HACKNEY /PRIVATE HIRE DRIVER KNOWLEDGE/LOCALITY TEST

To make an appointment to sit the knowledge/locality test you must submit the following:

• This completed knowledge test application form; • A knowledge test application fee upon submission (the current application fees are available on www.sunderland.gov.uk); • Your driving licence; and • One recently take passport size photograph of yourself in person to one of the following Customer Service Centres:

Please note that there are no cash or cheque handling facilities at the Houghton and Washington Centres. However, fees may be paid at these centres by credit or debit cards.

We will notify you where and when the knowledge test will be conducted. The test will be supervised by an officer of the Licensing Section. The test consists of 32 questions, in three sections, randomly selected from a prepared list of over two hundred questions and will last approximately 45 minutes.

In section one you will be asked ten questions relating to the law, conditions of licence and the Highway Code. There are 40 points available in this section.

In section two you will be asked to give the location of fourteen well known places such as hospitals, public , public houses, clubs and other places of leisure, shopping centres, facilities etc. There are 28 points available in this section.

Section Three will require you to demonstrate that you know the shortest route between two points, covering eight randomly selected routes. There are 32 points available in this section.

The pass mark required is 85% and you will be informed in writing, within five working days of sitting the test, whether you have passed or failed.

If you fail the test, you can make an appointment to re-sit the test at one of the above Customer Contact Centres. The fee to resit a knowledge/locality test is £20.05. This fee is payable each time you resit the knowledge/locality test.

If you pass the test you will then need to complete an application form for a licence to drive and or private hire vehicles. This application form will be sent to you along with the letter advising you that you have passed the knowledge test.

Please note that to make an application for a licence to drive Hackney Carriage and/or Private Hire Vehicles you must be 21 years of age or over and have held a full U.K. driving licence for at least 12 months.

All criminal convictions (including motoring convictions) and cautions must be disclosed to the Council upon application for a driver’s licence including those that are spent under the terms of the Rehabilitation of Offenders Act 1974, by virtue of the Rehabilitation of Offenders Act 1974 (Exceptions) (Amendment) Order 2002. This can cause a delay in an application, or affect whether you are granted a licence to drive Hackney Carriage and/or Private Hire Vehicles at all. In all such cases, the application will be referred to the Regulatory Committee, who will decide whether to grant or refuse a licence. The Licensing Section may be able to provide you with general guidance regarding any of the above matters prior to booking a test appointment. As well as carrying out a criminal record bureau check on applicants for a licence to drive Hackney Carriage and/or Private Hire Vehicle driver's licences, the Council will also check the driving history of applicants with the DVLA.

If you are in any doubt as to previous convictions, professional legal advice should be obtained. Please note that acceptance of a caution is the admission of guilt of an offence and will be treated as a conviction.

Please note that when you pass the knowledge/locality test and submit your application for a drivers badge your right to work in the UK will be checked as part of your licence application and this could include the licensing authority checking your immigration status with the Home Office.

If there are restrictions on the length of time you may work in the UK, your licence will not be issued for any longer than this period. In such circumstances the check will be repeated each time you apply to renew or extend your licence. If, during this period, you are disqualified from holding a licence because you have not complied with the UK’s immigration laws, your licence will cease to have effect and you must return it to the licensing authority. Failure to do so is a criminal offence.

UNTIL YOU HAVE BEEN ISSUED AND ARE IN RECEIPT OF A VALID HACKNEY CARRIAGE AND/OR PRIVATE HIRE DRIVER'S LICENCE AND BADGE YOU ARE NOT LICENSED WITH THE LOCAL AUTHORITY. YOU WOULD BE COMMITTING AN OFFENCE IN DRIVING SUCH A VEHICLE, REGARDLESS OF YOUR REASONS.

GUIDANCE NOTES ABOUT THE TRADE

The law relating to Hackney (better known as Taxis) and Private Hire Vehicles, and their drivers and operators is contained in the Local Government (Miscellaneous Provisions) Act 1976, The Town Police Clauses Act 1847, the Road Traffic Act 1988 and the Motor Vehicle (Construction and Use) Regulations 1986. Attached to the grant of a licence issued by a Council are conditions which must be complied with. When an application form for the grant of any licence is signed by an applicant, this signifies that they will comply with all the conditions attached to the licence. The holder of a licence issued by the Council must comply with all the conditions which includes informing the Council of a change of address, and of any convictions imposed on him/her during the period of the licence. This includes motoring offences.

Hackney Carriages in the City of Sunderland are White in colour. They are fitted with a full width roofsign bearing the word "TAXI" and exhibit a square shaped coloured licence plate. The licence plate will be Yellow, Red, Orange or Green and must be secured to the rear exterior of the vehicle. A Hackney Carriage may only carry the number of passengers specified on the licence and plate.

