Dear Delegates,
We inform you by this separate letter that the EGP Committee proceeds with the proposal to the Copenhagen Council to withdraw the membership of the ‘Confederación de los Verdes de Espana’.
We have sent you a separate mailing on the issue to avoid all confusion or running the risk that the issue will not be picked up from the mails with general information to the EGP Delegates. We know this is a delicate and sensitive issue and that is why we want you to be fully aware of all the facts.
You have received in November 2011 and in February 2012 a full dossier (annex) stating the European Green Party repeatedly received information that the Confederación has not been functioning properly.
Procedure at the Council We have scheduled a closed session in the Copenhagen programme, on Saturday from 9h00 to 10h00, for Delegates only, to discuss and give you the opportunity for questions and answers. Naturally we will give the representatives of the Confederación the floor as well to enable them to express their view on the matter. We bring the membership issue to the vote on Sunday morning at the beginning of the voting session, where we will proceed as in a normal voting session and give the floor to one speaker pro and one speaker contra before proceeding towards the vote.
More information The Committee received, among others, complaints on the Confederación regarding the following points: no respect for their statutes and internal democratic rules, lack of clarity as regards the leadership, lack of transparency and doubts regarding the existence of the legal seat of the party. The Confederación has not been able to abide by their own statutory requirements for years, nor adhered to internal democratic procedures, and the EGP has received complaints on this from several of the member parties of the Confederación. In October 2011 the European Green Party received notice that 13 out of the 16 of the confederated parties and local groups of the Confederación have now adhered to EQUO, and those parties and groups do not consider the Confederación as an existing party.

Since the dossier sent in February, we received a letter from the Confederación de Los Verdes, which you can find in annex. In this letter, the Confederación repeats most of the arguments we already went through in previous correspondence and confirmed to us what we consider the most important point of this procedure, meaning the fact that the Confederación is not a working structure and that its membership is not clear. The definition of who is a member and who is not and the disputes around statutes, fees and lists have been going on for years, as you can see in the letters and exchanges of mails in the dossier.
On the other hand, it is a fact that the process of reunification of the Green groups and parties is continuing in Spain and that the Congress of EQUO will take place on July the 6th 2012.
The Committee is aware that withdrawal of membership is a serious issue and that some of you might want extra information. We would greatly appreciate it if you would contact us should you need more information and/or contact us with any questions that you might have.

Yours sincerely, Monica Frassoni and Philippe Lamberts Co-Chairs of the European Green Party From: Los Verdes de Asturias To the attention of the European Green Party / European Greens: As members of the Confederation de Los Verdes (Spain), after a long process of internal complaints and organizational difficulties, lack of accountability, as well as lack of clarity about roles and responsibilities, we strongly feel we must spell out clearly to the EGP the organizational situation in Spain. The need for a caretaker has already arisen in 2008. So much so that we had to organize a working structure from scratch for the continued existence of political ecology in Spain, trying to overcome with a bottom-up approach the blockage imposed by its leaders. Thanks to the Coordinadora Verde, two summer schools have been organized, we have a modest presence at the national level, and far more importantly, we have put in touch the grassroots in all regions. Furthermore we maintain a close relationship with ICV, Green Party of Catalunya who demonstrates the electoral strength of the Confederacion in that particular region. We reiterated our complaints, requests for information (to which we are entitled) and challenges of organic processes to all available addresses by fax. The official party headquarter's address is unknown, the allocation of responsibilities within the Confederation is unclear, the parties registered by the Ministry of Interior are not in line with those claiming to hold responsibilities within the organization. Moreover we seriously question the legality of the proceeding for several years by the Confederation, marginalizing various parties adhered to the Confederacion and some others who have applied have been ignored or treated at times in a contradictory manner, some admitted all of a sudden and denied their membership rights afterwards. As evidence of our various attempts for communications please find attached to the various official fax messages to the given residences, all without success, except for one case (fax.no. 9151354) in the premises where their meetings were hold, our fax was received but we had no response at all. At the Congress of the Confederation of 16 January 2009 in Torrevieja a document was circulated pointing out the collapse of organizational structure and on the other hand proposing to resolve this matter in a collective way. In this letter we express our determination to continue rebuilding the green electoral project and find a way out of marginalization. At the same time, we regret the approach of the organizing secretariat inviting the Hondarribia initiative to the Congress of the Coordinadora. Considering that: 1. The collapse of the Confederacion, in our view, is due to a lack of respect for the statutes and internal democratic rules of Los Verdes, adding to that the poor management of organizational resources. We are critical about the lack of financial transparency of the Confederation, the blockage of political activity, and the suppression of the right to vote within the European Green Party. 