Because these workers are currently classified as independent contractors, they are without the protections and benefits that are guaranteed to employees. Instead, these drivers are saddled with significant work risks including: no minimum wage or overtime pay, no Title VII protections from workplace discrimination, and no access to social insurances like unemployment insurance and disability pay. Some scholars have called for the creation of a third intermediary category between employee and independent contractor to classify workers in the gig- economy.
