Within international law, no specific law regulates the state’s authority to establish ADIZ nor explicitly prohibits them to set their own ADIZ. Consequently, it is through states own various interpretations of provisions within international law that states have based their authority to determine its ADIZ. Following the practice of other states, Indonesia has also established ADIZ as part of Indonesia’s air defense system to enforce the sovereignty of the State and law over airspace. The Indonesian ADIZ is the airspace covering of a small portion of South Sumatra, Java and Madura, Bali, Lombok and a fraction of the western part of Sumbawa Island. A closer look to Indonesia’s ADIZ reveals that the zone is still within Indonesia’s national territorial airspace. Notably, this is contrary to several states practice in establishing its own ADIZ whose zone is outside its national airspace.

    MENELUSURI JEJAK AWAL PENERBANGAN DI INDONESIA (1913-1950-AN) Dadan Adi Kurniawan Program Studi Pendidikan Sejarah Universitas Sebelas Maret Surakarta [email protected] Abstrak Minimnya narasi tentang kiprah penerbangan di masa lalu menjadikan pemahaman sejarah terkait moda transportasi seakan pincang. Kebanyakan kajian masih berkutat pada sejarah transportasi darat dan laut, terutama masa kolonial. Padahal keunggulannya dalam menempuh berbagai medan jarak jauh, menjadikan transportasi udara sebagai salah satu primadona pilihan masyarakat modern dalam bermobilitas. Tulisan ini menelusuri lebih lanjut jejak kemunculan dan perkembangan awal penerbangan sipil-militer di Indonesia. Sejak kapan penerbangan mulai ada, faktor apa saja yang melatarbelakangi kemunculannya dan bagaimana dinamika awal perkembangannya. Penelitian ini menggunakan metode sejarah kritis dinama penulis memadukan sumber primer maupun sekunder yang relevan. Hasil dari penelitian ini menunjukkan bahwa penerbangan pertama di Indonesia telah ada sejak dekade kedua abad 20 dan mulai berkembang pesat pada periode 1950-an. Pada awalnya, penerbangan difungsikan untuk keperluan militer disusul penerbangan komersial dalam jumlah terbatas. Kemajuan teknologi di Barat dan persaingan global (perang) saat itu menyebabkan dunia penerbangan mencapai akselerasi kemajuan yang lebih cepat. Kata Kunci: transportasi, bandara, penerbangan, militer, komersial. Abstract The lack of narratives about the gait of flight in the past has made understanding history related to transportation modes as if limping. Most studies still dwell on the history of land and sea transportation, especially the colonial period. Though its superiority in taking various long-distance terrain, making air transportation one of the excellent choices of modern society in mobility. October 2013 Abstract How democratisation affects a state's foreign policy is a relatively neglected problem in International Relations. In Indonesia's case, there is a limited, but growing, body of literature examining the country's foreign policy in the post- authoritarian context. Yet this scholarship has tended to focus on the role of Indonesia's legislature and civil society organisations as newly-empowered foreign policy actors. Scholars of Southeast Asian politics, meanwhile, have concentrated on the effects of Indonesia's democratisation on regional integration and, in particular, on ASEAN cohesion and its traditional sovereignty-based norms. For the most part, the literature has completely ignored the effects of democratisation on Indonesia's foreign ministry – the principal institutional actor responsible for foreign policy formulation and conduct of Indonesia's diplomacy. Berkat perjuangan Djuanda, yang menganut prinsip Negara Kepulauan (Archipelagic State) yang pada awalnya mendapat tantangan keras dari negara-negara lain, terutama dari Negara Daratan. Namun pada akhirnya Deklarasi Djuanda dapat dijadikan UU RI No. 4/PRP/1960 sebagai Perairan Indonesia. Dampaknya wilayah Indonesia bertambah luas dari 2.027.087 km2 hingga