2. There is a clear lack of internal democracy in the confederation inasmuch as: • There is unclarity about the actual membership of each member party and some of them are oversized without justification, which prevents proper representation of the various parties and a healthy democratic process. • The last Congress was held in June 2004, meaning that the Congress in 2010 was beyond the statutory limit (section 29, "shall meet on a routine basis every four years"). • The convening of extra-statutory meetings e.g. Meeting of the Spokespeople in Valencia on September 20, 2008 or arbitrarily, as the meeting of December 19, 2009 in Barcelona. • The lack of official records for the last General Council of Valencia in July 2009. Given the absence of most parties, they also ignored the quorum in order to officially take place and take any binding decisions. • The unacceptable marginalization of a consolidated and reliable green party the Greens of Aragon, whose repeated requests for admission were answered first by accepting their vote on the Executive Committee and then explicitly prohibiting them from attending any meeting. • In general, we regret that the Secretary of the Confederation treats member parties differently according to their attitude towards the leadership. Using administrative hindrances and filtering and hiding information to parties deemed not faithful enough. 3. We also condemn a lack of transparency in economic affairs: they have not communicated the organization's financial statements for the years 2008 and 2009. Still missing half the balance of 2005, and for 2006-2007 they provided totally insufficient balances. On the agenda of the Congress of January 16, 2010 there was no time allocated to financial reporting. 4. This same lack of transparency is equally present with membership fees, which in turn affects voting powers and rights, making the the organization inoperable and further blocking its activities. For example, the Greens of Asturias sent lists of their members and fees due in 2008 to the Confederation. - asking for an indication about their membership fee (unknown), - indicates to which bank account they can make the payment(unknown) - asking for receipts for previous payments before making new payments. To date, there has been no response whatsoever. 5. With the above, is in contravention article 8) on obligations of members and 7 c) and f) on rights, including non-implementation of the statutes. 6. Poor management of resources the organization has lead to the suppression of votes in the Council Meetings of the European Green Party (Paris, October 2008) and accumulated a debt amounting to 20,000 euros for the years 2006, 2007, 2008 and 2009 (fees claimed by the European Green Party's Treasurer in different letters). Neither have they repaid EUR 1,500 to Florent Marcellesi for his travels as International Secretary (debt recognized in the minutes of January 13, 2008) nor the debt of EUR 3,000 claimed by ICV. 7. The actual composition of the Executive Committee is not known. Neither is it officially knows who the members legally constituting the Confederation. The latest update on the Register of Political Parties was in 2006. In this latest update (see attached), for example, Els Verds-Opció Verda do not appear as member party, which poses a problem inasmuch as both the Spokesman and the current organizational Secretary are coming from a party that is not legally member of the Confederacion. 8. Since 2006, the Commission on Member Party Rights is not operations. We did not received any acknowledgment nor answers to the various objections submitted in 2009. 9. No one knows the legal seat of the Confederation. All correspondences mailed (to the registered addressed, which is contained in the statutes, as well as in the register of the Ministry ofInterior ) were returned (copy attached). 10. We find it lamentable the way in which the Confederacion broke for obscure reasons (and without minutes available) the relationship with Los Jovenes Verdes, full member of the Federation of Young European Greens, and one of the most active and dynamic group. 11. In general, we regret that any organization or movement within the green spectrum outside the direct control of the leaders of the Confederation immediately fall in the category "not green" and "traitor to the cause." In any case, this narrow vision and uncompromising attitude by a minority of the Los Verdes cannot support the growth of the green family and the advancement of the principles of ecology. We propose that: For all the above reasons and because of the serious disrespect for the statutes of Los Verdes, for the lack of legitimacy of representation and that of the decision-making process, and because of the marginalization of the Confederation of the Greens: · The will to unify all currents of the political ecology movement in the Spanish State in a single actor with a single project, surpassing the current state of division