Some of the information you have requested could be exempt under section 23(1) of the FOI(A), Which relates to the bodies dealing with security matters, although it is also possible that the information relates to none of the bodies dealing with security matters. Sections 23(1) and 24(1) are being cited in the alternative as it is not appropriate, in the circumstances of the case, to say which of the two exemptions is engaged so as not to undermine national security cr reveal the extent of any involvement, or not, of the bodies dealing with security matters. Section 23 is an absolute exemption and, if it were engaged in this material, the MOD would not be required to consider whether the public interest favours disclosure of this information.

Any information that is not exempt from disclosure under section 23(1) could be exempt under section 24(1) of the FOI(A), which exempts information from disclosure ti its exemption is required 'for the purpose of safeguarding national security. We cannot say which of the two exemptions is engaged, but to the extent that S24(1) might be engaged. We acknowledge the public interest in openness and transparency. but we conside► that there is a stronger public interest in protecting national security.

Some of the information located falls within the scope of the FOI(A), at its release would or would be likely to prejudice the capability, effectiveness or security of any relevant Section 26 (Defence) as its release would be likely to prejudice the capability, effectiveness or security of any relevant forces. Section 26 is a qualified exemption and we have conducted a public interest test to determine whether the information should be released or withheld. The factors for this public interest have determined that whilst disclosure would demonstrate openness and transparency this is outweighed by the detrimental effect disclosure would have in revealing the capabilities of military operational planning by compromis►ng the methodologies and practices employed in the gathering and analysis of information. I have therefore concluded that the public interest supports withholding some information under Section 26. All Police Service of Northern (PSNI) cases remain open and if new evidence comes forward the PSNI will reinvestigate. Release of these documents must be carefully considered under Section 31 (Law Enforcement) of the FOI(A). I have completed this consideration through a public interest test including consultation with the PSNI who have advised that release of some of the information could adversely impact on any investigative process, and may jeopardise any future prosecutorial process. On this basis, I am withholding some of the information under Section 31 of the FOI(A).

I appreciate that the incidents took place between 30 and 38 years ago and the passage of time can be a factor in diminishing the applicability of exemptions to information. However, in this instance the passage of time is less relevant as the PSNI continue to investigate Troubles-related murders and the overall balance is in favour of partial exemption.

In addition, some of the information falls within the scope of Section 38 (Health and Safety) of the FOI (A), as its release could endanger the physical or mental health of any individual, or endanger the safety of any individual. Consideration must also be given to the impact release of this information may bring to the wider community especially members of the Security Forces not just in but globally and the general public. To release some of the information contained within our disclosure would enable terrorists to make better devices or weapons resulting in more killings.

Section 38 is a qualified exemption and we have conducted a public interest test to determine whether the information should be released or withheld. The factors for this public interest have determined that Midst disclosure would demonstrate openness and transparency this is outweighed by the detrimental effect disclosure could have on those mentioned in the documents, on their family members and friends. I have concluded that whilst disclosure may be of historical interest, the health and safety of individuals must be taken into account especially where release would be likely to endanger, the physical or mental health of any individual. Some information has therefore been redacted under Section 38 of the FOI(A).

Some of the information contained within the disclosure constitutes personal information, such as names and addresses. Under FOIA 2000 this information is exempt under Section 40 (2) by reason of the first condition under Section 40 (3) (a) (i), as disclosure would contravene data protection principles under the Data Protection Act 1998 (DPA 98). This is an absolute exemption and does not require a public interest test to be conducted in order for this information to be exempt from disclosure. Therefore all, personal information has been redacted.

