1. General

The transport services of EUROGATE Intermodal GmbH are subject to the following conditions.

Delivery of ISO containers 20ft, 40ft up to 9’6’’ height, as well as open top containers (without overwidth and overheight) and reefer containers (without active cooling during the entire rail transport). Transport of shippers own containers is possible after prior consultation.

Via the terminals , , Kornwestheim, , , , , , , , , , Schkopau, Schkeuditz- and the following ancillary charges apply.

For container transports via barge from/to western (Antwerp/Rotterdam), please note that possible supplements like "Low water" and "Congestion" can be charged according to expenses.

1.1. Special-goods categories

Special goods, such as alcohol, raw tobacco, cigarettes, munition or weapons, cannot be transported by EUROGATE Intermodal.

1.1.1. Carriage of goods subject to prohibition and restriction

In the Annex to this List of Ancillary Charges you will find a List of Prohibited and Restricted Goods. Under our status as a Licensed Forwarder we cannot ship the goods listed in this Annex. This naturally excludes shipments containing goods subject to prohibition and restriction leaving the Port of Hamburg as “community goods” (ATA or ATC dispatch or dispatch as combined freight transport). Should you have other goods for carriage, however, we shall be glad to assist you and will inform you whether we can transport them.

1.1.2. Goods subject to compulsory presentation

In the Annex to this List of Ancillary Charges you will find a List of Goods subjected to Compulsory Presentation under Section 55 Paragraph 1 No. 3 of the German Human and Animal Foodstuffs Act (LFGB). These goods are subject to presentation in the form of a GVDE, BLE or other types of control registration. Under our status as a Licensed Forwarder we are able to ship these goods by consignment system.

However, these goods are subject to the following regulation:

They must be marked “permitted for the internal market” in their respective control registration. They must be so marked in our consignment system, including the control number of the registration form.

This means that we always need you to supply the GVDE, BLE etc. number for these specific goods. You should further draw your customers’ attention to this instruction when importing such goods. There must be a link between the control registration and our consignment note. Should this link fail to be supplied, you and your customers run a risk that we will not be able to ship the container.

This list is designed as an aid. Should you have other goods for carriage, however, we shall be glad to assist you and inform you whether we are able to transport them.

1.2. Order data of shipping orders

An overview of all order data required is available in our information leaflet entitled “Information on Booking Procedures”. This information must arrive at EUROGATE Intermodal by no later than 12.00 midday on the day prior to the dispatch scheduled.

In general, please note that we pass on all eventually costs which ensure a smooth web run or a taking over at the terminal according to expense.

1.3. Cancellation charge (web run)

We reserve the right to charge a cancellation fee, as far as scheduled loading is prevented for the following reasons:

 Failure to provide the container(s) at the loading terminal on the dispatch day set due to lack of order data or incorrect order data.

 Damage to the cargo unit, as a consequence of which the container(s) cannot be loaded.

 Non-loading due to lack of release note and/or lack of V certificate.

 Lack of clarity for customs purposes or lack of accompanying documents.

 Failure to provide the container(s) at inland rail transhipment station in case we are not responsible for the delivery.

1.4. Heavy-lift containers (rail-loading)

A railway heavy-goods supplement of EUR 100.00 per container will be charged for 20’/40’ containers with a gross weight of more than 28 ts. This supplement is valid not only for import containers but also for export containers.

1.5. Dutiable goods, NCTS duration, terms and conditions

EUROGATE will issue an NCTS consignment note free of charge including 3 items of goods. For each additional item of goods we charge a lump-sum fee in the amount of EUR 3.00. The duration of the NCTS consignment note usually is 6 calendar days, starting from the day of despatch of the cargo unit in question.

The value of goods per NCTS consignment is limited to EUR 500.000,-. Goods with higher value adjustingly need to be checked by us in advance.

For a value of goods over EUR 500,000.00 we charge an additional surcharge in the amount of + 0.025 % of the value of the goods.

Besides our own monitoring systems, EUROGATE Intermodal assumes a duty of care of the NTCS consignment system(s) on the contractor’s / customer’s part.

The recipient must take care to ensure that the NCTS document is notified or supplied to the proper customs office of destination following receipt.

The recipient or customer must further inspect the NCTS documents, prior to removal of their seal, to check the expiry date and to ensure that the seal number is correct.

