How many hours may I drive in a given day? ➢ 11 hours after completing 10 hours off duty within a 14-hour period

Can I work past my 14th hour on duty? ➢ Yes, but you can not drive again until you have a minimum of 10 hours off duty

How long may I Drive and/or be on duty? ➢ 70 hours in an 8-day period ➢ 70 hours resets after 34 hours off duty.

Can I still do a post trip if I am out of hours? ➢ Yes – you can be On Duty or Yard move, even if you are completely out of hours. Your Omnitracs will warn you that you are out of hours, but you will NOT be in violation unless it changes to Driving.

When will my hours reset/restart? ➢ After a minimum of 34-hours off duty, your 70-hour clock will reset

What happens if I am stuck on the road and run out of hours? ➢ It is a violation – even 1 second over your hours is a violation. ➢ You may need to complete a counseling with the safety department. ➢ Repeated violations could result in progressive disciplinary action up to and including termination of employment. ➢ You must type in post trip remarks the reason you went over.

Am I allowed to use Personal Conveyance if I am stuck on the road and run out of hours? ➢ No – This is NOT a reason to use Personal Conveyance. o Please refer to Personal Conveyance guidelines, Section 5, page 6, of this book. ➢ You are required to plan your day to ensure that you are parked prior to running out of hours; however, if you are stuck you are required to go to the CLOSEST place available to shut down. o You MUST note in the remarks why you were delayed. ▪ If not properly noted you may receive a safety violation and/or a citation. o You must also complete a post-trip inspection once parked

Rest Break

Am I required to take a rest break? ➢ Yes

When am I required to take a rest break? ➢ Within eight (8) hours of the beginning and end of your day

How long must the rest break be? ➢ 30 minutes o If you start driving before you hit a total of 30 minutes for your rest break, you will receive a warning that you are in violation. o You will need to start your 30 minutes over.

Restart

What is a restart? ➢ Restarting and/or resetting your 70-hour clock after taking a 34-hour minimum off duty break.

Is the 34-hour restart provision optional? ➢ Yes o i.e. a driver who works eight (8) hours per day, seven (7) days per week, would never need to use the restart provision because he/she would never reach the 70-hour limit. o A Driver may continue to keep a running total or “recap” of their hours over the past eight (8) days and “do the math” each day to determine when they need time off before driving again.

Am I required to take my reset at home? ➢ No ➢ The break can be taken in any location and must be logged as “off duty” and/or in the sleeper berth.”

Will I take my reset at home? ➢ Usually, but it is not guaranteed. ➢ Reset may be required to be taken while out on the road if your hours of service so dictate.

What do I need to know about the ELD (Electronic Logging Device) Mandate? ➢ As of December 16, 2019, ALL carriers must be compliant with the ELD mandate.

➢ Your ELD MUST be mounted within view of a driver who is belted in the driver’s seat. o What if my ELD is NOT mounted? ▪ Contact the Shop immediately to that corrected.

➢ You Must know how to transmit your EROD (Electronic Record of Duty) to a law enforcement official upon request. o How do I transmit the EROD? ▪ Refer to the DOT Quick Reference Card for instructions/guidance.

o Where do I get the DOT Quick Reference Card? ▪ A copy is located in your permit book and at the end of Section 5 in this book.

➢ Your ELD unit MUST extend to where and officer can view it from the ground.

➢ You Must provide an instruction sheet to an officer upon request. o Where do I get the Instruction Sheet? ▪ They are available in your Permit Book and is Titled “DOT Quick Reference Card.”

➢ You Must have at least 8 days of blank paper logs in the truck for use in the event the ELD malfunctions.

What if the ELD is not working? ➢ You MUST notify Garner (Driver Manager) immediately and use paper logs ➢ You will need to get and have on-hand the last 8 days of log information.

From whom do I get the last 8 days of log information? ➢ The safety department o They can, will, and MUST email you the last 8 days of your logs.