The City of Sunderland is split into two zoned areas as follows:-

i. Sunderland Yellow, Orange or Red plates ii. Hetton, Houghton and Washington Green plates

A Hackney Carriage must be fitted with a meter which must be checked for its accuracy by the Council and display the Council's approved table. Hackney Carriages are licensed to ply for hire in public places, designated taxi ranks or be hailed in the street.

Hackney Carriages should be covered by a policy of insurance for Public Hire use.

Private Hire Vehicles in Sunderland can be any colour other than White, can be fitted with a small roofsign displaying the name of the Private Hire Operator for whom the vehicle works and the words "Private Only".

A Private Hire Vehicle need not be fitted with a meter. If a meter is fitted in a private hire vehicle, a fare table must be displayed in the vehicle that reflects what is being charged. If no meter is fitted the driver must negotiate the fare with the customer prior to commencement of the journey or display the alternative fare table used. A Private Hire Vehicle must also display a licence plate. The licence plate must be displayed on the rear exterior of the vehicle. A Private Hire Vehicle may only carry the number of passengers specified on the licence and plate.

The Council will license a vehicle as a Private Hire Vehicle provided it complies with the Council's Age and Colour Policy, is suitable in size, type and design, is in good mechanical condition, is safe and comfortable and is covered by the appropriate certificate of insurance i.e. (Private Hire).

The council also has a specification policy on mini vehicles submitted for licensing as Private Hire Vehicles, requiring that the vehicle meets with certain minimum and maximum measurements and complies with the relevant legislation.

Hackney Carriages and Private Hire Vehicles may carry advertisements on the rear doors provided the advertisement has been authorised by the Council

The City Council limits the number of Hackney Carriage licences issued and holds a waiting list of interested applicants.

Private Hire Operators are licensed by the Council to make provisions for the invitation and acceptance of Private Hire bookings. It is the responsibility of an Operator to ensure that all vehicles and Drivers working from his/her office are licensed. Operators are required to maintain various records relating to the operation of the business and regularly submit lists of vehicles and drivers operated by them.

Drivers of Hackney Carriages and Private Hire Vehicles must conduct themselves in a civil and orderly manner and be clean and respectable in their dress. They should take all reasonable steps to ensure the safety of passengers conveyed in, entering and alighting from the vehicle and must attend promptly for any hiring. A driver, when arriving at a location must wait for the customer to approach the vehicle and should ask the customer their name to ensure that he has the correct passenger before allowing them into the vehicle, or knock at the door to advise that he is there. He must not sound the vehicle horn to attract attention. The driver must not, without the express consent of the hirer, smoke, eat or drink whilst in the vehicle and must not allow a radio to be a source of nuisance to any person inside or outside the vehicle. When a driver is working, he/she must wear the identity badge issued to him/her by the Council in such a manner as to be plainly and distinctly visible and so that the face of the bearer may be compared to the photograph on the badge.

Should a driver lose his/her badge, or should it become defaced or damaged in any way, the driver must arrange with the Council to have a replacement badge prepared immediately. It is an offence to drive a licensed vehicle without wearing a badge.

It is the driver's responsibility to ensure that children are suitably restrained whilst in the vehicle and that no more than the number of passengers the vehicle is licensed to carry is conveyed during a hiring. A driver should ensure that any property found in a vehicle is handed into a local Police Station.

A Private Hire vehicle and driver must be pre-booked by the customer through a private hire operator before the commencement of the journey. Should a prospective passenger approach a private hire driver and ask to book the vehicle, the driver may instruct the customer to contact their operating office independently to create the booking. A driver must not be involved in direct communication with their operator in relation to the booking; e.g. he must not radio back to his operator, nor should he provide any means of communication to the passenger by offering his mobile telephone to be used. Any driver of a vehicle who accepts an un-booked customer will be committing an offence. Additionally, any driver who may be prosecuted for the offence of illegally plying for hire could also be prosecuted for the offence of ‘driving without insurance’ and this is done in almost every case. An illegal plying for hire offence may result in a driver being fined by the Courts and, in relation to the offence of driving without insurance, a driver may be fined separately and 6-8 penalty points could be endorsed upon his DVLA driving licence. Dependent upon the number of penalty points already endorsed upon a driver’s DVLA driving licence, this could result in the driver being disqualified from driving by the Courts. Furthermore, any private hire driver convicted of such offences will be referred to the Council’s Regulatory Committee where consideration will be given to the suspension or revocation of his licence to drive private hire vehicles.