and fragmentation. · The Confederation should start its own process of reestablishment based on the principles of internal democracy and transparency. For example, to avoid subjectivity and the use of unverifiable data. The representation of the parties should depend on the election results and the public offices held. This process of reestablishment should be done under the aegis of the European Green Party. · This will open the process of unification and should result in the structural convergence with the other actors of the greens and environmentalist of the country. In other words, the Confederation should co-operate and welcome the unification of the green movement or otherwise should not hinder the attempt to unify it. · Ensuring no electoral competition and close cooperation with other member parties in the European Green Party, in this case with ICV. · An Executive Committee should be elected, whose sole purpose is the organization and orderly management of this process of recasting and convergence. All this is made known to the European Green Party for their information and appropriate action. It is accompanied by various supporting documents (scanned), and there is much more if necessary from several members. The penultimate blunder of the Confederation was the convening of two party councils on the same day in two different cities, the call made by different members of the confederation. This duplicity we make the following response: To the parties of the Confederation, We are concerned about the fact that two assemblies are held simultaneously by members of the Confederation. These calls induce many doubts about the legality thereof, in terms of content and the conveners who make them. Undoubtedly, the consequences will be severe of such simultaneous councils, and will imply the end of the Confederation. Nor have doubts about our non-participation which we consider against the statues. We decided to say no to the arbitrary exclusion of parties from the Confederation and to say no to the constant breach of the statutes. We therefore believe that these calls for a council meetings should be discontinued and instead hold a single meeting in Madrid (for reasons of geographical centrality) in order to address the future issues of the Confederation and the corresponding preparations of the assembly to be held afterwards. In summary, we urge the convening organizations and individuals that: - Without guarantee of legitimacy of your convocations, call them both off, because, if sustained, it will be a direct way to the courts, and it may effect negatively any political progress that we have made recently. - We call for an assembly for due processes and with presence of EGP, with the only point in the agenda being creating a management, based on consensus, whose objectives are the re-foundation of the party, implementation of the EGP roadmap, and approach to the rest the green actors, starting with the Coordinadora. - We propose to all of our member parties to meet this Saturday 12 June in Madrid to advance this agenda by consensus and set the date and ratify the forthcoming assembly, following democratic rules, based on transparency, and in the presence of the European Green Party . According to our statutes we have the obligation to inform you three months ahead of the Council meeting, therefore we inform you now in order to fulfil the Statutory requirement should this become unavoidable. As you will read below we are still trying to reach another solution. Why? The reason for the proposal to suspend the membership of the Confederacion de los Verdes is threefold: 1. In spite of the current reunification process, the Confederacion has participated in regional elections in direct electoral competition with one of our Member Parties (ICV). Moreover people who claim to be representatives of the Confederacion have made a coalition pact with the United Left Party (Izquierda Unida) and thereby blurred the Green brand name, confused the voters and hampered the reunification process that the EGP strongly supports within Spain. We find it not acceptable that two member parties of the EGP compete against each other in the same elections and we deem the Confederacion to be in breach of the terms of their membership by this act. 2. We were repeatedly informed by parties members of the Confederacion de Los Verdes that there are substantial shortcomings in the functioning of the Confederations de Los Verdes. It is not clear to us who are the member parties of the Confederation. In the course of the last 1 ! year we could directly see that the Confederation structures were not working properly and that it did not represent the whole green reality in Spain. This process is run by a working Committee which was set up June 4, 2010 and which unites most Green partners in Spain under the auspices of the foundation EQUO: the idea being to prepare the establishment of a national Green Party ready to participate to the elections in 2012. (In the mean time the national elections have been set for November 2011.) Most Spanish local and regional parties and the Coordinadora Verde support and are involved in this process. The Committee considers that over the last year the process has been severely hindered by some individuals bearing the stamp of the Confederacion but has come to the conclusion that they do not have legal and democratic base to do represent the Greens in Spain. Process Currently the Committee is working to reach a solution for the situation which would allow the current Confederacion to be included in the new party being set up, thus