What is the allowable time frame to fix the malfunctioning ELD? ➢ Garner has no more than eight (8) days to repair or replace the malfunctioning unit.

What if the malfunctioning ELD is not repaired or replaced within the eight (8) day time frame? ➢ Garner is required to file for a federal waiver.

What if the malfunction immediately corrects itself? ➢ You will NOT need to use paper logs.

Do I need to use e-logs even if I’d prefer to use paper logs? ➢ Yes 3

Do I need to approve my logs? ➢ Yes o Approving/Certifying your logs is the same as signing a paper log.

How often do I need to approve my logs? ➢ Daily o You need to approve/certify your logs every 24-hours to be compliant.

Do I need to log out of the Omnitrac’s system? ➢ Yes

Why do I need to log out of the system? ➢ To avoid getting drive time added to your clock and a possible violation because someone else used your assigned vehicle while you were off and failed to log in. o I.e. your vehicle was in the shop and a technician drove it as part of the service.

What if I forget to log out and someone else uses my assigned truck? ➢ If they failed to log in, they are driving on your logs. ➢ It can interrupt your break and you may need to take another break so as not to be in violation. ➢ Can cause a log violation.

What if I don’t know how to edit logs, put in comments, etc. ➢ You may refer to the Omnitracs Hours of Service DOT Quick Reference Card instruction pamphlet in your permit book o A copy is located in your Permit Book and at the end of Section 5 of this book. ➢ You may contact the safety department

What is unassigned drive time? ➢ If the tractor is moved and no one is logged into the ELD, this drive time will register as Unassigned Drive Time.

What happens if there is unassigned drive time? ➢ The system will ask the next person that logs into the ELD to accept the drive time.

What if I did not move the truck? ➢ DO NOT accept the unassigned drive time.

What happens if I accidentally accept the unassigned drive time? ➢ It could interrupt your break and not allow you to run. ➢ May be required to take another break.

What happens if I do not accept the drive time? ➢ It will stay as an alert for the next eight (8) days or until it is assigned and accepted by the person that drove during that time frame?

Split Logging

Why would I need to split my logs? ➢ Most drivers prefer to run a regular 10-hour break; however, you may want to split your logs if taking an 8-hour break would help you.

How do I split my logs? ➢ If you want to split your logs you MUST take an 8-hour break in the sleeper berth only. ➢ The subsequent 2-hour break can be either off duty or sleeper berth. ➢ To fully understand the 8/2 split, please refer to the log splitting guide located at the end of this section.

Will my logs be audited? ➢ Yes

When and how are my logs audited? ➢ Logs are audited daily by the safety department ➢ Reports are run which identifies log violations for each and every driver.

What happens if I have a violation on my logs? ➢ The safety department will notify you of the violation ➢ If the violation is egregious, you may need to do one or more of the following: o Sign a violation counseling form o Receive a written discipline which could result in suspension or termination.

Does a log counseling affect my safety and performance bonus? ➢ No

How long does the log counseling remain on my record? ➢ Six (6) months

Can I lose my job over log violations? ➢ Yes – if you repeatedly violate hours of service rules and/or if the infraction is egregious and/or intentional/willful in nature.

How do I know if I am violating Hours of Service guidelines? ➢ Contact the Safety Department with any questions or concerns ➢ Please refer to the FMCSA rules and regulations – the “Green Book” given to you at orientation or go to www.fmcsa.gov for the most current regulations.

When may I Use Personal Conveyance?

Personal conveyance may ONLY be used in the following circumstances:

• Move from customer location to the closest safe location to complete off-duty period if they ran out of hours while being loaded/unloaded and were forced to leave premises.

• If instructed by a law officer to move vehicle during a break. Must move to the closest safe area to complete rest break.

Personal conveyance may NOT be used in the following situations:

• May Not extend a driver’s workday • May Not further a load • May Not use to go home if out of hours • May Not use if placed Out of Service for an Hours of Service violation

What do I do if I need to use Personal Conveyance?

