CAPARROS (gen ed. of English translation), Exegetical Commentary on the Code of Canon Law ii GENERAL INTRODUCTION The vow of obedience, as one of the evangelical counsels, is a hallmark of religious life in general and religious institutes in particular.1 Despite their vowed state, however, members of religious institutes remain members of the general body of the Christian faithful and, as such, can “legitimately vindicate the rights which they possess in the Church in the competent ecclesiastical forum according to the prescripts of the law applied with equity” (c.221 §1). Indeed, canon law has much to say about the relationship between superior and subject in an ecclesial context and the way in which power is to be exercised. It follows that, although members of religious institutes are parties to hierarchical relationships, acts of superiors cannot be arbitrary but must respect rights on the part of their subjects which are recognised and governed by law. One area where issues of administrative justice may arise has undoubtedly been much in the public mind of late. This is in relation to administrative penalties or other disciplinary measures, the ongoing revelations of sexual abuse within the Church and the rights which victims, accused and religious institutes have vis a vis each other. Like an iceberg, though, much administrative decision making passes unseen beneath this very public sphere, especially where it is not explicitly penal or disciplinary in character. While not matters of punishment or discipline per se, acts such as admitting a novice, allowing him or her subsequently to proceed to vows, moving a religious from one house to another, advancing him or her through the stages of formation, applying a member to a specific apostolate or exclaustration (among many others) just as surely involve administrative actions and concomitant rights and may have significant impacts on individuals. 1 Codex iuris canonici, auctoritate Ioannis Pauli PP. Superiors have therefore had relatively little guidance on the proper bases of, and formal requirements for, administrative action in the context of a religious institute and the avenues for redress open to a member who feels him or herself to be wronged by a superior’s act. This thesis attempts to remedy this lacuna by considering the basic principles of just administrative action in religious institutes: the nature of the authority of superiors over their subjects, the nature and classification of administrative acts, their application to action in religious institutes and the remedies available for justice denied. While I would hope that it could serve as something of a vade mecum for superiors, given its length, it will (of necessity) be an outline only. It will proceed in three chapters. Chapter 1 considers the nature and classification of administrative acts in canon law, the executive authority of superiors in religious institutes and the provisions of the law safeguarding fair procedures including the content of subjects’ general rights to administrative justice. Chapter 2 uses these conclusions to attempt to formulate general principles for just administrative action. It then considers exclusions of members from permanent final vows and reassignment within the institutes as paradigmatic applications of these principles. Chapter 3 briefly considers the remedies available to persons who consider themselves aggrieved by a religious superior’s administrative act and finally offers suggestions as to areas for future studies which might arise from this thesis. While my focus will mostly be the Latin Church, I will note features of Eastern canon law and practice where these are significantly different. CHAPTER 1 – ADMINISTRATIVE ACTS AND RIGHTS IN GENERAL This chapter aims to chart the scope of administrative action relevant to religious institutes. It begins by considering the nature and classification of administrative acts and then considers the nature of executive authority which religious superiors possess. Finally, it discusses the major legal constraints on superiors’ administrative action, focusing on general obligations of a superior and rights of the subject in relation to the placing of an act. Specific rights to challenge an administrative act once it has been placed will be dealt with in Chapter 3. 1.1 Classification of Administrative Acts While the actions of superiors generally fall into one category or another of administrative act (considered below), such acts are not placed in a vacuum. For legality, and occasionally for validity, they may require preliminary steps to be taken by the authority in order to safeguard the rights of those affected or to ensure that the act is appropriate. John Huels therefore uses the term “administrative activity” to cover both administrative acts themselves and the enquiries or other actions which precede and surround them.2 This term is attractive as it includes and subsumes the general process-oriented norms in cc. 50 and 51 which William Daniel describes as “the general administrative procedure”.3 Vital though this procedure is, there are many other safeguards on the justice of administrative action, including, for instance, the warning or consultation of affected parties, seeking advice from consultative bodies or enquiries as to whether an act is appropriate.4 This thesis will consider general and specific rules governing administrative activity surrounding an act when it discusses legal constraints on superiors and rules relating to particular actions. Administrative acts themselves may be described as juridic acts placed unilaterally by virtue of the executive power of governance, in nomine Ecclesiae (in the Church’s name) and on behalf of a public juridic person.5 They may sometimes be similar in form to laws, but their hallmark is their subordinate, 2 J.M. There is a canonical distinction be- tween religious congregation and religious order; the former's members take simple vows, the latter's members take solemn vows, a distinction of importance in regard to the ownership of property which I will elaborate on shortly. Religious institute is the canonical term, religious order is fa- vored in civil law and by the IRS, and religious congregation and religious community are the more popular terms. A religious institute comes into existence when a group of Catholic Christians who choose to live a common life in service to God's people on behalf of the Church receive the Holy See's or a local bishop's approval.

