Even as coronavirus deaths mount by the day in New York City, diagnosed infections are rising at a slower pace than before government stay-at- home orders. After peaking at a jump of 118 percent be- tween March 17 and March 18 — just after schools, restaurants and other gathering places closed — the increase in new cases has declined to between 9 percent and 13 percent per day since March 29, according to THE CITY’s analysis of city Health Department data. Social adult day care programs were introduced to combat social isolation, prevent hospitaliza- tions, and delay nursing home admissions. This is a win-win for seniors as well as the insurance companies. Healthy seniors residing in their homes cost the system significantly less than those in Irina Golub of the nursing homes. One of the most important activities is engaging in meaningful conversation with staff and other seniors, leading to a happier, more fulfilled self. Social adult day programs offer age-appropriate activities, nutritious meals, local outings, birth- day celebrations and group support. With over 50,000 coronavirus cases in New York City, and more than 1,500 related deaths, the pandemic has become one of the most devastating in recent history — particularly for senior citizens. Social adult day cares have been forced to serve seniors remotely, providing daily wellness check-ins and a variety of tele-services, delivering meals and medications to the seniors’ homes and being available around the clock to help members with everyday needs and problems during a global public health crisis. As seniors are asked to stay home to protect themselves from COVID-19, social isolation has become a serious concern. This concern is real and is highlighted daily in Gov. Andrew Cuomo’s briefings. Social isolation will lead to depression. Seniors with dementia or Alzheimer’s are very accustomed to their routine. When they are taken out of that routine and away from their peers, depression from social isolation will set in. With the clo- sure of social adult day cares for in-person attendance, it is im- perative to provide modified tele-services and to give members the continuity of care required. They need to hear familiar voices. They need to see familiar faces. They are petrified and alone. Social adult day care pro- vides these daily services to some of New York’s most vulnera- ble to ensure their safety, health and well-being. Yet social adult day programs were notified by the Managed Long-Term Care Plans, insurance plans that work under New York’s Medicaid program, to cease all services. This is a huge and very dangerous mistake. Without social adult day care teleservices, seniors — many of whom are frail, disabled or cognitively impaired — are at greater risk of hospitalizations. Whether it’s due to malnutrition, panic or simply feeling iso- lated, a trip to the ER puts them at greater risk of contracting coronavirus and even death. Social adult day cares have contin- ued serving their members, providing a range of vital tele-ser- vices in a pandemic, to prevent this unspeakable outcome. While the federal, state and local governments are promoting telemedicine and tele-care, the MLTCs are turning away their members’ desperate pleas for continuation of tele-services and are cutting lifesaving services at the time they are needed most. As an essential services provider, social adult day programs are empathetic and cannot turn a blind eye on their members. Why are MLTCs refusing to pay for social adult day care telecare programs, which have been providing vital services to seniors throughout this pandemic without support? Representing 56 centers servicing over 10,700 members, the Coalition of New York City Social Adult Day Cares needs the immediate support of New York City, New York State and es- pecially MLTCs in order to continue providing vital services to New York’s most vulnerable.