• Contact Dispatch/Driver Manager and provide the following: o Why need use Personal Conveyance ▪ Need MUST meet the allowable reasons above – NO Exceptions! o What location they are headed/going to ▪ Need to get to the closest safe-haven even if it is in the opposite direction • Make note on logs that used Personal Conveyance and the reason

Garner Trucking, Inc. has established a maximum of 30 minutes allowed to reach the CLOSEST safe location; however, you are still required to plan your day accordingly to reach your destination within the HOS guidelines.

Personal Conveyance is only to be used as a last resort and MUST meet the allowable guidelines above.

What do I need to know about HAZMAT Loads? ➢ If the hazardous material is less than 1001 pounds, you do NOT need a HAZMAT endorsement to haul the load. ➢ If the hazardous material is 1001 pounds or over, you MUST have a HAZMAT endorsement to haul the load. ➢ If you do NOT have a HAZMAT endorsement, you may NEVER move a trailer with HAZMAT placards whether it’s loaded or not. ➢ If you need to move an empty trailer that has HAZMAT placards, you MUST remove the placards before moving the empty trailer.

What Should I DO, If…

Picking Up EMPTY Trailer that has HAZMAT Placards: ➢ Placards MUST be removed before you begin moving the empty trailer ➢ Hauling an empty HAZMAT placarded trailer is against the law and fines could be incurred

Picking Up Load and Discover It is HAZMAT, but You DO NOT have an “H” or “X” Endorsement on your CDL A License: ➢ Contact Dispatch/Driver Manager Immediately ➢ Load will need to be reassigned to a driver with the proper endorsement

Picking up a HAZMAT Load because I have a HAZMAT Endorsement: ➢ Follow the checklist below

Checklist When Hauling a HAZMAT Load: 1. Driver a. MUST have “H” or “X” Endorsement on your CDL A license b. MUST have been trained within the last three (3) years 2. Shipping Papers a. Do I have to turn a copy of the ticket/citation in? ➢ Yes

Whom do I turn the copy of the ticket in to? ➢ The safety department

What if I get a ticket in my own personal vehicle ➢ You are still required to notify the safety department

How do I notify the safety department that I received a citation? ➢ Call the safety department at 419-427-3928 ➢ Complete and submit a Notification of Traffic Violation ➢ Submit by scanning and emailing to [email protected]

Where do I get a Notification of Traffic Violation form? ➢ Contact Human Resources or the Safety Department ➢ A copy of the form is also available on the company website under the employee login

What do I do if I’m stopped for a DOT Inspection? ➢ Stop and cooperate with the officer

What do I do if I am put “out of service?” ➢ Contact operations/driver manager immediately ➢ Contact safety department ➢ May need to contact shop/maintenance if the “out of service” violation is a mechanical/maintenance issue.

Do I have to turn the DOT Inspection form in? ➢ Yes

Who do I turn the DOT Inspection in to? ➢ The safety department by scanning to [email protected].

Why do I have to turn the DOT Inspection form in to the safety department? ➢ If it’s a clean inspection, you will receive a $75.00 bonus & inspection form is needed to verify inspection was clean. ➢ If received a violation, carrier is required to respond & inspection form is needed to verify violation & respond accordingly.

When do I have to turn the DOT Inspection form in to the safety department? ➢ Immediately – within 24 hours

How do I turn the inspection form in? ➢ Scan and email to [email protected]

What if I do not notify the safety department of a DOT Inspection? ➢ Your employment with Garner Trucking, Inc. may be terminated.

What do I do If I am in an Accident? ➢ Immediately call the Safety Department at 419-427-3928 no matter how serious or minor the accident.

Checklist if you are in an Accident:

1. Secure the Scene a. STOP b. Shut off your vehicle. c. Turn on your emergency flashers. d. Put out your reflective triangles within 10 minutes. e. See if anyone is injured. f. See if there is a fuel or HAZMAT spill.