    Statistical Analysis Marriage Nullity Cases in the United States of America from 2016-2018 Introduction Over three years have passed since the reform of the process for the declaration of the nullity of marriage legislated by the Motu proprio Mitis Iudex Dominus Iesus and Mitis et misericors Iesus has gone into effect. Due to the novelty of the Processus brevior coram Episcopo, there is much interest in the way it is being used. Several have already produced statistical studies. There are the two studies for the Ibero- American tribunals.1 In addition, the Canon Law Society of Great Britain and Ireland published in its 2019 Newsletter a statistical analysis for Tribunal activity in 2017.2 There is also the periodical Proceedings of the Canon Law Society of America, which began in 2017 to published the statistics for the briefer process.3 Scope and Method The present study seeks to analyze the statistics regarding the first instance activity of ecclesiastical Tribunals in the United States of America from 2016 through 2018. While some of above-mentioned studies relied heavily on reports of the Central Office of Statistics of the Church, the raw data for this study was gathered exclusively from the Annual Reports on the State and Activity of the Tribunal submitted to the Supreme Tribunal of the Apostolic Signatura. 4 Certainly this choice placed some limitations on the data intake; however, the report provides a unique data set including the number of appeals lodged by the defender of the bond. Immensely popular, it is high- lighted by some of the largest remaining fragments of the Wood of the True Cross in the world and a piece of the Veil that belonged to the Blessed Virgin. Each exposition begins with a presentation on relics that provides the catechetical and spiritual basis for the veneration that follows. The teaching presents the basic Gospel message: God wants to be encountered; He touches us through the lives and the sacred re- mains of His saints. “God never disappoints ... he always ‘shows up,’” remarks Fr. Martins. “There are healings at every exposition. Hun- dreds, perhaps even thousands, have been reported. Spectacular ones. Attendees have reported cancer, heart dis- ease, tumors, osteoporosis, physical deformities, etc., disappear immediately and completely.” Though a great num- ber of miracles have been physical (the exhibit’s website lists a sample of these), he admits that the most spectacu- lar is the healing of faith, where a new and deeper relationship with God and His saints are formed in the faithful.

    The beginning Everything started from father Gemelli’s inspiring ideas. He had the project of founding a Catholic University, the dream of Italian Catholics, to overcome at last the cultural inferiority caused by the Non expedit of the Church. (The Non expedit was a Vatican disposition forbidding the participation of Catholics in politics). The Non expedit (you cannot) had, in fact, a strong influence and caused the detachment of the majority of Catholics from political life. Father Gemelli believed that, to make the University strong and lasting, it was absolutely necessary to have a spiritual institution including people at all levels (professors, assistant professors, technical and financial staff, public relations staff and even door-keepers) supporting its life and activities by all means. He thought of the possibility of a lay consecration to God in the world, with vows taken secretly by lay people. The initial problem was that this type of consecration was considered impossible and unimaginable at that time, as it did not exist in the canon law. He started, however, with the women’s Institute of “the Missionaries of the Kingship of Christ” originated within the Third Order as “a branch of the great and prolific Franciscan tree”. The first twelve “Franciscan Tertiaries of the Social Kingdom of the Sacred Heart” consecrated themselves to the Lord, in the little choir of the church of San Damiano in Assisi, on the nineteenth of November 1919. This was before the foundation of the Catholic University of the Sacred Heart that took place in 1921. These early Missionaries, through their witness of consecrated life in the world, gave a great contribution to the official acknowledgement of this special vocation by the Church.

    Religious law versus secular law The example of the get refusal in Dutch, English and Israeli law Matthijs de Blois* 1. Introduction The revelation of the Torah on Mount Sinai as described in the book of Exodus is archetypical for religious law. ‘Then God spoke all these words (…).’1 Religious law is God-given. The law is theonomous and is binding ipso facto, independent of the consent of the governed. It may be a living instrument, but it is not subject to adaptation to changing opinions or practices among those who are bound by it. It is in that sense unchangeable, although it has to be interpreted by the members of the religious community or more specifically by those endowed with the task of interpreting the law. As far as the contents of the law are concerned, religious law tends to stress inter alia communal values and a submission to authority within hierarchical structures. It should also be underlined that in religious law there is no ‘public’ and ‘private’ distinction, which is so common to an Enlightenment approach to the law. It is not even possible to separate the relation- ship between God and man from those between men among each other. A violation of our obligations towards other persons implies a violation of God’s law and it therefore has its effect on the relationship with God. The religious is not a separate sphere next to the secular. There is no secular sphere. That is especially true for Judaism, which, in Maoz’s words, ‘encompasses all aspects of society and of an individual’s life.’2 In this day and age we can safely assume that religious law is based on a long tradition which already existed long before the idea of a pure secular law entered the scene with the Enlightenment.
