Adroddiad Yr Arolygwr (Rhan 2) Pennod 14 – Amgylchedd 241 Pennod 14 : Amgylchedd Y Bennod Gyfan Gwrthwynebiad 80/1251 – Y Cyng Robert Llewelyn Jones 1.0 Crynodeb o’r Gwrthwynebiad 1.1 Mae angen polisi ar barciau a gerddi am nad ymddengys fod planhigion i’w gweld o amgylch trefi ac atyniadau ymwelwyr. 2.0 Ymateb y Cyngor 2.1 Nid oes a wnelo’r mater hwn â defnydd tir y gellir mynd i’r afael ag ef yn y cynllun. 3.0 Casgliad yr Arolygydd 3.1 Nid yw darparu gwaith planhigion amwynder yn fater i’r cynllun. 4.0 Argymhelliad 4.1 Na ddylid diwygio Pennod 14 y cynllun a adneuwyd mewn ymateb i’r gwrthwynebiad hwn. Nodyn: Ystyrir gwrthwynebiadau 35/1312 a 36/321 ar Dudalennau 55 i 57 yr adroddiad hwn. Y Bennod Gyfan Gwrthwynebiadau 36/327 – Asiantaeth yr Amgylchedd Cymru 14/730 – Y Gymdeithas Frenhinol er Gwarchod Adar 35/1314 ac 1315 – Cyngor Cefn Gwlad Cymru 1.0 Crynodeb o’r Gwrthwynebiadau 1.1 Mae 36/327 yn gofyn am bolisi Cadwraeth Ynni a Dðr ym Mhennod 14. Dylai cynigion datblygu, hyd y gellir, ymgorffori mesurau i gadw ynni a dðr trwy: i. lleoli a chynllunio adeiladau unigol sy’n cynnwys nodweddion arbed dðr a chynlluniau safleoedd; ii. lleihau’r angen am deithiau gan gerbydau modur preifat a; iii. defnyddio trafnidiaeth gyhoeddus. 1.2 Yn lle paragraffau 14.1 i 14.5, mae 14/730 yn mynnu y dylid gosod cyflwyniad sy’n darparu fframwaith ar gyfer y Bennod trwy nodi cynefinoedd nodedig, prin neu ddiamddiffyn Ynys Môn, yn ogystal â’r adnoddau a’r systemau naturiol allweddol. 1.3 Mae 35/1314 yn mynnu y dylid gosod polisi newydd yn y Bennod i nodi y caniateir cynigion sy’n cefnogi amcanion Strategaeth Coetir Ynys Môn, ar yr amod y cydymffurfir â Pholisi GP1. Pennod 14 – Amgylchedd 242 1.4 Mae 35/1315 yn mynnu y dylid ychwanegu polisi newydd o blaid diogelu, rheoli a mwynhau Tir Comin cofrestredig ar yr amod y cydymffurfir â Pholisi GP1, fel y’i diwygiwyd. 2.0 Ymateb y Cyngor 2.1 Mewn ymateb i wrthwynebiad 36/327, mae’r cynllun yn annog pobl i ddefnyddio’r cerbyd modur preifat cyn lleied â phosibl. Mae Polisi PO4 a Pholisi TR4 yn optimeiddio’r defnydd o drafnidiaeth gyhoeddus mewn cynigion datblygu. Mae Polisi TR9 yn annog dulliau eraill o deithio ac yn diogelu llwybrau hamdden tra bod Polisi TO10 yn caniatáu ymestyn y llwybrau hynny. 2.2 Mae Polisi GP2 yn cynnwys nodweddion arbed dðr ac mae maen prawf (vi) yn hyrwyddo cynlluniau safleoedd (cyfeiriad, lleoliad ar lethr a gwaith tirlunio) a all leihau gofynion ynni annedd o 20% trwy’r ffynonellau amgylchol ‘am ddim’ a grëir gan fantais oddefol yr haul a gwelliannau o ran y ficrohinsawdd. Nid oes angen ailadrodd pwyslais y polisïau unigol hyn yn y cynllun drwyddo draw. 2.3 Mewn ymateb i wrthwynebiad 14/730 ymdrinnir â’r materion a godir gan y Cynllun Gweithredu Bioamrywiaeth Lleol [LBAP] y cyfeirir ato yn y cynllun. Mae Cynlluniau Gweithredu Bioamrywiaeth yn cael eu llunio er mwyn ceisio cadw a gwella cyflwr rhai cynefinoedd a rhywogaethau sydd wedi dioddef colledion mawr, neu sydd dan fygythiad arbennig. Nod y LBAP yw troi rhai o Gynlluniau Cynefinoedd a Gweithredu’r DU yn weithredoedd, tra hefyd yn ceisio cadw a gwella rhai eraill sy’n arbennig o bwysig. 