During the clearance of the building it was noted that there was a Kosengas cylinde in one of the back rooms. The caretaker could not account for it. It proved to be untampered and contained gas. From the damage to the building and the way the debris has fallen the seat of the explosion is believed to have been located inside and against the wall facing the war memorial. A witness stated that he heard a large crump as opposed to a sharp crack and saw a lot of dirty black smoke. It would appear from this that the explosion was caused by possible Home Made Explosive mit, and it is estimated that there was 10 to 20 Kgs. Dpmnge to the building was severe and there was a lot of glass damage in the immediate vicinity. There was no obvious structural damage to surroundin3 buildings. SERIOUS INCIDENT REPORT NO 49/83 SHOOTING ATTACK ON CHURCH CONGREGATION AT DARKLEY, CO ARMAGH SUN 20 NOV 83

1. At 1815 hrs on Sun 20 Nov 83 at least 2 terrorists opened fire on the congregation of the Elim Pentacostal Gospel Hall, Mountain Lodge, Barkley, Co Armagh. Three Church Elders standing in the doorway of the hall welcoming the congregation were shot dead at close range. The terrorists then fired indiscriminately at the congregation consisting of approximately 70 men, women and children inside the wooden building, and a further 7 people were seriously wounded, 4 of them women.

2. In an anonymous phone call to UTV this attack was claimed by a group calling r•• n

However in a recent interview with a Dublin based newspaper Dominic McGlinchey, the BO called leader of INLA, denied any involvement by his terrorist organisation, but he did admit supplying weapons to terrorists in the area of the attack. It is interesting to note that PIRA were quick to deny any responsibility for this attack, and at the same time PIRA took the opportunity to denounce in an almost unprecedented statement.

3. As a result of this attack the RUC requested additional troops for high profile operations to restore public confidence. Consequently S Coy Koo HLDRS was placed under opcon 2 UDR on Mon 21 Nov 83 for patrol operations in the area close to the border with the Republic of Ireland. Similarly C Coy 2 QUEENS, less one Pl, was placed under opcon 1 GREN GEO on Wed 23 Nov 83.

4. The current high level of patrolling in the border area continues, and a large operation was mounted jointly with the RUC to guard other isolated Protestant Churches in the area on the next Sunday after the attack at Darkley.

8. DETAILS OF INCIDENT

a. 20 N/K Nov 83 taxi was hired by a N/K number of men in Dundalk to take them to Castleblaney. Near Castleblaney the vehicle was hi-jacked and one man remained with the driver, whilst the remainder left in the veh. The veh was found burnt out at 202100 approx at Castlebellingham 6 miles South of Dundalk. RESTRICTED A - 2 RESTRICTED

b. 201815.1, Nov 83 2 x armed and masked men entered the door of the Elim Pentecostal Gospel Hall, Mountain Lodge, heady. 3 x male members of thechurch were in the entrance hall and the gunmen opened fire on these men. Two died instantly where they stood, and the third moved through the doors into the hall proper badly wounded and died in the hall. The gunmen continued to fire through the closed doors wounding seven of the congregation in the hall. There were approximately 60 - 70 persons present including about 25 children. As they left the location they sprayed the hall with fire.

BRIEF SUMMARY OF EVENTS

) LINKED INCIDENT: VEHICLE HIJACKING

1. On the 20 Nov about 1645hrc a taxi driver was sitting in his vehicle, a Ford Cortina at a taxi rank in Dundalk when he was approached by a male fare who requested to be taken to a public house on the Castleblaney Road, Dundalk. The taxi driver accepted the journey and drove out on to the Castleblaney Road when about 400 yards outside of Dundalk he was asked to stop at the nearby Bus Station and accept three more male fares. The taxi driver picked up the men and drove on to the original destination, the Public house. The taxi stopped at the public house and one of the men alighted from the vehicle and walked around the Public house. Upon returning the man stated that the car they wanted was not there and then asked the taxi driver to take them on to Castleblaney. The taxi driver agreed and drove off, as the taxi approached the Concession Road, at H29C one of the men told the taxi driver not to go up the Concession Road but to turn left and travel on the south side of the border. As the taxi approached the Castleblaney Road again at H53C a gun was put in the taxi drivers back and he was told to stop the taxi. He was then hooded and driven around for about 15 minutes and then held near a minor road on the south side of the border. After a short period the hood was removed and he was given directions to Castleblaney but told not to report the incident for four hours. The taxi driver obtained a lift to Dundalk and did not report the matter. 2. The taxi was later recovered at Castlebellingham, six miles south of Dundalk followin a shooting attack at a Gospel. Hall near Darkley, heady. The vehicle had been burnt out.

