In that time, many people have touched this project, and should be recognized. My thesis director, Dr. John T. Daugherity provided me with the initial encouragement to launch this project, offered research and stylistic advice, and introduced me to people who proved to be extremely helpful with this project – and there was nobody more valuable than Brian Grogan. iv Brian Grogan took me on as an intern for Mercy Seat Films’ production of They Closed Our Schools, the forthcoming documentary on the Prince Edward County school closings. Brian sent me on valuable research trips, has constantly sent me research materials, acted as a sounding board, and read my manuscript. Brian Grogan has proven time and again that he is the resource on the Prince Edward County school crisis. More importantly, he has become a good friend. Dr. Edward H. Peeples, Jr. wrote his master’s thesis on Prince Edward County when the schools were closed, and served as a volunteer in a recreation program for the locked out children. Ed Peeples opened his private papers to me and offered encouragement throughout this project. Dr. James H. Hershman, Jr. sent me research materials, provided his years of insight into massive resistance, and has read portions of the manuscript, proving valuable as fact checker. Ferguson, the U.S. Supreme Court ruled that separate but equal facilities were legal. This ruling upheld the idea of separation of the races and enforced the Jim Crow laws. MMaassssivivee RReessisisttaannccee Under the Jim Crow laws, life in the south was strictly segregated. Theaters, schools, waiting rooms, restaurants, even water fountains were segregated. MMaassssivivee RReessisisttaannccee After World War II, however, there was a desire for change. African Americans were no longer willing to accept the Jim Crow laws. MMaassssivivee RReessisisttaannccee President Truman issued an Executive Order integrating the Armed Forces in 1947.With his signature, the President, as Commander in Chief, ended segregation – in the Armed Forces, but not in the rest of society! Life was still segregated throughout the south. MMaassssivivee RReessisisttaannccee Schools and other facilities were supposed to be “separate but equal”. They were separate, but rarely were they equal! African American schools often went without indoor plumbing and heating systems. MMaassssivivee RReessisisttaannccee In 1954, The United States Supreme Court ruled in Brown v. Board of Education, that “Separate but equal was inherently unequal” and the Plessy decision of 1896 was overturned. Separate facilities were no longer legal. MMaassssivivee RReessisisttaannccee Senator Harry Byrd, Sr. of Virginia said the Brown decision “will bring implications and dangers of the greatest consequence.” He went on to announce that he would use all legal means to continue segregated schools in Virginia! MMaassssivivee RReessisisttaannccee Governor Stanley of Virginia appointed a commission to look at options for defying the Brown decision.

    WILLIAM WINTER AND THE POLITICS OF RACIAL MODERATION 335 William F. Winter and the Politics of Racial Moderation in Mississippi by Charles C. Bolton On May 12, 2008, William F. Winter received the Profile in Courage Award from the John F. Kennedy Foundation, which honored the former Mississippi governor for “championing public education and racial equality.” The award was certainly well deserved and highlighted two important legacies of one of Mississippi’s most important public servants in the post–World War II era. During Senator Edward M. Kennedy’s presentation of the award, he noted that Winter had been criticized “for his integrationist stances” that led to his defeat in the gubernatorial campaign of 1967. Although Winter’s opponents that year certainly tried to paint him as a moderate (or worse yet, a liberal) and as less than a true believer in racial segregation, he would be the first to admit that he did not advocate racial integration in 1967; indeed, much to his regret later, Winter actually pandered to white segregationists in a vain attempt to win the election. Because Winter, over the course of his long career, has increasingly become identified as a champion of racial justice, it is easy, as Senator Kennedy’s remarks illustrate, to flatten the complexity of Winter’s evolution on the issue CHARLES C.     Kennedy and the Other Missiles of 1962 Clarence Lam When the phrase ‘nuclear missiles’ is mentioned in connection with either President John F. Kennedy or the year 1962, the Cuban Missile Crisis usually comes to mind. Kennedy is remembered for a composed and tactful approach to defusing the conflict, prompting Khrushchev to remove the Soviet nuclear missiles from Cuba. Less well known are the United States’ Jupiter nuclear missiles that were in Turkey at the time of the crisis, much less their role in precipitating it. Despite their brief existence and tactical inferiority to other weapon systems such as the Polaris nuclear submarines, the Jupiters presented both major diplomatic problems and solutions for Kennedy. On the one hand, removal of these Jupiter missiles from Turkey was secretly part of the compromise that resolved the most tense and celebrated war of nerves between the United States and the Soviet Union. Even though the Jupiters had little military value and were limited in their ability to deter Soviet attacks, in the end they carried significant diplomatic value as bargaining chips for Kennedy. However, they were also sticky, problematic weapons that were obsolete even when deployed. The Kennedy administration was never impressed by the Jupiter missiles, yet it followed through with Eisenhower’s commitment to Turkey in 1959 and installed these nuclear weapons. Furthermore, the Jupiters were never removed from Turkey until after the Cuban Missile Crisis. If the missiles were inefficient, vulnerable, and provocative, rendering them practically useless, why were they still in Turkey in October 1962? Historians generally concur that Kennedy wanted to remove the missiles, but they disagree on one important question: did Kennedy order or suggest the removal of the missiles before the Cuban Missile Crisis? Roger Hilsman states that Kennedy had ordered the removal of the missiles from Turkey several times prior to the crisis.

