Passover Raisin Wine, The American Temperance Movement, and Mordecai Noah: The Origins, Meaning, And Wider Significance Of A Nineteenth-Century American Jewish Religious Practice JONATHAN D. SARNA Hebrew Union College -jewish Institute of Religion Cincinnati, Ohio The use of raism wine on Passover, described by Mordecai Noah (I785-I851) and considered by some in his day to have been a requirement of Jewish law, reflected (1) an old world custom that over time was trans formed into a "popular halacha," (2) a possible vestige of a Marrano practice, and (3) a rabbinically-sanctioned means of observing the commandments when regular kosher wine was unobtainable. Use of the wine demonstrates a desire on the part of nineteenth century American Jews to maintain se lected traditions and customs even under difficult "frontier" traditions. The practice enriched jewish life, served to distinguish Jews from their Christian neighbors, and helped to transform Passover into a time of religious revi talization. Jewish use of raisin wine also became an issue in the American temperance debate. The episode illustrates how American Christians some times used Jews as informants, viewed them as repositories of ancient wis dom, and looked to them as potential legitimators of Christian practices. Fi nally, the raisin wine issue sheds light on American Jewish attitudes to the temperance question as a whole. Mordecai Noah endorsed temperance as an important social cause, even as he warned adherents against extremism. Later Jews, who saw the movement at a more advanced stage, worried about the coercive evangelical fervor and nativism associated with it, and kept their distance. -

306 AMERICAN JEWISH YEAR BOOK JEWISH STATISTICS The statistics of Jews in the world rests largely upon estimates. In Russia, Austria-Hungary, Germany, and a few other countries, official figures are obtainable. In the main, however, the numbers given are based upon estimates repeated and added to by one statistical authority after another. In spite of the unsatisfactor- iness of the method, it may be assumed that the numbers given are approximately correct. For the statistics given below various authorities have been consulted, among them the " Statesman's Year Book" for 1904, the English " Jewish Year Book" for 5664, the " Jewish Ency- clopedia," and the Alliance Israelite Universelle reports. Some of the statements rest upon the authority of competent individ- uals. A comparison with last year's statistics will show that for several countries the figures have been changed. In most of the cases, the change i6 due to the fact that the results of the census of 1900 and 1901 have only now become available. THE UNITED STATES As the census of the United States has, in accordance with the spirit of American institutions, taken no heed of the reli- gious convictions of American citizens, whether native-born or naturalized, all statements concerning the number of Jews living in this country are based upon estimate, though several of the estimates have been most conscientiously made. Teshuvah: Introduction: About fifteen years ago, a congregant approached me to perform a baby naming for her newborn daughter. I knew the woman. She had grown up in the congregation. She was single, had despaired of ever getting married, and had chosen to utilize ART to have a child of her own and raise that child on her own. She wanted to welcome her child into the covenant within her congregational home. The next Sabbath, with the proud grandparents in attendance, the woman carried her daughter up to the bimah for her aliyah, following which I blessed her and her child and announced the child’s name. After services, I was approached by several older members who were distressed that the congregation had “legitimized” a child born “out of wedlock.” It was irrelevant to them that they knew the woman since she had been a child and were otherwise sympathetic to her. -

THE design of this volume is to show the degree of prominence and influence attained by the Hebrews of the United States. The preparation of the work was undertaken at the suggestion of the numerous readers of a less elaborate series of sketches upon the same subject which appeared in the " New York Mail and Express " about one year since. In the course of his earlier researches the author brought to light a vast amount of interesting material regard- ing the Hebrews in this country, the publication of which, in the secular press was, for obvious reasons, found impractic- able. The material then secured, which has been supple- mented by further investigation, constitutes the present volume. 52 AMERICAN JEWISH YEAR BOOK BIOGRAPHICAL SKETCHES OF JEWS PROMINENT IN THE PROFESSIONS, ETC., IN THE UNITED STATES The Biographical Sketches which follow are a second in- stalment of the series begun in the AMERICAN JEWISH YEAE BOOK for 5664. The Sketches there published were of Rabbis and Cantors officially connected with congregations in the United States. On pp. 214-225, will be found additions to the list of last year, designed to keep it up to date. It is intended to complete the series of Biographical Sketches in the AMERICAN JEWISH YEAR BOOK for 5666, in which an attempt will be made to present the biographical data of the men and women who are doing the communal work for the Jews of the United States. The present instalment does not deal with so unified a set of personages as the first dealt with and as the third is de- signed to deal with. It aims to bring together the names and biographical data of the Jews in the United States who have won a place in the professions, in the arts, the sciences, in journalism, in business, in public life. Only one class of pro- fessional men and women have been excluded from the present instalment, namely, those who have trained themselves to preside over Jewish charitable institutions; the superin- tendents and directors of the charities, the superintendents of orphan asylums and kindred institutions, the probation officers, the social settlement workers, etc. Their vocation is so closely allied to the activities that will constitute the ground for inclusion in the next instalment of sketchea BIOGRAPHICAL SKETCHES 53 that it seemed proper to associate them with the communal workers whose leaders and guides they are. -