An NCTS consignment note will be issued for every cargo unit. You will find the data needed for the NCTS in our information on booking procedures.

Forwarding or connection NCTS consignment system in cross-border transportation will be charged according to expense.

T1/NCTS via Terminal Dresden/Schkopau/Schkeuditz-Leipzig /Berlin/ Cologne/ Duisburg/ Neuss  T1 issue up to EUR 150,000.00 = EUR 35.00  one T1 position is included, thereafter EUR 5.00 for every further position  T1 cancellation = EUR 30.00

1.6. Transmission of inaccurate NCTS data

Should NCTS data be transmitted incorrectly, we shall undertake the clarification of such errors, in consultation and agreement with our customer. Errors include, among other things, differences in quantity and weight, and deadline overruns. In the course of this clarification process we shall communicate with the competent customs offices and, if necessary, with the goods recipients. For this service we shall make a one-time charge of EUR 120.00 excluding VAT, per transaction/NCTS. Any costs on the customs side, such as reminder charges or warning fines, and costs resulting from tax demands, will not be covered by this all-inclusive charge.

1.7. Hazardous goods

We accept orders for hazardous goods only if information is provided in accordance with the new Regulations on Dangerous Goods ADR/RID/ 2015, in the latest version of the respective amendment.

Classes 1, 4.1, 5.2 and 7 are excluded from carriage. Ancillary costs and ancillary charges – Germany Valid from 1st July 2018 until 31st December 2018 page 6/24

Also excluded are goods according to table 1.10.3.1.2 of the Regulations on Dangerous Goods ADR/RID/ 2015. These are goods which may be transported by rail only in connection with a safety plan due to their hazardousness. At present, we cannot provide such a safety plan.

In the annex to these ancillary costs you can find an extract of the goods in question.

EURGATE Intermodal accepts orders for hazardous goods subject to ascertainment of the road and rail facilities available.

We charge a hazardous-goods supplement of EUR 20.00 per container for the carriage of containers with hazardous goods via the EGIM terminals.

For transports via terminals Cologne, Duisburg, Neuss, Berlin, Schkopau, Schkeuditz- Leipzig and Dresden a hazardous-goods supplement of EUR 35.00 per container will be charged.

1.8. Transport of waste subject to authorization

In principle, transport of waste subject to authorization is possible. But it is necessary before despatch and delivery of these goods to undertake a respective check of transportability by our rail operator and inland trucking companies on the basis of the AVV number.

We charge a waste supplement of EUR 20.00 per container for the carriage of waste containers without authorization and subject to authorization.

1.9. Equipment

1.9.1 Outsize cargo/Out of gauge units

Open-top containers and flat-racks can only be carried on condition that loading measurements are NOT exceeded; i.e. the container must be tendered “in gauge”.

1.9.2 45ft Containers

A general transport facility is not available and is only possible in coordination with our disposition department. The surcharge for transports of 45ft containers amounts to EUR 45.00 per loading unit.

1.10. Export B/Z/BHT-number

Application may be made to issue a BHT number or customs registration if required. For this purpose we must be supplied promptly by e-mail with all the necessary documents.

Costs per registration: EUR 18.00, including 3 entries free, beyond that on request.

1.11. Demurrage and detention

EUROGATE Intermodal will not pay the costs of container rent or the costs of container storage (demurrage and detention).

1.12. Additional charges - energy/congestion/fuel & safeguarding

EUROGATE Intermodal reserves the right to charge supplements and/or make additional ancillary charges to reflect the increases in the price of diesel or energy and as a result of dispatch bottlenecks (congestion) in port and hinterland terminals. These supplements or ancillary charges will be shown separately on the invoice.

EUROGATE Intermodal reserves the right to invoice without prior notice any safeguarding measures needed during the loading of goods. Such safeguarding measures include (among others) inserting clamps and/or doorstops, or if necessary affixing labels.

2. Seaport

2.1. Supplementary charges for port transfers

Hamburg (within and outside former Free Port) The supplement charge for empty and full transportation by truck on FOT basis to other terminals or depots within or outside the former Hamburg Free Port is EUR 117.00 per container (excluding documentation).

In case of a possible container combination trucking, the surcharge is EUR 87.00 per 20ft container.