allowing the party EQUO to simply succeed in membership of the old Confederacion. A decision made by the Working Group on the 4th of June 2011 was to merge with EQUO and to call for a council of the Confederacion to dissolve the Confederacion. This should take place in the Constituent Assembly of EQUO due to take place in fall possibly before the Congress in Paris. It might be so that, due to unclear Statutes of the Confederacion this is not possible. Only if the natural dissolution of the Confederacion into EQUO fails the Committee will put to the vote of the Congress in Paris its proposal to suspend the membership of the confederation from the EGP. A few days later, you also received a letter from the address of Joan Oms and Pura Peris. We consider that some issues mentioned in that letter deserve an answer from our side, even if it is not our intention to start an endless chain of mails, letters, and denunciations on the Spanish situation, as it was the case in the last 20 years. For the very first time, there is a genuine attempt to join Green forces in Spain, with the enthusiastic participation of most active greens all over the country. It is our duty as Committee and as EGP to concentrate on this reality and to support it. In this context, we want to stress that we took the reasoned decision to initiate the long suspension procedure after several discussions, where all relevant aspects were given consideration. Starting the procedure will give the EGP the option to take a decision in our November meeting in Paris, should no agreement be found by then. However, we may still avoid using the option, as the current holders of Confederación leadership posts can still decide to participate in the on-going reunification process. But after one year and four months of periodical attempts of dialogue, contacts, mails and letters, phone conversations and on one occasion even a trip to Valencia, we have to accept the fact that it was not possible for the EGP to get an acceptable answer from the President, the organisation secretary and the international secretary of the Confederation, not only on their personal stand on the reunification process going on in Spain, but also on the need to call on the statutory bodies of the organisation to actually discuss and decide on it. Every time we questioned the formal position of the Confederación on the process and on the convocation of formal bodies of the Confederación, there was either no answer or convoluted arguments about who is a part of the Confederación and who is not. Furthermore, we noticed that since one year and four months, most of the European Green Party, aisbl - 31, Rue Wiertz, B-1050 Brussels, Belgium, Ph: 32 2 626 07 20 Fax: 32 2 626 07 29, e-mail: [email protected], http://www.europeangreens.eu member parties of the Confederation have been active and involved in implementing the roadmap agreed with the EGP and in cooperating with Equo, the recently established green foundation in Spain, thus making the Confederación look more and more like an empty shell. Today, we are at least glad that our letter was able to elicit a reaction. And rest assured that we will do our utmost to find a viable solution. This said, please consider our answer to some of the points raised by the letter of the Confederación representatives. 1. Our letter is not the result of an “agreement” with the working group involving most Green groups in Spain and Equo, which is currently working on the preparation of the reunification Congress in Fall. It is also not true that the signatories of the letter of the Confederación were not informed on the WG, since all parties and groups were invited. It was their choice not to take part. 2. As mentioned earlier, and as we already explained at several occasions, we are precisely questioning the very existence of the Confederación as “the only Green Spanish party” and its capacity to be a member of the EGP. We never received any formal or informal answer on this point. 3. The decision of the Committee was made after dialogue or consultation with the representatives of the Confederación. No answer was received from them to the numerous notes and communications, both oral and written. The latter are at the disposal of the member parties. 4. The Committee is strictly following the EGP rules. Faced by the concrete possibility of a new Green party emerging from a long collective work of both new and old green groups in Spain, and in the imminence of a crucial election in November, we need to take action and reduce the confusion around who is the EGP partner in Spain and who is not. We reiterate that this process is open, that no decision has been taken because the Committee cannot decide alone and that there is still some time to solve the issue. This is what we are striving for. 5. The process started on the basis of a roadmap proposed by EGP in a meeting in Madrid in 2010 and was accepted by most parties towards a dialogue for reunification. Unfortunately, no follow-up was given from the side of the leadership of the Confederación towards this commitment. However, many people and parties stayed involved in the process. Our goal is to support a process that will result in uniting all politically active Greens in Spain and their organisation being a full member of the EGP under the framework they will choose. Currently the WG is discussing about the steps and the rules of the process. It would be very important that those holding the legality of the Confederación would also decide to join and participate to the debate. If the Confederación leadership, which is losing