Another story is when the pandemic substitutes ‘a major crisis’ – then there may be a dual problem of analysing the present and forecasting the future. In one of his main interviews (if not the main one), which was supposed to be wrapping the difficult year up, Estonian Prime Minister Jüri Ratas was into memorable metaphors when it would come to pure politics, but distinctly shy when a question was on economics1. During 2020, in political terms, the country was getting involved into discussing way more intra- political scandals than it would have been necessary to test the ‘health’ of a democracy. As for the process of running the economy, apart from borrowing more to survive the pandemic, the only major economic reform that the current governmental coalition managed to ‘squeeze’ through the ‘hurdles’ of the Riigikogu’s passing and the presidential approval was the so-called second pillar pension reform. The idea of the Government was to respond to a particular societal call that was, in a way, ‘inspired’ by Pro Patria and some other proponents of the prospective reform.

  • Annual Report of the Chancello
    Dear reader, In accordance with section 4 of the Chancellor of Justice Act, the Chancellor has to submit an annual report of his activities to the Riigikogu. The present overview of the conformity of legislation of general application with the Constitution and the laws covers the period from 1 June until 31 December 2004, and the outline of activities concerning the protection of fundamental rights and freedoms of persons, the period from 1 January until 31 December 2004. The overview contains summaries of the main cases that were settled as well as generalisations of the legal problems and difficulties, together with proposals on how to improve the protection of fundamental rights and freedoms and how to raise the quality of law making. The readers will also be able to familiarise themselves with the organisation of work in the Office of the Chancellor of Justice. According to the Constitution, the Chancellor of Justice is an independent constitutional institution. Such a status enables him to assess problems objectively and to protect people effectively from arbitrary measures of the state authority. One tool for fulfilling this task is the opportunity that the Chancellor of Justice has to submit to the Riigikogu his conclusions and considerations regarding shortcomings in legislation, in order to contribute to strengthening the principles of democracy and the rule of law. I am grateful to the members of the Riigikogu and its committees, in particular the Constitutional Committee, the Legal Affairs Committee and the Social Affairs Committee, for having been open to mutual, trustful and effective cooperation, which will hopefully continue just as fruitfully in the future.

    Jaanika Erne LL.M., M.A. Contractual Consultant, European Union Electronic Information Service, European Documentation Centre, University of Tartu Estonia’s Integration into International Organisations — from the Viewpoint of Security The Republic of Estonia has been a full member state of the North Atlantic Treaty Organisation since 29 March 2004, Estonia is the full member state of the European Union since 1 May 2004. These developments are in testimony of a huge step towards a free, whole and peaceful Europe.*1 8or the acceding states, acces- sion to both these organisations means supranational integration in security issues, as has also meant the accession to other security organisations, such as the Western European Union (WEU), the Organisation for Security and Co-operation in Europe (OSCE) and the United Nations (UN). 8rom historical viewpoint as a small state that has been occupied many times security guarantees are essential to Estonia. The pursuit of independence, territorial integrity and cultural identity has accompanied the development of the Estonian nation. Although the author sees neither military nor political threats aim- ing to change Estonias internal or external policies today or in the near future, she is aware of and under- stands that the state must be ready to combat such threats as economic, social and environmental risks, international crime, and terrorism. Considering the previous, the purpose of this article is to estimate whether the accession of the Republic of Estonia to supranational organisations guarantees higher security in the region. Considering this purpose, the author has divided the article into three main sections. The first section gives an overview about the interrelationship of those security organisations in which Estonia participates.

Introduction, review of the early 1990s and comparison with the present day First of all, allow me to thank Konrad Adenauer Foundation for the organisation of this interesting roundtable and for the honourable invitation to speak about “Challenges of Estonian economy in the European Union”. Today’s event shows yet again how serious is the respected organisers’ interest towards the EU applicant countries. I personally appreciate highly your support to our reforms and convergence in the society and economy. From the outside it may seem that the transformation and convergence process in Estonia has been easy and smooth, but against this background there still exist numerous hidden problems. One should not forget that for two generations half of Europe was deprived of civil society, private ownership, market economy. This is truth and it has to be reckoned with. It is also clear that the reflections of the “shadows of the past” can still be observed. They are of different kind. If people want the state to ensure their well-being but are reluctant to take themselves any responsibility for their own future, it is the effect of the shadows of the past. If people are reluctant to pay taxes but demand social security and good roads, it is the shadow of the past. In brief, if people do not understand why elections are held and what is the state’s role, it is the shadow of the past.

Since the restoration of independence in 1991, Estonia's policies have consistently aimed at the restoration of economic, social, political and cultural ties with our western neighbours. We have sought to restore our place in the family of democratic European nations. Estonia's application to join the EU is underpinned by a number of motivating factors. Estonia shares the basic values and principles upon which the Union has been established and wishes to preserve and defend these values in co-operation with the Union.

Accordingly, the list of participants included many invitees from the acceding countries, and the programme was conceived also in order to encourage them to take the floor on an equal footing with invitees from the current member states. The former Estonian Foreign Minister Toomas Hendrik Ilves gave a much-appreciated keynote speech. I. Between stabilisation and integration The first session was expected to set the general framework for the discussion by stressing a) the evolution of the approach of the EC/EU to its (ever-changing) neighbourhood, whereby direct integration has gradually won the day as both a security policy “by other means” and a way to stabilise the immediate proximity of the Community/Union; and b) the varying and multi-faceted nature of the new neighbourhood(s) of the enlarged Union, which may or may not require more differentiated policies – differentiated by area and/or by country.
