Troy Thompson is a partner and practice group leader of the Labor and Employment Practice Group. He is also a member of the  rm’s Litigation Practice Group. Mr. Thompson represents private and public sector employers in all facets of traditional labor and employment, litigation and other business matters.

In addition to advising employers on day-to-day issues relating to personnel polices and practices a ecting the labor force, Mr. Thompson represents the interests of management in actions pending before federal and state courts, as well as in administrative hearings and appeals. Mr. Thompson has appeared and practiced before the National Labor Relations Board (NLRB), the United States Equal Employment Opportunity Commission (EEOC), the Wage and Hour Division of the United States Department of Labor (DOL), the Occupational and Safety Health Administration (OSHA), the Employment Relations Commission (WERC), the Wisconsin Wage and Hour Division, the Wisconsin Equal Rights Division (ERD), the Wisconsin Worker’s Compensation Division, the Wisconsin Unemployment Insurance Division and the Madison Equal Opportunities Commission (MEOC). Mr. Thompson’s review of a treatise entitled, “Business and Commercial Litigation in Federal Courts,” was published in the Wisconsin Lawyer.

While attending law school at Marquette University, Mr. Thompson served as legal intern to the National Labor Relations Board, and separately with the Wisconsin Court of Appeals, District 1.

Michael Westcott is a partner and member of the Labor & Employment Practice Group at Axley, as well as a member of the  rm’s Executive Committee. Mr. Westcott represents management in all facets of labor and employment law matters. He represents private and public sector employers in union organizational drives, labor negotiations, grievance and interest arbitration hearings, and unfair labor practice hearings. A large portion of his practice also involves litigating employment discrimination claims on behalf of employees. He regularly advises employers on worker’s compensation, unemployment compensation, employee handbooks and policies and other related personnel issues. He represents employers before the Wisconsin Employment Relations Commission, the National Labor Relations Board, the Occupational Safety and Health Commission, the Wage and Hour Division of the United States Department of Labor, the Wage and Hour Division of the State of Wisconsin Equal Rights Division, and federal, state and local administrative agencies concerning employment discrimination matters. Mr. Westcott also spends a signi cant amount of time advising health care employers in the labor and employment law implications of mergers and integrations.

Mr. Westcott frequently speaks on labor and employment-related issues before civic and business groups. He also regularly conducts training seminars for clients of Axley on issues including sexual harassment, maintaining a non-union environment, interviewing techniques, avoiding fair employment claims and related subjects.

As a partner at Axley, Saul Glazer has practiced law for than 20 years. His two primary focus areas are construction and employment law. He serves as an attorney for a number of Wisconsin companies, and recently served as interim counsel to a national manufacturer. He is also a seasoned litigator, representing clients in mediation, litigation and arbitrations involving construction, employment, commercial, dealership, distributorship, and intellectual property. He uses creative solutions to complex problems, and prides himself on his ability to help clients cost-e ectively to work through di¥ cult situations.

Mr. Glazer has a special expertise in representing owners, contractors, subcontractors, engineers and architects in preparation of construction contracts and integrated project delivery documents (including AIA, EJCDC, DBIA and Consensus documents). He has also represented clients regarding bid disputes, change orders, construction and design defects, di ering site condition claims, delay claims, insurance coverage issues, ATCP 110, and lien law claims.

Mr. Glazer is the co-author of the Wisconsin Chapter of the State by State Guide to Construction Contracts and Claims (Aspen 2012). Mr. Glazer is a co-author of the Wisconsin chapter of the DRI Construction Litigation Desk Reference. Mr. Glazer authored the chapter for Construction Dispute Resolution for the Inside the Minds series (Aspatore 2010).

Mr. Glazer is an associate board member of the Associated General Contractors (AGC) of Wisconsin. He is on the board for the Construction and Public Contract Law Section for the State Bar of Wisconsin. He regularly assists contractors and subcontractors through the Associated Builders & Contractors’ legal hotline. He was formerly an attorney with Wickwire Gavin PC, a national construction law  rm.

Mr. Glazer’s work as an employment lawyer includes representing employers before administrative agencies and state and federal courts. He counsels clients on the Americans with Disabilities Act and other state and federal disability discrimination and accommodation laws. His experience also includes serving as an attorney in cases involving hostile work environments, retaliation, OSHA regulatory compliance, wage and hour laws, arrest and criminal convictions, equal pay, employment contracts, restrictive covenants, con dentiality and non-compete agreements. Mr. Glazer successfully represented a national retailer against a physical appearance discrimination claim before the Wisconsin Court of Appeals. Mr. Glazer is an editor of the Wisconsin Employment Law Letter. He contributed to the 2012 publications of Fifty Employment Laws in Fifty States. Additionally, he created the Seven Questions to Use When Disciplining and Terminating Employees seminar, and regularly presents this seminar to national audiences.

