Brewer-Caria* Federalism in Venezuela reveals a very contradictory form of government. Typically, a Federation is a politically decentralized State organization based on the existence and functioning of autonomous States. The power of that decentralized state organi- zation is distributed among the national State (the Union or the federation) and the member States. In contrast, the Federation in Venezuela is a Centralized Federation, which of course, is a con- tradiction in itself. That is why, unfortunately, my Country is not a good example for explaining "Federalism in the Americas," being as it is a Fed- eration based in a very centralized national government, with 23 formal autonomous states. Each of these 23 formal autonomous states is without their own effective public policies and without their own substantive sub-national constitutions. But our Federation has not always been like it is now. The process of centralization of the Federation progressively occurred during the 20th Century, and has been particularly accentuated during the past five years. -

The diversity in the history of this institution is one of the striking evidences of the individuality and differentiation of these Hispanic- American groups. It is suggestive, too, of the decentralization and consequent variations in operation now recognized to have been fundamental characteristics of the Spanish colonial system; for in the colonial background, racial, social, and political, lie the roots of this institutional evolution, whatever may have been the contributions of the national period. Although the progress of anti-clericalism and the operation of other forces have weakened in varying degrees the hold of the church in all Hispanic-American states, in none did the loss of influence fall so early ,^ in none was it so complete as in Venezuela. Indeed, the virtual impotence of the church has been recognized as a peculiar feature of the history of this people which distinguishes it from all other Hispanic-American groups. -

Unconditionally and Irrevocably Guaranteed by PDVSA Petróleo, S.A. 8.5% Senior Notes due 2017 Our 8.5% senior notes due 2017, or the Notes, are being offered by Petróleos de Venezuela, S.A., or PDVSA or the Issuer, a corporation (sociedad anónima) organized under the laws of the Bolivarian Republic of Venezuela, or Venezuela. The Notes will be unconditionally and irrevocably guaranteed, or the Guaranty, by PDVSA Petróleo, S.A., or the Guarantor, a corporation (sociedad anónima) organized under the laws of Venezuela that is wholly owned by PDVSA. The Notes and the Guaranty will be the unsecured, senior obligations of the Issuer and the Guarantor and will rank pari passu with all other senior unsecured obligations of the Issuer and the Guarantor, in each case other than obligations granted preferential treatment pursuant to the laws of Venezuela. The Notes will mature on November 2, 2017 and will bear interest at the rate of 8.5% per annum payable semiannually on each May 2 and November 2, commencing on May 2, 2011. Principal payments on the Notes will be payable in three equal installments. The first principal installment will be payable on November 2, 2015, the second will be payable on November 2, 2016 and the third will be payable on the maturity date. The Issuer may redeem the Notes in whole or in part at any time or from time to time by paying the then outstanding principal amount of the Notes and a “make-whole” amount, if applicable plus accrued and unpaid interest. -

That the contracts provide a mode of settlement by arbitration for any differences or difficulties that may arise as to their legal validity which is inconsistent with any attempt to make them cause for an international claim on any pretext whatever. 4. That there is no evidence satisfactory to us that the peti tioners’ testator was interested to the extent of one-third of the claim for the damages alleged to have been suffered by the annulment of the said contracts, or that he ever expended any money or incurred any liability, or did anything in execution of the said contracts; and, treating the petitioners represent ing their testator as original claimants, we can discover no ground on which to base an award in their favor. 5. That the evidence seems to indicate very strongly that the petitioners’ testator came into possession of a single cer tificate, which was found among his papers, by purchase, hypothecation, or some other channel than his inter- est in the original claim, and if the petitioners are to be regarded as claiming derivatively in the right of bona fide holders for value under the 9th section of the treaty, the claim must be rejected, because for the reasons stated the original claim itself is with out merit, and falls therefore within the purview of the first article of the supplementary convention. -

Venezuela I. introduction 439. Having evaluated the human rights situation in Venezuela, the IACHR decided to include Venezuela in this Chapter because it considers that it falls under Article 59(6)(a)(i) of the IACHR’s Rules of Procedure that came into force on August 1, 2013, which establishes as a criterion for the inclusion of a member state in this chapter the existence of “a. a serious breach of the core requirements and institutions of representative democracy mentioned in the Inter-American Democratic Charter, which are essential means of achieving human rights, including: i. there is discriminatory access to or abusive exercise of power that undermines or denies the rule of law, such as systematic infringement of the independence of the judiciary or lack of subordination of State institutions to the legally constituted civilian authority….” 440. On November 22, 2013, the IACHR transmitted to the State a copy of the preliminary draft of this section of its 2013 Annual Report, pursuant to Article 59.10 of its Rules, and asked that it presented its observations within a month. On December 20, 2013, the Commission received the observations and comments of the State which were incorporated, where pertinente, in the instant report. 441. The Commission has identified structural situations, such as changes in the law that create legal and administrative restrictions that affect the exercise and enjoyment of human rights in Venezuela. In its previous reports on Venezuela, the Commission has repeatedly pointed to structural issues such as the practice of appointing provisional, temporary or interim judges and prosecutors, which weakens the judicial branch and strips it of its Independence and impartiality, thereby adversely affecting the right of access to justice. -