2.4 Mewn ymateb i wrthwynebiad 35/1314, nid rôl y cynllun yw dibynnu ar arweiniad arall. Bydd Strategaeth Coed, Gwrychoedd a Choetir 2003-2008 yn cyflawni ei thargedau ei hun. 2.5 Mewn ymateb i wrthwynebiad 35/1315, diogelir Tir Comin gan fathau eraill o ddeddfwriaeth. Fel arfer ni ddylid defnyddio’r system gynllunio i gyflawni amcanion y gellir eu cyflawni o dan ddeddfwriaeth arall (paragraff 1.2.4 Polisi Cynllunio Cymru). Felly nid oes angen polisi i ddiogelu, rheoli a mwynhau Tir Comin yn y cynllun. 3.0 Mater 3.1 A oes angen diwygio Pennod 14 y cynllun a adneuwyd fel yr awgrymir mewn unrhyw un o’r gwrthwynebiadau hyn. 4.0 Casgliadau’r Arolygydd 4.1 O ran gwrthwynebiad 36/327, mae Polisi PO4 yn ceisio lleihau’r ddibyniaeth ar ddefnyddio ceir preifat a hyrwyddo defnyddio trafnidiaeth gyhoeddus. Byddai PC30 yn ymestyn maen prawf (vi) Polisi GP2 er mwyn ystyried mesurau arbed dðr. 4.2 Mae’n fwy priodol ymdrin â’r materion manwl a godir yng ngwrthwynebiad 14/730 yn LBAP y Cyngor. 4.3 Yn yr un modd, o ran gwrthwynebiadau 35/1314 a 35/1315, nid oes angen i’r cynllun roi caniatâd penodol i ddatblygiadau a fyddai’n cefnogi amcanion Strategaeth Coetir Ynys Môn, na diogelu Tir Comin a ddiogelir eisoes gan ddeddfwriaeth arall. Pennod 14 – Amgylchedd 243 5.0 Argymhelliad 5.1 Na ddylid diwygio Pennod 14 y cynllun a adneuwyd mewn ymateb i’r un o’r gwrthwynebiadau hyn. Paragraff 14.1 Gwrthwynebiad 34/1024 – Ymddiriedolaeth Archeolegol Gwynedd 1.0 Crynodeb o’r Gwrthwynebiad 1.1 Dylai’r frawddeg gyntaf gynnwys yr ymadrodd ‘ei threftadaeth archeolegol a hanesyddol gyfoethog’ ar ôl y cyfeiriad at fioamrywiaeth. 2.0 Ymateb y Cyngor 2.1 Byddai PC86 yn goresgyn y gwrthwynebiad hwn, a dynnir yn ôl yn amodol. 3.0 Casgliad yr Arolygydd 3.1 Am y byddai PC86 yn goresgyn y gwrthwynebiad hwn, rwyf o’r farn y dylid ei wneud. 4.0 Argymhelliad 4.1 Dylid diwygio paragraff 14.1 y cynllun a adneuwyd yn unol â PC86. Polisi EN1 Cymeriad Tirwedd Gwrthwynebiadau 4/5 – Dr Martyn Petty 10/105 - Mr A F Nixon 1.0 Crynodeb o’r Gwrthwynebiad 1.1 Mae 4/5 o’r farn bod yn rhaid i ni ymdrechu i gadw’r tir naturiol. Mae’n rhaid gofalu am olwg frodorol bur y safleoedd panoramig hyn a’i chadw. Mae’r gwrthwynebiad yn mynnu y dylid ailddatblygu a gwella’r ardaloedd masnachol a phreswyl a fodolai gynt sydd bellach yn ddirywiedig, yn segur ac yn adfeiliedig. Mae’n rhaid parchu union ffiniau’r ardaloedd lle y ceir y Safleoedd o Ddiddordeb Gwyddonol Arbennig (SoDdGA) a’r lleiniau glas ac ni ddylid newid y diffiniadau na’r meini prawf. 1.2 Mae 10/105 yn nodi bod y polisi yn cynnwys y geiriau ‘niwed annerbyniol’ heb ddiffinio pa niwed sy’n dderbyniol, gan ganiatáu i’r geiriau gael eu dehongli’n wahanol a’u cymhwyso’n anghyson. Dylid hepgor y gair ‘annerbyniol’. 