1 2 INTRODUCTION

Italy has now become a country of immigration, and Parma, with over 59,000 resident foreign citizens on the 1st January 2015, 13.3% of the province’s population represents a district and a community that is first in line to achieve the objectives outlined by the Government in the ‘National plan for safe integration, identity and reception’, which defines the guidelines for the combined action of both public administrations and civil society.

It is declared in the Plan that “the success of a pathway towards integration is developed primarily on five axes, where the life of a migrant unfolds. By viewing the centrality of the person and the family, with their responsible freedom and educational function respectively, as essential elements of integration, it appears that the most important factor in facilitating a migrant’s reception is the learning of both the Italian language and the constitutional values on which our Country is founded. School and work are, in any case, the main places where this knowledge is spread. But without access to a home and to essential services, all of this would not be enough to allow the complete integration of an immigrant into the life of our society. Alongside these issues, we aim to highlight the role of women as the driving force behind integration. The social inclusion of foreign women is certainly the litmus test for the level of integration achieved by a society. We therefore consider women to be the first target to reach in order to ensure that the right path is taken towards integration”.

To this effect, our province offers a wide variety of specific Services dedicated to foreigners, in accordance with European Union guidelines and with National directives on Immigration, Solidarity and Integration. These services reinforce the ability and the quality of the services offered by public and private establishments to all citizens, in the spirit of principles of equality and non-discrimination as declared by the Constitution.

The European Union, together with the SOLID Funds programme, which was established to ensure an equal sharing of responsibilities between Member States and to implement common immigration and

3 asylum policies, funds projects that aim to facilitate the integration of Third Country nationals in their host country. The year-long projects are coordinated and co-financed by the Ministry of the Interior in a strict and transparent procedure. In the context of cooperation with the Territorial Councils that are set up in every Prefecture, the presence of foreigners in the district is monitored and the levels of social and employment insertion are analysed with the aim of promoting useful integration policies, and also through EFI (European Fund for Integration) projects presented by any district Body. This year the Prefecture of Parma has also had access to the EU Funds set up by the individual Prefectures/Territorial Government Offices and has implemented the EFI project ’Friends of the S.P.I.’ (the One- Stop Immigration Desk). The project’s objectives also include the compilation of this Guide which has been translated into the major languages. The aim of this guide is to increase knowledge of Services offered by the district and to facilitate access to these services for Third Country nationals, describing how and what to do, where to go and whom to contact, and which documents they must provide in order to enjoy their rights and to find out what their responsibilities are. This guide lists the functions and the means of access to all of the institutional Offices and Bodies in the province, as well as to Third Sector organisations. The organisations supplement the Services offered by these Offices in supporting foreign citizens in the long journey towards integration, which can only be fully achieved once citizens, immigrants and non-immigrants have equal rights and responsibilities, through undifferentiated access to all of the Services offered by the district. In the belief that we have produced a useful instrument for encouraging the use of the many opportunities offered, as is an inherent tradition in the culture of Parma, we thank all of those who collaborated in creating this guide. 4 ENTRY INTO ITALY

If you are in Italy you have obtained an entry visa following recognition of clearance for

ENTRY FOR EMPLOYMENT PURPOSES: entry for non-seasonal or seasonal subordinate work and for self-employment happens exclusively within the entry quotas set by the so-called ‘flow-decree’. Entry visas for work purposes are therefore issued within the limits of this numerical quota. The issue of entry clearance for the employment of a foreign worker, by the competent One-Stop Immigration Desk for the employment location, is given only for seasonal or non-seasonal subordinate work. The employer who intends to employ a worker who is resident abroad must send the online request within the timeframes and dates indicated by the flow-decree and within 6 months from when the decree came into force. What are the requirements? The requirements for entering and residing for work purposes in Italy are normally laid out detail in the flow-decree, but in general the following requirements apply: • proof of a minimum income to be paid by the employer; • documentary evidence of suitable accommodation for the foreign worker; • a residence contract proposal containing all of the agreement’s essential components (services, hours, employment contract) and the commitment to pay the foreign worker’s return travel costs to their home country or country of origin in the event of dismissal; • declaration of the non-existence of grounds for impeding the foreign worker’s entry into Italy. The applications are examined by the One-Stop Immigration Desk through an investigation involving the Territorial Labour Office, who

5 verifies the validity of the contractual conditions contained in the application and the Provincial Police Headquarters’ Immigration Office who verify the eligibility of conditions for the worker in the Schengen Area. If these are successfully verified, the employer will be notified that entry clearance has been issued. The One-Stop Immigration Desk will send the entry clearance to the Diplomatic Mission of the worker’s Country of residence. The entry clearance for employment is valid for six months.