It is the driver's responsibility to ensure that, if driving a vehicle that is not his/her own, he/she is included on the policy of insurance and covered for the purpose for which the vehicle is being used, and before driving the vehicle that all appropriate checks are carried out with regard to the roadworthiness of the vehicle, e.g. tyres (minimum legal tyre tread depth = 1.6mm, see tread wear indicators), Lights etc. (see Highway Code book).

If driving his/her own vehicle, the driver should carry out the usual checks with regard to the roadworthiness as above.

Hackney Carriages and Private Hire Vehicles in Sunderland must carry a suitable Fire Extinguisher which must be kept in a convenient place, close at hand.

Disabled People form an important client group and drivers are expected to be able to deal with a wide variety of situations when transporting such passengers with specific requirements. Communication is vital. Drivers should always offer assistance but it must be left to each individual passenger to decide whether assistance is required or not. Drivers should however ensure that passengers board the vehicle safely and are suitably restrained. In purpose built vehicles, should the passenger be a wheelchair user and not be able to or wish to transfer to a seat, then the driver should ensure that the wheelchair is securely anchored in the vehicle, using the restraints provided. Passengers who are blind or partially sighted should be advised of the type of vehicle they are about to get into i.e. ( Type Taxi or saloon car). They should be advised as to which way the vehicle is facing, whether the door of the vehicle is open or not and asked whether they wish to sit in the front or rear of the vehicle. Guide, hearing or assistance dogs should not be spoken to or distracted in any way.

The driver has a duty to carry a disabled passenger with their guide, hearing or assistance dog, and to allow the dog to remain with the passenger, and not make any additional charge for doing so. The driver may apply to the Council for an exemption certificate on medical grounds (1995 Act section 37A). A driver who has been issued a Certificate of Exemption must exhibit a Notice of Exemption in his/her vehicle.

Seatbelts in Private Hire Vehicles may not be worn by the driver whilst passengers are being conveyed. The driver must however use his seatbelt at all other times. The wearing of seatbelts by Hackney Carriage drivers is optional whilst on duty.

The Licensing Section, based at Jack Crawford House, Commercial Road, Sunderland are not only responsible for the licensing and enforcement of Hackney Carriage and Private Hire Vehicle, Driver and Operators licences, they are also there for advice and guidance to members of the Trade and are happy to assist with any advice or enquiries.

General

Any driver, proprietor, or operator must inform the Department of any change of address, by either completing a change of address form obtained from the City Centre Customer Services Centre or in writing, to the Senior Licensing Officer, Jack Crawford House, Commercial Road, Sunderland, SR2 8QR. Licences must be also be returned for amendment.

CONDITIONS ATTACHED TO A LICENCE TO DRIVE HACKNEY CARRIAGES

1. In these conditions, unless the subject or context otherwise requires, the 'Driver' means a person holding and acting in accordance with a Licence to drive Hackney Carriages issued by the Council, 'the Council' means the Council of the City of Sunderland, and 'vehicle' means Hackney Carriage licensed by the Council.

2. The driver shall ensure he is fully conversant with the conditions of the licence and the Statutory Provisions relating to the licence.

3. A driver must hold a full driving licence for at least 12 months and have attained the full age of 21.

4. The driver wishing to renew his licence must make application at least 7 days before expiration.

5. A driver shall return the licence for endorsement when changing his address, or his operator.

6. A driver shall within seventy two hours disclose to the Council in writing details of any caution(s) or conviction(s) for any offence(s). The Council will then decide whether the licence should be suspended or revoked, having regard to the offences.

7. The Driver shall: -

a) not wilfully or negligently cause or suffer the licence number marked on a vehicle of the Licence Plate Insignia or the 'Taxi' or 'For Hire' signs attached to a vehicle to be concealed from public view to be so defaced that any figure or material particular is illegible.

b) The Driver shall ensure that the 'Taxi' and 'For Hire' signs attached to a vehicle are illuminated when the vehicle is available for hire but not at any other time.

8. The Driver shall: -

a) not require for a journey a fare greater than that authorised by the table of enforced within the District;

b) not wilfully or negligently cause or suffer the fare table fixed upon the vehicle to be inverted or detached or altered or the letters or figures on such table to be in any manner or by any means concealed at any time.

9. The Driver shall not by calling out or otherwise importune any person to hire the vehicle which he is using and shall not make use of the services of any other person for such purposes.

10. A Driver who knowingly conveys the dead body of any person within a vehicle shall notify the Council's Licensing Section forthwith.