2.0 Ymateb y Cyngor 2.1 Mewn ymateb i Wrthwynebiad 4/5, nid yw’r Cyngor yn bwriadu newid y cynllun. Pennod 14 – Amgylchedd 244 2.2 Mae Polisi PO8 yn diogelu’r amgylchedd naturiol. Mae Polisïau EN3 ac EN6 yn diogelu lletemau glas a Safleoedd o Ddiddordeb Gwyddonol Arbennig yn y drefn honno, yn unol â Pholisi Cynllunio Cymru lle y mae rhagdybiaeth gyffredinol yn erbyn datblygiadau sy’n amhriodol o ran dibenion y dynodiad (paragraff 2.6.12). Dylai cynlluniau geisio sicrhau bod cymaint o waith datblygu â phosibl yn digwydd o fewn ardaloedd trefol sy’n bodoli eisoes, yn gyson â chynnal a gwella ansawdd yr amgylchedd trefol (Cynllunio ar gyfer Datblygu Cynaliadwy: Tuag at Arfer Gwell, 1998, pennod 2). 2.3 Mewn ymateb i wrthwynebiad 10/105, caiff y term ‘niwed annerbyniol’ ei gydnasyddu a’i dderbyn gan Gynulliad Cenedlaethol Cymru. Mae penderfyniadau cynllunio yn cynnwys elfen o bwyso a mesur ar ran y sawl sy’n gwneud y penderfyniad. 3.0 Mater 3.1 A oes angen diwygio Polisi EN1 y cynllun a adneuwyd mewn ymateb i’r naill o’r gwrthwynebiadau hyn neu’r llall. 4.0 Casgliad yr Arolygydd 4.1 Nid yw gwrthwynebiad 4/5 yn amlwg berthnasol i’r polisi hwn a, sut bynnag, nid yw’n gwneud unrhyw awgrymiadau penodol ar gyfer ei newid. Ymdrinnir â’r materion a godir yn ddigonol gan y polisïau a’r cyfeiriadau yn Ymateb y Cyngor. 4.2 O ran gwrthwynebiad 10/105 deallir y term ‘niwed annerbyniol’ yn eang wrth wneud penderfyniadau cynllunio defnydd tir. Fodd bynnag nid yw’n digwydd bob tro y gwneir y penderfyniad hwnnw ar sail un polisi yn unig. Felly dylai pob polisi ymdrin â phwnc penodol a nodi ei safbwynt o ran cynigion datblygu. Yn achos Polisi EN1 mae’n briodol ei fod yn nodi na chaniateir datblygiadau a fyddai’n amharu’n sylweddol ar Ardal Cymeriad Tirwedd. Mater o farn gynllunio fyddai p’un a fyddai’r niwed yn sylweddol mewn unrhyw achos penodol o ran y polisi hwn. 5.0 Argymhelliad 5.1 Dylid diwygio Polisi EN1 y cynllun a adneuwyd trwy ddileu’r geiriau ‘niwed annerbyniol’ a gosod y geiriau ‘niwed sylweddol’ yn eu lle. Aberffraw boasts beautiful white sands and panoramic views of Snowdonia. Certainly one of Anglesey's most beautiful beaches. Lots of space, clean sand and ice cream parlours, a seaside shop and food available right beside the beach. Parking is available but can get very busy. Llanfaelog village has a selection of shops and restaurants for day trippers and families. Cemaes is a small town overlooking a picturesque sheltered bay on the far north coast of Anglesey. Cemaes Beach Cemaes LL67 0ND Within the bay and next to the town, Traeth Mawr is a sandy beach with rock pools and a promenade. There is a slipway giving access to disabled visitors. A great place for nature and bird watching, shore and kayak fishing, kayaking and rock pooling. A large Cemlyn Bay Cemaes LL67 0DU shingle ridge separates the sea from the salt and fresh water lagoon which becomes a hive of activity in the summer months when terns arrive to nest here.