REMEMBER After entry to Italy you have 8 days to make an appointment at the Municipality where you live to visit the Prefecture to register your arrival, sign the Integration Agreement and the residence contract.

The One-Stop Desk will send you a pre-filled request form for the residence permit which you must send using the authorised post office desk who will then issue you with a receipt for the request submission and a sheet indicating your appointment (with date and time) at the Immigration office of the competent Provincial Police Headquarters for photo-identification. If you have met all of the requirements, you will then be sent an SMS containing the issue date for the residence permit.

You can check the status of your request for the residence permit on the ‘immigrazione.it’ website portal, using the user ID and password shown on your Post Office receipt.

If you are unable to collect your permit or have your photo-identification on the assigned date, the computer program used by the Police Headquarters’ Immigration Office will automatically generate a new appointment; you will be notified of this by the SMS service on your mobile phone as well as by registered Italian Post; you will also be able to check the new appointment by visiting the ‘immigrazione.it’ website using the user ID and the password indicated on the Post Office receipt. The receipt for the residence permit request entitles you to the rights of residency and it is important to note that:

6 - you must show the receipt as proof of the regularity of your residency - you may provisionally request registration in the vital statistics records and the national health service, documenting your entry clearance, the permit request and the existence of an employment contract.

ENTRY FOR FAMILY REASONS: You can request family reunification if you are the holder of a • residence permit for subordinate work or self-employment, for a duration no less than one year; • permit for political asylum; • permit for subsidiary protection; • permit for study or religious reasons; • permit for family reasons; • EU residence permit for long-term residents; • permit while awaiting citizenship. You may request this for • a spouse, not legally separated, no younger than eighteen years and not married to another spouse regularly residing in Italy; • minor children, including those of the spouse or born outside matrimony, on the condition that the other parent, if alive, has given his/her consent. Adopted or fostered minors, or those subject to protection plans are considered as children; • dependant children aged over eighteen who, for objective reasons, are unable to support themselves due to health conditions resulting in total disability (100%); • dependant parents, if they have no other children in their home country or country of origin , and are not married to a spouse who is a legal resident or; • parents aged over 65, if their other children resident in the Country of origin or provenance are unable to support them for documented serious health problems. Entry is then permitted for reunification

7 with a minor child who is already regularly residing in Italy with his/her natural parent provided that they have proven to meet the requirements of available accommodation and income as set out by the reunification procedure. For the purposes of the existence of such requirements, it is assumed that the other parent also meets these. The legal requirements for family reunification are principally an income, with reference to increased social allowance based on a calculation that takes into account the family members and the accommodation, in order to ensure that the reunified family member has a decent life in Italy. The request is submitted either in person or electronically to the One-Stop Immigration Desk of the Prefecture which will verify the requirements for the issue of entry clearance, subject to approval from the Provincial Police Headquarters; the Italian Diplomatic-consular Representation in the Country of residence of the family member to be reunited will verify the subjective requirements for the issue of the entry visa, namely their relationship with the spouse or relative.

REMEMBER Within 8 days of entry you must go to the helpdesks of the Municipality where you live and book an appointment at the Prefecture to register your entry into Italy, to sign the Integration Agreement and to collect the necessary documentation to request a residence permit for family reasons which is needed at the post office to send the documentation.

REMEMBER to also keep the documentation certifying the degree of relationship (a translated and certified marriage or birth certificate) that you used at the Italian Embassy to obtain the ‘Entry Visa’. This documentation is important as it will be requested by the Police Headquarters’ Immigration Office, especially when you need to include minor children on the residence permit.

8 WHAT MUST I DO WHEN I ARRIVE IN ITALY?

The Integration Agreement Within 8 days of arriving in Italy you must go to the Municipality where you live to make an appointment with the One-Stop Immigration Desk of the Prefecture of Parma. At the Prefecture you must sign the Integration Agreement, together with the request for a residence permit which is a contract that the Italian State signs with all foreigners aged over 16 who enter national territory for the first time, and who request a residence permit for one year or more. In signing the agreement, the Italian State undertakes to assure that you benefit from the fundamental rights and to provide you with the tools to learn the language, culture and principles of the Italian Constitution. You must commit to learning the Italian language and culture, the rights and duties set out by the Italian Constitution, attending language classes and participating in civic information sessions organised by the Prefecture and by the CTP (Territorial Centres for Education).