2. Notify the Authorities a. Call the police. i. Be polite and courteous. ii. Don’t apologize or admit guilt b. Call the Safety Department at Garner Trucking c. Don’t talk to anyone except the police, a Garner official, and our insurance investigator. i. You can ask to see I.D. d. Don’t leave the scene.

3. Document the Accident a. Fill out the Vehicle Accident Report Kit – located at the end of this section i. Obtain witness names, addresses and phone numbers ii. Get the license number of any vehicles at the scene; they may be witnesses b. Take pictures from the north, south, east and west, and from varied distances from the crash scene i. DO NOT take pictures of injured people c. Return the preliminary accident report to the Safety Department and email any accident pictures to [email protected]. 1. Pick up a replacement preliminary accident report from the Human Resources Departments

What happens if I don’t report an accident or incident? ➢ Failure to report accident/incident, no matter how minor, will result in termination of employment.

ALL ACCIDENTS MUST BE REPORTED – NO EXCEPTIONS!

Why do I have a drug screen kit in my assigned vehicle?

➢ In-the-event that an associate has a traffic accident in a company vehicle and/or personal injury, the associate may be sent for drug and/or alcohol testing. In-order-for testing to be accomplished with ease and in a timely manner, while a driver/associate is on the road and/or in another state, Garner will provide a drug screen kit.

When do I use the drug screen kit in my assigned vehicle?

➢ The drug screen kit will only be used when directed. If the need arises for testing, the associate will be directed to take the drug screen kit to a specified location where the kit will be utilized for drug testing purposes.

➢ If directed to use the drug screen kit, please see Human Resources for a replacement drug screen kit within a week of your directed testing date.

What do I do If I do NOT have a drug screen kit in my assigned vehicle?

➢ See Human Resources as soon as possible for a new drug screen kit.

Speed Reduction

Do I have to follow the ? ➢ Yes

What if I choose not to follow the speed limit? ➢ If you receive a ticket o You will receive a write-up/reprimand o Your safety & performance bonus will be suspended ▪ See safety & performance bonus in the Associate Policy Handbook, Section 3, Page 23. o Your assigned truck maximum speed limit will be governed at a reduced/lower speed. o Your employment may be terminated

What if I tamper with or allow someone else tamper with the top speed of a tractor? ➢ Your employment with Garner Trucking, Inc. will be terminated

Revised March 2019 Section 5 Riders/Passengers Am allowed to have a passenger? ➢ You may only have a passenger if you meet certain requirements & have written permission from the safety department. ➢ See Associate Policy Handbook, Riders/Passengers, Section 4, Page 10 for complete details.

What if I have a passenger without authorization? ➢ Your employment will be terminated immediately. ➢ It is against the law and company policy to have a passenger without proper authorization.

Pets/Service Animals Am I allowed to have an animal in the truck? ➢ Please refer to the company Pet and Service Animal Policy in the Associate Handbook, Section 4, Page 12, for complete details. ➢ Pets are NOT authorized in a company vehicle at any time. o Having a pet in a company vehicle is subject to immediate termination ➢ Service Animals may be allowed with approval o You must complete and submit an Accommodation for Service Animal Form to Human Resources to get approval o You Must provide proof animal has been trained for a specific task for service o Having a service animal in a company vehicle without authorization is subject to immediate termination ➢ See Human Resources for the appropriate form and requirements

Injuries/Illnesses & Other Emergencies

What do I do if I get Hurt/Injured while on the road? ➢ Contact Dispatch/Driver Manager Immediately

➢ You will be Instructed to Contact/Call Human Resources (HR) at 419-422-5742 o Contact HR so paperwork on injury can be completed o Contact HR even if you feel you are okay/fine

➢ Complete First Report of Injury & Injury Identification Log

What do I need to do on my last day of employment with Garner Trucking, Inc.? ➢ See Human Resources ➢ Turn in all items assigned to you o See Termination Checklist for items that need to be returned located at the end of this section or contact Human Resources for a copy.