1 On th at 1619hrs RUC Armagh received a telephone call from a Will Kead t a a shooting had occurred at the Mountain Lodge Gospel Hall, where On investigation it was ascertained that a number of civilians had received fatal injuries in the attack.

2. At about 1815hrs four armed and masked men approached the entrance hall of the Pentacostal Gospel Hall, Mountain Lodge, near Eeedy. As at least two of the gunmen entered the entrance hall they fired at point blank range at three male elders of the Church who were acting as ushers to those members of the congregation arriving late. Two elders Victor CUNNINGHAM and Harold BROWN died instantly where they stood, the third elder David WILSON although fatally injured moved through the entrance hall and ran into the Church proper, he then stumbled to the rear of the Church and died outside,adjacent to the rear steps of the Church. The gunmen then discharged a number of shots through the closed doors of the hall into the interior of the Church wounding seven of the congregation inside the Church. The gunmen then left the entrance hall and once outside they fired into the outer wooden walls of the gospel hall. They then escaped in a vehicle in the direction of the Eire border.

3. All relevant agencies were tasked to the scene. All the injured and deceased were conveyed to Craigavon Area Hospital. Following a Fost Mortem examination that night the deceased were confirmed as having sustained the following injuries:

4. Close examination of the scene by SOCC/WIS/NIFSL resulted in the following items of forensic interest being recovered for onward transmission to DRC:

(e) x 5. Harold BROWN. CUNNINGHAM. Eleven entrance strike marks were evident on the outside front of the Gospel Hall and twelve entrance strike marks were evident on the inside of the entrance hall.

6. At 2100hrs Dundalk Garda received a report that there was a car on fire at Castlebellingham, six miles south of Dundalk. A patrol was tasked to the scene and they discovered a Blue Ford Cortina burning. As a result of Garda enquiries the full story of the burnt out Cortina emerged and it was established that this Cortina was the same vehicle which had been hijacked at 1645hrs earlier that night in the Dundalk area. INVESTIGATORS COMMENTS

1. The attack at Mountain Lodge Gospel Hall is reminiscent of the sectarian group assassinations of the mid 1970's. Although this incident has set a precedent inasmuch as this is the first time Republican terrorists have actually entered a place of worship and indiscriminately shot at members of a congregation.

2. Eyewitness accounts of the attack reveal that four men were involved in the execution phase of the attack. It is known that the gunmen approached the entrance hall of the Church and then whilst standing in the porch of the entrance hall the gunmen discharged a number of shots at point blank range at the three male elders acting ae ushers to members of the congregation entering the Church. Two of the deceased elders CUNNINGHAM and BROWN died where they stood at the entrance hall. The third elder WILSON ran into the Church proper,fatally wounded; at that stage at least two gunmen stepped into the entrance hall and discharged a number of rounds into the closed wooden doors of the hall wounding seven of the congregation within the Church. The gunmen then stepped out of the entrance hall and stood on the concrete path by the Gospel Hall fence and fired shots into the wooden panelled sides of the Gospel Hall. It is then thought that the gunmen escaped in their hijacked Blue Ford Cortina in the direction of K4 and thence into the Irish Republic.

3. Examination of the recovered cases and heads has determined that the weapons used were as follows: (a)

5. The choice of the Fountain Lodge Gospel Hall is an interesting one and an ideal choice from a terrorist point of view. The Hall is isolated and located in a deeply Republican area and targetting the Hall would have been an easy matter. Until the killings et Fountain Lodge such attacks were thought to be things of the past and therefore noone would have paid any attention to security precautions. It is felt that the targetting could have been easily carried out, with rugged countryside lending itself to any means of observation. Because of its location few people outside the immediate locals would have known any of the relevant information regarding the hall and its congregation and it is therefore thought that the initial targetting information robably came from nearby Darkley.

Dundalk 7. In conclusion this was a well planned and executed attack although it could hardly have been otherwise against such a defenceless and easy target. Despite the fears of many Protestants these types of attack are infrequent and unlikely to occur within a short period of time. This sectarian shooting was callous and indiscriminate and indefensible even by INLA standards but if their motive was to increase sectarian tension in the Armagh area, they have certainly succeeded.