11. The Driver shall:-

a) when standing or plying for hire, keep the meter of the vehicle locked in the position in which no fare is recorded on the face of the taxi meter;

b) as soon as the vehicle is hired and before commencing the journey, bring the machinery of the taxi meter into action by operating the key, flag, or other device, so that the word 'hired' is legible on the face of the taxi meter and keep the machinery of the taxi meter in action until the termination of the hiring;

c) ensure, during the continuance of any hiring, that the dial of the taxi meter is not concealed in any manner or by any means and that such dial is distinctly and plainly visible and legible to any person hiring or being conveyed in the vehicle;

d) cause the dial of the taxi meter to be kept properly illuminated throughout the hiring;

e) report immediately to the Council any failure of the taxi meter.

12. The Driver shall not tamper with or permit any person to tamper with the taxi meter with which a vehicle is provided, with the fittings thereof or with the seals affixed thereto.

13. The Driver shall at all times when a vehicle is standing, plying or being driven for hire:-

a) be clean and respectable in his dress and person and conduct himself in an orderly manner and with civility and propriety towards every person seeking to hire, hiring or being conveyed in such a vehicle and shall comply with every reasonable requirement of any person hiring or being conveyed in such vehicle;

b) take all reasonable precautions to ensure the safety of persons conveyed in or alighting from such carriage.

14. The Driver shall when plying for hire in a vehicle in any street and not actually hired:-

a) on arriving at a stand not already occupied by the full number of vehicles authorised to occupy it, station the vehicle immediately behind the vehicle or vehicle on the stand so that they face in the same direction;

b) from time to time when any other vehicle immediately in front is driven off or moved forward cause the vehicle to be moved forward so as to fill the place previously occupied by the vehicle driven off or moved forward;

c) remain with the vehicle and be ready to be hired at once by any person when his vehicle is the first vehicle on the stand.

15. The Driver who has agreed to be or has been hired to be in attendance with a vehicle at an appointed time and place, shall, unless delayed or prevented by some sufficient cause, punctually attend with such vehicle at such appointed time and place.

16. The Driver shall not convey or permit to be conveyed in a vehicle any greater number of persons than the number of persons specified on the plate affixed to the outside of the vehicle.

17. The Driver shall when requested by the person hiring or seeking to hire a vehicle:-

a) convey a reasonable quantity of luggage;

b) afford reasonable assistance in loading and unloading such luggage;

c) afford reasonable assistance in removing such luggage to or from the entrance of any , station or place at which he may take up or set down such a person.

18. The Driver shall daily search the vehicle which he uses for any property which may have been accidentally left therein.

19. The Driver shall, if any property is accidentally left therein by any person who may have been conveyed in the vehicle be found by or handed to him:-

a) convey as soon as possible, and in any event within 48 hours, if not sooner claimed by or on behalf of its owner, to the Licensing Section of the Council and leave it in the custody of an Officer of that section on his giving a receipt for it;

b) be entitled to receive from any person to whom the property shall be re- delivered an amount equal to five pence in the pound of its estimated value (or the fare for the distance from the place of finding to the Office of the Council, whichever be the greater) but not more than £5.00.

20. The Driver shall within 14 days of the suspension, revocation or refusal to renew his licence by the Council return to the Council the Driver's badge issued to him.

CONDITIONS ATTACHED TO A LICENCE TO DRIVE PRIVATE HIRE VEHICLES

1. In these conditions unless the subject or context otherwise requires 'the Council' means the council of the City of Sunderland, 'Driver' means a person holding and acting in accordance with a licence to drive private hire vehicles issued by the Council and 'Vehicle' means a private hire vehicle licensed by the Council.

2. The Driver shall ensure he is fully conversant with the conditions of the licence and the Statutory Provisions relating to the licence.

3. A Driver must hold a full Driving Licence for at least 12 months and have attained the full age of 21 years.

4. The Driver of a vehicle who wishes to renew his licence must make application at least 7 days before expiration.

5. A Driver shall return the licence for endorsement when changing his address or his operator.

7. The Driver shall not while driving in charge of the vehicle:

a) Tout, solicit on a road or other public place any person to hire or be carried in any Private Hire vehicle, or;

b) Cause or procure any other person to tout, solicit on a road or other public place any person to hire or be carried in any Private Hire vehicle, or;

c) Offer the vehicle for immediate hire while the vehicle is on a road or other public place.

8. The Driver shall not wilfully or negligently cause or suffer the licence number marked on the vehicle or the Licence Plate attached to a vehicle to be concealed from public view or to be so defaced that any figure or material particular is illegible.