Mr. Glazer was a judicial intern for the Honorable John L. Co ey, Seventh Circuit Court of Appeals, , Wisconsin, and a lecturer at the University of Wisconsin Law School. Mr. Glazer’s father, Sidney M. Glazer, recently retired after serving 50 years as a federal prosecutor for the United States Department of Justice. His portrait hangs next to the President’s and the Attorney General’s in the Glazer conference room at the Department of Justice. His father was a member of the Watergate Prosecution Force, argued six cases before the U.S. , and had four U.S. Supreme Court certiorari petitions granted when he was in private practice.

Michael Modl is a partner at the  rm, practicing with the Litigation and Labor and Employment Practice Groups.

Mr. Modl’s litigation practice focuses on federal court litigation, primarily in the areas of intellectual property, commercial disputes, employment, insurance defense, defense of municipalities and schools, and defense of civil rights and constitutional claims. He has appeared as local counsel for various regional, national and international companies in federal court litigation in Wisconsin. He has represented municipalities, including counties, cities and villages, as well as municipal o¥ cials and employees in state and federal court civil rights actions. Mr. Modl has successfully defended law enforcement o¥ cers and municipalities in claims arising out of police conduct, including claims of use of excessive force, claims arising out of high speed chases and claims alleging illegal searches, seizures and arrests. Mr. Modl is also experienced in class action litigation and electronic discovery matters.

Mr. Modl has successfully represented municipalities and municipal o¥ cials in employment related claims, including claims of employment discrimination, claims of workplace harassment, First Amendment speech and association claims, and claims alleging adverse employment actions without due process of law. Mr. Modl has also represented public and private sector employers in claims alleging employment discrimination, workplace harassment and retaliation before federal, state and local agencies, including the United States Equal Employment Opportunity Commission, the Wisconsin Equal Rights Division and the Madison Equal Opportunities Commission.

Mr. Modl’s litigation practice includes an active federal court practice. He has appeared in over 200 cases before federal court judges in the United States District Court for the Western District of Wisconsin. Mr. Modl has tried more than 30 cases to the federal court, including patent and trademark infringement cases, federal constitutional and civil rights cases, federal employment discrimination cases, including cases under the Americans with Disabilities Act, the Age Discrimination in Employment Act and Title VII, defense of prisoner litigation and defense of  nancial institutions in claims alleging discrimination in making loans.

Mr. Modl’s practice also focuses on advising employers on employment and personnel matters. He assists clients in reviewing and drafting personnel policies and employee handbooks. Mr. Modl provides training, seminars and legal updates to clients on developments in the law, including the areas of workplace harassment prevention and investigation of complaints. He also advises clients on the federal and state Family and Medical Leave Acts and Americans with Disabilities Act compliance. He has appeared on behalf of employers before federal, state and local agencies.

Leslie Sammon is a partner with the  rm, practicing in the area of labor and employment law, advising and representing private and public sector employers. She regularly provides consultation, representation and training to human resources professionals and speaks on labor and employment-related issues before a variety of professional and business groups. She also has industry experience with unionized and non-unionized employers, acute and long-term health care facilities, telecommunications, municipalities and construction matters.

Prior to beginning her law career, Ms. Sammon was a sta nurse in the intensive care unit of two Madison-area hospitals and maintains her licensure as a registered nurse in Wisconsin.

Gesina (Ena) Seiler is a litigator and partner at Axley with an active insurance defense and employment law practice. She handles cases involving a wide variety of disputes arising from automobile accidents, slip and falls, construction defects, farm equipment, copyright issues, health care, employment and contracts. She also frequently represents municipalities and school districts on civil rights claims. These days, Ms. Seiler is devoting increased time to defending health care providers and employers. As a prominent member of Axley’s A ordable Care Act (“ACA”) Team, Seiler has written countless articles and alerts on the topic. In addition to giving presentations on the ACA across the state, Ms. Seiler has also served as an expert on various ACA panels.

Ms. Seiler’s practical, problem-solving approach to her work helped her to win recognition as a Wisconsin Rising Star by Wisconsin Super Lawyers and Rising Stars magazine. Her ability to work tirelessly, e¥ ciently, and compassionately traces back to her childhood on the farm. Her intimate understanding of farming is immensely useful, she says, when she is handling claims related to stray voltage, bad feed, and dairy equipment.

Ms. Seiler spent a decade before law school working in a variety of jobs that also played a role in shaping how she practices law. She was a  nancial planner, an accountant, an insurance salesperson and a bar/restaurant worker. She says that her  rsthand knowledge of these industries helps her to understand the issues facing her clients.