In the above mentioned rates there are two Handlings at the train terminal in the sea port included.

Bremerhaven The supplement charge for empty and full transportation by truck on FOT basis to other terminals or depots within Bremerhaven (except EUROGATE Bremerhaven, MSC-Gate, CT 2/3 and NTB) is EUR 210.00 per container (excluding documentation, including handlings).

Bremen The supplement charge for empty and full transportation by truck on FOT basis to other terminals or depots within , e.g. GVZ Bremen (with loading at Bremerhaven Terminal) is EUR 275.00 per container (excluding documentation, including handlings).

Wilhelmshaven The supplement charge for empty and full transportation by truck on FOT basis with loading at Bremerhaven Terminal is EUR 325.00 per container (including documentation and handlings).

2.2. Veterinary/plant and vegetable inspections and CPA

Hamburg (KTH/CTA/CTT/CTB) For container delivery to veterinary-/plant and vegetable inspections which are organized by the customer himself we charge at KTH/CTA a provision lump sum of EUR 285.00 per loading unit.

In case delivery to a different inspection place is required we charge EUR 402.00 incl. transfer/ handlings.

In the context of the presentation we grant a free parking time of one hour, thereafter we charge EUR 32.00 for each 1/2 hour or part thereof.

When arranging a mobile CPA we will charge the incurred time expenditure on basis of the known waiting time rates according point 4.1. A free waiting period is not granted.

Hamburg (EKOM/EGH) For container delivery to veterinary-/plant and vegetable inspections or for a presentation to customs clearance (CPA) the charge is EUR 285.00. Train side Handlings are included in the mentioned rate.

In the context of the presentation we grant a free parking time of one hour, thereafter we charge EUR 30.00 for each 0.5 hour or part thereof.

In case of returning the container to the shipping line's stock, we shall charge EUR 185.00 per tour. The coordination connected with returning the container to the shipping line’s stock will be the customer's responsibility.

When arranging a CPA through customs in the course of regular port transfer (point 2.1/Hamburg) we will charge to the transfer an additional lump sum in the amount of + EUR 95.00 per loading unit.

Bremerhaven For container delivery to veterinary-/plant and vegetable inspections or for a presentation to customs clearance (CPA) we charge EUR 285.00. Train side Handlings are included in the mentioned rate. For NTB (CT4) special handling rates shall apply.

In case of returning the container to the shipping line's stock, we shall charge EUR 185.00 per tour. The coordination connected with returning the container to the shipping lines stock will be the customer's responsibility.

In the context of the presentation we grant a free parking time of one hour, thereafter we charge EUR 30.00 for each 0.5 hour or part thereof.

2.3. Status documents for imports at Bremerhaven

When leaving Bremen Free Port private carriers must submit a so-called status document to Customs. In case we only receive an ATC number with the booking, we must register the container via BHT, to obtain a corresponding BHT number. Using this BHT number, it is then possible to print out the status document needed for loading. No supplementary charges will be made for this transaction.

2.4. Handling of customs papers

Starting from December 2010, accompanying documents for trains will be handled at the Finkenwerder Straße Customs Office. Upon customer’s request, EUROGATE Intermodal GmbH will organise a courier service according to the following terms and conditions:

From Kurt-Eckelmann-Str.1 - Finkenwerder Str. 4 - Kurt-Eckelmann-Str. 1: the price per round trip amounts to EUR 40.00 including 60 minutes free waiting time. We shall charge EUR 1.55 for every further 6 minutes waiting period. These charges are exclusive of VAT.

2.5. Extra handling - Seaport

2.5.1. Hamburg

For containers, which will be delivered or collected by our customers themselves in Hamburg-Waltershof at EUROKOMBI / EUROGATE, or KTH Terminal, EUROGATE Intermodal will charge the following handlings:

KLV-Terminal Handling:  EKOM – EUROKOMBI Terminal Hamburg = EUR 54.00 per shipment o regular: delivery day + 1 day free, thereafter EUR 7.50 per TEU/day o IMO: delivery day + 1 day free, thereafter EUR 13.00 per TEU/day  KTH – Kombi Terminal Hamburg = EUR 54.00 per shipment o delivery day + 1 day free, thereafter day 1-3 = EUR 9.70 TEU/day o day 4-7 = EUR 18.40 per TEU/day o from day 8 = EUR 23.50 per TEU/day

Seaport Terminal Handling:  EGH – EUROGATE Terminal Hamburg = EUR 110.00 per shipment  CTB – Container Terminal Burchardkai = EUR 110.00 per shipment

Storage charges which might arise at the Seaport Terminals EGH or CTB will be charged according to expenses.