9. Where a vehicle is equipped with a and where such taximeter is to be used to record the fare for a hiring, the driver shall:-

a) ensure, during the continuance of such hiring, that the dial of the taximeter is not concealed in any manner or by any means and that such dial is distinctly and plainly visible and legible to any person hiring or being conveyed in the vehicles;

b) cause the dial of the taximeter to be kept properly illuminated throughout the hiring;

c) report immediately to the Council any failure of the taximeter;

d) cause a table indicating the fare scale governing such hiring to be fixed upon the vehicle in such a position and manner that the letters and figures of such table are distinctly and plainly visible to any person being conveyed in such vehicle;

e) not wilfully or negligently cause or suffer the table required by Condition 9(d) to be inverted or detached or altered or the letters or figures on such table to be in any manner or by any means concealed at any time.

10. The Driver of a vehicle which is fitted with a taximeter shall not tamper with or permit any person to tamper with the taximeter with which the vehicle is provided, with the fittings thereof or with the seals affixed thereto.

11. The Driver shall at all times when a vehicle is being driven for hire:-

a) be clean and respectable in his dress and person and conduct himself in an orderly manner and with civility and propriety towards every person seeking to hire, or hiring, or being conveyed in such vehicle and shall comply with every reasonable requirement of any person hiring or being conveyed in such vehicle;

b) take all reasonable precautions to ensure the safety of persons conveyed in or alighting from such vehicle.

18. The Driver of a vehicle in which is displayed during or at the commencement of a hiring any table of fares shall not require for such hiring a fare greater than that authorised by such table of fares.

19. The Driver of a vehicle shall carry guide, hearing or other assistance dogs without making an additional charge, unless a medical exemption certificate issued by the Council is displayed facing outwards either to the windscreen or in a prominent position on the dashboard.

CONDITIONS ATTACHED TO HACKNEY CARRIAGE VEHICLE LICENCES

1. In these conditions unless the subject or context otherwise requires 'the Proprietor' means the holder of Hackney Carriage Licence 'the Council' means the Council of the City of Sunderland, 'Licence' means Hackney Carriage Licence.

2. (a) The Proprietor shall cause the number of the Licence granted to him in respect of a vehicle to be legibly marked on the inside of the vehicle and on the outside of the vehicle on a plate affixed thereto, such plate to be of the colour, size and shape and in such position as determined by the Council.

(b) The Proprietor shall not wilfully or negligently cause or suffer the number or Licence plate marked or attached in pursuance of this Condition to be concealed from public view or to be so defaced that any figure or material particular is illegible.

3. (a) With effect from 1st June 1985, the Proprietor of a hackney carriage, other than a London type cab with an inbuilt sign showing the word TAXI, shall cause a sign not less than 95 centimetres or more than 105 centimetres long and 18 centimetres high to be fitted to the roof of the vehicle. The face of the sign shall bear the word TAXI in black lettering on a white background with such insignia as determined by the Council on each side.

The sign shall show red to the rear and bear the telephone number of the hackney carriage company or proprietor in black numerals not more than 5 centimetres in height with the licence number of the vehicle to which it is attached, in black numerals not less than 7 centimetres in height at each side.

Such sign shall be illuminated when the vehicle is available for hire, but not at any other time.

(b) The Proprietor shall cause a 'For Hire' sign to be displayed in a conspicuous position on the vehicle and illuminated when the vehicle is available for hire but not at other times.

(c) The 'Taxi' and 'For Hire' signs referred to in this Condition shall be so constructed as to switch off automatically when the taximeter is operating.

(d) The Proprietor shall cause such insignia as determined by the Council to be displayed on the exterior of each of the two front doors of the vehicle.

(e) The Proprietor shall not wilfully or negligently cause or suffer the signs or insignia attached in pursuance of this Condition to be concealed from public view or to be so defaced that any figure or material particular is illegible.

(f) The Proprietor may cause a sign not exceeding 8 centimetres in height and 50 centimetres in length to be displayed on the front nearside windscreen and/or on the rear windscreen stating the name of the hackney carriage company or firm. Such sign shall be in black lettering on a white background and shall not be illuminated.

(g) The Proprietor may attach, affix or cause to be attached or affixed to the vehicle, an advertisement or advertisements provided that before so doing the proprietor shall obtain the approval of the Council to each advertisement.

(h) The Proprietor shall not attach or affix or cause to be attached or affixed to a vehicle any sign or mark other than one required or authorised by Conditions 2(a), 3(d), or 3(g).

4. A Proprietor shall ensure with regard to the vehicle to which his Licence relates:-

(a) that the vehicle is provided with sufficient means by which any person in the vehicle may communicate with the driver and that such means of communication is maintained;

(b) that the vehicle is maintained in a clean, comfortable, safe, watertight and mechanically sound condition;

(c) that the vehicle is provided with a suitable and efficient fire extinguisher in such a position as to be readily available for use;

(d) that the vehicle is provided with adequate means for securing luggage.

