A. Introduction

This updated Resettlement Plan (URP) has been prepared for the Civil Works for Water Supply Distribution Pipeline Upgrading and Reconstruction subproject (Contract No. QH-WS-W6 (A, B and C)). The URP should be read in conjunction with the Resettlement Plan in May 2017, the website is : https://www.adb.org/zh/projects/documents/prc-49021-002-rp-2.

The contract includes: construction of (1) 33 new water supply pipelines with a total length of 37.3 km in Taoshan ; (2) 8 new water supply pipelines with 18.3 km in Qiezihe District; and (3) 14 new water supply pipelines with 29.4 km in Xinxing District and Jinsha District. The construction locations of the laying pipelines are shown in the figures below.

B. Resettlement impacts identified at the feasibility stage

The 2017 Resettlement Plan (RP) assessed that the Qitaihe Civil Works for Water Supply Distribution Pipeline Upgrading and Reconstruction Subproject have involved:

"Water supply network construction and reconstruction, including construction and reconstruction of water supply pipes in the downtown area with a total length of 17,800 m. a). Water supply network construction and reconstruction of 13 stations: This component consists of pipes in the downtown area, Jinsha New District, and the west and Longhu mining areas. Pipes in the downtown area: construction of water supply pipes north of Dong’an Street in Qiezihe District, and along Datong Street and Tongren Road in Taoshan District, reconstruction of existing water supply pipes on Xuefu Street in Taoshan District, reconstruction of the booster pump station of the residential quarter south of Datong Street; pipes in Jinsha New District: construction of water supply pipes along Huanhu Road, Xinjin Road, Development Zone Avenue, Zhenxing Avenue, Chuangye Avenue and Shengxin Street; pipes in the west mining area: construction of water supply lines along Shanhu Road, Yibao Highway, Laodong Road, Xinxing Jingyi Road, Xinxing Jingsan Road and Xinxing Weiyi Road; pipes in the Longhu mining area: construction of water supply lines along Taoshan Wei’er Road and Dongshun Street. Laying of pipes will be along the roads right-of-way while reconstruction of 13 stations; it will not involve additional land acquisition or temporary impacts. The source of water is from the existing Taoshan Reservoir which was built in August 1990 as source of water supply, irrigation and flood control. b). Construction of Two Booster Pump Stations. This will involve the acquisition of 18 mu, in two villages. There are two affected households (8 persons). In each household, 9 mu will be affected. Each household has an average 33.75 mu of farmland. Loss is 27% per household. "

C. Changes to the project scope at the detailed design stage

1. Engineering parameters in the Feasibility Study and the Resettlement Plan are inconsistent

Some engineering parameters are inconsistent in the Resettlement Plan and the Feasibility Study Report (FSR). After the detailed design, the engineering parameters have been changed compared with those in the FSR, and the specific changes are shown in the following table:

In the FSR, the construction content of this subproject included water supply pipelines with a total length of 91,000 m, 13 pump stations and 2 new booster pump stations. The number of pump stations stated in the RP is the same as that in the FSR, but the total length of water supply pipelines has only 17,800 m.

After the detailed design, the contract contains the construction of water supply pipelines with a total length of 82,830 m, while the original construction of 13 pump stations and 2 new booster pump stations that involve permanent land acquisition (PLA) were removed from the contract. In addition, 2,196 out of 85,029 m pipelines in the detail design was constructed completely in August 2020, and the 2 new booster pump stations are under construction in locations different from the original locations with government funds, as presented in Appendix 1: Resettlement Due Diligence Report for details.

2. Decreased construction contents in the detailed design stage

As presented in the above table, compared with water supply pipelines of 91,000 m planned to be constructed in the FSR, the total length of new and re-construction of water supply pipelines is reduced to 85,029 m after actual measurement in the detailed design stage, among which 2,196 m pipelines have been constructed completely with a counterpart fund. At the same time, construction locations of the water supply pipelines also have been adjusted. In addition, construction locations of the original 2 new booster pump stations have been changed from the West Mining Area and Longhu Mining Area to Xinxing District, which was removed out of this contract, and being constructed with government funds instead. D. Impacts of land acquisition and house demolition

1. Temporary land occupation of water supply pipelines

According to the RP, the contract would involve TLO of state owned urban road land but not involve TLO of collective land and house demolition. At the same time, the original 2 booster pump stations would involve PLA of 18 mu collective land, affecting 2 households with 18 people. After the detailed design, the subproject only will involve TLO of state owned urban road land, and will not involve house demolition and any APs. The construction locations of 2 new booster pump stations have been changed avoiding PLA of collective land and APs. Therefore, after the detailed design, this subproject for 85,029 m water pipeline construction will involve TLO of 491.34 mu of state-owned urban road land,of which 12.69 mu land required for the construction of 2,196 m pipelines have been recovered after the TLO. Therefore, the impact scope of TLO for this contract is 478.65 mu (or 31.91 ha). Changes in impact scope of the resettlement in the RP and the detail measurement survey are shown in the following table:

2. Impact scope of constructed pipelines and booster pump stations

This subproject has used counterpart funds to construct 2,196 m pipelines, involving 12.69 mu of TLO. The temporarily occupied state-owned urban roads have now been recovered; 2 water booster pump stations are being constructed with government funds in the existing state-owned construction land of the water supply company.

