“HIDDEN HESTON” - TERMS & CONDITIONS As part of MasterChef 2016, Endemol Shine Australia Pty Ltd (ABN 20 136 451 208) (inclusive of its employees, agents and contractors) (“Producer”) is inviting applications from fans interested in attending pop-up events to enjoy food created by this year’s talented crop of MasterChef contestants as inspired by Heston Blumenthal (each an “Event”). The Events will be held at various ‘secret’ locations to be held in Melbourne during 29 February and 8 March 2016. These Terms and Conditions set out the eligibility criteria and other conditions that apply to applicants (“You”) wishing to participate in the Events. 1. You must be at least 18 years of age, resident in Australia and applying to participate in your personal and private capacity only. 2. If You are successful in the selection process and are invited to attend an Event, You and your nominated guest must be able to travel to/from the Event location to be held in metropolitan Melbourne (on not more than 24 hours’ notice). You and your guest shall be solely responsible for making your own way to/from the Event, including all travel and any related costs or liabilities. 3. To be eligible to participate in the selection process for each Event, You must: a. follow MasterChef Australia (2016) on the following social media sites: Facebook https://www.facebook.com/MasterChefAU/, Twitter https://twitter.com/masterchefau and/or Instagram at: https://www.instagram.com/masterchefau/ (each a “Site”) and watch for the release of “Clues” for each Event; b. submit Your answer for each Clue via the link provided in the post for the Clue, including stating, in 25 words or less, the reasons why You should be invited to attend the Event; and c. correctly and fully complete all information required on the answer form (including Your age, mobile number and email address); and d. submit Your answer by no later than by the time and date published on the Site. 4. The number of persons to be invited to each Event are very limited. Successful applicants will be selected from the first correct answers received for the applicable Clue and those judged as providing the best reasons, in 25 words or less, as to why they should be invited to attend the Event. 5. Only those applicants who are successful will be notified by the Producer and their invitation to attend the Event provided by the mobile phone and/or the email address provided by the applicant at the time of submitting their answer). 6. Invitations to attend an Event are not transferable and are subject to Your and/or Your nominated guest: a. arriving on time at the location at the time as designated by the Producer (at the discretion of the Producer, latecomers forfeit their right to attend the Event); b. providing, if requested by the Producer, a valid form of identification (eg, Driver’s Licence, Proof of Age card or equivalent); c. ensuring You and Your guest do not have any food allergies and/or special dietary requirements, do not wear open toe shoes to the Event and that each of you otherwise comply with all reasonable directions of the Producer as notified prior to and during the Event, including in relation to health and safety; d. not using any camera, mobile phone or other device to film / or record or take still images of any of the Events; and e. otherwise acting in a responsible, courteous and friendly manner at all times whilst at the Event. 7. The Producer reserves the right to deny You and/or your nominated guest entry to the Event and to direct either of you to leave the Event if the Producer believes either of you are intoxicated by alcohol, affected by any other substance or otherwise incapacitated in a way that presents a risk to yourselves and/or any other persons at the Event. 8. You acknowledge and understand that entry to the Events does not guarantee any ‘meet and greet’ with Heston Blumenthal and/or the MasterChef Australia judges.

By attending an Event, You consent to the Producer recording and using your name, likeness, image and/or voice in perpetuity and in any media throughout the world in connection with the Event, MasterChef and any other television program or digital or online content made by or for the Producer and/or its licensees including Network Ten without requiring any further consent or making any payment from or to You and/or your guest. You also grant the Producer and its licensees the perpetual right to use and reproduce your name and the answers to Clues provided by You in any media for all purposes in connection with MasterChef.
10. The Producer reserves the right at its sole discretion to change, vary, suspend, cancel or terminate each Event without notice and accepts no responsibility for the cancellation, rescheduling, change or delay of any Event for any reason beyond the control of the Producer subject to any written directions made under applicable State or Territory legislation. 11. You are solely responsible for all data and carriers charges You may incur in use of your mobile or other device or service to access and use the Sites in connection with your participation in the application process and each Event. 12. Your access and use of any of the Sites generally is subject to the current terms and conditions as published by each. You acknowledge that the ‘Hidden Heston’ promotion is conducted by the Producer and is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or Instagram. Any questions, comments or complaints about the Hidden Heston promotion should be directed to the Producer and not to the operators of Facebook, Twitter or Instagram. 13. The Producer accepts no responsibility for applications and/or answers to Clues that are received after the closing dates and/or times as published by it. Your answers and all accompanying information shall be deemed received at the time of receipt by the Producer, not time of transmission. Incomplete, erroneous, fraudulent, misleading and/or ineligible answers or accompanying information shall be invalid. The Producer accepts no responsibility for late, lost or misdirected applications. Any email address, phone number or other contact details entered incorrectly by You shall render your application invalid. 14. The Producer reserves the right to verify the validity of any and all answers and other information provided by You and reserves the right to disqualify any applicant for tampering with the application process or otherwise failing to comply with these Terms and Conditions. 15. The Producer excludes all liability, including negligence, except for any liability that cannot be excluded by under operation of State and/or Territory laws, for any direct or indirect injury, loss and/or damage arising in any way out in connection with any of the Events. This includes, but is not limited to technical malfunctions, delays or failures and/or any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with the application and/or selection process for each Event. Collection Statement (Privacy) 16. The Producer and its related Australian bodies corporate (“Endemol Shine Australia”) are bound by the Privacy Act 1988 in respect of the personal information provided by You which shall be used in accordance with this Collection Statement and Endemol Shine Australia’s Privacy Policy - http://www.endemolshine.com.au/privacy-policy The Producer collects your personal information for the primary purpose of selecting participants for the Events as part of the MasterChef television program and may share your personal information with the Producer’s related bodies corporate and with the broadcaster of the Program, Network Ten, for this purpose and You consent to this use. 17. If You have ‘opted-in’, Endemol Shine Australia may retain your personal information as part of a record of individuals who have applied to be participants in the Events and may use it to contact You to inquire whether You wish to participate in any other offers, events and/or any other television programs intended to be produced by Endemol Shine Australia and to send You information about those offers, events and programs. You may update or request access to the personal information provided by You by emailing [email protected] and including Your name, mobile number and email address in that request.