Jews and Slavery can easily be the focus of a graduate seminar, a lengthy book and a life-time of research. Just to focus on anyone specific area honestly is a task far beyond this short half-hour. I do not even have the time to take us on a quick tour that would bring us through over three thousand years of history and over five continents. So what I plan to do this morning is to focus on three areas: The first – general observations – basically ideas on the issue of slavery and the ways in which Jews have been touched by slavery that have crossed my mind as I have reflected over the years as a rabbi, a historian and a theologian and particularly as I prepared for this presentation. The second – an attempt to frame ways in which I can talk about the experience of Jews with regard to chattel / productive slavery in the New World, particularly in the United States through the Civil War. The third is to look at the way the rabbinic tradition handled the issue of slavery in an attempt to protect enslaved people through the lens of the 12th century philosopher and jurist, Moses Maimonides’ compendium of Jewish law – his Mishneh Torah. -

KAUFMANN KOHLER 1843-1926 AMERICAN JEWISH SCHOLARSHIP: A SURVEY In Honor of the Centenary of Kaufmann Kohler By ISMAR ELBOGEN EINRICH HEINE aptly said that the Jew had a port- H able fatherland. Wherever the Jew migrated he carried with him his spiritual heritage. Different countries at differ- ent periods of Jewish history have held the hegemony in Jewish studies. During the past fifty years the mantle of Elijah has fallen on the United States. America was fast becoming a center of Jewish scholarship, and within the past decade it has become the sole center — with the exception of Palestine. I OUR sages were wont to express the continuity of Jewish tradition by the expression, "Before the sun of A set, the sun of B rose." Kaufmann Kohler, who was born in the old Kehillahof Fiirth, Bavaria, one hundred years ago — May 10, 1843 — had the good fortune to become a link between the generations. He was one of the last bahurim of an old- fashioned yeshivah, and he became a student of modern universities. As a high school student at Frankfurt, he came under the influence of Samson Raphael Hirsch, and a few years later under the spell of Abraham Geiger, then rabbi of the same city. While the neo-Orthodox Hirsch "imbued him with the divine ardour of true idealism," he received from the Reformer Geiger the inspiration for liberalizing the Jewish religion and for studying it in the light of modern biblical criticism and historical research. Kohler landed in the United States in 1869. The American Jewish community was then going through a period of 48 AMERICAN JEWISH YEAR BOOK transition. -

Rabbi Shim'on ben Yochai found it necessary to rafionalise the fact that the Torah says, ' nwx w’x np’ ’3 ’If a wife' H , a man takes (Deut. 22:13), and not, w~x nwx 7: 'If a husband' npn , a woman takes (Kid. 2b). Correspondingly, divorce was unilateral. The husband 'sent away' or 'dismissed' 'drove away' or 'expelled’ 'made (nbm ), (wfix ) or go out' (8'313) the wife. This fact; too, was noted by the Rabbis, when Yochanan Nuri's ben colléagues said to him: ’mp-unbn nwx’; grub“ mix” 5511 1393 131315 «Ex «’31:: 13'x‘w’xn1 ,n3131’7 x'nn #31315 nxxw nwxrm' 'The husband who divorces is not like the wife who is divorced, for she goes out with or without her consent, whereas he makes her go out only if he wishes' (Yev. 14:1). An exception was the 5th century BCE Jewish soldier colony in Elephantine whose marriage contracts make it clear that usband and wife had equal rights in the matter of divorce. (If one of their Gittin had survived it might have served us as a model for a reciprocal Get!) Another exception is recorded by Josephus (Ant. XV, 7, 10) concerning I Queen Salome who divorced her husband Costobarus. The chief source for biblical divorce (although an oblique one) is Deut. 24:1-4, which shows that, in addition to any oral declaration, the divorcing husband was required to write a note of dismissal ( n1n’13 150} and hand it to his wife.