Regarding the TLO of completed water supply pipelines and the land for 2 booster pump stations, a resettlement due diligence was carried out, as presented in Appendix 2: Resettlement due diligence report for details.

E. Temporary land use and recovery and expenses

The total length of the new and reconstructed water supply pipelines in this contract is 82,830 m, and the water pipelines will be laid under the existing urban roads, involving TLO of state-owned roads in 478.65 mu.

The land use for construction of the subproject was approved by the Qitaihe Natrual Resource Bureau on 1 April 2021, as presented in Appendix 1. Contractors of the subproject will take responsibilities on excavation and recovery of the roads for the pipeline construction, and costs thereof will be included in the contract for civil works construction.

The TLO of roads will have a greater impact on transport in the project area for residents on both sides of the roads. Therefore, the contractors need to arrange well the construction activities. The contractors shall inform the residents with the construction agenda, and take any safety measures to ensure the safety of the residents, to ensure that the pipeline construction is completed within the specified construction period, and the road access is recovered in time.

F. Grievance Redress Mechanism

A grievance redress mechanism (GRM) has been established for the subproject. Any affected people (AP) who have any grievance related to the subproject during the construction can complaint through the GRM in following stages:

Stage 1: If the AP is dissatisfied with implementation of the TLO and construction of two pump stations, he/she may make oral or written complaint to local subdistrict (or street administrative office) government; in case of oral complaint, the subdistrict government shall handle such complaint and make written records. The subdistrict government shall provide solution within one week; Stage 2: If the AP is still dissatisfied with the resolution of Stage 1, he/she may file the complaint to Qitaihe City Water Supply and Drainage Co. and requires for arbitration. The result shall be made within 2 weeks.

Stage 3: If the AP is still dissatisfied with the resolution of Stage 2, he/she may file the complaint to Qitaihe PMO and requires for arbitration. The result shall be made within 2 weeks.

The APs may appeal to a local court in accordance with the Administrative Procedure Law of the PRC as their alternative way of grievance redress at any time.

APs may also complain about any aspects of implementation of the TLO and construction of two pump stations an external monitoring and evaluation agency. APs can also submit complaints to ADB which will first be handled by the project team. If an AP is still not satisfied and believes he/she has been harmed due to non-compliance with ADB policy, s/he may submit a complaint to ADB’s Accountability Mechanism.

The above grievance channel has been discussed during the updated RP preparation and will be further notified to the APs while distributing the URP through meeting or otherwise, so that the APs are fully aware of their right of complaint.

G. Monitoring and Reporting

During the implementation period of this contract, the monitoring shall be carried out in accordance with an internal monitoring and an external monitoring requirements set out in the RP, and the monitoring report shall be submitted to the ADB semi-annually.

Annex 1: Submission on Land Pre-examination and Site Selection for Pipeline, Central Pump Station and 204 Pump Station Construction Project

Appendix 2: Resettlement Due Diligence Report

As part of construction contents of the Qitaihe Civil Works for Water Supply Distribution Pipeline Upgrading and Reconstruction subproject, Qitaihe City Water Supply and Drainage Co. completed the construction of water supply pipelines in a total of 2,196 m length with counterpart funds, involving 12.69 mu of temporary land occupation (TLO). In addition, Qitaihe City Water Supply and Drainage Co. is constructing two water supply booster pump stations with government funds now, involving 6.15 mu of permanent land occupation (PLO) of public facility land. Although these constructions do not apply to the ADB loan, they still are included in construction contents of the Qitaihe subproject loaned by ADB. Therefore, in accordance with requirements of ADB's "Safeguard Policy Statement (SPS)", due diligence should be conducted on land acquisition and house demolition of the constructions. This is a due diligence report on the resettlement of the constructions.

1. Temporary Land Occupation for Pipeline Construction

In 2020, Qitaihe Municipal Government reconstructed some urban roads, which involved some urban water supply pipeline reconstruction planned by Qitaihe City Water Supply and Drainage Co. Since these pipelines are laid under these roads, in order to avoid the pipeline reconstruction after the road reconstruction is completed, which cause damage to the roads again, the municipal government decided to reconstruct the water pipelines at the same time as the road reconstruction. Therefore, at the same time as the roads were renovated, the water pipeline reconstruction in a total of 2,196 m length was completed. The length of pipelines and roads involved are shown in the table below.

