Democratic states are more susceptible to terrorist attacks and yet have the most responsibility to ensure their counterterrorism responses are in accordance with democratic principles. Respect for the rule of law and the freedoms of speech and press are just a few of the principles ingrained in democratic philosophy and likewise, by the very nature of a democracy, democratic states must be held accountable to their citizenries. These factors, however, can be a cause of dissention and can lead to a dangerous overreaction or a disproportionate response by democratic states in their counterterrorism policies, including leading to the very undemocratic response of restricting civil liberties. This thesis researches and analyzes the counterterrorism policies of Britain and Spain and applies the theory of Moral Panics to evaluate how Moral Panics has influenced their respective counterterrorism policies to account for the discrepancy found between the British and Spanish state responses to terrorism. Introduction It is well known that terrorism is not a new concept, however, the ways in which democratic states deal with the threat of terrorism today and considerations of the implications of their counterterrorism policies are relatively new. Regarding a state‘s counterterrorism policies, democratic states face an important dilemma regarding how to find the right balance between maintaining state security and upholding civil liberties, and how to address any imbalances between the two. The focus and intent of this thesis is to explore how and attempt to explain why Britain and Spain, both being European democracies having had very similar experiences with both domestic and international incidents of terrorism, have enacted quite different counterterrorism measures. This thesis includes key concepts in the history of terrorism in both Britain and Spain, discusses the existing literature, and presents the research question and the methodology utilized to analyze this comparative case study through the application of the sociological concept of Moral Panics. The theory of Moral Panics is introduced below, and justification is given as to why this theory has been chosen in the attempt to explain the divergence in Britain and Spain‘s respective counterterrorism responses, but, first, a few alternative explanations are addressed that could explain this difference. Firstly, one could hypothesize that the difference between the British and Spanish counterterrorism responses could be explained through the nature of the most recent terrorist attacks committed in their respective states and the subsequent threat perception. In the Spanish case, the response 1 to the terrorist attacks of 11 March 2004 (11/M) was reactionary. After initially blaming the Spanish terrorist group ETA1 for the 11/M attacks, the Spanish public became aware that the attacks were perpetrated by Islamic terrorists and were related to the Spanish military‘s presence in Iraq. Consequently, in the 2004 Presidential elections that followed just days after the 11/M attacks, Spaniards voted the party they deemed responsible for 11/M, the Popular Party, or PP, out of office and as such largely believed the terrorist threat to be over.2 Contrary to the Spanish reactionary response, the British response was largely forward looking; legislation was enacted that would, with any luck, prevent future terrorist attacks. This hypothesis can be ruled out due to the fact that one could attribute the (ir)rational response of the Spanish citizenry to vote the PP out of office to acting out of fear; fear for what might happen if the PP were to stay in office, which in turn, allows for the theory of Moral Panics to possibly explain the public‘s reaction. A second hypothesis one could offer as an alternate explanation to the theory of Moral Panics concerns the history of terrorism and democracy in the two countries. Whereas while the British Government did enact undemocratic policies against the Irish Republican Army, IRA, they were not as repressive as the Spanish policies, especially regarding the state-sponsored death squads used, unsuccessfully, during the Spanish dirty war to thwart ETA.3 Even if one were to argue that the Spanish tactics were less repressive than the British, this still does not account for the fact that the Spanish democracy is much younger than British democracy and, as such, confidence in the 1 Euskadi ta Askatasuna or Basque Homeland and Freedom 2 Partido Popular or Popular Party; the PP led by José Maria Aznar was deemed responsible for the 11/M attacks and, therefore, in the 14 March 2004 elections, the PSOE, Partido Socialista Obrero Español or Spanish Socialist Workers‘ Party, led by José Luis Rodriguez Zapatero, was elected to office. 3 The Spanish state-sponsored death squads were the Grupos Antiterrorista de Liberación, GAL, or Anti-Terrorist Liberation Groups 2 Spanish democracy is less stable, especially in the minds of older Spaniards who still remember well the times of General Francisco Franco‘s, former dictator of Spain, rule just over three decades ago.     ETA and the Public McCreanor ETA and the Public, 1959-1987 KYLE McCREANOR1 After an ephemeral moment of autonomy during the Spanish Civil War, the Basque Country was conquered by Spanish Nationalist forces. Under the dictatorship of General Francisco Franco, the Basque people were subject to heavy oppression. The Francoist state sought to eliminate the Basque language and culture as part of a grand vision to create a ‘unified Spain.’ In 1959, a Basque guerrilla resistance movement, Euskadi ta Askatasuna (ETA: Basque Country and Freedom) was born with a mission to preserve their unique language and culture, and ultimately, to secure an independent Basque state. Their initial strategy was to incite a revolution by symbolic acts of violence against the Franco regime and gain popular support in the Basque Country. This paper explores ETA’s relationship with the public, analyzing the ways in which they cultivated support and disseminated their ideas to the masses. However, what the research finds is that as ETA’s strategy changed, so did their relationship with the public. After Spain’s democratization, ETA abandoned the idea of bringing about a revolution of the masses, and sought only to wage a violent war of attrition against the Spanish state in order to establish a sovereign Basque nation. The Basque Country, or Euskadi, is a region straddling the Northern Pyrenees, falling under the jurisdiction of Spain and France. A las pocas horas de haberse producido el atentado, numerosas barricadas fueron levantadas por grupos de manifestantes en Bilbao, en cuyo centro quedó congestionada la circulación rodada. El Gobierno Civil de Vizcaya comunicó anoche que no se autorizará ninguna manifestación en la calle y exhortó a evitar provocaciones. Dos hombres, uno de fuerte complexión, de unos 40 años, que vestía cazadora de color azul oscuro, y otro más joven, armados con una pistola y un fusil ametrallador -armas que abandonaron en su huida-, penetraron, minutos antes de las 18.30 de ayer, en la consulta de Brouard y, tras apartar a la enfermera que les había abierto la puerta, se encaminaron directamente al despacho del dirigente abertzale, contra quien efectuaron ocho disparos, cinco de los cuales le alcanzaron en la cabeza. Fuentes policiales de absoluta solvencia no descartaron anoche que Brouard fuera un hombre que pudiera participar en el inicio de las conversaciones con ETA para conseguir la pacificación de Euskadi y aseguraron que el hecho de dejar las armas sin ninguna huella es obra de profesionales. El objetivo de este trabajo es exponer con un cierto detalle, pero también de una manera sistemática, el ingente número de resoluciones judiciales reca- ídas en relación con el partido político Batasuna desde su inicial suspensión penal en 2002 hasta el rechazo a la inscripción en el Registro de partidos de su sucesora ASB en mayo de 2007. 1. SUSPENSIÓN PENAL DE BATASUNA La suspensión de las actividades de Batasuna comienza en el verano de 2002 con el Auto de 26 de agosto del Juzgado central de instrucción núm. 5 (1) Este artículo se ha realizado en el marco del proyecto de investigación «Constituciona- lización y constitucionalidad de los partidos políticos» dirigido por Javier Corcuera Atienza y financiado por el Ministerio de Ciencia y Tecnología (BJU2003-07795).     Thousands in nationalist Basque country demo as Madrid fumes Agence Presse France, 8/22/03 Thousands demonstrated in this Basque city Friday in support of self-determination for the restless Basque country in northern Spain, while the central Spanish government in Madrid raged at Basque authorities for allowing the rally to take place. Prominent among demonstrators were members of the radical Basque party Batasuna, banned by Madrid courts because of its close connection with the armed separatist group ETA, which has been blamed for the deaths of more than 800 people. Participants called for an amnesty for ETA members jailed for violence including bombings and shootings during the group's three-decade campaign for an independent state. Arnaldo Otegi, a Batasuna leader, told the crowd that Friday's rally represented defeat for the "Spanish fascists", who would not prevent the "patriotic Basque Left" from demonstrating and participating in political and institutional activities. The demonstration was authorised by the interior minister of the Basque regional government, dominated by the moderate Basque Nationalist Party (PNV). The decision to allow the gathering sparked rage in Madrid. "Friends of ETA and its accomplices will march freely through the streets of the Basque country today because the Basque government has allowed it," complained Jose Maria Michavila, justice minister in the national government. "The truth of the matter is that ETA has been expelled from every democratic institution in Spain and the European Union," the minister said: "Its only remaining oxygen is that provided by the institutions in which the PNV rules," he added, calling on the PNV Basque executive to stop acting as "official sponsor for ETA, Batasuna and friends of terrorism".

ETAm pretendió inhibir- se de la política y centrarse en el terrorismo. ETApm optó por formar un nuevo par- tido político, EIA. Las elecciones de 1977 fueron un reto para el nacionalismo vasco radical, que adoptó estrategias divergentes. ANV, ESB, ESEI y EIA decidieron par- ticipar, este último en el seno de la candidatura Euskadiko Ezkerra; ETAm, EHAS y LAIA apostaron por el boicot. EE obtuvo dos parlamentarios y apostó por la vía ins- titucional. La alta participación obligó a ETAm a cambiar de planes. Se quedó con la mayor parte de la herencia de ETA y, cuando HASI, LAIA, ANV y ESB formaron Herri Batasuna, ETAm la tomó bajo su control.