2.5.2. Bremerhaven

For containers, which will be delivered or collected by our customers themselves in Bremerhaven at CT2 Terminal, EUROGATE Intermodal will charge the following handlings:

 CT2 EGIM stock (EGI) – CTB Bremerhaven = EUR 110.00 per shipment

Storage charges which might arise at the Terminal will be charged according to expenses.

3. Inland

3.1. Terms and conditions of Storage

Supplement for Munich/Ulm/Augsburg/Kornwestheim*: At the Munich/Augsburg/Kornwestheim Terminals, from day 5 of storage (day of arrival + 4), at Ulm Terminal from day 3 of storage (day of arrival + 2), all import shipments will be automatically transferred to a separate extension area. A supplementary storage charge of EUR 35.00 per loading unit will be made for this facility. The stated storage charges per day and per TEU will likewise continue to apply. No alternative long-term storage will be possible after this time.

Supplement for Nuremberg**: From 15 April 2016 at the Nuremberg TriCon Terminal, from day 5 of storage (day of arrival + 4), all import shipments will be automatically transferred to a separate extension area.

A supplementary storage charge of EUR 61.00 (20ft.) and EUR 82.00 (40ft) per loading unit will be made for this facility. The day of arrival + 3 (Storage day 4) will likewise be charged at the usual storage rate as set out in the foregoing overview. The all-inclusive charge as stated includes a free storage period up to Storage day 9 (arrival + 8). From day 10 of storage the usual storage charge will come into force.

On public holidays incoming containers will be calculated on the base of arrival of the following official working day.

On Saturday incoming containers will be calculated on the base of arrival of the following Monday (calculate free weekend).

Long-term import-side storage will be offered upon request.

3.1.2. Terms and conditions of storage - EXPORT

Long-term storage on the export side at the stated inland terminals will only be possible in future at individual locations and not in full via all terminals, assuming free terminal access. Should loading units be delivered prematurely at the terminal at the customer’s wish, please note the following terms and conditions:

Supplement for Munich/Ulm*:

At the Munich/Ulm Terminal, from day 5 of storage (day of arrival + 2), all export shipments will be automatically transferred to a separate extension area. A supplementary storage charge of EUR 55.00 per loading unit will be made for this facility. The stated storage charges per day and per TEU will likewise continue to apply. No alternative long-term storage will be possible from this time.

Supplement for Nuremberg**: In Nuremberg, from day 5 of storage (day of arrival + 4 days), all export shipments at the Nuremberg TriCon Terminal will be automatically transferred to a separate extension area.

A supplementary storage charge of EUR 61.00 (20ft) and EUR 82.00 (40ft) per loading unit will be made for this facility. Day of arrival + 3 (Storage day 4) will likewise be charged at the usual storage rate as set out in the foregoing overview. The all-inclusive charge as stated includes a free storage period up to day 6 of storage (arrival + 8). From day 10 of storage the usual storage charge will be applied.

On public holidays incoming containers will be calculated on the base of arrival of the following official working day.

On Saturday incoming containers will be calculated on the base of arrival of the following Monday (calculate free weekend).

3.1.3. Alternative interim storage outside rail handling station

Should the customer so wish, EUROGATE Intermodal GmbH can transfer containers to interim external storage on the following terms and conditions:

3.2. Storage of Hazardous Goods

Storage of hazardous goods is only possible for import containers. At the terminals Munich, Augsburg, Ulm, Kornwestheim, Frankfurt/Main, Regensburg, Mannheim and Nuremberg an additional hazardous-goods delay charge will be charged from the first day of storage (incl. day of arrival).

3.3. Extra handling - inland

We make the following charges for handling shipments without pre-transport or post- transport by rail:

 Storage charge per container per day EUR 25.00 from the first day of storage

 Handling per shipment EUR 56.00 per hub

4. Truck delivery

4.1. Free loading and unloading time

Free loading and unloading time is two hours. This applies to all deliveries within Germany. Likewise this regulation applies to consignments abroad shipped via a national terminal.