The pipeline construction was undertaken by a contractor recruited by Qitaihe City Water Supply and Drainage Co., involving TLO of 12.69 mu. The contractor is responsible for excavation and backfilling of the roads by laying the pipelines, and then the road construction contractor is responsible for the pavement reconstruction of the roads. The TLO for pipeline construction has no direct impact on local residents, nor does it have a direct impact on commercial activities on both sides of the roads. The cost of road excavation, backfilling and pavement reconstruction, including the cost of TLO, are all included in the contractor’s civil works construction contract prices and not paid separately.

Before the construction of roads (including the water pipelines), the local government notified the relevant communities construction plan, and informed contact numbers of contractors and owner units to residents. If residents have any problems, they can directly contact the contractors or owner units. During the whole construction process, no residents complained to the construction. The entire pipeline construction and road pavement construction had been completed by August 2020, and the pavement had been completely recovered to traffic, as presented in Annex 1: Description on Constructed Water Pipelines for details.

2. Permanent Land Occupation for Water Booster Station Construction

According to the RP, it was planned to build 2 new booster pump stations, which will permanently occupy 18 mu of collective land and affect 18 people in 2 households. The original construction sites of the pump stations in the West mining area and Longhu mining area, respectively, need to permanently acquire 9 mu of collective land for each station.

After the detailed design, the construction sites of the two booster pump stations are adjusted to Xinxing District, and they will be built within the land scope of the existing pump stations. Through expansion and reconstruction on the existing central pump station and No. 204 pump station, respectively, the water supply volume of the 2 pump stations can meet the design requirements. In addition, the construction of the two pump stations has been funded by Qitaihe Municipal Government and has been cancelled from construction contents of this contract. The current situation of the 2 pump stations is shown in the following figure:

Central Pump Station:

The current location of central pump station is in Yuexiu Street of Xinxing District. It was built in May 1989 by Qitaihe City Water Supply and Drainage Corporation, the PIU, for residential and commercial water need in Xinxing District-Beishan Area of Qitaihe City, covering an area of 3.9 mu. The land belongs to the urban public facility land of Qitaihe City, and the Qitaihe City Water Supply and Drainage Corporation has obtained the "Letter of Pre-examination and Site Selection for the Construction Project Land of Pipeline, Central Pumping Station and No. 204 Pumping Station" in April 2021, as presented in Appendix 1 of the URP.

The new water booster pump station funded by the government is being built within the land of the existing central pump station. It will not involve new permanent land acquisition, nor will it involve affected people. The existing building of the central pump station will be demolished and rebuilt during the construction due to its poor condition. The office building is also part of the PIU and does not involve the affected people or any compensation.

The construction of the new water booster pump station began in April 2021 and is still under construction.

No. 204 Pump Station:

The current location of No. 204 pumping station is in Zhengyang Street of Xinxing District. It was built in June 1991 by Qitaihe City Water Supply and Drainage Corporation for residential and commercial water need in Xinxing District-Dongfeng Mine Area of Qitaihe City, which covers an area of 2.25 mu. This land belongs to the urban public facility land of Qitaihe City. The Qitahe City Water Supply and Drainage Corporation has obtained the “Letter of Pre-examination and Site Selection for the Construction Project Land of Pipeline, Central Pumping Station and No. 204 Pumping Station" in April 2021, as presented in Appendix 1 of the URP.

The new water booster pump station funded by the government is being built within the land scope of the existing No. 204 pump station and will not involve new permanent land acquisition, house demolition, or affected people and, therefore, no compensation will be involved.

The construction of the new water booster pump station began in October 2020 and is still under construction.

Although Qitaihe City Water Supply and Drainage Corporation has used the current central pump station and No. 204 pump station for more than 30 years, due to historical reasons, Qitaihe City Water Supply and Drainage Corporation did not apply for the real estate certificate of the two pump stations and land use right certificate. To this end, Qitaihe City Water Supply and Drainage Corporation submitted a letter of “Request for Instructions on Handling the Real Estate Certificate of Old Xinxing Water Supply Company and the Original No. 204 Factory Workshop” to Qitaihe Municipal Government on June 4, 2020, as presented in Annex 2. The request is under review and process.

3. Conclusion

The water supply pipelines with 2,196 m have been completed on the urban state-owned road land, and the road has been completely recovered. The due diligence report confirmed that the TLO and land recovery process involved in the construction of water pipelines followed meet the ADB SPS SR2 requirements.

The construction of two new water supply booster pump stations are being carried out on the state-owned public facility land of the existing pump stations of the PIU and did not involve land acquisition and any affected people. The PIU is re-applying the real property right certificate and land use certificate of the existing pump station now.