any kind of representativity since most of its members are part of the current process, does not intend to open a discussion and negotiation on its legality, then we have no other option than to ask the EGP to suspend its membership: without members, with no democratic functioning, the Confederación is more and more an empty shell which simply does not fulfil the criteria to be a member of the EGP. Mobilizations during the last weeks occurring throughout the Spanish territory express the deep social unrest and public discontent with the functioning of the political and economic system, with the behavior of the economic powers and political representatives and with corruption. This situation must be fought with proposals of independence of the public governance from economic powers, transparency and zero tolerance to corruption; and from the ethics, the political commitment and the conviction that other solutions from the public institutions and from civil society are possible. That commitment carry to a political practice capable of giving a participatory response to citizen demands, thus restoring the public confidence in political action and, above all, to adopting strong and innovative proposals aimed at achieving social and environmental justice. Against the policies of the traditional parties, EQUO intends to recover the sense of politics as an instrument of transformation and collective public governance that meets the small needs and large aspirations of people and society to enable everyday happiness within ecological limits of the planet. Delegates, Last August the 7th you have received a letter from the Committee announcing our intention to start the procedure for asking the Council to suspend the membership of the “Confederacion de los Verdes de Espana”. We also informed the member parties, that we would take a final decision on the submission of this proposal of suspension to the Council in view of the political situation and of the on-going process of reunification of the Spanish Greens. As a reminder, it is worth noting that EGP agreed a roadmap for Spanish Greens in 2010 with the various green groupings in Spain and with EQUO aiming at the reunification of the Greens. After various meetings, the process of reunification of the Greens was foreseen to culminate in January/February 2012, before the elections, which were originally due in March 2012. But as you know, Prime Minister Zapatero decided to call for elections on November the 20th, thereby anticipating by 5 months on the initial calendar. Elections in Spain will therefore take place one week after our Congress in Paris. The decision to anticipate the elections has considerably cut the time for the Greens to campaign. The formal constitution of the new Green party will have to take place after the elections. Last October the 6th, an Assembly took part in Madrid during which EQUO and all organised Green groupings in Spain, except three, decided to run for the elections under the banner of EQUO and, where geographically relevant, Iniciativa per Catalunya-Verds... Meaning that 13 regional parties (out of 16), formally still members of the Confederation, will participate in the elections under the banner of EQUO. In one case, the Confederation will present candidates. In view of this situation and seen the fact that a new set of statutes and membership rules are to be adopted by the Congress in Paris, the Committee has decided to postpone the discussion and the vote on the suspension of the Confederation from the EGP to the next Council in spring. The Committee also proposes to table a resolution supporting the election campaign of the Greens in Spain, gathered under the banner of EQUO and ICV. We postponed the discussion and decision on this issue at the last Congress due to the fact that the Paris Congress took place one week before the (early) national Spanish elections, and we decided to refer the issue to the Council in Spring. The situation has not changed after the elections and the Committee therefore proposes to the Council to withdraw the membership of the Confederacion. As you can see in the attached file that was sent to you in November, the European Green Party repeatedly received information that the Confederacion has not been functioning properly. The Committee received, among others, complaints regarding the following points: no respect for their statutes and internal democratic rules, lack of clarity as regards the leadership, lack of transparency and doubts regarding the existence of the legal seat of the party. The Confederacion has not been able to abide by their own statutory requirements for years, nor adhered to internal democratic procedures, and the EGP has received complaints on this from several of the member parties of the Confederacion. In line with the EGP Statutes and membership rules, the Committee proposes the withdrawal of membership from the Confederacion, as it is no longer a working structure with a valid membership. The Committee had, over time and before the withdrawal of the 13 parties and groups, tried in several occasions to solve the issue by asking the Confederacion to gather the official bodies and its members and decide the way forward. Unfortunately this never happened. The representatives of the Confederacion were always invited to all events and meetings, which took place in the last two years aimed at the reorganisation of the Greens in Spain and only participated at the very beginning. We will nonetheless use the time before the Council to try to bring them to join the common effort of unifying the Greens in Spain.
