INVESTIGATIVE REPORT Lori Torres, Inspector General OFFICE: INDIANA BUREAU OF MOTOR VEHICLES TITLE: FORGERY; PERJURY; THEFT CASE ID: 2017-12-0293 DATE: August 30, 2018 Inspector General Staff Attorney Kelly Elliott, after an investigation by Special Agent Mark Mitchell, reports as follows: The Indiana General Assembly charged the Office of Inspector General (OIG) with addressing fraud, waste, abuse, and wrongdoing in the executive branch of state government. IC 4-2-7-2(b). The OIG also investigates criminal activity and ethics violations by state workers. IC 4-2-7-3. The OIG may recommend policies and carry out other activities designed to deter, detect, and eradicate fraud, waste, abuse, mismanagement, and misconduct in state government. IC 4-2- 7-3(2). On March 23, 2017, the OIG received a complaint from the Indiana Bureau of Motor Vehicles (BMV) that alleged a former BMV employee, Richard Pringle, submitted false information to the BMV on personal certificate of title applications. OIG Special Agent Mark Mitchell conducted an investigation into this matter. Through the course of his investigation, Special Agent Mitchell interviewed Pringle and reviewed documentation received from BMV, including their internal investigation report on this matter. According to BMV’s investigative report of the allegations against Pringle, BMV found that Pringle submitted an application for a 1997 GMC Yukon in October 2016 that listed a sale price 1 that was different from the price the seller of the vehicle stated they sold it. At the conclusion of their investigation, BMV terminated Pringle’s employment in or around March 2017. Special Agent Mitchell reviewed the BMV certificate of title application for the 1997 GMC Yukon. -

63 Section 7: Criminal Offense, Criminal Responsibility, and Commission of a Criminal Offense Article 15: Criminal Offense A criminal offense is an unlawful act: (a) that is prescribed as a criminal offense by law; (b) whose characteristics are specified by law; and (c) for which a penalty is prescribed by law. Commentary This provision reiterates some of the aspects of the principle of legality and others relating to the purposes and limits of criminal legislation. Reference should be made to Article 2 (“Purpose and Limits of Criminal Legislation”) and Article 3 (“Principle of Legality”) and their accompanying commentaries. Article 16: Criminal Responsibility A person who commits a criminal offense is criminally responsible if: (a) he or she commits a criminal offense, as defined under Article 15, with intention, recklessness, or negligence as defined in Article 18; IOP573A_ModelCodes_Part1.indd 63 6/25/07 10:13:18 AM 64 • General Part, Section (b) no lawful justification exists under Articles 20–22 of the MCC for the commission of the criminal offense; (c) there are no grounds excluding criminal responsibility for the commission of the criminal offense under Articles 2–26 of the MCC; and (d) there are no other statutorily defined grounds excluding criminal responsibility. Commentary When a person is found criminally responsible for the commission of a criminal offense, he or she can be convicted of this offense, and a penalty or penalties may be imposed upon him or her as provided for in the MCC. Article 16 lays down the elements required for a finding of criminal responsibility against a person. -

She uses the State v. Peairs criminal and Hattori v. Peairs tort mistaken self-defense cases to illustrate why application of the reasonable person standard to the same set of facts in two areas of law can lead to different outcomes. She also uses these cases to highlight how fundamentally different the perception of what is reasonable can be in different cultures. She then questions whether both criminal and tort law should continue to treat a reasonably mistaken belief that deadly force is necessary as justifiable self-defense. Based on the different purposes that tort and criminal law serve, Professor Forell explains why in self-defense cases criminal law should retain the reasonable mistake standard while tort law should move to a strict liability with comparative fault standard. A DESCRIPTIVE ANALYSIS OF GEORGIA HIGH SCHOOL TEACHERS’ PERCEPTIONS OF ACADEMIC DISHONESTY by AMY MANNING ROWLAND (Under the Direction of Walter Polka) ABSTRACT This research study was conducted with the assistance of Georgia high school teachers for the purpose of examining teachers’ perceptions of academic dishonesty during the 2006-2007 school year. Data were gathered to establish teachers’ perceptions of academic dishonesty by exploring what behaviors teachers felt to be academically dishonest, how teachers addressed such occurrences, whether teachers felt any internal conflict regarding academic dishonesty, whether any external pressures were involved in instances of academic dishonesty, and how these experiences affected teachers’ attitudes toward their profession. Results of the study indicated that high school teachers in Georgia consider academic dishonesty to be a prevalent problem. Teachers consider some types of academic dishonesty to be more serious than other types of academic dishonesty. -

Conspiracy, it is generally said, is a necessary doctrine in some respects, but also one that is overbroad and invites abuse. Conspiracy has been thought to be necessary for one or both of two reasons. First, it is said that a separate offense of conspiracy is useful to supplement the generally restrictive law of attempts. BRANDENBURG IN A TIME OF TERROR Thomas Healy* Forfour decades, the Supreme Court's decision in Brandenburg v. Ohio has been celebrated as a landmark in First Amendment law. In one short unsigned opinion, the Court distanced itselffrom the embarrassment of the Red Scare and adopted a highly protective test that permits advocacy of unlawful conduct in all but the most dangerous cases. But 9/11 and the threat of terror- ism pose a new challenge to Brandenburg. Although the government has not resorted to the excesses of McCarthyism, it has taken disturbing steps to silence the speech of political dissenters. These efforts raise questions about the ade- quacy of Brandenburg to protect speech during a time of crisis andfear. They also highlight ambiguities in the Brandenburg test that have been largely ignored by courts. For instance, does Brandenburg apply during war as well as peace? Does it apply to private advocacy as well as public advocacy? And is there anything about the current terrorist threat that would make its protections inapplicable? To answer these and other important questions, this Article undertakes a comprehensive reexamination of Brandenburg and the issue of criminal advocacy. -

INTRODUCTION Imagine a case featuring a manufacturing shop boss who sent his employees into a toxic work environment. As happens at many job sites, hazardous chemicals unavoidably were nearby, and safety always was a matter of reducing their concentration. This attempted solution, however, may mean that dangerous levels of chemicals remain. But this time, the level of toxicity was far higher than usual. There is strong evidence that the shop boss knew about the danger, at least well enough to have realized that it probably had reached a deadly level, but the shop boss disputes this evidence. The employees all became ill, and one of them has died. The survivors sue in an attempt to recover damages for wrongful death.
