The statement denounces the action of the Israeli occupation authorities by which the Israeli occupation authorities sentenced Archbishop Hilarion Capucci of Jerusalem to twelve (12) years imprisonment.

I have the honour to request that the statement of the Minister for Foreign Affairs of the Arab Republic of Egypt be circulated as an official document of the General Assembly and the Security Council.

Annex Statement by the Palestine Liberation Organization on the situation in the occupied territories

The masses of the Palestinian people in the occupied territories have been expressing their commitment and support for the Palestine Liberation Organization (PLO) through accepted means and practices, s*uch as strikes and demonstrations. They have been expressing their support for the PLO as the sole and legitimate representative of the people of Palestine and as the authority which has been working diligently to put an end to the occupation.

These expressions of support portray the solidarity of our people under Israeli occupation and coincide with the position taken by the PLO during the present session of the General Assembly.

Yet the occupation authorities have used the most barbaric, oppressive and inhuman methods to combat these legitimate means of expression. Scores of civilians were wounded, scores were detained and some killed as a result of the utilization of tanks to disperse the demonstrators. A 16-year-old girl was the victim of such measures when she was run down by one of the Israeli tanks.

The delegation of the PLO would like to bring to the attention of Member States the oppressive measures used against the Palestinian people under Israeli occupation. These measures have been accelerated in cruelty and in severity as the popular resistance and support have increased.

The Israeli occupation authorities during the past seven years have tried by every possible means at their disposal to suppress the Palestinian resistance. In doing so, it was violating the Charter of the United Nations, the Universal Declaration of Human Rights and the Geneva Conventions, a/ The delegation of the PLO feels that the deteriorating situation in the occupied territories and the suppress!ve measures used by the'occupying authorities demand an immediate and effective intervention from the United Nations to put an end to the outrageous and inhuman oppression of the Palestinian people.

Our people, under the leadership of the PLO, through its popular bases and through the massive support of all segments of its population, have categorically expressed its rejection of occupation. This necessitates that the United Nations and the countries of the world should assume their responsibilities now to bring an immediate end to occupation.

Dear Mr, President, I have been following with great anxiety the mounting tension in the Middle East in recent days and have discussed the situation at length with Minister of State Anwar and with Ambassador Meguid. I have found my talks with theia most helpful and constructive. I am deeply concerned both at the difficulties encountered in making real progress towards a settlement of the basic problems of the Z-iiddle East and at the possibility that, if this progress is too long delayed, there will be a breakdown of the cease~fire. In the latter connexion I am particularly anxious that all the parties continue to co-operate with the United Nations and to support the peace-keeping mechanisms which ensure that the calm and the cease-fire that are essential to negotiations are preserved. Although I can well understand the frustration caused by the lack of progress towards a settlement, I am also firmly convinced that a renewed outbreak of hostilities would only serve to delay that progress even further, quite apart from the very great dangers involved not only for the peoples of the Middle East but also for world peace. I am hopeful therefore that means can be found to avoid such a development. I know that you, Mr. President, arc also much concerned at the hazards of the present situation. For my part, I have been making intensive efforts to find ways out of our present dilerrma. To this end I have today made a public statement, the text of which is attached to this letter, I would be prepared to make a brief visit to the area if this could in any way be helpful. I know that I can count on your co-operation and your full support in finding a solution to the problems which face us. I shall, of course, remain in close touch with Ambassador Meguid on current developments. Please accept, Mr. President, the assurances of my highest consideration.

