Q. How did the new bankruptcy law that was passed in 2005 affect a person filing bankruptcy?

A. The Bankruptcy Reform Act requires debtors to obtain cred- it counseling from an approved agency prior to filing. This can be done over the internet. If you come in for a free consultation, my office can direct you to approved counselors. In addition, the new law requires a means test to be filed. Your bankruptcy attorney will complete the means test to determine whether you can file Chapter 7, or what your payment would be if you file Professional Chapter 13. The new law also requires you to complete a Finan- cial Management Course. Chapter 13 debtors can complete this by attending the free session which is conducted the same day as their bankruptcy meeting. Chapter 7 debtors can complete this by watching a video, and answering some questions. Under the new law, if the debtor received a Chapter 7 discharge in the past, he cannot receive another discharge for 8 years after the prior case was filed. However, if he received a Chapter 7 discharge over four years ago, he could file under Chapter 13 and receive a discharge. If the debtor receives a Chapter 13 discharge over FORUM 2 years ago, he is eligible for another discharge in a Chapter 13 case.
