State Immunity and Human Rights: The Italian Supreme Court Decision on the Ferrini Case Pasquale De Sena* and Francesca De Vittor** Abstract In the Ferrini case the Italian Supreme Court affirmed that Germany was not entitled to sovereign immunity for serious violations of human rights carried out by German occupying forces during World War II. In order to reach this innovative conclusion, the Court widely referred to international legal arguments, such as the concept of international crimes, the principle of primacy of jus cogens norms and the notion of a strict analogy between state immunity and the ‘functional immunity’ of state officials. Based upon a systematic interpretation of the international legal order, the Court conducted a ‘balancing of values’ between the two fundamental international law principles of the sovereign equality of states and of the protection of inviolable human rights. This article explores the Court’s reasoning and its consistency with international legal theory and preceding case law with the view to verifying whether, and in which sense, the Ferrini judgment may facilitate a radical reappraisal of the relationship between human rights and the law of state immunity. 1 Introduction and Outline The recent judgment of the Italian Supreme Court (Corte di Cassazione) in Ferrini v. [email protected] Abstract This paper focuses on state surveillance under Mussolini’s regime (1922–1943) in Italy. While the cultural approach to Italian fascism has been fertile (de Grazia 1981; 1992; Ghirardo 1996; Whitaker 2000), archival research on police state surveillance is very limited and, due to the language barrier, has remained unknown in the field of Surveillance Studies. This short contribution is both an attempt to reckon with a surveillance past that has been neglected until recent times and to engage with revealing studies specifically related to state surveillance and classification. Surveillance under the duce was multifaceted and this paper aims at exploring the twenty years of the regime by focusing on different surveillance stages through a socio–historical perspective. Moreover, the concluding remarks briefly address some important issues which are related to political and cultural legacies of the fascist dictatorship that are essential to understanding some contemporary trends. Introduction This paper is focused on one of the many forms of the fascist society of surveillance, namely police state surveillance carried out in Italy under Mussolini’s regime (1922–1943). New archival evidence (Canali 2004; 2009; Franzinelli 1999; 2000; 2001) has in fact shed light on a ‘surveillance past’ that has been neglected until recent times. If, on the one hand, a few Italian historians have attempted to provide a comprehensive understanding of the fascist society of surveillance, on the other, this topic––most likely due to the language barrier––has remained unknown to the cross–disciplinary field of Surveillance Studies.

Introduzione Tra il 9 settembre 1943 ed il 2 maggio 1945, date di inizio e fine dell’occupazione tedesca, furono deportati (o uccisi) dall’Italia poco più di 8.000 ebrei, su una popolazione (compresi gli stranieri), di circa 47.000,1 una percentuale paragonabile a quella degli altri paesi dell’Europa occidentale, anche se l’Italia Centro settentrionale fu occupata per molto meno tempo. A Roma, ad esempio, i circa 750 ebrei catturati dopo la razzia del 16 ottobre 1943, furono presi in un arco di tempo di 7 mesi e mezzo: un periodo relativamente breve che conferma l’efficacia degli organi della SiPo-SD nella ex capitale del Regno, nonostante l’esiguo numero delle forze a disposizione. Lo scopo di questo saggio è di descrivere la prassi della persecuzione, per capire quali siano stati i metodi che hanno portato a risultati così tragicamente soddisfacenti per i persecutori.
