U.N.L.P. 2014 PRESENTACIÓN En el volumen de este año, la Facultad de Ciencias Jurídicas y Sociales de la Universidad Nacio- nal de La Plata, expresa su homenaje al vigésimo aniversario de la Reforma Constitucional de 1994, a la vez que formula sus fervientes aspiraciones para lograr entre todos su cabal cumplimiento. Des- tacamos —entre otros— dos excelentes aportes académicos acerca de este tema, el primero, que inicia esta edición de nuestro nº 44 de la Nueva Serie (2014), se debe al Sr. Profesor Extraordinario Emérito Dr. Juan Carlos Hitters: “La Reforma de la Constitución Argentina de 1994 y los Tratados de los Derechos Humanos”, una brillante exposición que enaltece estas páginas. El segundo, en su respectiva sección, debemos agradecerle muy especialmente al Sr. Profesor Ordinario Titular y Director del Instituto de Derecho Constitucional y Político, Dr. Carlos A. Mayón su trabajo titulado: “A Veinte años de la Reforma de la Constitución Nacional” que con gran claridad y erudición expone las principales características de esta Reforma Constitucional, con sus virtudes y defectos y su ubicación actual, su realidad. Continuando con la publicación de trabajos enviados para su evaluación por los árbitros y eventualmente su publicación, por Profesores de Universidades de nuestra América Latina, en esta edición contamos con los aportes presentados por un Profesor Chileno y dos Profesores Cubanos. También publicamos en la Sección de Derecho Político, la segunda parte del horror y el abismo del Holocausto, entre 1939 y 1945, su historia y su significado, remitido por el Profesor Dr. Héctor Zimerman (UNNE). Lamentamos el fallecimiento del Sr. Profesor Extraordinario Consulto Dr. Rafael Novello, quién se desempeñó durante muchos años como Profesor Adjunto y posteriormente Profesor Ordinario Titular de Derecho Agrario. Asimismo, falleció el Profesor Dr. Ángel Eduardo Gatti, Consejero Di- rectivo Titular y Profesor Ordinario Titular de Derecho Social. A ellos todo nuestro agradecido reco- nocimiento por sus trabajos en nuestra Facultad, sus enseñanzas y sus inclaudicables vocaciones docentes. Quisiéramos recordar que en 2016, nuestro Anuario cumplirá noventa años, ya que fue creado en 1926. Una vez más reiteramos la necesidad de cumplir estrictamente con todos los requisitos estable- cidos en las pautas de publicación y con aquellos establecidos por Latindex para obtener la califica- ción de revista científica.     LA RICERCA STORICA SULLA PRESENZA DEL III REICH IN ARGENTINA (Pier Luigi Guiducci) Per un non breve periodo di tempo, diversi storici hanno descritto l’interazione che avvenne tra il III Reich e l’Argentina focalizzando in prevalenza gli anni della seconda guerra mondiale, e il periodo immediatamente successivo (quando molti ex-nazisti fuggirono dall’Europa per raggiungere le terre dell’America meridionale). In realtà, la costruzione di stabili canali tra tedeschi e argentini precedette di diversi anni il 1939.1 Si tratta di una storia che è importante da ricordare. Serve infatti a spiegare la presenza di consolidate comunità tedesche, e l’organizzazione di un sistema produttivo locale, ancor oggi esistente, riconducibile a investimenti che provennero da fondi della Germania.2 La Nazi Landesgruppe Argentinien (1931) Il movimento nazista in Argentina, e a Buenos Aires in particolare, ricevette un primo sostegno dai tedeschi che operavano nelle Compagnie di navigazione ‘Hamburg-Süd’3 e ‘Hapag-Lloyd’4. Le navi di queste società salpavano dal porto di Hamburg (Amburgo). Qui, dalla metà del 1930, i membri del partito nazionalsocialista cominciarono ad attivarsi per istituire un proprio ufficio a Buenos Aires. L’obiettivo era di attivare contatti permanenti con i tedeschi che vivevano all'estero, e di raccogliere fondi per il movimento hitleriano.5 Il 7 aprile 1931 venne fondata la Nazi Landesgruppe Argentinien6. Era composta da cinquantanove membri. L’organismo costituì un gruppo estero dipendente da una sezione speciale del partito nazista (Auslandsabteilung der Reichsleitung der NSDAP7). Due mesi dopo, il capitano Rudolf Seyd condusse la Landesgruppe argentina in Germania. Quest’ultima, partecipò pure a una cerimonia che si svolse a Berlino, presso il Memoriale dei caduti della I guerra modiale8.