WARNING! If you have minor children you must ensure that you fulfil the education obligation by enrolling them in school. Failure to comply with the obligation of school enrolment for minor children will invariably result in the loss of your residence permit.

Within two years of signing the Agreement you must have earnt 30 credits, proving that you have fulfilled the obligations described. If you do not manage to obtain these 30 credits, your residence permit will not be renewed and you may be expelled, unless you have obtained recognition of international protection or if you have carried out family reunification.

9 RESIDENCE PERMITS

Residence permit for subordinate work Your residence permit for subordinate work is valid for 2 years if the employment contract is for an indefinite time or longer than 2 years, or valid for 1 year if the employment contract is for a fixed period less than 2 years.

WARNING! If you leave Italy for a period longer than half the duration of your residence permit, YOUR PERMIT WILL NOT BE RENEWED.

E.g.: If you have a permit valid for one year and you leave Italy for a continuous period of over six months YOUR PERMIT WILL NOT BE RENEWED; if you have a permit that is valid for two years and you leave Italy for a continuous period of over one year YOUR PERMIT WILL NOT BE RENEWED.

To renew your residence permit you must go to the Post Office and complete the appropriate Kit. You can contact the Immigration Desk for your Municipality for help with completing the form. At the time of renewal you must fulfil the requirements for entry, you must have sufficient economic resources and you must not have had any convictions for crimes that would impede entry, except in cases of rehabilitation or if the offence was extinguished.

REMEMBER! The deadlines for submitting a request for renewal of your residence permit are 60 days before the expiry date or a maximum of 60 days after. In this second case you must provide evidence for the reason for the delay.

10 If the permit has expired for over 60 days, the renewal must be requested directly at the help desk of the Provincial Police Headquarters’ Immigration Office.

Residence permit while awaiting employment If you lose your job you can obtain a residence permit while awaiting employment, which is valid for one year from the moment you become unemployed.

WARNING! In order to obtain this residence permit you must prove your state of unemployment by requesting certification of this from the employment centre.

The residence permit in use while awaiting employment cannot be renewed beyond one year, except for particular cases where other elements must be evaluated that would allow the issue of another type of residence permit.

Residence permit for family reasons The residence permit for family reasons grants you access to healthcare services, enrolment in study courses (at the CTP) or vocational training courses, allows you to undertake subordinate employment or self-employment and if requested, can be converted into a permit for employment reasons, if the requirements for issue have been fulfilled. Children under 14 years are registered on their parent’s residence permit. On reaching 14 years of age they will be issued with a residence permit for family reasons, upon request of this at the authorised Italian Post Office desks. In the case of minors who are relatives of naturalised Italian citizens or EU citizens, the request must be made at the helpdesk of the Provincial Police Headquarters’ Immigration Office. On reaching the age of majority, the child who is still dependent on his/her parents

11 can be issued with a residence permit for family reasons, if they meet the requirements.

REMEMBER: as regards the residence permit for family cohesion (conversion of the residence by another member to the family) the request must be made at the counters of the Provincial Police Headquarters’ Immigration Office, with all the requirements fulfilled to obtain family reunification.

REMEMBER: In Italy parents have an obligation to support their children until they become socially and economically independent. They must also ensure that their children fulfil the educational obligation.

EU Residence Permit for Long-Term Residents You can request an EU Residence Permit for Long-Term Residents if: • you have held a residence permit for at least 5 years and you have not left the national territory for 6 consecutive months in one year or for a total of 10 months in 5 years; • your residence permit is still valid; • you can prove that you have an income available which is no less than the annual value of social allowance; • you have passed an Italian language test or you can prove that you have A2 level knowledge of the Italian language.

WARNING! If you are a holder of international protection you do not need to take the Italian language test.

The calculation of the period of residence (at least 5 years) for the issue of the EU Residence Permit for Long-Term residents is made starting from the submission date of the request for international protection, based on which international protection has been granted, while for other foreigners it is calculated from the issue date of the first residence permit.