Kurt Waldheiia His Excellency Mr. Anwar El Sadat President of the Arab Republic of Egypt Cairo, Egypt In the past few days tension has risen dangerously In the Middle Sast, although at the present time there seems to be some relaxation and less grounds for fearing an imminent breakdown of the cease-fire. I do not need to dwell on the threat to international peace or on ;.he consequences for the people of the area of a new war in any part of the Middle Sast. Such a war would inevi- tably cause vast suffering and destruction in the region itself, and it would also have most serious repercussions elsewhere in the world. The reasons for the present tension are basi- cally similar to those which have on several occa- sions in the past led to the breakdown of peace- keeping arrangements followed by fullscale hostili- ties. A future war is likely to be even more bitter and destructive and the danger to international peace and well-being even greater. As long as there is no settlement of the basic problems of the Middle East or appreciable and conti- nuing advance towards that goal, the sense of frustra- tion and bitterness on one side and of insecurity on the other will create the explosive situation At.ich is at the root of the present tension. The t«vo vital needs, therefore, are real progress towards a just and peaceful settlement and the. maintenance of the cease-fire in all sectors. The'United Nations is deeply involved in the effort to achieve both of these aims. When the two disengagement agreements were concluded, there was a widely shared hope that they would provide the necessary first step in the process of settlement. It is vital that the momentum that existed at that time should be regained. Whatever the difficulties - and they are very great - progress must be made, and made very soon, toward a solution of the real underlying problems whose continued existence is the reason for the explosiveness-of the Middle East situation. As for the cease-fire, the United Nations and its peace-k-eplng instruments in the area, ;vMch work.on the basis of the existing disengagement agreements, have played and are playing a crucial role in avoiding active military confrontations and preserving the calm which is essential for effective negotiations. As I have said many times, peace-keeping must not become a pretext for slackening the momentum of the search for a settlement of underlying problems. On the other hand, effective peace-keeping is also essential to that search. I therefore appeal to all the governments concerned to redouble their efforts to make progress through negotiation toward a settlement. I also appeal to them to co-operate with the United Nations and to support the peace-keeping mechanisms .vr.ich ensure that the ca 1m and the cease-fire that are essential to negotiations are preserved. In their own interests, as well as in the interests of the international community as a whole, I appeal to them to avoid any action -vhich may lead to new hostilities, and to exercise the restraint through which alone we may reach the goal rchlch all desire, a just peace in the Middle East. Mr. FAHMY (Egypt) (interpretation from Arabic): Mr. President, it is a source of pride and gratification for me to express to you my heartfelt congratulations on your election as President of the General Assembly during the current session, which is undoubtedly considered one of the most important sessions in the history of the United Nations on account of the vital questions set before it and because of the present critical stage in the history of countries and peoples. Your election to the Presidency is also to be looked upon as a compliment addressed by the United nations to your country and to its great leader, President Houari Boumedienne, who has dedicated himself to the cause of all peace-loving peoples. I should like to pay tribute to the tremendous effort exerted by your predecessor, our dear friend Ambassador Leopoldo Benites, who conducted .the deliberations of the previous Assembly session and of the sixth special session with wisdom, foresight and objectivity. I should also like to pay tribute to the work accomplished throughout the whole of last year by the Secretary-General, Mr. Kurt Waldheim, and to his devotion to the objectives and principles of the United Nations. It gives me pleasure to welcome the friendly countries which have joined our Organization. The admission of Bangladesh, Grenada and Guinea-Bissau to the United Nations is undoubtedly an incontestable victory for the right of all peoples to decide their own fate and to shoulder their international responsibilities in full and to undertake a positive, constructive role for the building of a better world for all of us. We look forward to the declaration of the independence of the remaining countries which have been suffering for nany centuries from the fetters that have bound them, depriving them of their natural right to participate effectively in decisions which influence the future of the human race. Here, I refer in particular to the necessity of declaring the independence of Mozambique in conformity with the Lusaka Agreement. Upon instructions from my Government, I have the honour to bring to your attention a new serious violation perpetrated by the occupation authorities of Israel in the City of Jerusalem.

Information which has reached the Egyptian Government indicates that the Israeli occupation authorities intend to connect all Arab villages and quarters within the -municipality of Jerusalem with the Israeli telephone network.

The new Israeli scheme is supposed to be under way and will involve the villages of Eissawiya,, Sur Baher, Swahda, Abidiya and Urn Tuba.

This information demonstrates once again the failure of Israel to respect the relevant resolutions adopted by the United Nations concerning the measures and actions by Israel purporting to affect the status of the City of Jerusalem.

Both the General Assembly and the Security Council have already deplored the non-compliance of Israel and its failure to implement the United Nations resolutions.

It is to be recalled that the General Assembly and the Security Council have condemned and censured in the strongest terms all measures taken by Israel to change the character and status of Jerusalem. The Security Council further called on Israel to rescind forthwith all measures taken by Israel which may tend to change the status of the City of Jerusalem and to refrain in the future from all actions likely to have such an effect.