5. The Proprietor shall cause the vehicle to be provided with a taximeter which shall be so constructed, attached and maintained as to comply with the following requirements:-

(a) the taximeter shall be so constructed that it is not possible for any person manually to alter the tariff rate without breaking the seals affixed thereto;

(b) the taximeter shall be fitted with a key, flag or other device, the operation of which will bring the machinery of the taximeter into action and cause the word 'hired' to appear on the face of the taximeter;

(c) such key, flag or other device shall be capable of being locked in such a position that the machinery of the taximeter is not in action and that no fare is recorded on the face of the taximeter;

(d) when the machinery of the taximeter is in action, there shall be recorded on the face thereof in figures clearly legible and free from ambiguity the fare which the Proprietor or driver is entitled to demand and take for the hire or the carriage by distance;

(e) the word 'fare' shall be printed on the face of the taximeter in plain letters so as clearly to apply to the fare recorded thereon;

(f) the taximeter shall be so placed that all letter and figures on the face thereof shall be at all times plainly visible to any person being conveyed in the vehicle and for that purpose the letters and figures shall be suitably illuminated during any period of hiring and the switch for operating the light providing the said illumination shall be incorporated in and operated in conjunction with the key flag, or other device which brings the machinery of the taximeter into action and no other method of operating the said light shall be employed;

(g) the taximeter and all the fittings thereon shall be so affixed to the vehicle with seals or other appliances that it shall not be practicable for any person to tamper with them except by breaking, damaging or permanently displacing the seals or other appliances.

6. The Proprietor shall at the request of an authorised officer produce:

(a) the current drivers licence of any person authorised to drive the vehicle

(b) the vehicle registration document

(c) the insurance document for the vehicle

(d) evidence he is self-employed if appropriate either forthwith or at the offices of the Council’s Licensing Section within 7 days of the request.

7. A Proprietor who wishes to renew a licence must make application at least 7 days before its expiration.

8. The Proprietor shall return the licence for endorsement when changing his address or his operational base.

9. The Proprietor shall at all times during the currency of the licence ensure a policy of insurance is held authorising the use of the or reward and complying with the Road Traffic Acts and any regulations or amendments thereto.

10. The Proprietor shall ensure that every driver employed by him holds a Licence to Drive Hackney Carriages and shall ensure that such driver is acquainted with, understands and observes the conditions attached to his Licence and the statutory provisions relating to such Licence.

11. A Proprietor shall not by calling out or otherwise importune any person to hire his carriage and shall not make use of the services of any other person for such purpose.

12. A Proprietor whose vehicle conveys the dead body of any person shall notify the Council's Licensing Section forthwith.

13. The Proprietor shall daily search his vehicle for any property which may have been accidentally left therein.

14. The Proprietor shall, if any property accidentally left therein by any person who may have been conveyed in the vehicle be found by or handed to him:-

(a) carry it as soon as possible, and in any event within 48 hours, if not sooner claimed by or on behalf of its owner, to the Licensing Section of the Council and leave it in the custody of an Officer of that Section on his giving a receipt for it;

(b) be entitled to receive from any person to whom the property shall be re- delivered an amount equal to five pence in the pound of its estimated value (or the fare for the distance from the place of its finding to the Office of the Council, whichever be the greater) but not more than £5.00.

15. A Proprietor shall:-

(a) not require for a journey a fare greater than that authorised by the table of fares in force within the District;

(b) cause the fare table provided by the Council to be fixed upon the vehicle in such a position and manner that the letters of such table are distinctly and plainly visible to any person being conveyed in such carriage;

(c) not wilfully or negligently cause or suffer such table to be inverted or detached or altered or the letters or figures on such table to be in any manner or by any means concealed at any time.

16. If the proprietor transfers his interest in his vehicle to any person other than the proprietor whose name is specified in the licence he shall within 14 days after such transfer give notice in writing to the Council specifying the name and address of the person to whom the vehicle has been transferred.

17. The Proprietor shall within seventy two hours disclose to the Council in writing details of his conviction for any offence(s). The Council will then decide whether the licence should be suspended or revoked, having regard to the offence(s).

18. No vehicle will be accepted for licensing by the Council as a hackney carriage or private hire vehicle unless it has been certified by either the Vehicle Certification Agency or the Vehicle and Operator Services Agency as meeting the requirements of:

a) European Community Whole Vehicle Type Approval;

b) European Community Small Series Type Approval;

c) National Small Series Type Approval;

d) Individual Single Vehicle Approval; or

e) any relevant predecessor scheme.

