Strasbourg, 15 December 2009 MIN-LANG/PR (2010) 1 EUROPEAN CHARTER FOR REGIONAL OR MINORITY LANGUAGES Fourth Periodical Report presented to the Secretary General of the Council of Europe in accordance with Article 15 of the Charter SWITZERLAND Periodical report relating to the European Charter for Regional or Minority Languages Fourth report by Switzerland 4 December 2009 SUMMARY OF THE REPORT Switzerland ratified the European Charter for Regional or Minority Languages (Charter) in 1997. The Charter came into force on 1 April 1998. Article 15 of the Charter requires states to present a report to the Secretary General of the Council of Europe on the policy and measures adopted by them to implement its provisions. Switzerland‘s first report was submitted to the Secretary General of the Council of Europe in September 1999. Since then, Switzerland has submitted reports at three-yearly intervals (December 2002 and May 2006) on developments in the implementation of the Charter, with explanations relating to changes in the language situation in the country, new legal instruments and implementation of the recommendations of the Committee of Ministers and the Council of Europe committee of experts. This document is the fourth periodical report by Switzerland. The report is divided into a preliminary section and three main parts. The preliminary section presents the historical, economic, legal, political and demographic context as it affects the language situation in Switzerland. The main changes since the third report include the enactment of the federal law on national languages and understanding between linguistic communities (Languages Law) (FF 2007 6557) and the new model for teaching the national languages at school (—HarmoS“ intercantonal agreement). -

Die geografisch eng beieinander liegenden Schneesportgebiete sind nur durch das Urdental von- einander getrennt. Die Distanz beträgt lediglich 2 km Luftlinie. Bereits am 1. Die Sprachgebiete der Schweiz gehören wohl zu den am häufigsten angesprochenen geogra- fischen Einheiten auf grossregionaler Ebene. Es handelt sich um die älteste nicht-institutionelle Gliede- rung der Schweizer Statistik. Die Sprachgebiete der Schweiz sind auf der Ebene des Bundes nicht verfassungsmässig festgelegt. Der Sprachenartikel der Bundesverfassung legt aber unter anderem fest, dass die Kantone ihre Amtssprachen bestimmen (Art. 70 Abs. 2, SR 101). Dies führt dazu, dass die mehrsprachigen Kantone verschiedene sprachpolitische Konzepte erarbeitet haben. Die einen definie- ren innerkantonale Sprachenräume, andere überlassen die Sprachenpolitik den Gemeinden. Es gibt in einigen Kantonen vom Kanton offiziell anerkannte zweisprachige Gemeinden. Am komplexesten ist die Situation wohl in Graubünden. Selbst bei verfassungsmässiger Zuordnung einer Gemeinde zu einem Sprachgebiet bedeutet dies nicht zwingend, dass Verwaltungs- und/oder Schulsprache diejenige des Sprachgebietes zu sein hat. Nicht zuletzt, weil keine rechtlich verbindliche Definition der Sprachgebiete auf Bundesebene existiert, hat sich das BFS in der Vergangenheit immer auf die Mehrheitsverhältnisse gemäss den Volkszählungsergebnissen auf Gemeindestufe gestützt. In der Vergangenheit schied das Bundesamt für Statistik BFS alle zehn Jahre die Räume mit mehrheit- lich deutscher, französischer, italienischer oder rätoromanischer Hauptsprache aus, wie sie sich durch die Resultate der Volkszählungen ergaben. 1 Dabei wurde in einem ersten Schritt die relative Mehrheit einer Landessprache auf der Ebene der Gemeinde ermittelt und dann die Sprachgebiete festgelegt. -

Skigebietsverbindung Arosa-Lenzerheide Grundlage für das Referat an der Jahresversammlung der BVR vom 20. Juni 2008 Daniel Monsch, Parpan A) Einleitung Als ich letzten Herbst für ein Referat zur Skigebietsverbindung Arosa – Lenzerheide ange- fragt wurde, freute ich mich schon, über ein erfolgreiches Projekt berichten zu können. Wie Sie wissen wurde das Projekt an der Urnenabstimmung auf der Lenzerheide mit knapp 60% Nein deutlich abgelehnt. Es nützt dagegen wenig, dass gleichentags Arosa mit über 84% Ja dem Vorhaben überwältigend zugestimmt hat. Da die Skigebietsverbindung Arosa-Lenzerheide allgemein als ein sehr sinnvolles Projekt gilt und auch die Gegnerschaft sich grundsätzlich für eine Verbindung ausspricht (halt nur nicht so), muss das Vorhaben trotz dieses Rückschlages weiter verfolgt werden. An der heutigen Jahresversammlung der BVR ist es sicher von Interesse auf die Planungs- geschichte und besonders auf die Rolle (und die Grenzen) der Raumplanung einzugehen. B) Erste Ideen zur Erweiterung der Skigebiete (chronologisch) Die Verbindung Arosa-Lenzerheide-Tschiertschen durch das obere Urdental wird seit 1972 diskutiert. Die Auslöser waren jeweils Revisionen der Richtplanungen oder der Nutzungspla- nungen, in deren Verfahren die Betroffenen jeweils Gelegenheit zur Stellungnahme erhielten. Während sich der damalige Regionalverein Pro Schanfigg und die Gemeinden Tschiert- schen, Praden sowie die Bürgergemeinden Calfreisen, Castiel und Lüen als Grundeigentü- merinnen positiv zu diesen zusätzlichen Entwicklungs- und Nutzungsmöglichkeiten äusser- ten, wollte die Gemeinde Arosa diese Möglichkeit zwar langfristig offen halten, aber die Verbindung zum Aroser Hörnli noch zurück stellen. 1981 vereinbarte die Gemeinde Arosa mit den genannten Bürgergemeinden, dass im Urdental keine mechanische Erschliessung erstellt werden solle, welche eine Verbindung mit Arosa ermöglichen würde. Als Entschädigung für diese Einschränkung erhielten die drei Bürgergemeinden durch die Gemeinde Arosa, die Arosa Bergbahnen und Arosa Tourismus je Fr. -