Such new violations conspicuously manifest the persistence of the Israeli authorities in pursuing its policies of occupation and annexation in flagrant contravention of the relevant Security Council and General Assembly resolutions.

PRESIDENT OF EGYPT COMMENDS UNEF ON ITS WORK

(The following was received from the Chief Information Officer of UNEF in Cairo.)

The President of the Arab Republic of Egypt, Anwar El Sadat, today thanked the United Nations Emergency Force (UNEF) for preserving peace and he promised full co-operation from the Egyptian Government and the armed forces. President Sadat spoke at the airfield in Al Gala Camp in Ismailia where the UNEF is establishing its headquarters* President Sadat, who is visiting the Egyptian Army in the Suez Canal area, stayed overnight in Ismailia, before flying to Kantara and Port Said, He inspected o. detachment of 65 UNEF officers an£ soldiers, led by Acting UNEF Commander, Brig.-Gen, Emmanuel Erskine. The Commanding Officers of 10 UNEF battalions which had supplied troops for the detachment were introduced to President Sadat by Brig.-Gen. Erskine. After inspecting the troops, President Sadat made the following statement: "In the name of the people and of myself, we thank you for the job you are doing to preserve peace in the area, We shall not tolerate any action against this peace. We hope your stay will be a happy one. You will find all co-operation from our Government and armed forces." President Sadat was accompanied by Field Marshal Ahmed Ismail, Deputy Premier and Minister of War, as well as other high military and civilian officials.

Egypt1 s Viewpoint 1. Disengagement is purely military issue, but it is a part of Security Council Resolution 338 which considers disengagement as a stage and not an end, since the resolution is a step towards moving towards implementation of resolution. 2. Egyptian side takes into account that disengagement is not an advantage for Egypt but represents the first move towards implementation of Resolution 242, 3. Thereupon this step must be connected with total , withdrawal from the occupied territories according to a timetable.

On 12 January: 1. Between 1000 and 1315 hours local tiir.e, Israeli forces opened fire from mortars and machine guns on our positions in the northern sector east of the Suez Canal. 2. Between 1300 and 1930 hours, Israeli forces opened machine gun fire sporadically on our positions in the southern sector east of the Suez Canal. 3. At 1000 hours, Israeli forces opened artillery fire on our positions from three areas north of Wadi Elaashra, west of the Suez Canal. On 1.3 January; 4. At 1015 hours, Israeli forces opened tank gun fire on our positions from three areas north of Wadi Elaashra, west of the Suez Canal. 5. At 0930 hours, Israeli forces opened mortar and small arms fire on our positions from the area west of Wahat Elmanaief west of the Suez Canal. 6. At 1215 hours, Israeli forces opened artillery fire on our positions from the area north of Gabal Attaka, west of the Suez Canal. 7. At 1255 hours, Israeli forces opened tank gun fire on our positions in the area of Gabal Oum Kathib, west of the Suez Canal. 8. At 1405 hours, Israeli forces opened artillery and tank fire on our forces in the area of Wadi Elaashra, west of the Suez Canal. 9. At 1220, 1200, and 1325 hours, Israeli forces opened mortar fire on our positions from the area west of Wadi Abou Hessah (west of the Suez Canal). 10. Between 1515 and 1525 Israeli forces opened machine gun fire on our positions in the area of Ismailia Serapium crossroads. 11. At 2112 hours and between 2315 and 2350 hours, Israeli forces shelled our positions in the area of Kathib Aboul Arouk in Sinai. - 2 - 12. At 2215 hours, Israeli forces opened machine gun fire on our positions in the area west of Elmanaief Canal and south of Isinailia Canal. On 14 January: 13. Between 1015 and 1035 hours, Israeli forces undertook technical constructions in the area of Kathib Aboul Arouk under the cover of heavy mortar firing on our positions. 14. During the morning/ Israeli forces opened sporadic artillery fire on our positions in the area of Kebrit. 15. At 0730 hours, Israeli forces opened small arms fire on our positions from the area of Bir Elborg in Sinai. 16. Between 1230 and 1235 Israeli forces in the aforementioned area opened mortar fire on our positions. 17. Between 1300 and 1320 Israeli forces opened small arms fire on our positions from the area west of Elmanaief Canal. On 15 January: 18. Between 1240 and 1240 hours local time, Israeli forces opened artillery/ r.ortar end machine gun fire on our forces in the northern sector of the eastern bank of the Suez Canal. 3. 6. Between 0550 and 0725 hours local time, Israeli forces opened artillery and tank gun fire on our positions in the area of the city of Suez and the third army bridgehead.