19. The seat type and layout of any vehicles licensed to carry 5 or more passengers shall not be altered or amended in any way from that which subsisted on the date of issue of this licence without the written consent of the Council.

20. The glazing of any vehicle submitted for licensing as either a hackney carriage or a private hire vehicle must have a light transmittance as detailed below:

Front windscreen; minimum light transmittance 75%;

Both front doors vehicle glass; minimum light transmittance 70%;

All remaining vehicle glass behind the two front doors; minimum light transmittance of 35%.

Note: A tolerance level of minus 4% is allowed in relation to the measured transmittance.

CONDITIONS ATTACHED TO PRIVATE HIRE VEHICLE LICENCES

1. In these conditions unless the subject or context otherwise requires 'the Proprietor' means the holder of a Private Hire Vehicle Licence 'the Council' means Sunderland City Council, 'Licence' means a Private Hire Vehicle Licence issued by the Council.

2. (a) The Proprietor shall cause the number of the Licence granted to him in respect of the vehicle to be legibly marked on the inside of the vehicle and on the outside of the vehicle on a plate affixed thereto, such plate to be of the colour, size and shape and in such position as determined by the Council.

(b) The Proprietor shall not wilfully or negligently cause or suffer the Licence plates attached in pursuance of this Condition to be concealed from public view or to be so defaced that any figure or material particular is illegible.

(c) Subject to condition 2 (d) below, the operator/proprietor shall not attach or affix or cause to be attached or affixed to a vehicle any sign or mark other than required by condition 2(a) and ANY of the following, namely:-

i) A sign fitted to the roof of the vehicle, positioned in the centre of the roof of the vehicle, such sign measuring a minimum of 12.7cm (5in) in height and 30.5cm (12in) in width and a maximum of 17.8cm (7in), in height and 45.7cm (18in) in width, bearing the words indicating the operating company name or trading name. Additionally, below this name, the words “PRIVATE ONLY” shall be shown to the front and rear of the sign. The letters of the words and any numbers must be of a minimum height of 2.54cm (1in) and a maximum of 5.1cm (2in). Such sign shall be white, with black lettering, and shall not carry the words “TAXI(S)” or “CAB(S)” or any other word which in the opinion of the Council implies the vehicle is a hackney carriage. The sign referred to in this section may bear the telephone number of the operating company. The telephone number, if affixed to the sign, must be above the operating company name or trading name. The letters and numbers must be marked by means of adhesive insignia. The sign referred to in this section may be capable of illumination.

Any illumination of such sign shall be controlled by a switch independent of the vehicles other lighting systems, or controlled by the ignition system in a way which ensures that when the ignition is on the roof sign switches off. The sign shall only be illuminated when the vehicle is stationary at, or as near as practicable to a pre-arranged point of pick-up.

OR

ii) A display on or affixed within the upper panel of the rear nearside and rear offside passenger doors of the vehicle (and the wheelchair access doors on wheelchair accessible vehicles, if desired) not exceeding a size of 38.1cm (15 inches) in height and 61cm (24 inches) in width bearing words and figures indicating the trading name of the operator and in characters not less than 7.6cm (3 inches) in height, the words "BY PRIOR BOOKING ONLY" and with no reference to the words TAXI(S) or CAB(S) or any other word which in the opinion of the Council implies that the vehicle is a hackney carriage. The display referred to in this section may show a telephone number of the operator or other means of contacting the operator. Wheelchair accessible vehicles shall bear a reference to that facility in any such door display. OR

iii) Signs not exceeding 7cm 6mm (3 inches) in height displayed in the top sections of the windscreen and rear window bearing the trading name of the operator, provided that the signs shall not be so positioned or of such a length as to contravene the Road Traffic Acts or Regulations made thereunder and:-

- shall not carry the word TAXI(S) or CAB(S) or any other word which in the opinion of the Council implies that the vehicle is a hackney carriage and shall not illuminate in any way. The signs referred to in this section may show a telephone number of the operator or other means of contacting the operator.

(d) The Proprietor may attach, affix or cause to be attached or affixed to the vehicle, an advertisement or advertisements provided that before so doing the proprietor shall obtain the approval of the Council to each advertisement.”

3. A Proprietor shall ensure with regard to the vehicle to which his Licence relates:-

(a) that the vehicle is provided with sufficient means by which any person in the vehicle may communicate with the driver and that such means of communication is maintained;

(b) that the vehicle is maintained in a clean, comfortable, safe, watertight and mechanically sound condition;

(c) that the vehicle is provided with a suitable and efficient fire extinguisher carried in such a position as to be readily available for use;

(d) that the vehicle is provided with adequate means for securing luggage.

