The terms on which land is held, used, and transferred have important con- sequences for economic growth, the distribution of wealth, and alleviation of poverty. We live in an age of profound and often rapid transitions in the economies and societies of nations. It is notable that in those transitional economies that are moving to rely more heavily on market forces, land law reform is commonly near the top of the national reform agenda. Difficult policy choices are required because land tenure serves a multitude of purposes. Land is valued by some as an investment opportunity, by others as a safety net, and by yet others as critical to their cultural identity. Accordingly, land law reform is increasingly becoming a pressing need in many parts of the world. Many developing countries seek to move beyond the laws inherited from their colonial past or to update their land law in key areas like condominium law or the law relating to mortgages. Others grapple with the socially complex issue of the future of customary land tenure and the traditional institutions associated with it. This book examines issues at the forefront of the debate on land law reform, pays particular attention to how reform options affect the poor and disadvantaged, and recommends strategies for alleviating poverty more effectively through land law reform. It reviews the role of the World Bank in land law reform, examining issues of process as well as substance. It also identifies key challenges and direc- tions, and stresses the need to design law reforms in ways that suit diverse eco- nomic, legal, and institutional environments. The Legal Vice Presidency is pleased to offer this publication and hopes it will deepen the understanding of the role of land law reform in poverty alleviation, gender equity, and environmental protection.

    LEASES AND THE RULE AGAINST PERPETUITIES EDWIN H. ABBOT, JUNIOR of the Boston Bar INTRODUCTION The purpose of this article is to consider the application of the rule against perpetuities to leases. A leasehold estate has certain peculiari- ties which distinguish it, as a practical matter, from other estates in land. At common law it required no livery of seisin, and so could be created to begin in futuro. Although it is not an estate of freehold the duration of the estate may be practically unlimited-it may be for 999 years or even in perpetuity. The reversion after an estate for years is necessarily vested, no matter how long the term of the lease may be, yet the leasehold estate is generally terminable at an earlier time upon numerous conditions subsequent, defined in the lease. In other words the leasehold estate determines without condition by the effluxion of the term defined in the lease but such termination may be hastened by the happening of one or more conditions. The application of the rule against perpetuities to such an estate presents special problems. The purpose of this article is to consider the application of the rule to the creation, termination and renewal of leases; and also its effect upon options inserted in leases. II CREATION A leasehold estate may be created to begin in futuro, since livery of seisin was not at common law required for its creation. Unless limited by the rule a contingent lease might be granted to begin a thousand years hence. But the creation of a contingent estate for years to begin a thousand years hence is for practical reasons just as objectionable as the limitation of a contingent fee to begin at such a remote period by means of springing or shifting uses, or by the device of an execu- tory devise.

Within the South African context, the Auditor-General of South Africa recently reported that only a few municipalities obtained clean audit reports. In fact, the drive towards clean municipal audit outcomes initiated by the South African government in 2009 evidently failed. Subsequently, this study set out to obtain a deepened understanding of why municipalities repeatedly fail to achieve clean audit outcomes. For this purpose, the Amathole District Municipality and its constituted local municipalities were selected as a case for this study. The reviewed material consisted of a rich collection of audit reports, annual reports, regulatory documents, and a wide variety of other official documents. In addition, the findings of a survey amongst municipal officials and councillors also informed this study. As a result, enduring and deep-rooted systemic leadership deficiencies, financial and performance management restraints, and ineffective and inefficient governance structures were revealed.

    Results from the questionnaire: analysis of needs and preferred methods of co-operation Following the demand-driven approach and in order to better assess the needs of the regional and local level, a questionnaire was sent in April 2012. The main findings were: 103 replies from 26 different countries were received in response to the questionnaire. Among the respondents there were several capital cites (for instance Berlin, Budapest, Lisbon, Belgrade, Vilnius, Tirana) as well as many other big cities. INTRODUCTION Modern water allocation decisions inevitably involve difficult choices among competing consumptive and natural uses that are highly valued by diverse but equally passionate sectors of the community.2 Particularly in an island state like Hawai‘i, with its limited sources of fresh water, fragile environment, and unique economic challenges, debates over re-allocation of precious water resources and the merits of stream restoration are likely to become only more intense as human needs for 1 Assistant Professor of Law at the William S.
