Revised March 2019 Section 5 Hours of Service (HOS) How many hours may I drive in a given day? ➢ 11 hours after completing 10 hours off duty within a 14-hour period Can I work past my 14th hour on duty? ➢ Yes, but you can not drive again until you have a minimum of 10 hours off duty How long may I Drive and/or be on duty? ➢ 70 hours in an 8-day period ➢ 70 hours resets after 34 hours off duty. Can I still do a post trip if I am out of hours? ➢ Yes – you can be On Duty or Yard move, even if you are completely out of hours. Your Omnitracs will warn you that you are out of hours, but you will NOT be in violation unless it changes to Driving. When will my hours reset/restart? ➢ After a minimum of 34-hours off duty, your 70-hour clock will reset What happens if I am stuck on the road and run out of hours? ➢ It is a violation – even 1 second over your hours is a violation. ➢ You may need to complete a counseling with the safety department. ➢ Repeated violations could result in progressive disciplinary action up to and including termination of employment. ➢ You must type in post trip remarks the reason you went over. Am I allowed to use Personal Conveyance if I am stuck on the road and run out of hours? ➢ No – This is NOT a reason to use Personal Conveyance. o Please refer to Personal Conveyance guidelines, Section 5, page 6, of this book. ➢ You are required to plan your day to ensure that you are parked prior to running out of hours; however, if you are stuck you are required to go to the CLOSEST place available to shut down. o You MUST note in the remarks why you were delayed. ▪ If not properly noted you may receive a safety violation and/or a citation. o You must also complete a post-trip inspection once parked 1 Revised March 2019 Section 5 Rest Break Am I required to take a rest break? ➢ Yes When am I required to take a rest break? ➢ Within eight (8) hours of the beginning and end of your day How long must the rest break be? ➢ 30 minutes o If you start driving before you hit a total of 30 minutes for your rest break, you will receive a warning that you are in violation. o You will need to start your 30 minutes over. Restart What is a restart? ➢ Restarting and/or resetting your 70-hour clock after taking a 34-hour minimum off duty break. Is the 34-hour restart provision optional? ➢ Yes o i.e. a driver who works eight (8) hours per day, seven (7) days per week, would never need to use the restart provision because he/she would never reach the 70-hour limit. o A Driver may continue to keep a running total or “recap” of their hours over the past eight (8) days and “do the math” each day to determine when they need time off before driving again. Am I required to take my reset at home? ➢ No ➢ The break can be taken in any location and must be logged as “off duty” and/or in the sleeper berth.” Will I take my reset at home? ➢ Usually, but it is not guaranteed. ➢ Reset may be required to be taken while out on the road if your hours of service so dictate. 2 Revised March 2019 Section 5 Electronic Logs (E-logs) What do I need to know about the ELD (Electronic Logging Device) Mandate? ➢ As of December 16, 2019, ALL carriers must be compliant with the ELD mandate. ➢ Your ELD MUST be mounted within view of a driver who is belted in the driver’s seat. o What if my ELD is NOT mounted? ▪ Contact the Shop immediately to that corrected. ➢ You Must know how to transmit your EROD (Electronic Record of Duty) to a law enforcement official upon request. o How do I transmit the EROD? ▪ Refer to the DOT Quick Reference Card for instructions/guidance. o Where do I get the DOT Quick Reference Card? ▪ A copy is located in your permit book and at the end of Section 5 in this book. ➢ Your ELD unit MUST extend to where and officer can view it from the ground. ➢ You Must provide an instruction sheet to an officer upon request. o Where do I get the Instruction Sheet? ▪ They are available in your Permit Book and is Titled “DOT Quick Reference Card.” ➢ You Must have at least 8 days of blank paper logs in the truck for use in the event the ELD malfunctions. What if the ELD is not working? ➢ You MUST notify Garner (Driver Manager) immediately and use paper logs ➢ You will need to get and have on-hand the last 8 days of log information. From whom do I get the last 8 days of log information? ➢ The safety department o They can, will, and MUST email you the last 8 days of your logs. What is the allowable time frame to fix the malfunctioning ELD? ➢ Garner has no more than eight (8) days to repair or replace the malfunctioning unit. What if the malfunctioning ELD is not repaired or replaced within the eight (8) day time frame? ➢ Garner is required to file for a federal waiver. What if the malfunction immediately corrects itself? ➢ You will NOT need to use paper logs. Do I need to use e-logs even if I’d prefer to use paper logs? ➢ Yes 3 Revised March 2019 Section 5 Can I use paper logs if my ELD is working? ➢ No Do I need to approve my logs? ➢ Yes o Approving/Certifying your logs is the same as signing a paper log. How often do I need to approve my logs? ➢ Daily o You need to approve/certify your logs every 24-hours to be compliant. Do I need to log out of the Omnitrac’s system? ➢ Yes Why do I need to log out of the system? ➢ To avoid getting drive time added to your clock and a possible violation because someone else used your assigned vehicle while you were off and failed to log in. o I.e. your vehicle was in the shop and a technician drove it as part of the service. What if I forget to log out and someone else uses my assigned truck? ➢ If they failed to log in, they are driving on your logs. ➢ It can interrupt your break and you may need to take another break so as not to be in violation. ➢ Can cause a log violation. What if I don’t know how to edit logs, put in comments, etc. ➢ You may refer to the Omnitracs Hours of Service DOT Quick Reference Card instruction pamphlet in your permit book o A copy is located in your Permit Book and at the end of Section 5 of this book. ➢ You may contact the safety department 4 Revised March 2019 Section 5 Unassigned Drive Time What is unassigned drive time? ➢ If the tractor is moved and no one is logged into the ELD, this drive time will register as Unassigned Drive Time. What happens if there is unassigned drive time? ➢ The system will ask the next person that logs into the ELD to accept the drive time. What if I did not move the truck? ➢ DO NOT accept the unassigned drive time. What happens if I accidentally accept the unassigned drive time? ➢ It could interrupt your break and not allow you to run. ➢ May be required to take another break. What happens if I do not accept the drive time? ➢ It will stay as an alert for the next eight (8) days or until it is assigned and accepted by the person that drove during that time frame? Split Logging Why would I need to split my logs? ➢ Most drivers prefer to run a regular 10-hour break; however, you may want to split your logs if taking an 8-hour break would help you. How do I split my logs? ➢ If you want to split your logs you MUST take an 8-hour break in the sleeper berth only. ➢ The subsequent 2-hour break can be either off duty or sleeper berth. ➢ To fully understand the 8/2 split, please refer to the log splitting guide located at the end of this section. 5 Revised March 2019 Section 5 Log Auditing Will my logs be audited? ➢ Yes When and how are my logs audited? ➢ Logs are audited daily by the safety department ➢ Reports are run which identifies log violations for each and every driver. What happens if I have a violation on my logs? ➢ The safety department will notify you of the violation ➢ If the violation is egregious, you may need to do one or more of the following: o Sign a violation counseling form o Receive a written discipline which could result in suspension or termination. Does a log counseling affect my safety and performance bonus? ➢ No How long does the log counseling remain on my record? ➢ Six (6) months Can I lose my job over log violations? ➢ Yes – if you repeatedly violate hours of service rules and/or if the infraction is egregious and/or intentional/willful in nature. How do I know if I am violating Hours of Service guidelines? ➢ Contact the Safety Department with any questions or concerns ➢ Please refer to the FMCSA rules and regulations – the “Green Book” given to you at orientation or go to www.fmcsa.gov for the most current regulations.