menjadi 5.193.250 km2. Akhirya hasil Deklarasi Djuanda dimasukkan dalam agenda UNCLOS (United Nations Convention on the Law Of the Sea) yang pertama dilaksanakan di Jenewa pada tahun 1958 dan pada UNCLOS tahun 1982 sehingga dapat ditetapkan sebagai Hukum Laut Internasional. There is an urgent need for bureaucracy reform, harmonization of legislation, and especially ensuring legal enforcement, to bring Indonesian aviation safety back to world standards. The Indonesian Aviation Law of 2009 was enacted to reform the situation in Indonesia. The law has become the ground for drafting legal framework under decrees of the Minister of Transportation, which have allowed the government to perform follow-up actions such as establishing a single air navigation service provider and guaranteeing the independency of the Indonesian National Transportation Safety Committee. As noted in the last update of current military data in 2003, we have had difficulty in systematically updating personnel changes at the Korem (Military Resort Command), largely due to the absence of the TNI-owned daily newspaper, Angkatan Bersenjata, since the financial crisis of 1997.2 We now rely mainly on the official letters of TNI Commander-in-Chief and general newspapers, both national and local, in collecting data regarding officer corps and their posts. Although the information on Korem commanders is not very satisfactory, it is still possible to analyze macro-trends in leadership transformation at the local level. The period covered in this update, i.e., from March 2003 to August 2005, has seen significant developments in post-reformasi civil-military relations. We have seen: 1) the all-out war in Aceh under martial law (May 2003-May 2004); 2) parliamentary elections in April 2004; 3) direct presidential elections in July and September 2004 for the first time in Indonesian history; and 4) the birth of a new government led by a retired army general, Susilo Bambang Yudhoyono, in October 2004. How did they shape Indonesia's civil-military relations? The war in Aceh greatly empowered those TNI officers who had demanded that the military take on a larger role in internal security.

    BAB 2 PERKEMBANGAN FUNGSI PEMBINAAN TERITORIAL SATUAN KOMANDO KEWILAYAHAN TNI AD Bab 2 ini membahas perkembangan pelaksanaan fungsi pembinaan teritorial Satuan Kowil TNI AD dari tahun 1945 hingga tahun 2009. Pembahasan fungsi pembinaan teritorial Satuan Kowil TNI AD mencakup: (1) fungsi pembinaan teritorial sebagai perwujudan dari strategi perang semesta (total war); (2) fungsi pembinaan teritorial sebagai strategi pengelolaan potensi nasional; (3) fungsi pembinaan teritorial sebagai strategi penjaga stabilitas politik dan keamanan pemerintahan Orde Baru; (4) fungsi pembinaan teritorial sebagai pemberdayaan wilayah pertahanan di darat dan kekuatan pendukungnya secara dini untuk mendukung sistem pertahanan dan sistem pelawanan rakyat semesta. Pembahasan dimulai dari fungsi teritorial militer Belanda (KNIL) tahun 1830-1942 dan perang gerilya militer Jepang (PETA/Heiho) tahun 1942-1945 untuk melihat “benang merah” keterkaitan dengan pembentukan fungsi Satuan Kowil TNI AD. Sedangkan pelaksanaan fungsi pembinaan teritorial Satuan Kowil TNI AD dari masing-masing tahap pembentukannya sejak Komanden TKR hingga Satuan Kowil TNI AD dan konflik internal militer yang menyertainya merupakan inti pembahasan dari Sub-Bab 2 ini. 2.1. Komando Teritorial KNIL Koninklijk Nederlandsch Indische Leger (KNIL) merupakan badan militer resmi Kerajaan Belanda yang dibentuk pada tahun 1830 di Hindia Belanda.161 Tujuan pembentukan badan militer ini adalah untuk melaksanakan dua fungsi sekaligus (dwifungsi), yaitu: (1) fungsi militer untuk menjaga Hindia Belanda dari 161 Koninklijk Nederlands Indisch Leger (KNIL) yang terbentuk pada 10 Maret 1830 adalah nama resmi Tentara Kerajaan Hindia-Belanda. Meskipun KNIL militer pemerintahan Hindia Belanda, tapi banyak para anggotanya merupakan penduduk pribumi.
