Dear Friends, Last weekend’s bulletin contained as an insert a letter to all in the Diocese of Rochester from Bishop Matano con- cerning the New York State Child Victims Act (CVA) which goes into effect on Wednesday, August 14th. This law, adopted earlier this year, revises the statute of limitations concerning sexual abuse of children. Under the CVA criminal charges can be brought against abusers any time until the victim turns 28 years of age (this is 5 years later than previously). Those who were abused as children now have until they turn 55 to bring civil lawsuits against their abusers and institutions where the abuse occurred. Additionally, the CVA suspends the statute of limitations for one year beginning this August 14th. Thus for one year those who were abused as children can sue for damages no matter how long ago the abuse took place. Institutions such as schools, colleges, hospitals, the Boy Scouts, and the Catholic Church and other religious organizations all may be sued because of sexual abuse of children committed by their representatives, even if the abuse happened long ago.

This oneyear “window” allowing suits that would otherwise be barred by the statute of limitations gives those who suffered sexual abuse long ago (when the statute of limitations was much shorter) an opportunity to at last receive a measure of justice. The New York State Catholic Bishops said in January, “We pray that the passage of the Child Victims Act brings some measure of healing to all survivors by offering them a path of recourse and rec- onciliation.” We must never forget the suffering of those who were sexually abused as children. What happened to them was real, incredibly damaging, a crime and a grave sin.

From now until next August we may well be learning of many lawsuits concerning sexual abuse of children in years past. This will be disturbing and challenging for all of us. People may question their relationship to the Catholic Church, and even their faith in God. Bishop Robert Barron, an auxiliary bishop of the Archdiocese of Los Angeles, has written a small book entitled Letter to a Suffering Church in which he seeks to help us reflect upon the evil of sexual abuse in the Church in the light of our faith. He writes, “What I finally urge my brothers and sisters in the Church to do is to stay and fightNand to do so on be- half of themselves and their families, but especially on behalf of those who have suffered so grievously at the hands of wicked men.” Bishop Barron is a Bishop Fulton Sheen for the twentyfirst century. The Diocese of Rochester has programs, policies and Codes of Conduct in place aimed at prevention of sexual abuse and at creating a safe envi- ronment. The Diocese conducts background checks, including criminal history, for clerics, educators, employees and volunteers who work with children and vulnerable adults. The Diocese has provided training for more than 25,000 clerics, educators, employees and volunteers. The Dio- cese’s programs are independently audited, and the Diocese has always been found in compliance. The Diocese has not had a contemporary case of sexual abuse of a minor reported in the past 13 years.