7. Between 1330 and 1545, Israeli forces reopened artillery and tank gun fire on our forces in the city of Suez. 8. Between 1405 and 1535 hours local time, Israeli forces opened small arms fire in the area southwest of Elshallufa (south of Wadi Abu Kessah). 9. Between 1700 and 1730 hours local time, Israeli forces opened small arms and half inch machine gun fire in the area north of Lake,Abu El Fatouh (south of Ismailia Canal). 10. Between 1730 and 1810 hours local time, Israeli forces opened artillery fire in the area south of Nefesha (west of the Suez Canal).

Excellency,

On instructions of my Government and further to my letter addressed to you on 26 December 1973 (A/9473 - S/11170), I have the honour to draw your attention to additional Egyptian violations of the cease-fire called for by the Security Council and of the Agreement of 11 November 1973 between Egypt and Israel for the implementation of the cease-fire.

These additional violations took place along the cease-fire lines between 26 December 1973 and 3 January 1974 incl. and included 21 attempts to cross the cease-fire lines, to advance positions and to push forward mine-fields; two such attempts were accompanied by the opening of fire; two crossings of the cease-fire lines by helicopters; one case of firing by snipers; 138 cases of small-arms fire; .one case of mortar shelling; two cases of anti-tank fire; 28 cases of artillery fire, including 20 cases of heavy artillery fire.

Detailed complaints in respect of all these Egyptian attacks on Israeli forces have been lodged with the United Nations ^Observers Headquarters.

As in the past, the official reports'of the United Nations Emergency Force and the United Nations Observers Headquarters indicate a proliferation of Egyptian violations and attacks, including attempts to advance positions.

These persistent and continuing Egyptian violations are not isolated or accidental, but are the result of a cfear, systematic and deliberate policy of the Egyptian Government with the object of creating an atmosphere of military confrontation, violating the cease-fire and attempting to improve the cease-fire lines in favour of Egypt.

This policy finds its expression in statements by official Egyptian spokesmen such as the Chief of Military Operations of the Egyptian Army, Major-General Hassan el-Ghreidli, who declared on 26 December 1973 that "what we are doing now is the attrition of the enemy, because for us the war has not ended at all".(UPI from Cairo - 26 December 1973).

A few days later General el-Ghreidli was reported to have stated that "one purpose of Egypt's military pressure on the Israeli forces was to strain the economy of Israel by forcing her to remain in a state of mobilization and alert. " (New York Times - 2 January 1974).

Similarly, and as has been pointed out in the past, this policy is reflected in the government-controlled Egyptian media which openly boast of the Egyptian initiatives of violating the cease-fire and their effort to advance their forces in order to effect changes in the cease-fire lines, as expressed by the Egyptian weekly Rose El-Youssef on 30 December 1973: "The purpose of the daily clashes along the Egyptian front line east and west of the Suez Canal is to make the Israelis feel that it is impossible for them to remain in their positions". —3—

It should be pointed out that these unprovoked attacks on Israel forces continue even whilst supply convoys are passing to the Third Corps and Suez City, and, obviously, Egyptian cease-fire violations impede these supply operations which are carried out in accordance with the aforesaid .Agreement of 11 November 1973, paragraph A of which reads as follows: "Egypt and Israel agree to observe scrupulously the cease- fire called for by the United Nations Security Council.11

The adverse effect of these violations on the supply convoys is confirmed by the statement of a UNEP spokesman on 26 December 1973, as transmitted by UPI from Cairo: "A U.N. spokesman in Cairo reported that firing between Egyptian and Israel forces near Suez City was causing a slowdown in unloading supplies for Egypt's isolated Third Army. He said: 'In the last few days more trucks were sent than were unloaded. Among the factors causing the slowdown were incidents in the area'. " .

