Mngomezulu Date II Abstract The institution of traditional leadership remains one of the hotly contested topics in post- apartheid South Africa. This is despite the fact that Chapter 12 of the Constitution of the Republic of South Africa accords this institution status under the new political dispensation. What seems to be the bone of contention is the role traditional leaders should play in the present context. The roles and functions of amakhosi have been in constant flux, being redefined by different stages of history, from colonialism to apartheid and once again in the democratic South Africa. As such, amakhosi remain part of the present governance system. This study was guided by several aims which included but were not limited to: establish and articulate the roles and functions of amakhosi in post-apartheid South Africa and local governance, with a specific focus on amakhosi falling under Ingonyama Trust; evaluate the adequacy of resources allocated to amakhosi for achieving their directive; parallel legal requirements with work taking place at grassroots level; as well as compare and contrast the mandate of amakhosi against that of democratically elected councillors focusing particularly on those who fall under Ingonyama Trust. Empirical research using questionnaires and interviews was conducted in the Ugu District Municipality. The findings revealed inter alia that the roles and functions of amakhosi have been in constant flux over a lengthy period of time. As such, amakhosi and their traditional leadership supporting structures have had to constantly evolve to pass the bar. Another finding was that amakhosi are still accorded status and relevance in society but need to be provided financial resources for them to be more effective. Lastly, the study revealed that at times amakhosi and elected councillors compete for supremacy. It is therefore recommended that further legislation is needed to ensure that these two leadership structures work in harmony to ensure community development. Existing accounts of obligation cannot parry critiques from rival theories, nor refute philosophical anarchists’ formidable attack on obligation. To move discussion of obligation forward, this dissertation offers an alternative solution to what George Klosko has called the ‘voluntarist paradox’ of liberal-democratic political obligation. While liberal ideas about the individual require that any obligation to obey be assumed through a voluntary act, individuals do not voluntarily assume obligations frequently enough to support legitimacy claims. In response to this paradox, most scholars deploy non-voluntary justifications for a general obligation to obey, while philosophical anarchists deny that such an obligation exists at all. In contrast, I argue that overcoming the voluntarist paradox requires a radically different view of the aims and scope of political obligation.

    Planting Parliaments in Eurasia, 1850–1950 Parliaments are often seen as Western European and North American institutions and their establishment in other parts of the world as a derivative and mostly defec- tive process. This book challenges such Eurocentric visions by retracing the evo- lution of modern institutions of collective decision-making in Eurasia. Breaching the divide between different area studies, the book provides nine case studies cov- ering the area between the eastern edge of Asia and Eastern Europe, including the former Russian, Ottoman, Qing, and Japanese Empires as well as their succes- sor states. In particular, it explores the appeals to concepts of parliamentarism, deliberative decision-making, and constitutionalism; historical practices related to parliamentarism; and political mythologies across Eurasia. It focuses on the historical and “reestablished” institutions of decision-making, which consciously hark back to indigenous traditions and adapt them to the changing circumstances in imperial and postimperial contexts. Thereby, the book explains how represent- ative institutions were needed for the establishment of modernized empires or postimperial states but at the same time offered a connection to the past. To this extent it is best understood as a kind of ethical naturalism according to which the lives of human beings (ought to) refl ect or conform to the order of nature. Political relations and institutions, by extension, are described and/or justifi ed in relation to natural laws. For Aristotle, human beings are social creatures by nature, thus life in the polis is natural for human beings. Certain Stoics, while not necessarily disagreeing with the idea that human beings are social by nature, nonetheless deny that the polis (or at least certain of its key features, such as private property) is natural in the strict sense. In both cases, the concept of the individual person is at best secondary to the concept of the community, which is in turn secondary to the archic concept of natural order. Because human beings are essentially social, and because this essential sociability helps to defi ne the place of human beings within the broader cosmological order, sociopolitical relations within communities and among individual human beings are justifi ed to the extent that they are deemed “natural.” Political naturalism of this sort is better understood as a species of a wider genre which might be called “political holism.” This “holism,” as I understand it, rests on two crucial theses.

In the last ten years, universities in North America have produced on average over ten doctoral dissertations a year that discuss the practical philosophy that Aristotle espouses in his Nicomachean Ethics, Eudemian Ethics, and Politics. Since the beginning of the millennium there have been three new translations of the entire Ethics into English alone, several more that translate parts of the work into English and other modern languages, and half a dozen collections of new articles discussing Aristotle’s Ethics. Such an outpouring of scholarship has produced an almost unmanageable wave of books, articles, and reviews. Through my topical bibliography, I seek to organize this wealth of scholarly writing so as to make it manageable both to scholars working across the disciplines of philosophy, classics, history, and politics, and to scholars pursuing theses on specifi c topics within the Ethics. The bibliography takes as its model and is much indebted to that compiled by Barnes, Schofi eld, and Sorabji in their Articles on Aristotle, Volume 2: Ethics and Politics (1977), which was further updated and incorporated into the complete bibliography to all of Aristotle’s writings in Barnes’s Cambridge Companion to Aristotle (1995).
