    Gemeindefreies Gebiet Harz, Samtgemeinde Oberharz, Stadt Goslar, Stadt Bad Harzburg, Stadt Vienenburg B e k a n n t m a c h u n g der Auslegung des Entwurfs einer Verordnung über die Festsetzung eines Überschwem- mungsgebiets der Oker im Landkreis Goslar gem. § 73 Abs. 5 VwVfG Der Landkreis Goslar und die Stadt Goslar als untere Wasserbehörden beabsichtigen, ein Überschwemmungsgebiet der Oker einschl. Talsperre durch Verordnung nach § 115 Nie- ders. Wassergesetz (NWG) in Verbindung mit § 76 Wasserhaushaltsgesetz (WHG) festzu- setzen, und zwar von der Okertalsperre (RW 3599292 / HW 5743417) bis zur Kreisgrenze zum Landkreis Wolfenbüttel. Der Gewässerabschnitt verläuft im Gemeindefreien Gebiet Harz, der Samtgemeinde Oberharz, der Stadt Goslar, der Stadt Bad Harzburg sowie der Stadt Vienenburg. Die Zuständigkeit für den Erlass der Verordnung obliegt nach § 127 Abs. 2 NWG den Was- serbehörden der Stadt Goslar und des Landkreises Goslar. Um das Verfahren zweckmäßig durchzuführen, erfolgte nach Abstimmung mit der Stadt Gos- lar die Bestimmung des Landkreises Goslar als verfahrensführende untere Wasserbehörde durch das Nds. Ministerium für Umwelt und Klimaschutz.