On expiry of the free loading and unloading time we charge EUR 32.00 for each half hour or part thereof. The free loading and unloading time runs from the beginning of the loading or unloading time, but no later than from the time agreed. When operating several loading points or customs stops a total free time of 2 hours will be granted.

Delivery times or fixed deadlines cannot be guaranteed. These assume unhindered conditions of carriage both on rail and road.

4.2. Free holding time at empty returns

At the empty returns we offer a free time of 30 minutes. After that we charge EUR 30.00 extra per started 30 minutes.

4.3. Multi-stop rule/Customs-stop rule

Applicable to all the national terminals listed

For any further loading or unloading point we shall charge EUR 60.00 for an extra cost of 10 km round-trip. A free loading and unloading time of 2 hours in total will apply to all loading points or customs stops.

Multi-stop configurations with a cost of more than 10 km round-trip must be calculated separately. We shall be glad to quote you the costs for this upon enquiry.

Additional loading points which are not placed in the context of the order will be announced in written form and charged accordingly by the administration within 24 hours (Monday-Friday).

Possible multi-stops for the terminals Cologne, Duisburg, Neuss, Schkeuditz-Leipzig, Dresden, Schkopau and Berlin we are pleased to offer on request.

4.4. 2nd journey – outage freight, unsaddling & loading/unloading by crane

4.4.1. Loading and unloading by crane

When loading or unloading a container at the loading or unloading point, delivery will be charged in accordance with our list of charges. For billing purposes the delivery will be viewed as a normal shipment.

The following rule shall apply. “Free delivery not set-down.”

This shall not apply if a side-loader delivery has been expressly ordered, in which case the rule to be applied is: “Free delivery and set-down.”

The supplements for side-loaders shall apply as listed for the terminal in question.

Should a further journey to the loading point be necessary, or should you order such a journey, this will be charged on the basis of the Table in Section 4.4.2., plus the additional road toll as well as fuel surcharge. Should a further side-loader journey be made, a further side-loader supplement will likewise be charged. The respective costs will be based on the place in the kilometre scale, set out in Section 4.4.2., to which the location is assigned. We shall be glad, on request, to indicate the place in the scale to which the location is assigned.

4.4.2. Unsaddling, 2nd journey as well as outage freight truck

Unsaddling plus a further second journey, should customer so desire, will be subject to the following supplements:

As part of the unsaddling process we shall grant a free waiting time of 30 minutes. On expiry of this period we shall make a charge as set out in 4.1.

4.5. Chassis rental

Use of a chassis without charge is 24 hours; after that we shall charge a chassis rent of EUR 36.00 per chassis per calendar day.

4.6. Special equipment

Due to the limited availability of special equipment, please note that fixed appointments cannot be assumed or guaranteed.

4.6.1. Tip chassis

Facilities are available to deliver your booked container by tip chassis. Please refer to the table below concerning the supplement for delivery by tip chassis per shipment (capacities and facilities may be obtained from the respective terminals upon request).

4.6.2. Side-loaders

We charge a supplement per shipment (single journey) for delivery by side-loader via the below mentioned EUROGATE Intermodal Terminals. Should a second journey be required, we will be glad to offer you the same on request under [email protected].

Depending on the local space available at the delivery location and possible customer request a 2nd lift in the mentioned amount can be charged.

Side-loaders with a higher maximum weight will be offered upon request.

Please note that capacities and availabilities concerning deliveries by side-loaders via the respective terminals in general have to be clarified in advance with our disposition department. In principle, the availability cannot be ensured for all regions.

We can offer side-loader via the Frankfurt Terminal only within a distance of 150 km.

Should a side-loader have been provided, we likewise reserve the right to withdraw it at a charge once the free loading and unloading period has expired.

4.7. Supplementary for outside depot (FIT, DP World Stuttgart)

Frankfurt am Main FIT Depot. When collecting or depositing at the FIT Depot (Hoechst Industrial Park), we shall charge a supplement of EUR 35.00 per container.

Stuttgart-Port Depot DP World. When collecting or depositing at the DP World Depot we shall charge a supplement of EUR 35.00 per container.

