Aims and Objectives The core objective of the ISSI is to foster dialogue, understanding and collaboration amongst scholars, policy-makers and other stakeholders. For this purpose, the ISSI undertakes studies, arranges discussions and promotes research and analysis. It also offers a forum for scholars, specialists and policymakers to examine and engage in scholarly interaction on national security and strategic issues. Organisation The Government of Pakistan funds the ISSI annually through the Ministry of Foreign Affairs. However, the Institute functions as an autonomous research organisation. It is headed by the Director General, who acts as its Chief Executive. A Board of Governors and its Chairman supervise the functioning and work of the Institute. Research Focus The research interests of the ISSI cover all critical geographical regions. The focus, however, remains on contemporary thematic issues, such as nuclear non-proliferation; arms control and disarmament; energy security and water security issues; internal security challenges; terrorism, extremism, insurgencies and radical militant movements and sectarianism. In addition, state and nation-building, regional economic cooperation, regional security problems and other related research areas are also pursued at the Institute. The Institute maintains a sizeable research faculty, trained in Pakistan and in foreign universities, with diverse expertise, covers major areas of the ISSI’s research interests. ISSI-Hanns Seidel Foundation Fellowship Programme The Institute offers this fellowship to two candidates each quarter, selecting among distinguished scholars, intellectuals, former high-ranking officials of the armed forces of Pakistan, former diplomats and policymakers. The Institute has funding available for eight fellowships during a calendar year. 02 Annual Report 2017 ISSI Internship Programme The ISSI offers internship opportunities to promising under-graduate and graduate students. The objective of this internship is to groom and train students in research methods and orient them towards national security issues. International Cooperation The ISSI has signed memorandums of understanding (MoUs) with over 30 institutes and think-tanks in 24 countries. Under these MoUs, the Institute holds bilateral dialogues, hosts scholars from partner institutes and organises joint seminars and conferences with them. These arrangements also facilitate research visits of the Institute’s research faculty to foreign institutions. Conferences, Seminars and Talks The ISSI convenes national and international conferences and seminars on a regular basis. Distinguished scholars and policy makers are invited to address in-house meetings of the research faculty. The Institute frequently organises roundtable discussions, public talks and book launches with the aim of promoting a culture of dialogue and open debate. Participants at these events usually include foreign diplomats, senior government officials, military experts, leading academics and civil society activists. Most of these events are open to the public. Library and Documentation Centre The Institute’s library has over 15,000 books, and subscribes to 68 printed

  • Freedom of Religion & Religious Minorities in Pakistan: a Study Of
Fordham International Law Journal Volume 19, Issue 1 1995 Article 5 Freedom of Religion & Religious Minorities in Pakistan: A Study of Judicial Practice Tayyab Mahmud∗ ∗ Copyright c 1995 by the authors. Fordham International Law Journal is produced by The Berke- ley Electronic Press (bepress). http://ir.lawnet.fordham.edu/ilj Freedom of Religion & Religious Minorities in Pakistan: A Study of Judicial Practice Tayyab Mahmud Abstract Pakistan’s successive constitutions, which enumerate guaranteed fundamental rights and pro- vide for the separation of state power and judicial review, contemplate judicial protection of vul- nerable sections of society against unlawful executive and legislative actions. This Article focuses upon the remarkably divergent pronouncements of Pakistan’s judiciary regarding the religious status and freedom of religion of one particular religious minority, the Ahmadis. The superior judiciary of Pakistan has visited the issue of religious freedom for the Ahmadis repeatedly since the establishment of the State, each time with a different result. The point of departure for this ex- amination is furnished by the recent pronouncement of the Supreme Court of Pakistan (”Supreme Court” or “Court”) in Zaheeruddin v. State,’ wherein the Court decided that Ordinance XX of 1984 (”Ordinance XX” or ”Ordinance”), which amended Pakistan’s Penal Code to make the public prac- tice by the Ahmadis of their religion a crime, does not violate freedom of religion as mandated by the Pakistan Constitution. This Article argues that Zaheeruddin is at an impermissible variance with the implied covenant of freedom of religion between religious minorities and the Founding Fathers of Pakistan, the foundational constitutional jurisprudence of the country, and the dictates of international human rights law.

Defining Shariʿa The Politics of Islamic Judicial Review By Shoaib A. Ghias A dissertation submitted in partial satisfaction of the Requirements for the degree of Doctor of Philosophy in Jurisprudence and Social Policy in the Graduate Division of the University of California, Berkeley Committee in Charge: Professor Malcolm M. Feeley, Chair Professor Martin M. Shapiro Professor Asad Q. Ahmed Summer 2015 Defining Shariʿa The Politics of Islamic Judicial Review © 2015 By Shoaib A. Ghias Abstract Defining Shariʿa: The Politics of Islamic Judicial Review by Shoaib A. Ghias Doctor of Philosophy in Jurisprudence and Social Policy University of California, Berkeley Professor Malcolm M. Feeley, Chair Since the Islamic resurgence of the 1970s, many Muslim postcolonial countries have established and empowered constitutional courts to declare laws conflicting with shariʿa as unconstitutional. The central question explored in this dissertation is whether and to what extent constitutional doctrine developed in shariʿa review is contingent on the ruling regime or represents lasting trends in interpretations of shariʿa. Using the case of Pakistan, this dissertation contends that the long-term discursive trends in shariʿa are determined in the religio-political space and only reflected in state law through the interaction of shariʿa politics, regime politics, and judicial politics. The research is based on materials gathered during fieldwork in Pakistan and datasets of Federal Shariat Court and Supreme Court cases and judges. In particular, the dissertation offers a political-institutional framework to study shariʿa review in a British postcolonial court system through exploring the role of professional and scholar judges, the discretion of the chief justice, the system of judicial appointments and tenure, and the political structure of appeal that combine to make courts agents of the political regime.

The origins of the shrine cults are outlined, the similarities between traditional Muslim and Christian attitudes to shrines are emphasized and the functions of the shrine and the mosque are contrasted. Iranian and Afghan shrines are classified, firstly in terms of the objects which form their principal attrac tions and the saints associated with them, and secondly in terms of the distances over which they attract pilgrims. The administration and endowments of shrines are described and the relationship between shrines and secular authorities analysed.
