Box 999 Butner, NC 27509-999 t QUESTIONS PRESENTED Briefly, an Agent of Defense Criminal Investigation Service of the Inspector General's Office of the Department of Defense obtained the search and seizure warrant under the color of law enforcement, and solely conducted the investigation, grand jury indictment and bringing charges against the Petitioner, a civilian, in this campaign contribution violation case without the approval of FEC. Appellant was convicted and sentenced for imprisonment. Upon appeal, the Appellate Court affirmed the conviction, ruling that military conduct civilian law enforcement without jurisdiction and in violations of Posse Comitatus Act and the federal statutes "are defects in instituting prosecution must be raised before trial," and "provide no remedy," and only repeated violations may be considered for a "special sanction of judicial deterrent." The rulings on PCA violations are inconsistent and contradicting among nearly every circuit of the court of appeals. Does the Third Amendment of the Constitution afford people the protection from military intrusion into civilian affairs, such as investigation and bringing charges against civilians for a political contribution violation? Does the provision of prohibiting the use of military as a posse comitatus in law enforcement proscribed in the Posse Comitatus Act, 18 U.S.C. §1385 and Domestic Security Act, 6 U.S.C. §466 deprive the military of jurisdiction in investigation and prosecution of civilians? Does Congress enact the Statutes 18 U.S.C. §1385, 6 U.S.C. §466 as jurisdiction removal rules? II t Is it constitutional to punish a defendant for a violation committed by a co-defendant, such as the amount of the campaign contribution made by another person? Is the appellate court's standard ruling unlawful that violations of Posse Comitatus Act (PCA) and its statutes "provide no remedy" for the victim of the violation, and these laws may be violated repeatedly before the court to consider the "possibilities" for "the special sanction of a judicial deterrent"? The jurisdiction of this Court is invoked under 28 U.S. C. § 1254(1). 1 4 CONSTITUTIONAL AND STATUTORY PROVISIONS INVOLVED Constitutional: The First Amendment of the Constitution Freedom of Speech The Third Amendment of the Constitution Free of military intrusion in civilian affairs and enforcement of law The Fourth, Fifth, and Sixth Amendment of the Constitution Due Process Clause Statutory: Posse Comitatus Act, 18 U.S.C. §1385 Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully use any part of the Army or the Airforce as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years or both. Domestic Security Act, 6. U.S.C. §466 (2002) Section 1385 of title 18, known as Posse Comitatus Act prohibits the use of the Armed Forces as a posse comitatus to execute the laws except in cases and under circumstances expressly authorized by the Constitution or Act of Congress. Congress reaffirms the continued importance of section 1385 of title 18, United States Code, and it is the sense of Congress that nothing in this Act should be construed to alter the applicability of such section to any use of the Armed Forces as a posse comitatus to execute the laws. 0111 A STATEMENT OF THE CASE The Third Amendment of the Constitution affords citizens of the United States the protection from military intrusion in civilian affairs. Congress enacted Posse Comitatus Act (PCA) and federal statutes prohibiting military from participation of law enforcement. However, the incidences of military participated law enforcement have increased dramatically since the establishment of variable Criminal Investigation Services of Department of Defense (DoD) under the Inspector General Act (IGA). The question of PCA violation has been raised repeatedly in nearly every Circuit of the appellate courts, and resulted in contradicting or inconsistent rulings and resulted "disastrous consequences for the Constitution". "For a court to uphold a claim to such extraordinary power [of using military for civilian law enforcement] would do more than render lifeless the Suspension Clause, the Due Process Clause, and the rights to criminal process in the Fourth, Fifth, Sixth, and Eighth amendments; it would effectively undermine all the freedoms guaranteed by the Constitution." At the head of the predominately minority crowd walked the Reverend Ignatius Waters. A decade and a half earlier, Reverend Waters was a key figure in establishingthe highly successful community-policing program in Boston. That, however, was before weapons-grade anthrax was released in the Washington, D. C. Metro system and before car bombs simultaneously exploded at the headquartersof five major corporations in Dallas, Atlanta, Chicago, Seattle, and Boston. Those acts of terrorprompted Congress to pass the "Freedom and Policing Act of 2004," which removed any legal obstacles to deploying the military domestically and mandated that a reluctant Pentagon become fully involved in law enforcement activities.

    LEGAL MEMORANDUM: THE FEDERAL GOVERNMENT’S LIMITED ROLE IN ELECTION LAW ENFORCEMENT From: Voter Protection Program To: Interested Parties Re: The Federal Government’s Limited Role in Election Law Enforcement Date: 10/21/20 State governments have the primary responsibility to administer elections and enforce election law. Traditionally, the federal role has been limited to two areas: (1) Enforcing the protections of the Voting Rights Act to ensure that every eligible citizen has the right to vote, and (2) after an election is concluded, prosecuting federal election crimes. But recent comments and actions by federal government officials have raised concerns about the possibility of unprecedented federal involvement – and potentially interference – with the conduct of elections and enforcement of election laws at the state and local level. This memorandum analyzes applicable law and concludes that multiple federal laws prohibit the deployment of troops or other armed federal agents to polling places before or on Election Day. The memorandum also examines the Insurrection Act, which does not allow the federal government to interfere in the election’s aftermath by deploying federal troops under the guise of enforcing public order laws. I. The Federal Government Cannot Send Armed Agents to Polling Places Multiple overlapping federal laws and constitutional rules bar the government from deploying, or even threatening to deploy, armed agents to the polls.1 A. Federal Law Prohibits Armed Agents at the Polls. Several statutes prohibit federal agents from interfering in an election. Those include: 1. 52 U.S.C. § 10102 (“Interference with freedom of elections”) provides that “[n]o officer of the Army, Navy, or Air Force of the United States shall…in any manner interfere with the freedom of any election in any State, or with the exercise of the free right of Suffrage in any State.” 2.