4.8. Heavy-lift containers (truck delivery)

A heavy lift supplement of EUR 50.00 per delivery will be charged for containers with an overall weight of more than 29.5 ts. In principle, containers of this weight have to be discussed with our transport department.

4.9. Special-containers

4.9.1. Tank containers

20ft ISO tank containers can be transported by EUROGATE Intermodal GmbH. Tank containers which exceed the ISO dimensions will be offered separately on demand.

4.9.2. Reefer containers

Reefer containers can be loaded via EUROGATE Intermodal in combined transportation, but without active cooling during rail transportation.

Transport with gensets or clip-on aggregates is possible upon agreement. We would be glad to provide you with an individual offer.

4.10. Weighing of containers (SOLAS)

Pursuant to the provision in force since 1 July 2016 governing the weighing of export containers, we offer facilities for weighing via the inland terminals set out below.

To ensure smooth order handling may we please ask you to supply a clearly identifiable commission for the shipment order in question, marked "SOLAS/VGM/weighing."

Likewise please note that cash payments cannot be guaranteed at the weighing facility.

The said conditions apply exclusively in conjunction with an HGV provision order to EUROGATE Intermodal.

Naturally it will be possible not to accept our recommended facilities and to travel to another weighing facility. For this purpose please contact the EGIM Sales Team at any time to receive an individual offer.

In case of an optional weighing in the seaport (Hamburg, Bremerhaven and Bremen) after web run, we would like to ask you for prior consultation.

Exclusion of liability:

As an additional service, under SOLAS regulations, EUROGATE Intermodal offers weighing in combined transport. EGIM does not undertake any further obligations resulting from SOLAS regulations. All further costs and risks associated with weighing shall be the responsibility of EGIM’s customer.

Nor shall EGIM be liable for the following:  Additional costs incurred by way of weighing (waiting time at the weighing machine, additional outward journeys due to failure to observe the opening times of the weighing machine, etc.)  Costs incurred due to delay through weighing, such as demurrage or detention and storage charges in inland + seaport  Circumstances entailing failure to load the container at the seaport, such as an error in the weighing certificate, failure to transmit or submit it to the shipping line, deviations in weight, or further problems in the information chain.

Likewise all ancillary costs shall be net plus statutory value added tax.

4.11. High-security seal

We offer facilities, if required, to apply a high-security seal. Since not all the contractors we employ have such a seal available, please consult with ourselves in advance, in order that we can deal with these requirements. Cost per seal: EUR 15.00

4.12. Supplements for late/weekend and night deliveries

We charge a supplement of EUR 100.00 per delivery for deliveries between 22:00 hours and 05:00 hours.

Should a delivery be desired at a weekend, this shall require prior consultation and agreement with our Operations Team. We shall also charge a supplement of EUR 100.00 per provision.

4.13. Truck tolls

EUROGATE Intermodal reserves the right, following proper prior notice, to pass on to its customers or to adapt any statutory increases in national road tolls.

4.14. Set-down and pick-up of empty containers

4.14.1.

Corresponding return of an empty container, in the wake of an import shipment, to the container depot set by the client is only possible if the turn-in number is given in correctly and correct registration has been made by the shipping line concerned. Additional costs resulting from incorrect submission of the reference number or defective information to EUROGATE INTERMODAL and/or depot will be passed on to our client in accordance with actual expenditure.

4.14.2.

Corresponding the pick-up of an empty container, in the wake of an export shipment, to the container depot set by the client is only possible if the pick-up number is given correctly and correct registration has been made by the shipping line concerned. Additional costs resulting from incorrect submission of the reference number or Defective information to EUROGATE Intermodal and/or depot will be passed on to our client in accordance with actual expenditure.

The type and characteristics of the equipment provided must be suitable for the loading intended and be supplied in a corresponding condition for delivery at the depot or terminal. Due to local circumstances (space and light available and any safety regulations) at the depots or terminals, the equipment so supplied will only be given an external visual inspection by the subcontractor employed by EUROGATE Intermodal. EUROGATE Intermodal will not pay any additional costs resulting from wrong deliveries at the depot or terminal or a refusal to accept on the part of the unloader.

All terms and conditions apply in EUR and shall be valid until withdrawn, but no longer than 31st December 2018.
