DOI://10.25167/ osap2174 W dniach 7–9 listopada 2019 r. w Kragujevacu w Serbii odbyła się The Fourth International Conference of the Balkan Association of Roman Law and Roman Legal Traditions pt. „Res Publica & Res Privata”. Organizacji konferencji podjął się Wydział Prawa Uniwersytetu w Kragujevacu. Otwarcia konferencji 7 listopada 2019 r. w sali Urzędu Miasta Kragujevac dokonała prof. Malina Novkirishka Stoyanova, przewodnicząca Balkan Association of Roman Law and Roman Legal Traditions „Societas Pro Iure Romano”. Oprócz niej gości powitali: Miroslav Petrašinović, przewodniczący rady miasta Kragujevac, Pa- ola Cardone, dyrektor Włoskiego Centrum Kultury z Belgradu, a także prof. Emilija Stanković z Uniwersytetu w Kragujevacu. Konferencja odbyła się w stolicy okręgu szumadijskiego, w mieście, w którym w październiku 1941 r. 200 Piotr Sadowski hitlerowscy Niemcy rozstrzelali kilka tysięcy ludności cywilnej. Uniwersytet Kragujevacki został założony w 1976 r. 8 listopada 2019 r. w hotelu Šumarice trwały obrady konferencyjne w dwóch sekcjach: rzymskiego prawa publicznego (I) i rzymskiego prawa prywatnego (II). Sekcji pierwszej przewodniczyli profesorowie: Tatiana Alexeeva (Moskwa) i Samir Aličić (Sarajewo), sekcji drugiej: Vlado Bučkovski (Skopje) i Zdravko Lučić (Sarajewo). W sekcji rzymskiego prawa publicznego zaprezentowane zostały następujące referaty: dr Salvatore Puliatti, Professore Ordinario, Dipartimento di Giuri- sprudenza, Studi politici e Internazionale, Università di Parma, In spectaculis iudices non excedant impendia. W ramach sekcji rzymskiego prawa publicznego prof. Salvatore Puliatti omówił kwestię wydatków potrzebnych do przygotowania różnych ludi, jak np. gry czy igrzyska, zwłaszcza w okresie późnego cesarstwa. Rzymianie lubowali się w różnych igrzyskach, a troska o ich organizację za cesarstwa należała do pretorów, podczas gdy wcześniej za republiki – do edylów. Dr Piotr Sadowski zaprezentował kwestię regulacji prawnych dotyczących mostów w ustawodawstwie Justyniana. Rzymianie byli świadomi, że mosty to ważna rzecz zarówno w codziennym funkcjonowaniu, jak i w momentach strategicznych dla państwa. Potrafili wznosić mosty i burzyć je – jak choćby zrobił Juliusz Cezar na Renie, chcąc zamanifestować potęgę Rzymian, czy Hadrian, niszcząc most Trajana na Dunaju ze względów bezpieczeństwa. Rzymianie nie wypracowali całościowej doktryny prawnej dotyczącej mostów. Ustawodawstwo Justyniana traktowało o nich poniekąd marginalnie i incyden- talnie. Mimo wszystko w regulacji Justyniana omówione zostały takie kwestie jak: troska o mosty, wybudowanie mostu na swój prywatny użytek, mosty a podatki płacone przez Kościół, mosty a służebność, mosty a samobójstwo czy zabójstwo. Ustawodawstwo polskie dotyczące obiektów mostowych jest dzisiaj bardziej szczegółowe niźli to w starożytnym Rzymie. Świadczy o tym dzisiejsza wrażliwość ekologiczna dostrzegana w pochylaniu się nad takimi kwestiami jak np. przemieszczanie się zwierząt dziko żyjących czy ciągłość ekosystemu cieku. Oczekiwanie takiej wrażliwości od starożytnych Rzymian byłoby zwyczajnym anachronizmem. Jednak chciałoby się, aby współczesne mosty

    Mr.sc.Matvey LOMONOSOV “New Nation-Building” or What?: Serbian and Kosovan laws on expatriates Matvey Lomonosov Abstract Special legal provisions on preferential treatment of expatriates introduced during last decade by the kin-states are oftentimes construed by the scholars as visible sings and effective tools of new, post-territorial nation-building in Eastern Europe. However, the analysis of Serbian and Kosovan laws on citizenship and diaspora shows that the picture is more complex, whereas the situation varies across countries of the region. Despite the rising concerns with the issues of the co-ethnics since late 2000 the Serbian government for some years has been reluctant to introduce the exclusive preferential treatment for the Serbs in the realm of citizenship. Only the law passed in 2009 overtly showed that the executives and legislators of the Republic of Serbia now are on the way of creating post-territorial Serb national community. Contrariwise the political establishment of Kosovo equally pushing forward special laws on “diaspora” in 2008 and 2011 was rather concerned with forming and reasserting of as well as tightening its grip over post-territorial citizenry because of notable social and economic problems. In contrast to Easter European status laws, trans-border “ethnic relatives” of the Kosovan majority are effectively excluded by the documents from the membership in the “diaspora,” while the representatives of ethnic minorities from the territory of the country legally qualify for being Kosovo diasporans.     "Zooming Albanian factor in the MA. nineteenth century through Western lenses" SALIHU Arben Arben Salihu Abstract The developments of the nineteenth century were determining for the history of Balkan region as it shaped the future of many generations to come, resulting in (mainly) growing discontents that led to several wars during the last century. It was beginning of the decay of the Ottoman Empire that many longed for, and many nations used every opportunity to take a full advantage of it. The aim of this work is to explore exclusively (only) Western sources in an attempt to provide, as much as possible, an objective and neutral picture. Therefore, the idea behind the decision to examine non-Balkan sources is impartiality, in order to bring the reader as close as possible to the reality of the nineteenth century. A number of nineteenth century books, magazines and newspapers of the time, by respective Western authors, are explored and analysed. Reading and examining a large volume of data and information of this period, offers a unique sense of feeling, similar to that of living the nineteenth century world. Albanians, who have historically populated the heart of Balkans, are focal point of this region (in many of the regional and international sources) for this particular period, vis-à-vis the Ottoman governance as well as relations with other regional neighbours.