When Ms. Seiler is not working with clients, publishing articles or presenting at law-related conferences, she enjoys camping with her family. She also is a devoted Green Bay Packers fan (and stockholder).

Timothy Barber is a senior associate at Axley Brynelson, LLP. His busy practice focuses on commercial and municipal insurance defense work and litigation, appellate practice, and labor and employment law. Mr. Barber handles cases on a wide range of topics, including employment discrimination, insurance coverage, municipal liability, copyright law, business disputes, tort-liability, non-compete agreements, and property rights. He is also an adjunct professor at UW Madison, teaching legal writing and research.

Mr. Barber’s experience litigating and teaching in several legal areas allows him to provide his clients with a broad-based understanding of the challenges they face. Mr. Barber enjoys helping small businesses navigate through complex legal issues, so they can focus on what really matters to them.

Mr. Barber also frequently works on appellate matters and handles appeals before the Wisconsin Court of Appeals, , and Seventh Circuit Court of Appeals. He recently won two insurance defense cases before the Wisconsin Supreme Court, the  rst, involving the interpretation of a pollution exclusion clause in a policy of homeowner’s insurance and the second, involving the meaning of a “following form” endorsement in a commercial umbrella policy. He is also frequently asked to write “friend of court briefs” on behalf of trade associations and interests groups. As a self-described “appellate-guru,” Mr. Barber is often consulted by other attorneys facing di¥ cult appellate issues and asked to help posture cases in trial for a potential appeal. Mr. Barber credits his two-year experience clerking Justice Jon P. Wilcox (ret.) on the Wisconsin Supreme Court with providing him an insider’s understanding of how appellate courts operate and on what arguments they  nd persuasive. Attorney Barber has argued cases before the Wisconsin Supreme Court and United States Seventh Circuit Court of Appeals.

As an amateur shutter-bug, Mr. Barber enjoys working on cases involving trademark and copyright disputes, particularly as they relate to photography. Mr. Barber is also an avid cyclist and mountain bike racer and takes satisfaction in handling cases involving bicycle accidents, recreational immunity issues, and liability waivers. Mr. Barber is heavily involved in the local cycling community and serves on several committees relating to transportation issues. He also serves on the board of directors of a local non-pro t group that builds and maintains bike trails in the Madison area.

The  rst lawyer in his family, Mr. Barber distinguished himself at Marquette University Law School by serving on the editorial board of the Marquette Law Review and as Managing Editor of the Marquette Intellectual Property Law Review. He continues be a regular contributor to legal publications and is a frequent speaker at legal seminars.

Daniel McAlvanah specializes in spotting and correcting problems that can lead to big headaches for Wisconsin employers. As a member of Axley’s Litigation and Labor & Employment Practice Groups and Class Action Team, Mr. McAlvanah has litigated high-stakes, multi-million-dollar cases involving alleged violations of the Fair Labor Standards Act – but his central goal is helping his clients to stay out of court.

Mr. McAlvanah helps clients to avoid running afoul of wage and hour laws by conducting audits. During these audits, he reviews clients’ compensation systems and payment policies to ensure compliance with complex and continually changing laws. He says one common mistake is misunderstanding which employees are exempt from overtime. By correcting mistakes such as this, and counseling employers on ways to avoid future problems, Mr. McAlvanah works to minimize a client’s exposure to liability and to safeguard against costly, time-consuming legal battles down the road.

When a client becomes involved in a lawsuit, Mr. McAlvanah brings his extensive litigation experience to the process, working to identify with precision the strengths and weaknesses of each side’s case, to evaluate the various options that are available and to recommend the best, most cost-e ective course of action.

Mr. McAlvanah’s ability to analyze each client’s case and to quickly hone in on the central issues reª ects his background as a professional restaurant critic in New York City. A James Beard Journalism Award nominee, Mr. McAlvanah was instrumental in the early development of an online restaurant review system that has become an invaluable resource for consumers. He turned to restaurant critiques after working for a number of years in various capacities in upscale restaurants, an experience that gave him an intimate understanding of food service operations that he says is immensely useful in relating to the challenges facing his clients in the hospitality industry.

In deciding to leave journalism and the restaurant industry to pursue a career in the law, Mr. McAlvanah followed in the footsteps of his father, a well-respected immigration attorney who continues to practice law in New Jersey. Watching his father help immigrants to achieve the dream of American citizenship, he says, gave him a special appreciation for the critical role lawyers play as trusted advisors and problem solvers.

When he is not working for his clients, Mr. McAlvanah spends time with his wife and children and enjoys running, cross-country skiing (he competes in the American Birkebeiner in northern Wisconsin) and golf. Where possible, he also devotes time to volunteer endeavors. He presently serves as the president of the governance council of Badger Rock Middle School, a local charter school that promotes environmental sustainability, culturally relevant teaching, and civic engagement.
