Mr Abraham SHEK will address the Council on the "Public Accounts Committee Report No. 75A". Supplemental Report of the Public Accounts Committee on Report No. 75 of the Director of Audit on the Results of Value for Money Audits (May 2021―P.A.C. Report No. 75A) MR ABRAHAM SHEK: President, on behalf of the Public Accounts Committee ("the Committee"), I have the honour to table our Report No. 75A. This is the Committee's second report in response to the Director of Audit's Report No. 75. It contains our conclusions and recommendations on Chapter 1 on "Collection and removal of marine refuse by the Marine Department", Chapter 2 on "Government's efforts in tackling shoreline refuse" and Chapter 4 on "Efforts of the Home Affairs Department in facilitating building management". The public hearings on these chapters had previously been postponed in view of COVID-19. Our first report, i.e. Report No. 75, which focuses on the other seven chapters, was tabled in the Council on 24 February this year. I will now highlight some of the Committee's conclusions and recommendations in our Report No. 75A. Collection and removal of marine refuse by the Marine Department The Committee expresses serious concern that the Marine Department ("MD") has failed to ensure that the quantity of marine refuse collected is reasonably accurate and can truly reflect its performance in tackling marine refuse. The weight of marine refuse collected as reported in MD's Controlling Officer's Reports ("CORs") was only an estimate based on the number of bags of such refuse collected by MD's contractor. From 2012 to 2019, the overall weight of municipal solid waste, which includes, among others, marine refuse, disposed of by MD's contractor at designated disposal facilities was a meagre 19.9% of the overall weight of marine refuse as reported in MD's CORs. 5818 LEGISLATIVE COUNCIL ― 12 May 2021 The Committee recommends that, as all marine refuse collected by MD's contractor will be disposed of at the designated disposal facilities, MD should consider using the actual weight of marine refuse disposed of for reporting in its CORs. The Committee expresses grave concern about MD's ineffectiveness in managing its contracts for marine refuse cleansing and disposal services. MD has not enforced the penalty provisions under the contracts against the contractor for its unauthorized subcontracting arrangements. Furthermore, MD has not, in accordance with the relevant contract provisions, taken any follow-up actions in respect of the contractor's failures to perform its marine refuse cleansing work at a number of typhoon shelters and promenades, and to operate the four marine refuse collection points. The Committee urges MD to step up the monitoring of the contractor's performance, and exercise its right under the contracts to impose penalties against the contractor as and when appropriate. Government's efforts in tackling shoreline refuse The Environment Bureau ("ENB") coordinated the establishment of an interdepartmental working group ("the Working Group") to enhance the collaborative efforts among relevant departments in tackling marine refuse. However, no performance target or timetable for improving the cleanliness of shorelines has been set by the Working Group, and there are some areas along Hong Kong shorelines which do not fall within the purview of any bureaux/departments as such. The Committee expresses concern that ENB has not demonstrated that it had exerted its best efforts to steer the Working Group towards maximizing the collaborative efforts made by member departments in tackling shoreline refuse. The Committee urges ENB to set specific measurable performance target and timetable for improving shoreline cleanliness, and assign a department to take up the responsibility to ensure the cleanliness of the shoreline areas which do not fall within the purview of any government departments or bureaux. Efforts of the Home Affairs Department in facilitating building management The last subject is relating to the efforts of the Home Affairs Department ("HAD") in facilitating building management.
