ISIL gained prominence, when in early 2014 it drove Iraqi government forces out of key cities in its Western Iraq offensive, followed by the capture of Mosul and the Sinjar massacre, almost causing a collapse of the Iraqi government and prompting a renewal of US military action in Iraq. In Syria, the group has conducted ground attacks on both government forces and rebel factions. The number of fighters the group commands in Iraq and Syria was estimated by the CIA at 31,000, with foreign fighters accounting for around two thirds, while ISIL leaders claim 40,000 fighters, with the majority being Iraqi and Syrian nationals.

Yazidi Australian Association represents the needs and issues of the newly arrived Yazidi community members in Australia. We are one of the most recently arrived small and emerging refugee communities in Australia. Majority of our community members have settled in rural and regional Australia including Coffs Harbour, Wagga Wagga, Armidale and Toowoomba with a smaller cohort settling in Western Sydney. Below is a brief outline of the persecution faced by Yazidi community members. Further cultural information can be provided upon request. The Yazidi (or Ezidi) are a people who originate from Iraq, Syria and Turkey. The population is estimated to be between 800, 000 and 1000, 0001 globally, although their population is difficult to estimate considering their dwindling numbers over the last century due to constant persecution. The Yazidis are located primarily in the Nineveh province of northern Iraq, and in the Al-Jazira and Kurd- Dagh areas of Syria. The sacred valley of Lalish is the centre of pilgrimage for Yazidis. Some also live in Armenia and Georgia and many have migrated to parts of Europe. Sweden has had a significant Yazidi population since 20082 and Germany since the 1970s3 Yazidis almost all speak Kurmanji, with the exception of some villages in northern Iraq where Arabic is spoken.

The thesis compares evidence of the incidences and atrocities of ISIS with provisions of the UN Genocide Convention and other international treaties to find out whether Yezidis belong to a protected group under international law and whether these crimes could be legally named as genocide, crimes against humanity or war crimes. Secondly, the study highlights the international reactions and symbolic political recognition of Yezidi genocide worldwide and explains the obligations of those states who recognized the genocide by taking three examples of the USA, UK and European Union to examine what they did post-recognition and whether their measures promoted the initiation of a legal entity to punish the crimes of ISIS. Finally, this thesis analysis the perspectives and challenges of establishing a national or international tribunal for the crimes of ISIS, by highlighting the obstacles and possibilities for three roads towards bringing justice: referring the case to ICC; establishment of an Ad hoc/Hybrid tribunal; or the activation of an Iraqi national jurisdiction for international crimes. On the basis that facts are given about the current legal situation and appropriate ideas are recommended to reform Iraqi law in order to fulfil the contemporary standards of ICL and comply with the principles of international human rights.

Predominantly located in Northern Iraq, Yazidis are ethnically Kurdish and speak Kurmanji (northern Iraqi Kurdish). Before the 2014 Islamic State’s (ISIS) incursion in the Nineveh province, the Yazidi community of Iraq numbered around 1 600,000. Yazidi leaders estimate that there are now about 400,000 – 500,000 Yazidi still residing in Iraq, 2 primarily in the north and approximately 360,000 remain displaced. The origins of the Yazidi religion is believed to date back to the 11th century, though some trace their origins 3 ​ to the ancient Sumerian period. Their religious beliefs are syncretic and share many elements with Zoroastrianism while observing many Abrahamic customs, such as baptism, circumcision, and not eating 4 pork. Yazidis are endogamous, rarely intermarry with other Kurds, and conversion to the Yazidi religion is 5 prohibited. 6 Under Article 2 of the Iraqi Constitution, Yazidis are guaranteed freedom of religious belief and practice. This gives the religion legal recognition in Iraq allowing it to appoint legal representatives and perform legal 7 transactions as well as give adherents of the faith access to their own personal status courts.

Her new-born baby died of malnutrition and her daughter went missing. Nadya told her story under IS captivity to ANF news. IS invaded huge territory in Iraq including Sinjar in August 2014. In the following days, IS militants perpetrated the Sinjar massacre, killing 2,000 Yazidi men and taking Yazidi women into slavery, leading to a mass exodus of Yazidi residents. According to a UN report, 5,000 Yazidi civilians were killed during IS' August offensive. Nadya was kidnapped by IS members in a village near Sinjar in August 2014 when IS first killed her mother and father in front of her eyes and took her to Tal Afar and then to Mosul. She gave birth to her baby during this journey. About 40 days after her abduction, Nadya was taken to Raqqa and sold to a Saudi IS member as a slave. She was forced to work for about two months in severely bad conditions where her new-born son died of malnutrition. “My son was crying all the time. I couldn’t give him food or milk. On 3 August 2014, the Islamic State of Iraq and the Levant (ISIL)—who considered the Yazidis to be heretics—launched a sustained attack on the Sinjar region as part of their larger campaign to capture territory in Iraq and impose their extremist ideology. Reports soon emerged of atrocities being committed against the Yazidis: men were tortured, killed or forced to convert to Islam; women and girls were sold at slave markets and held in sexual Two Yazidi Men living in Bersive IDP Camp (2019) captivity by ISIL fighters; and young boys were [Photo Credit: OCHA] forcibly taken from their families and pushed into service as child soldiers.2 Thousands died, thousands more remain missing, and hundreds of thousands of Yazidis were displaced, many living in camps in Duhok governorate in the Kurdistan Region of Iraq. Although Iraqi and Coalition forces re-established control over Sinjar in 2017, and military operations against ISIL ended in December of that year, Yazidis have faced innumerable obstacles in trying to rebuild their lives, including widespread destruction of infrastructure.