The education department received reports of issues that impact the security and privacy of the platform during the credentialing pro- cess, according to a document shared with principals that was ob- tained by Chalkbeat on Friday night. “Based on the DOE’s review of those documented concerns, the DOE will no longer permit the use of Zoom at this time,” the memo said. Instead, the guidance says, schools should switch to Microsoft Teams “as soon as possible,” which the education department sug- gests has similar functionality and is more secure. After initially saying educators should not use Google platforms for video and audio conferencing with students, department officials on Sunday said the platform is safe enough to use. Schools Chancellor Richard Carranza did not give a specific timeline for schools to stop using Zoom and acknowledged the tran- sition could not happen immediately. “We want people to gradually transition to another format,” he said at a Sunday press conference. “We’re going to do this in a thoughtful manner.” Still, the change is likely to cause headaches for schools and families, as the use of Zoom became widespread after the city shut- tered school buildings on March 16 and moved over a million stu- dents to remote learning a week later. INSURER FREE FROM INDEMNIFYING LATE ADDITION TO POLICY Appellate Division, Second Department In Kings County Supreme Court, Civil Term, Caren Williams filed a complaint against Pham Tran and Crown Fried Chicken and Pizza, Inc. to recover damages for personal injuries she allegedly sustained at the premises on Utica Avenue. Tran is the owner and landlord of the premises. Dang My Linh is the tenant of the prem- ises who subleased them to 226 Utica Food Corporation, the named insured on a policy issued by Utica First Insurance Company. Tran and Linh filed a complaint seeking a judgment declaring that Utica Hon. Carolyn Wade First is obligated to defend and indem- Eagle file photo by Rob Abruzzese nify them in the suit by Williams. In December of 2016, Utica First moved for summary judgment declaring that it was not obligated to defend and indemnify Tran. Tran and Linh cross-moved for summary judgment declaring that Utica First is obligated to defend and indemnify them. In an order dated July 14, 2017, Hon. Carolyn Wade denied both the motion and the cross motion. In September 2017, Utica First moved for leave to reargue that branch of its prior motions that was for summary judgment. It contended that the court had misunderstood the plain language of the insurance policy. In response, Tran and Linh cross-moved for leave to renew and reargue that branch of their prior cross-motion for summa- ry judgment. Justice Wade granted Utica First’s motion, vacated the prior determination and granted that branch of the prior motion. The court adhered to its prior determination denying that branch of Tran and Linh’s prior cross motion. Upon the appeal by the plaintiffs, the justices of the Appellate Division, Second Department, affirmed the ruling of the Supreme Court. The justices explained that they agreed with the Supreme Court’s determination, upon reargument, to grant Utica First’s motion for summary judgment in its favor. They noted that Utica First submitted evidence that established that Tran was not named as an additional insured under the policy until more than three months after the accident on Sept. 28, 2015 occurred. The justices found that the subsequently issued policy amend- ment naming Tran as an additional insured was not effec- tive until Jan. 16, 2016. Thus, they concluded that Utica First had no duty to defend and indemnify Tran. The justices remitted the matter back to the Supreme Court for an entry of a judgment. —Pham Tran v. Utica First Ins. Co., 2018-01608, March 18, 2020 ••• SUMMARY JUDGMENT REVERSED IN FAMILY DISPUTE OVER PROPERTY Appellate Division, Second Department Jason Goldberg and Barrie Meyers are the adult children of the deceased, Beverly Tuzzolino. On May 31, 2006, Tuzzolino executed a durable power of attorney in favor of Meyers for purposes that included real estate transactions. By deed dated Aug. 15, 2011, Meyers, as attorney-in-fact for her mother, transferred her mother’s premises on 79th Street in Brooklyn to herself. Tuzzolino died 13 months later. By deed dated Oct. 10, 2012, Meyers transferred the premises to herself and her husband, Paul Meyers, as tenants by the entirety. In November 2015, Goldberg filed a complaint in Kings County Supreme Court, Civil Term to rescind the deeds as invalid so that the property would pass equally to the siblings. Goldberg moved for summary judgment on the complaint. The defendants cross-moved for dismissal of the complaint. In response, the Supreme Court granted Goldberg’s motion, denied the Meyers’ cross motion and rescinded the deeds as invalid. Meyers thereafter moved for leave to renew her opposition to Goldberg’s prior motion. The Supreme Court denied that motion and Meyers appealed. In the Appellate Division, Second Department, the justices reversed the decision and denied summary judgment in favor of Goldberg. They explained that, in the absence of a specific provision authorizing gifts, an attorney in-fact may not make a gift to herself, since "such a gift carries with it a presumption of impropriety" unless there is a clear showing of intent on the part of the deceased to make the gift. The justices found that Goldberg demonstrated that the power of attorney given by his mother to Meyers did not contain the required statutory gift rider. However, they concluded that Meyers raised triable issues of fact as to whether the transfer of the premises to Meyers was intended by Tuzzolino and was for her own benefit. Additionally, the justices noted that the defendant raised a triable issue of fact as to whether Goldberg’s complaint was barred due to his three-year delay in filing the complaint after his mother’s death, while she continued to maintain the prem- ises at her own expense. —Goldberg v. DiFiore discussed the temporary change in a video message to court personnel across the state on March 30. “Our shift to a virtual court system has made it possible for participants in essential and emer- gency proceedings to appear remotely via Skype, dramatically reducing the number of people in our courthouses to protect public health and safety,” DiFiore said Monday.