12 WARNING! You cannot request the EU Residence Permit for Long-Term Residents for: a) stays for study or vocational training; b) stays for temporary protection or if you have requested the residence permit for this reason and you are awaiting a decision on the request; c) you have requested international protection and you are still awaiting a final decision; d) you hold a short-term residence permit.

The EU Permit for Long-Term Residents is valid for an undetermined amount of time. It does not expire and therefore it does not need to be renewed but only updated. This permit grants the foreigner an “extra” series of rights in comparison to the “standard” residence permit and also serves as a valid personal identification document for 5 years.

WARNING! The permit can be revoked in the following cases: • if acquired fraudulently; • when the foreigner becomes a danger to public order and the security of the state, or obtains a conviction for a crime that impedes entry into Italy; • in the event of their absence from the EU for 12 consecutive months; • in the event that another EU country has issued an EU Permit for Long-Term residents; • in the event of their absence from the national territory for 6 years.

In the event that the permit is revoked for reasons of absence from the territory of the State or in the event an EU permit is granted by another Member State, is it possible to re-obtain the EU permit after 3 years and still obtain a normal residence permit in compliance with legal requirements.

13 Long-Term EU Permit for family members You can also request an EU Permit for Long-Term residents for the family members living with you for whom reunification can be carried out. In addition to the Italian language test, you must demonstrate the following requirements: • the suitability of the accommodation (ACER) or the hygiene and health requirements certified by the Local Health Authority competent (AUSL); • an adequate income calculated on the basis of parameters set for family reunification (also derived from the accumulation of the incomes of family members living together).

REMEMBER! Even dependant family members must satisfy the requirements for the length of stay (5 years).

With the aim of issuing the EU residence permit for family members of the beneficiaries of international protection, documentation relating to accommodation suitability is not required from the foreign holder of international protection or from his/her family members, apart from the requirement to indicate a place of residence. You must complete the appropriate KIT which can be found at the competent Post Office

WARNING! If you request the EU residence permit for a child over 14 years of age who was previously included in your EU permit, you do not have to prove that the requirements have been fulfilled. REMEMBER to update your EU Residence Permit for Long- Term residents in the following cases: • change of residence; • inclusion of a child under 14 years; • amendment of passport details; • changes in personal details; • updating the photos. Update requests do not involve a new assessment of the requirements.

(see pgs. below) Residences permit for social protection purposes Italian legislation recognises a particular form of protection for the foreigner who is a victim of violence or serious sexual exploitation, prostitution or labour exploitation by criminal organisations, or for those who find themselves in a dangerous situation due to their desire to leave a criminal organisation. These people will be issued with a residence permit for social protection purposes and they will be given the opportunity to participate in a project of assistance and social integration.

WARNING! Social protection has been recognised in cases in which violence or abuse in the domestic or family environment has been verified and where there is a danger for the person’s safety. In cases in which you are suffering abuse and violence in the domestic or family environment you should contact the Parma Women’s Crisis Centre as quickly as possible.

Reporting situations of violence or serious exploitation concerning the foreigner, and the proposal to issue the residence permit, can be made by: • the Social Services of local Bodies or associations; • bodies and other private organisations qualified to provide social assistance and protection programmes for foreigners; • the Public Prosecutor, if the foreigner has made a statement within the context of criminal proceedings relating to events of violence or serious exploitation. Upon receipt of the proposal and after checking that the required conditions have been met, the Provincial Police Headquarters will arrange for the residence permit to be issued for humanitarian reasons. The residence permit for social protection purposes is valid for 6 months and can be renewed for one year or for the longest period necessary for reasons of justice.

15 ASSISTED VOLUNTARY REPATRIATION

Assisted Voluntary Repatriation (RVA) is when migrants are offered the chance to return if they cannot or do not want to stay in the host Country and who wish, in a voluntary and spontaneous way, to return to their own Country of origin. EU citizens or those with dual European/Third country nationality are excluded, as are holders of an EU Residence permit for Long-Term residents (ex residence card). In addition, those who return in this way renounce the international protection status or request, if started. 16 HOW DO I OBTAIN ITALIAN CITIZENSHIP?

The main ways to become an Italian citizen are by becoming a resident and through marriage. You can request the recognition of citizenship if you have resided legally and continuously for at least 10 years in the territory of the Italian State. If you are an EU citizen, 4 years of legal residency are required; for holders of permits for political asylum or subsidiary protection, for stateless persons and for children over 18 adopted by Italian citizens, 5 years of legal residence are required.