On 29 December 1973: 1. Between 1110 and 1145 hours local time/ the Israeli forces opened fire from the area south-east/Kathib Aifan. 2. Between 1910 and 1930 hours local time the Israeli forces opened machine gunfire from the area southeast^Elferdan bridge ( on the eastern bank of the Suez Canal) . *+ On 30 December 1973; . . ' 3. Between 1054 and 1059 hours local time Israeli forces jet aircrafts violated Egypt's air space in the area from 30 Kms south of El Soukhna to 5 Kms north of Suez and in depth of thirty kilometers west of the Suez Gulf. 4. At 1105 hours local time,, the Israeli forces, opened fire from the area southwest of Kathib :Li pbou Alarouk (east of the Suez Canal) . 5. Between 1110 and 1130 hours local time, the Israeli forces opened fire on our forces in the area of Shatbet Elbaramil southwest of Bir Eiborg (East of the Suez Canal) . 6. At 1215 hours local time, Israeli forces opened mortar fire towards the above mentioned area. 7. Between 1000 arid 1005 hours local time, Israeli forces opened artillery fire from the area southwest of Wadi El Aashra. 8. At 1030 hours local time, Israeli forces opened artillery fire again from the above mentioned area. 9. Between 1130 and 1200 hours local time, Israeli tanks opened fire on our positions from the same area. 10. Between 1420 and 1535 hours local time, Israeli forces opened artillery and tank guns fire on our positions in the area south of the crossroad of Ismailia and Serapium. 11. At 1230 hours local time, Israeli forces launched anti-tank missiles on our positions in the area southwest of Eltemsah lake. 12. Between 1945 and 2000 hours local time/ the Israeli forces opened fire on our forces in two areas east of Elferdan bridge (east of the Suez Canal). 3. Between 1200 and 1545 hours local time/ the Israeli forces opened fire from the area east of Gabal El Loufa (east of the Suez Canal). On 25 December 1973; 4. At 1145 hours local time/ the Israeli forces undertook technical constructions/ under the cover of continuous firing, from artillery/ tank guns/ and mortars, on our forces'rntwo areas south of Wadi El Ashra (west of the Suez Canal). 5. Between 1330 and 1545 hours local time/ the Israeli forces opened fire five times on our forces in the areas South and North Wadi El Ashra (west of the Suez Canal)/ and in the areas north and northwest Gabal El Shehabi (west of the Suez Canal). 11. Betv.'een 1111 and 1114 hours local time, two Israeli phantom aircrafts violated Egypt's air space in the Suez area. On 28 December 1973: 12. Between 1030 and 1135 hours local time, four Israeli aircraft violated Egypt's air space in the southern sector of the Suez Canal. 13. Between 1140 and 1155, the Israeli forces opened fire on our forces, from the area north of Gabal Ataka to the Suez road. 14. Betv.'een 1204 and 1211 hours local time, the Israeli forces opened small arms and machine guns fire on our forces from the same area. 15. Betv.'een 1030: and 1100 hours local time the Israeli forces opened artillery fire on our forces north of Gcjbal Ataka in the vicinity of the Suez road.

16. Between 1303 and 1308 hours local time, the Israeli forces opened fire on our forces, from the area south of Elfnanaief oasis (west of the Suez Canal). NEW YORK 24 December 1973 No. 584 Excellency/ Upon instructions from my Government/ I wish to bring to your Excellency's urgent attention a serious aspect of Israel's cruel and inhuman attitude concerning human lives, and its persistent refusal to carry out its obligations in accordance with the Geneva Conventions of 12 August 1949 as well as the principles of International Humanitarian Law. Israel has continuously refused to allow the evacuation of more than 150 emergency cases of wounded and sick in the Suez hospital. The International Committee of the Red Cross has repeatedly requested the Israeli authorities to allow the ICRC representatives to evacuate the wounded from the Suez hospital but all its requests have been adamantly rejected. The Israeli refusal to all such evacuation requests leads to the death of a number of the wounded in the Suez hospital. Thus Israel arrogantly continues to violate the Geneva Conventions of 12 August 1949 and in particular Article 15 of the Geneva Convention for the amelioration of the conditions of the wounded and sick in armed forces in the field as well as the Geneva Convention relating to the protections of civilian persons in time of war. In accordance with the rules of these conventions/ the principles of international humanitarian law as well as the basic co'hcepts of humanity/ Israel bears the full responsibility for its violations and the serious consequences thereof.
