Taylor, Chair This dissertation examines how Tuareg people in Niger use music to reckon with their increasing but incomplete entanglement in global neoliberal capitalism. I argue that a variety of social actors—Tuareg musicians, fans, festival organizers, and government officials, as well as music producers from Europe and North America—have come to regard Tuareg music as a resource by which to realize economic, political, and other social ambitions. Such treatment of culture-as-resource is intimately linked to the global expansion of neoliberal capitalism, which has led individual and collective subjects around the world to take on a more entrepreneurial nature by exploiting representations of their identities for a variety of ends. While Tuareg collective identity has strongly been tied to an economy of pastoralism and caravan trade, the contemporary moment demands a reimagining of what it means to be, and to survive as, Tuareg. Since the 1970s, cycles of drought, entrenched poverty, and periodic conflicts have pushed more and more Tuaregs to pursue wage labor in cities across northwestern Africa or to work as trans- ii Saharan smugglers; meanwhile, tourism expanded from the 1980s into one of the region’s biggest industries by drawing on pastoralist skills while capitalizing on strategic essentialisms of Tuareg culture and identity.

JUPITER, FL October 30, 2017 An energetic and highly amplified electronic rock music having a hard beat, that is how Merriam-Webster defines heavy metal. If there was a viable channel in which to personify this description, then Jason Newsted would surely be one of its embodiments. A six-time Grammy winner, Rock and Roll Hall of Fame artist, Newsted—also known as “Jasonic”—is the former bassist of the band that arguably bred the metal genre—Metallica. From 1986 to 2001, Newsted forged his name in the annals of rock history with his beefy, fast-paced, and at times, nostalgic bass lines, as Metallica took the world by storm. Eternal staples like “Enter Sandman,” “The Unforgiven,” “Nothing Else Matters,” “One,” and “Fuel,” are but a brief sampling of the songs that were hatched during Newsted’s tenure. By singing lead on a few songs during the band’s live performances and astounding countless audiences with his remarkable bass solos, Newsted stamped his musical footprint. He even took over lead vocals for a whole show at the Kentucky Speedway during the 1999 Summer Sanitarium Tour, while frontman James Hetfield recovered from injury—and fiercely delivered. “I got to join my favorite band,” Newsted remarks. “I got real, real f***** lucky and got to travel around the world five times. Name: Bujorel Lucaci Signature: Date: 25 March 2011 i ABSTRACT This thesis seeks to develop a new method of interpretation for lament psalms and to apply it to Psalms 13, 22, 44, 88. The new method is called Theo-dramatic approach. This method recognizes lament psalms as dialogical prayers, (multi- voicing) which describe the drama of suffering experienced by the psalmists. The Theo-dramatic approach is an imaginative method of interpretation. The most important elements are: the script, the theatre and the performance. The actors are: God, the supplicant, the enemy, the community. Script : lament Psalms: 13, 22, 44, and 88, were chosen because they demonstrate much of the vocabulary of the absence or hostility of God. Theatre : the public space provided by the covenant relationship between God and pray-er. Performance : the dramatized grief and pain of the psalmist, caused by the hostility or absence of God. This method of interpretation emphasizes the drama presented in the script: protest, argument, accusation of God for being unfaithful to the covenantal responsibilities.

In addition to having products or services to sell, an Internet presence has become critically important for businesses that want to connect with consumers near and far. While most businesses use trademarks like words, logos, slogans, and other designations to facilitate such consumer connections across the geographically borderless Internet, many of these businesses have not availed themselves of state or federal registration mechanisms for those trademarks. While unregistered trademarks, also known as common-law trademarks, have historically been entitled to legal protection in geographically delimited territorial zones, current trademark jurisprudence is grounded in the physical world and provides scant guidance on the geographic extent of common-law trademark protection in the Internet context. In addition, when such unregistered trademarks inevitably collide with other similar, unregistered trademarks in cyberspace, it is unclear whether the current law, grounded in the concurrent-use doctrine, can survive in an Internet environment. This Article analyzes previous models for evaluating unregistered trademarks used in the Internet context and proposes that these models are insufficient to deal with the myriad issues raised in cyberspace.     SAME BUT DIFFERENT: Chaos and TV Drama Narratives BY ALISON MCLACHLAN A thesis submitted to the Victoria University of Wellington in fulfilment of the requirements for the degree of Doctor of Philosophy Victoria University of Wellington (2019) ABSTRACT Complexity is a term that is now commonly used when discussing TV serial dramas and the way that, in recent years, creators and producers of this narrative form have embraced innovative and challenging strategies to tell their stories. As a result, it is also often argued that all TV serial dramas are strikingly different from one another; one of the few things that contemporary TV serial dramas have in common is their employment of complex narrative strategies. However, in this thesis, I argue that—while serial dramas are different from one another in many ways—they are also all the same at a fundamental level. In order to examine the fundamental narrative components that all serial dramas employ, I use chaos as a framework. Chaos is a branch of mathematics and science which examines systems that display unpredictable behaviour that is actually determined by deep structures of order and stability. At its most basic level, chaos corresponds with the way in which serial dramas are both complex and simple at the same time; beneath the complexity of serial dramas are fundamental building blocks that are used to generate innovative, challenging and unpredictable narratives. I apply the findings from my critical examination of chaos and TV drama narratives to the creation of my own TV projects, which employ the inherent structures and patterns of TV drama narratives in a way that produces innovative and complex stories.

From my point of view, there is no other citation, which more properly expresses the emotional impact of music to human beings. People come and go, but music remains forever, since acoustic waves are not bound to matter like monuments, paintings, or sculptures. In contrast, music as sound in general is transmitted by matter vibrations and can be reproduced independent of space and time. In this way, music is able to connect humans from the earliest high cultures to people of our present societies all over the world. Music is indeed a universal language and likely not restricted to our planetary society. The importance of music to the human society is also underlined by the Voyager mission: Both Voyager spacecrafts, which were launched at August 20th and September 05th, 1977, are bound for the stars, now, after their visits to the outer planets of our solar system (mission status: https://voyager.jpl.nasa.gov/mission/status/). They carry a gold- plated copper phonograph record, which comprises 90 minutes of music selected from all cultures next to sounds, spoken messages, and images from our planet Earth. There is rather little hope that any extraterrestrial form of life will ever come along the Voyager spacecrafts. But if this is yet going to happen they are likely able to understand the sound of music from these records at least.