    Miranda Walston Witnessing Extermination: Using Diaries to Understand the Final Solution in Poland Honours Thesis By: Miranda Walston Supervisor: Dr. Lauren Rossi 1 Miranda Walston Introduction The Holocaust spanned multiple years and states, occurring in both German-occupied countries and those of their collaborators. But in no one state were the actions of the Holocaust felt more intensely than in Poland. It was in Poland that the Nazis constructed and ran their four death camps– Treblinka, Sobibor, Chelmno, and Belzec – and created combination camps that both concentrated people for labour, and exterminated them – Auschwitz and Majdanek.1 Chelmno was the first of the death camps, established in 1941, while Treblinka, Sobibor, and Belzec were created during Operation Reinhard in 1942.2 In Poland, the Nazis concentrated many of the Jews from countries they had conquered during the war. As the major killing centers of the “Final Solution” were located within Poland, when did people in Poland become aware of the level of death and destruction perpetrated by the Nazi regime? While scholars have attributed dates to the “Final Solution,” predominantly starting in 1942, when did the people of Poland notice the shift in the treatment of Jews from relocation towards physical elimination using gas chambers? Or did they remain unaware of such events? To answer these questions, I have researched the writings of various people who were in Poland at the time of the “Final Solution.” I am specifically addressing the information found in diaries and memoirs. Given language barriers, this thesis will focus only on diaries and memoirs that were written in English or later translated and published in English.3 This thesis addresses twenty diaries and memoirs from people who were living in Poland at the time of the “Final Solution.” Most of these diaries (fifteen of twenty) were written by members of the intelligentsia.

We argue that Washington’s policy evolved from the initial loose support of the Ford administration to what we call “the Carter exception” in 1977—79 when the violation of Human Rights were denounced and concrete measures taken to put pressure on the military to end their repressive campaign. Human Rights, however, lost their importance on Washington’s foreign policy agenda with the Soviet invasion of Afghanistan in 1979 and the end of the Détente. The Argentine military briefly recuperated US support with Ronald Reagan in 1981 to soon lose it with the Malvinas War. PRIMERA PARTE: EL CINE ARGENTINO DESDE SUS COMIENZOS HASTA 1970 María Inés Dugini de De Cándido Introducción La historia del cine no puede separarse de la vida, las ideas y las pasiones de los hombres. Tampoco puede separarse de su contexto. Al estudiar sus obras y sus hombres no podemos olvidar que el cine es parte del conocimiento de nuestro país. Es un elemento de valor en el reflejo de su his- toria y sus costumbres que realmente integra su cultura. El cine es un referente de gran trascendencia, para el conocimiento o recreación histórica. Su adecuada utilización nos permite acceder a interesantes planteos de nuestra historia. Cabe destacar que un film puede o no tratar un hecho histórico pero la trama o guión nos dará una excelente pesquisa de un tiempo político, social y cultural. El cine ocupa un lugar muy importante en el panorama del arte y la cultura contemporánea, y también un instrumento pedagógico y científico en las universidades. Las películas constituyen excelentes documentos históricos, son magníficas fuentes impresas. Se pueden mencionar -además- antiguos noticieros o "actualidades" (ahora históricos), reportajes a personajes gravitantes en un momento o a personas que los han conocido, películas etnológicas, de las cuales hay abundante material en la UNESCO. Otro aspecto muy valioso constituyen las películas de reconstrucciones socio-históricas contemporáneas o no, de interpretaciones de la realidad, de políticas y de ideologías. El conocimiento que a través de un film podemos obtener, considerado como fuente impresa, vale decir el cine como laboratorio histórico.

