Brunner, et al.: [Proposed] Consent Decree - 1 - Dockets.Justia.com 1 The Court, having read and considered the Joint Stipulation for Entry of 2 Consent Decree and Permanent Injunction that has been executed by Plaintiffs Warner 3 Bros. Entertainment Inc. and Twentieth Century Fox Film Corporation (collectively 4 “Plaintiffs”) and Defendants Jeremy Brunner, an individual and d/b/a 5 www.nostalgiafamilyvideo.com, and Nostalgia Family Video, Inc. (collectively 6 “Defendants”), in this action, and good cause appearing therefore, hereby: 7 ORDERS that based on the Parties’ stipulation and only as to Defendants, their 8 successors, heirs, and assignees, this Injunction shall be and is hereby entered in the 9 within action as follows: 10 1) This Court has jurisdiction over the parties to this action and over the subject 11 matter hereof pursuant to 17 U.S.C. § 101 et seq., and 28 U.S.C. §§ 1331 and 1338. 12 Service of process was properly made against Defendants. 13 2) Plaintiffs own or control the copyright or pertinent exclusive right to distribute 14 or license the distribution of home video and digital products, including video home 15 cassettes (VHS) as well as optical discs, including, but not limited to, video compact 16 discs (VCDs), digital versatile discs (DVDs) and Blu-ray discs (collectively “Media 17 Products”) incorporating the motion picture or television titles subject to the copyright 18 registrations listed in Exhibit “A” attached hereto and incorporated herein by this 19 reference (collectively referred to herein as the “Plaintiffs’ Works”). 20 3) Plaintiffs have alleged that Defendants have made unauthorized uses of 21 Plaintiffs’ Works or substantially similar likenesses or colorable imitations thereof. 22 4) Defendants and their agents, servants, employees, representatives, successor and 23 assigns, and all persons, firms, corporations or other entities in active concert or 24 participation with him who receive actual notice of the Injunction are hereby 25 restrained and permanently enjoined from infringing – directly, contributorily or 26 vicariously – or enabling, facilitating, permitting, assisting, soliciting, encouraging, 27 inducing, authorizing, aiding or abetting, materially contributing to, or persuading 28 Warner Bros., et al. v. Brunner, et al.: [Proposed] Consent Decree - 2 - 1 anyone to infringe in any manner Plaintiffs’ Works, including, but not limited to, the 2 following: 3 a) Copying, reproducing, downloading, distributing, uploading, linking to, 4 transmitting, or publicly performing, or using trademarks, trade names or 5 logos in connection with unauthorized Media Products containing any of 6 Plaintiffs’ Works; 7 b) Enabling, facilitating, permitting, assisting, soliciting, encouraging, 8 abetting, or inducing any person or entity to copy, reproduce, download, 9 distribute, upload, link to, transmit, or publicly perform any of Plaintiffs’ 10 Works; or 11 c) Profiting from the unauthorized copying, reproduction, downloading, 12 distribution, uploading, linking to, transmission, or public performance of 13 any of Plaintiffs’ Works while declining to exercise a right to stop or limit 14 such unauthorized copying, reproduction, downloading, distribution, 15 uploading, linking to, transmission, or public performance of any of 16 Plaintiffs’ Works. 17 5) Each side shall bear its own fees and costs of suit. 18 6) Except as provided herein, all claims alleged in the Complaint are dismissed 19 with prejudice. 20 7) This Injunction shall be deemed to have been served upon Defendants at the 21 time of its execution by the Court. 22 8) The Court finds there is no just reason for delay in entering this Injunction and, 23 pursuant to Rule 54(a) of the Federal Rules of Civil Procedure, the Court directs 24 immediate entry of this Injunction against Defendants. 25 9) The Court shall retain jurisdiction of this action to entertain such further 26 proceedings and to enter such further orders as may be necessary or appropriate to 27 implement and enforce the provisions of this Injunction. 28 Warner Bros., et al. v. Brunner, et al.: [Proposed] Consent Decree - 3 - 1 10) The above-captioned action, shall, upon filing by Plaintiffs of the Settlement 2 Agreement, Stipulation for Entry of Judgment and Judgment Pursuant to Stipulation, 3 and requesting entry of judgment against Defendants, be reopened should Defendants 4 default under the terms of the Settlement Agreement. 5 11) This Court shall retain jurisdiction over Defendants for the purpose of making 6 further orders necessary or proper for the construction or modification of this consent 7 decree and judgment; the enforcement hereof; the punishment of any violations 8 hereof; and for the possible entry of a further Judgment Pursuant to Stipulation in this 9 action. 10 DATED: May 02, 2012 11 ________________________________ 12 Hon.     TRANSPOSICIÓN CON GÉNERO: EL CASO DE EL INQUILINO (BELLOC – HITCHCOCK) GENDER TRANSPOSITION: THE CASE OF THE LODGER (BELLOC - HITCHCOCK) Raquel Gutiérrez Estupiñán Universidad Autónoma de Puebla (México) RESUMEN Este trabajo se propone abordar la transposición de la novela de Marie Belloc Lowndes titulada El inquilino (1913) al filme homónimo realizado por Alfred Hitchcock (1926), desde una perspectiva de género. Hasta ahora, muchos estudios se han centrado en cuestiones relacionadas con el paso de una novela a la pantalla, pero rara vez se han abordado las implicaciones genéricas. En este trabajo me centraré en poner de relieve cómo se retoman los personajes femeninos de la novela (escrita por una mujer) en la película (realizada por un hombre). A partir de lo anterior aportaré elementos para dilucidar si algunos de los rasgos localizados en El inquilino persisten en películas posteriores de Hitchcock en cuanto al tratamiento de la figura femenina. Palabras clave: Género – transposición / adaptación – cine – literatura ABSTRACT The aim of this article is to examine the adaptation of Marie Belloc’s novel The Lodger (1913) into the film by Alfred Hitchcock (1926) from a gender perspective. Hayes 2009 PREFACE When the University of Wyoming began collecting the papers of national entertainment figures in the 1970s, it was one of only a handful of repositories actively engaged in the field. Business and industry, science, family history, even print literature were all recognized as legitimate fields of study while prejudice remained against mere entertainment as a source of scholarship. There are two arguments to be made against this narrow vision. In the first place, entertainment is very much an industry. It employs thousands. It requires vast capital expenditure, and it lives or dies on profit. In the second place, popular culture is more universal than any other field. Each individual’s experience is unique, but one common thread running throughout humanity is the desire to be taken out of ourselves, to share with our neighbors some story of humor or adventure. This is the basis for entertainment. The Entertainment Industry collections at the American Heritage Center focus on the twentieth century. During the twentieth century, entertainment in the United States changed radically due to advances in communications technology. The development of radio made it possible for the first time for people on both coasts to listen to a performance simultaneously. The delivery of entertainment thus became immensely cheaper and, at the same time, the fame of individual performers grew.