Halbrook1 Armed Forces and National Guard Enforcement Activities In July of 1983, a Navy destroyer spotted a freighter in international waters north of San Juan, Puerto Rico. The destroyer gave chase after the freighter, known as the Ranger and registered in Honduras, refused to stop. At dawn, the destroyer fired on the Ranger, hitting its stern and ending its flight. A Coast Guard enforcement team boarded the vessel and soon discovered its cargo of 881 bales of marijuana. At trail in the U.S. District Court for Puerto Rico, defendants moved for dismissal of the indictments on the ground that the Navy gunners committed an illegal military arrest under the Posse Comitatus Act, 18 U.S.C. § 1385. The U.S. Court of Appeals for the First Circuit upheld the action with no discussion of the severe constitutional implications of allowing the army or navy to enforce civilian laws. United States v. del Prado-Montero, 740 F.2d 113 (1st Cir. 1984)(citing 32 C.F.R. §213.10 (c)). The regulation requires that the Navy be given permission to assist the Coast Guard in its law enforcement activities, implying that lack of such permission would have invalidated the search. History supplies the grist for an argument that the Constitution prohibits military involvement in civilian affairs subject to only limited alterations by Congress or the President, but the courts do not appear to have ever accepted the argument unless violation of more explicit constitutional command could also be shown. The provision for express constitutional authorization when in fact the Constitution contains no such express authorizations has been explained alternatively as a meaningless political face saving device or as an unartful reference to the President's constitutional powers. Outraged at numerous abuses by the British crown—to include the conduct of British soldiers in the colonists’ daily lives—Americans declared their independence, creating a new republic with deep suspicions of a standing army. These suspicions were intensely debated at the time of the nation’s formation and enshrined in the Constitution. But congressional limitations on the role of the military in day-to-day affairs would have to wait. This did not occur until after the Civil War when Southern congressmen successfully co- opted the framers’ earlier concerns of a standing army and passed a criminal statute—the 1878 Posse Comitatus Act (PCA)—that restricted the ability of the army to be used as a “posse comitatus” to “execute the laws.” Today, the PCA’s history and scope are often misunderstood with continual unintended consequences for today’s modern military that are far removed from the law’s earlier constitutional and statutory origins. This Article addresses a significant unintended consequence in the modern era: the PCA’s peculiar modern application to the Navy. The text of the PCA is silent on the Navy, yet the Department of Defense (DoD) has determined that the PCA applies to the Navy worldwide. The early civil libertarian concerns that originated with the birth of the republic and at the time of the PCA’s passage are based on concerns over a standing army.

    Posse Comitatus – Has the Posse outlived its purpose? Craig T. Trebilcock The Posse Comitatus Act1, has been a limitation on the use of military forces in civilian law enforcement operations since the Nineteenth Century. Today, where national defense may hinge on detecting smuggled biological or chemical weapons in small quantities, the continued relevance of this law is at issue. The history of the Posse Comitatus Act (“the Act” or PCA) reflects a tension between preserving the national defense, while keeping the military from becoming entangled in day to day law enforcement. The name Posse Comitatus means, “the Power of the County”, bringing to mind colorful images of the old west county sheriff swearing in a posse to pursue fleeing criminals. The Act was born out of the extensive use of federal troops for law enforcement in the South following the Civil War. Congress, recognizing that the long-term use of the Army to enforce civilian laws posed a potential danger to the military’s subordination to civilian control, passed the Act. The 1878 Posse Comitatus Act made it a crime for anyone to use the Army to enforce federal, state, or local civil laws.2. In order to understand the current relevancy of the Act, one must first examine to whom it applies and under what circumstances. Through statute and regulation, the Posse Comitatus Act restricts the law enforcement activities of the active and reserve3 components of the Army, Air Force, Navy and Marines. It does not apply to the Coast Guard, whose peacetime mission specifically includes the enforcement of civilian maritime laws.

    Authorities Governing the Deployment of Troops during the Election and Post-Election Season This memo responds to some of the most commonly asked questions regarding the laws and authorities for the possible use of federal or state military forces in the United States from early voting through the inauguration. Section I covers deployment under federal command; Section II covers deployment under state Gubernatorial control; and Section III is an overview of relevant election laws that apply to service member activities during election season. FEDERAL COMMAND: FEDERAL MILITARY & NATIONAL GUARD UNDER TITLE 10 Command and Control: The chain of command for federal forces follows the National Command Authority, ​ ​ which runs from the President to the Secretary of Defense to United States Northern Command (NORTHCOM) and/or other relevant United States Department of Defense combatant commands. Civilian Control Our founders were concerned about the misuse of a standing military, particularly its use for law enforcement purposes. The Constitution therefore ensured that the military would operate under civilian control, and that the president would share power over any domestic military deployment with Congress. The Militia Clauses in Article ​ ​ ​ ​ I, § 8 of the Constitution make clear that deployment of federal forces “to execute the Laws of the Union, suppress Insurrections and repel Invasions” must be pre-authorized by Congress. Posse Comitatus Act To avoid the unauthorized use of the military for law enforcement purposes, Congress further constrained military action with the Posse Comitatus Act of 1878. The Act is considered foundational to our armed forces and their ​ ​ ​ ​ mission of repelling foreign enemies, not policing fellow citizens.