The department, along with its governing board, would quickly establish a system of technical colleges located regionally throughout Virginia, with the first of those colleges opening their doors for classes in the fall of 1965.

On December 31, 1961, Harry Monroe, a Richmond area radio host for WRVA, described the tendency to look back on past events during his “Virginia 1961” broadcast: “One of man’s inherent characteristics is a tendency to look back. He embraces this tendency because its alternative is a natural reluctance to look forward. Man, for the most part, would prefer to remember what he has experienced, rather than to open a Pandora’s box of things he has yet to undergo.”1 In the same broadcast, Monroe and his partner Lon Backman described the commemorations and parades that took place on the streets of Richmond that year as part of the state’s official “look back” at the Civil War one hundred years later. The Civil War Centennial took place from 1961-1965 as the nation was beset with both international and domestic struggles, the most immediate of which for Virginians was the Civil Rights Movement, which challenged centuries of white supremacy and institutionalized segregation that had remained the social and cultural status quo since Reconstruction.

    Sed Quis Custodiet Ipsos Custodes: The CIA’s Office of General Counsel? A. John Radsan* After 9/11, two officials at the Central Intelligence Agency (CIA) made decisions that led to major news. In 2002, one CIA official asked the Justice Department’s Office of Legal Counsel (OLC) to clarify how aggressive CIA interrogators could be in questioning al Qaeda operatives held overseas.1 This request led to the August 2002 memorandum, later leaked, in which John Yoo argued that an interrogator crosses the line into torture only by inflicting pain on a par with organ failure.2 Yoo further suggested that interrogators would have many defenses, justifications, and excuses if they faced possible criminal charges.3 One commentator described the advice as that of a “mob lawyer to a mafia don on how to skirt the law and stay out of prison.”4 To cool the debate about torture, the Bush administration retracted the memorandum and replaced it with another.5 The second decision was made in 2003, when another CIA official asked the Justice Department to investigate possible misconduct in the disclosure to the media of the identity of a CIA employee. The employee was Valerie Plame, a covert CIA analyst and the wife of Ambassador Joseph Wilson. * Associate Professor of Law, William Mitchell College of Law.   • Virginia State Capitol and Capitol Square
    Virginia State Capitol and Capitol Square In 1779, the Virginia Legislature voted to move the capital from Williamsburg to Richmond. Until a permanent Capitol could be built, the Virginia General Assembly met in two wood-framed buildings at the corner of what is now 14th Street and Cary Street. With Richmond as the new capital, six squares of land were selected for the placement of permanent public buildings. In 1788, the Thomas Jefferson designed Capitol was considered finished enough to house the Virginia General Assembly. Jefferson’s Roman temple form building is the middle portion of the present-day Capitol. The original building was expanded in 1906 with the addition of two wings, and again in 2007 with an underground extension. The architecturally and historically important building is designated as a National Historic Landmark and tentatively listed as a World Heritage Site by UNESCO. The public area surrounding the Capitol was originally a weed-filled open square with informal lanes and footpaths. In 1816, the Virginia General Assembly hired French-born Maximilian Godefroy to lay out a formal park. Two years later, the newly landscaped grounds were enclosed by the cast- and wrought-iron fence still in place today, and this area eventually came to be called Capitol Square. While retaining aspects of Godefroy’s framework, Scottish-born John Notman developed an 1850 overlay plan of meandering walkways and native trees and shrubs that gave Capitol Square much of the character and appeal it retains today. This designed historic landscape is nationally significant. Is The New York Times "Actual Malice" Standard Really Necessary? A Comparative Perspective Russell L. Weaver* Geoffrey Bennett** In New York Times Co. v. Sullivan,' the United States Supreme Court extended First Amendment guarantees to defamation actions.2 Many greeted the Court's decision with joy. Alexander Meiklejohn claimed that the decision was "an occasion for dancing in the streets. ' 3 He believed that the decision would have a major impact on defamation law, and he was right. After the decision, many years elapsed during which "there were virtually no recoveries by public officials in libel 4 actions." The most important component of the New York Times decision was its "actual malice" standard. This standard provided that, in order to recover against a media defendant, a public official must demonstrate that the defendant acted with "malice.'