WARNING! The residence must be continuous and uninterrupted up until the moment of taking the oath of citizenship.

The requirements are: • legal and continuous residence • having sufficient income, • social integration in Italy; • absence of convictions in the Country of origin and in Italy; • absence of reasons to deny for public security purposes. The request is made at the Prefecture (see pg. below).

REMEMBER! From the 18th May 2015 an online system for submitting citizenship requests will be in operation. For more information contact the One-Stop Immigration Desk or the Municipalities’ Immigration Desks.

What should the citizen The applicant must fill out the application form, using the access credentials he received after registering on the special portal, and

17 must forward this electronically, together with proof of identity, as well as all the documents issued by the authorities of the country of origin (birth certificate and the certificate issued by the criminal records office) and the receipt of payment of the contribution of EUR 200.00 pursuant to Law no. 94/2009 . You can acquire Italian citizenship if you have been married for at least two years to an Italian citizen and you reside in Italy (in this case, if children are born during the marriage, the period is reduced by half); if you reside abroad, three years are required, provided that at the time of the relative decision, there has been no spousal separation, or the dissolution or cessation of all the civil effects of marriage.

WARNING! A foreign minor born in Italy becomes an Italian citizen only if they stay uninterruptedly in Italy until they reach 18 years of age and request recognition of Italian citizenship from their Municipality of residence before reaching 19 years of age.

REMEMBER! If you have obtained citizenship, you can request recognition of citizenship for minor children living with you who are regularly residing in the territory and who are present at the time of notification of the decree granting citizenship.

24 HOW DO I RECEIVE HEALTHCARE?

Some important information about your health! You are required to register with the National Health Service (SSN) if you are a non-EU foreign citizen with a regular residence permit for the following reasons: employment, family, political asylum, humanitarian asylum, asylum request, awaiting adoption, foster care or a citizenship request. Once you are registered, you will acquire the same rights to healthcare as all Italian citizens: check-ups and specialist examinations, hospitalisation, medicines, reduced costs, etc. are also a right of foreign immigrants registered in the SSN. You can register at the Local Health Authority of your place of residence or stay (indicated on your residence permit), presenting the residence permit, the tax code and the certificate of residence, which can be replaced if you are not a resident with a written declaration from yourself indicating your habitual place of stay. The registration is valid until your residence permit expires: when it expires, you just need to present the receipt for the renewal request issued by the police headquarters to the healthcare registry office. If you are an illegal foreign national, you still have the right to receive all urgent or essential clinical and hospital treatments, for illness and injury, as well as preventative healthcare. The following are guaranteed: prenatal and maternity care; child healthcare; vaccinations and interventions of international preventative care; the prevention, diagnosis and cure of infectious diseases. You can obtain these services by presenting the STP card (Foreign National Temporarily Present) that is issued to you by again going to your Local Health Authority. If you are poverty-stricken, the services listed above will be guaranteed to you free of charge, with the exception of those for which a contribution payment is due, even for legal foreigners and Italians. Studying is a right! The right to study is one of the fundamental rights of every citizen all over the world, as set out by the Universal Declaration of Human Rights. This right is also guaranteed in Italy, without distinction of race, language or religion, as contained in articles 3, 33 and 34 of the Italian Constitution.

If you are over 14 you can contact: The Adolescent service in NOF (New Training Obligations), as part of the Province of Parma’s Employment Centres (for addresses see pg. XXX above) is aimed at all young people who have attended school for 8 years and are under 18 years old. The services offered by the Centres are aimed in particular at those who have left school, a

“Nelson Mandela” Multimedia Centre: is open everyday, and offers the chance to use language materials (books, magazines, music CDs, films on DVD) and free internet access. The centre also holds Italian language and IT courses and serves as a meeting place, a place of reunion for communities. In the winter, the Centre simply becomes a place to stay for those who live in difficult conditions, so that they can keep warm during the day. 1 Vicolo S. Quirino, Parma.

Three hours per week on booking with a maximum of one hour per day, printing facilities (0.10 Euro per page). Once connected, open any navigation page and you will automatically be redirected to the authentication page that requests a Username and Password. Select ‘How to open an account via SMS’ and follow the instructions, entering the details required including your mobile phone number; you will shortly receive a message with your log- in details to access the network. Every password is linked to the device that requests it.
