Even in remedies, where the line persists, the conventional scholarly wisdom favors erasing it. Yet something surprisinghas happened. In a series of cases over the last decade and a half, the U.S. Supreme Court has acted directly contrary to this conventional wisdom. These cases range across many areas of substantive law-from commercial contracts and employee benefits to habeas and immigration, from patents and copyright to environmental law and national security. Throughout these disparate areas, the Court has consistently reinforced the line between legal and equitable remedies, and it has treated equitable remedies as having distinctive powers and limitations. This Article describes and begins to evaluate the Court's new equity cases. -
Representing Yourself and Your Business in Magistrate Court
REPRESENTING YOURSELF AND YOUR BUSINESS IN MAGISTRATE COURT I. INTRODUCTION Business is rife with conflict. To succeed, a business owner must be adept at resolving these disputes quickly and efficiently. Sometimes, more that a simple phone call, refund or apology is needed. Some disputes must be resolved in court. The American civil judicial system is designed to resolve disputes. Although the process works well, it is expensive and time consuming, sometimes taking several years and costing tens or even hundreds of thousands of dollars. For many smaller disputes, the time and cost associated with a traditional lawsuit makes litigation in these forums impractical. Mediation or arbitration are sometimes good options, but only if your adversary is of a similar mindset. There is an alternative. Georgia’s Magistrate Court is a court of limited jurisdiction, hearing civil claims involving disputes of $15,000 and less. It is often described as “Small Claims Court.” With the right judge, it might be more aptly called a “Court of Common Sense.” The rules of procedure and evidence are relaxed. There is no jury. In the State and Superior Courts of Georgia, a corporation must by law be represented by an attorney. This is not true for Magistrate Court, where a business may be represented by an employee or owner. In short, Magistrate Court provides a forum in which it is often possible to secure justice quickly and inexpensively for smaller disputes. The purpose of this article is to provide a basic roadmap for representing yourself and your business successfully in Magistrate Court. II. PROS AND CONS There are advantages and disadvantages to trying your case in Magistrate Court as opposed to the slower and more expensive State and Superior Courts of Georgia.