    Daniel Tinayre en un contexto de cambios (1945-1955) Rodolfo Rodriguez UNNOBA [email protected] Resumen: El amor hacia la literatura policial y el cine de los años 30- influido por diversas corrientes de vanguardias- determinaron la elección del cine como camino de expresión de uno de los más talentosos directores de nuestro séptimo arte, lamentablemente incomprendido por sus contemporáneos. Luego de dos colaboraciones en París y de trabajar como asesor, decide filmar solo a partir de 1934 cristalizando lo que sería su primer filme, en el que aborda una temática histórica: Bajo la Santa Federación (estrenado en 1935), a pocos años de que el cine silente diera lugar al parlante y sonoro. No es, sin embargo lo que consideramos la primera etapa lo que pretendemos analizar, sino la segunda, que coincide con el ascenso y caída del primer peronismo, es decir el período comprendido entre 1945-1955, donde el realizador concretó 8 películas. Encabalgado en el marco genérico del melodrama- policial, psicológico, carcelario o la comedia- sus mejores aportes se produjeron en un período de cambios generales que le permitieron crear entrelazando ficción y realidad. Dentro de aquel marco cronológico, Tinayre logró el aplauso de los estratos medios y populares, que gustaban de la calidad de su cine y de algunos pocos críticos. Posaremos nuestra mirada en Camino del infierno (codirector junto a Saslavsky); A sangre fría; Pasaporte a Río; Danza del fuego y Deshonra. Sin dudas 5 clásicos del melodrama, por donde es perceptible ver críticas a una sociedad y laudatorias expresiones, que no eran sino emergentes de una Nueva Argentina.

    ISSN 0716-1840 EN EL CENTRO DEL CANON: LEOPOLDO LUGONES EN LAS ANTOLOGÍAS POÉTICAS ARGENTINAS (1900-1938) ANÍBAL SALAZAR ANGLADA* RESUMEN La historiografía literaria argentina, cuyo proceso de maduración se inicia en torno a 1915- 1920, nos muestra a Leopoldo Lugones como a uno de los grandes artífices de la modernidad poética en el contexto cultural de Hispanoamérica, y también como al escritor totalizante que orada todos los caminos estéticos, más allá de modas y modismos. ABSTRACT Argentinian literary historiography, which began to mature around 1915-1920, shows us Leopoldo Lugones as one of the great representatives of the poetic modernity in Latin America’s cultural context; he also stands for the writer who experiments with all the aes- thetic styles, regardless of fashions and idioms. In this sense, the main image that we receive of Lugones in Argentinian poetic anthologies, in a key period of national literature (1900- 1938) is essential concerning the process of the author’s canonization. The particular case of Lugones, thoroughly revised since the anthologies, shows a rare peculiarity: he has persisted unharmed throughout time and survived literary criticism until he has become one of the few certainties unanimously accepted within the Argentinian literary canon.

Hussar My comparative study focuses on the negotiation of national, regional, religious, and ethnic identity in the works of four Latin American Jewish authors: Argentines Alberto Gerchunoff and Rebeca Mactas, and Brazilians Frida Alexandr and Adão Voloch. Each author uses collections of independent but interrelated short stories, or short story cycles, to fictionalize his/her experiences as a child growing up in Jewish agricultural colonies in Latin America in the late-nineteenth and early-twentieth centuries.   • Argentine National Identity and the War on Terror: Civilization, Barbarism, and Rumors of Islamic Radicalism in the Tri-Border A
    God is everywhere, but his office is in Buenos Aires. – Argentine Proverb ii ABSTRACT This thesis explores the nuanced relationship between Argentine national identity, or argentinidad, and the introduction of the War on Terror into the Tri-Border Area of South America. An isolated and ill-governed frontier zone shared by Argentina, Brazil, and Paraguay, the Tri-Border Area was commonly associated with various illegal economic activities for decades. However, following the September 11, 2001 attacks, the American government and media falsely vilified the region as a haven for terrorist groups. While Paraguay and Brazil were guarded in their responses to the negative discourse regarding the Tri-Border Area, Argentina readily accepted the possibility of terrorists on its northeastern frontier. The project explains this behavior through examination of the influence of national identity on foreign policy. First utilizing the method of causal process tracing, the analysis demonstrates that Argentine national identity predominately accounts for Buenos Aires and the surrounding pampas. Consequently, this development created “negative spaces” within formal state boundaries. These areas are perceived as located outside of the sovereign and civilized state. Discourse analysis exhibits that the Tri-Border Area has traditionally been characterized as one such uncivilized space. Finally, reuse of discourse analysis reveals that American antiterrorism dialogue was particularly compatible with historical portrayal of the region. Therefore, Argentine