4. The Proprietor of a vehicle which is fitted with a taximeter shall ensure that such taximeter is constructed, attached and maintained as to comply with the following requirements:-

(a) the taximeter shall be so constructed that it is not possible for any person manually to alter the tariff rate without breaking the seals affixed thereto;

(b) the taximeter shall be fitted with a key, flag or other device, the operation of which will bring the machinery of the taximeter into action and cause the word 'hired' to appear on the face of the taximeter;

(c) such key, flag or other device shall be capable of being locked in such a position that the machinery of the taximeter is not in action and that no fare is recorded on the face of the taximeter;

(d) the word 'fare' shall be printed on the face of the taximeter in plain letters so as clearly to apply to the fare recorded thereon;

(e) the taximeter shall be so placed that when in use all letter and figures on the face thereof shall be at all times plainly visible to any person being conveyed in the vehicle and for that purpose the letters and figures shall when in use be suitably illuminated during any period of hiring and the switch for operating the light providing the said illumination shall be incorporated in and operated in conjunction with the key flag, or other device which brings the machinery of the taximeter into action and no other method of operating the said light shall be employed;

(f) the taximeter and all the fittings thereon shall be so affixed to the vehicle with seals or other appliances that it shall not be practicable for any person to tamper with them except by breaking, damaging or permanently displacing the seals or other appliances.

5. Where a taximeter is used to record the fare for hiring the Proprietor shall:-

(a) cause a table indicating the fare scale governing such hiring to be fixed upon the vehicle in such a position and manner that the letters and figures of such table are distinctly and plainly visible to any person being conveyed in such vehicle;

(b) not wilfully or negligently cause or suffer the table required by Condition 5(a) to be inverted or detached or altered or the letters or figures on such table to be in any manner or by any means concealed at any time.

6. The Proprietor shall ensure that every driver employed by him holds a Licence to Drive Private Hire Vehicle's and shall ensure that such driver is acquainted with, understands and observes the conditions attached to his Licence and the statutory provisions relating to such Licence.

7. The Proprietor shall at all times during the currency of the licence ensure a policy of insurance is held, for hire or reward and complying with the Road Traffic Acts and any amendments thereto.

8. The Proprietor shall not accept a booking for a vehicle to convey any greater number of persons than the number of persons which the vehicle is licensed to convey.

9. A Proprietor whose vehicle conveys the dead body of any person shall notify the Council's Licensing Section.

10. The Proprietor shall regularly search his vehicle for any property which may have been accidentally left therein.

11. The Proprietor shall, if any property accidentally left therein by any person who may have been conveyed in the vehicle be found by or handed to him:-

(a) carry it as soon as possible, and in any event within 48 hours, if not sooner claimed by or on behalf of its owner, to the Licensing Section of the Council and leave it in the custody of an Officer of that Section on his giving a receipt for it;

(b) be entitled to receive from any person to whom the property shall be re- delivered an amount equal to five pence in the pound of its estimated value (or the fare for the distance from the place of its finding to the Office of the Council, whichever be the greater) but not more than £5.00.

12. The Proprietor of a vehicle who displays in his vehicle during or at the commencement of hiring a table of fares shall not require for such hiring a fare greater than that authorised by the table of fares.

13. The Proprietor shall at the request of an authorised officer produce:

(a) his vehicle registration document

(b) a valid insurance document

at the offices of the Council’s Licensing Section within seven days of the request.

14. A Proprietor shall inform the Licensing Section in writing within 72 hours after changing his/her address.

15. The Proprietor shall ensure that when a Private Hire Vehicle Driver's Licence expires and such driver is, or until the expiry of the licence was, employed by him, and no application is made for renewal of the licence, the badge granted to the driver by the Council is returned to the Council's Licensing Section within fourteen days.

16. The Proprietor shall not while driving or in charge of the vehicle:-

(a) Tout, solicit on a road or other public place any person to hire or to be carried in any Private Hire Vehicle; or

(b) Cause or procure any other person to tout or solicit on a road or public place any person to hire or to be carried in any Private Hire Vehicle; or

(c) Offer the vehicle for immediate hire while the vehicle is on a road or other public place.

17. The Proprietor shall within seventy two hours disclose to the Council’s Licensing Section in writing details of any conviction or any offence(s). The Council will then decide whether the licence should be suspended or revoked, having regard to the offence(s).

18. No vehicle will be accepted for licensing by the Council as a hackney carriage or private hire vehicle unless it has been certified by either the Vehicle Certification Agency or the Vehicle and Operator Services Agency as meeting the requirements of:
