RESOLUTION #21.09 District #2 County Revenue Sharing Fund Chairman of the Board Robert Adrian WHEREAS,.as the State of Michigan faced the great recession, they looked to find creative ways to save money in the State's general fund; and District #7 Vice.Chairman WHEREAS, in 2004, a deal between county govemments and the State of Michigan, created Marty Thomson a property tax collection shift which would provide for revenue sharing funds to the Counties while not relying on the State's general fund for that; and District #l Commissioner WHEREAS, during this time, the proceeds from the property tax collection shift was put in a Don Gilmet County Revenue Sharing Reserve Fund whereby a county could obtain funds from there; and

WHEREAS, once a county exhausted their reserve fund, they re-entered the state revenue District #3 system where they should be receiving their full funding amount; and Commissioner Dave Karschnick WHEREAS, the Michigan Association of Counties has done extensive research into county revenue sharing and the impact the County Revenue Sharing Fund has had on county District ll4 allocations and indicates that the State of Michigan has cumulatively shorted 60 counties of Commissioner more than $l l0 million between 2009 and 2014; and Bill Peterson WHEREAS, Alpena County is one ofthose counties, experiencing a shortfall of$494,016; District #5 and a cumulative shortfall of$1,067,487 due to CPI increases being discounted after Alpena Commissioner County's retum to CRS; and Brenda Fournier WHEREAS, it is time for those funds to be restored in full this year; and District #6 WHEREAS, despite receiving federal funds through the state as part ofthe American Commissioner Rescue Plan, the use ofthe federal funds is tied to COVlD/pandemic related expenses; and Kevin Osbourne WHEREAS, while Alpena County has exhausted thousands of dollars related to the COVID- District #8 l9 pandemic, we have budgeted services to provide to our citizens which are not related to Commissioner COVID- l9; and John Kozlowski WHEREAS, services provided by the Alpena County Courts, Prosecutor, SherifVJail, Executive Manager Counry Clerk, Treasurer, Register of Deeds, Drain Commissioner, Administration and in part by County Revenue Sharing and Tammy Sumerix-Bates Alpena Counry Regional Airport are all funded would be impacted by a restriction of funds for COVID only; and Board Assistant WHEREAS, a portion ofthe revenue sharing also goes to support operations ofother Lyrn Bunting functions that requires an investment of local county matching funds to accept federal or state funded programs. Board Admin Assistant Kim Elkie NOW, THEREFORE, BE IT HEREBY RESOLVED that the Alpena County Board of Commissioners calls upon state leaders to restore the County Revenue Sharing Fund and to provide a one-time payment of the cumulative shortfall.

Chair Wallace opened the public hearing for the closeout of the Michigan Community Development Block Grant (CDBG) Funding for CDBG CARES Funding. Administrator Lawson commented that Cheboygan County was awarded $271,084 to be spent by December 31, 2020. Of this amount, the County was able to spend $155,022.99 by the project deadline. CITIZENS COMMENTS

Tom Smith, citizen of Inverness Township and Chairman of the Cheboygan County Veterans Park Committee gave an update on what’s happening in the park. This year the committee was planning on spending $50,000 with the installation of two (2) granite benches; two (2) tabulates – a purple heart and a POW; an MIA stone, which was donated to them; a gold star family monument, which will cost $20,000 and they are planning on replacing all of the sidewalks in the center. The committee has two (2) raffles planned for this year with the hope that after this year, they would go down to only one (1) raffle per year to help with landscaping and stuff like that. He thanked the Board of Commissioners and the Administrator Jeff Lawson for all their help and cooperation. Also two (2) decorative flowering trees will be placed on the front path in the park. Sheriff Clarmont saluted him for all that he has done for the veterans. Applause was given. Mr. Smith stated that this was respect for all the veterans who didn’t return home.

Beth Bridgman, citizen of the City of Cheboygan questioned if there was an Election Information Sub-committee scheduled to date and commented that there was a lot of new evidence out there that has been presented and she would like to see things move along because if we can’t turn this around at the County level, then we can’t turn it around.

William Burnell, citizen of Benton Township commented that he was here to stand with the Board of Commissioners because they were their voice and he asked the Board to take a look at their children, their grandchildren, and their great-great grandchildren regarding the future. If the Board doesn’t do what was correct, they were all going to live in socialism. He asked the Board to do what was correct and stay with the constitution.

Finance Director’s Report

Finance Director Sue Buitenhuis presented the Revenue and Expenditure Report for the General Fund for the month ending March 31, 2021. She reported total year-to-date revenue of $1,068,378.91, or 7.35% of the budget compared to $788,610.05, or 5.5% of the budget last year at this same time. Ms. Buitenhuis reported expenditures year-to-date of $2,789,313.16 or 19.16% of the budget, compared to $2,664,377.06 or 18.79%, last year as of the end of March 31, 2020. She reviewed each department that had any significant changes. Ms. Buitenhuis reported that the Cash Summary by Fund had a beginning balance of $21,634,840.73 and ended with a balance of $19,878,363.77 for March 2021. A summary of expenses by category was given along with a Quarterly Fund Balance Report of $21,113,380 at the beginning of the year and as of March 31, 2021 and a year to date total of $21,706,285.

Administrator’s Report

Administrator Jeff Lawson gave an update on the Marina Fuel Tank Project. Ryba Marine has started installation of sediment control barriers in the water adjacent to the areas for sheet pile installation. Two bids/quotes for the construction of the 400 sq. ft. fuel dock building were opened on April 30, 2021. The low bid/ quote was received from Matt Barter Masonry for building construction labor only in the amount of $18,500. A project agreement was awarded by staff to the County’s Purchasing/Bid Policy on May 6, 2021. Construction of the building will be coordinated with Ryba Marine. The County will also have requests for bids/quotes for electrical, mechanical and plumbing for the building in the next few weeks.

Administrator Jeff Lawson gave an update on the County Building Column Repair. The engineer has confirmed that six columns will need to have welded support plates installed prior to recapping. Then the system would be completely painted and there would be granite covering the lower portion with limestone on the upper portions. This was scheduled to begin by the end of the month. While the engineer was here, staff did have them look at the building. A couple of other areas were identified and staff asked the engineer to give them a proposal to do a deeper inspection of the facility looking for any other problems with the building. Staff will put a list together and address these over the next several years.

Administrator Jeff Lawson gave an update on the Board Planning Session. The Board Planning Session has been scheduled for 9:30 a.m. on May 27, 2021 at the Sand Road Senior Center. Session topics were as follows: Review of Current Board Mission, Vision and Goals Statement; American Rescue Plan Funding and possible projects/programs; Millage funding; infrastructure Project Preview and Pension obligation. The Road Commission has submitted correspondence related to America Rescue Plan Funding and will have a representative attending the meeting. This correspondence will be provided in the Board Planning Packet.

COMMITTEE REPORTS

Commissioner Sangster reported on scheduling an Election Information Sub-committee meeting at 8:30 a.m. on Thursday May 13th.

OLD BUSINESS

Commissioner Warfield asked the Administrator to give some history regarding the Berrien County Resolution in Support of Restoring the County Revenue Sharing Fund. Administrator Lawson stated that the State of Michigan in 2004 enacted Public Act 357, which changed the collection schedule for General Fund operating tax from December to July. The additional funds collected, as a result of the accelerated tax billings over this three-year time period, were placed in a special fund and were appropriated on a schedule similar to distributions the County would have received in revenue sharing payments from the State. Appropriations from this fund were received by counties in Michigan until the funds were depleted. At that time a county would then re-enter the State Revenue Sharing system, receiving the appropriations approved by the Governor and Legislators each year. A review by the Michigan Association of Counties has identified that the State has not fully funded State revenue Sharing due to the counties that have re-entered the system. Cheboygan County re- entered State revenue Sharing in 2016. The Berrien County Resolution was requesting that counties that have entered back in to the revenue sharing program receive their full increase in funding percentage since entering back into the program. The state has never fully funded this over time based on inflationary gains. So each year, MAC and the counties ask the legislature to fully fund revenue sharing. Staff could certainly do a resolution, but what was also important was to call their representatives and identity that they encourage full funding for revenue sharing. Another issue this year was there has been discussion at the Senate level requiring any gains that the County had from last year’s revenue sharing to specifically go to pensions. Michigan Association of Counties recommendation was to have the flexibility in the funding and not have the legislature place specific rules on this and was encouraging the governmental units to encourage our legislators not to adopt this and allow governmental units to spend appropriations as they see fit. The most effective way was to call our representatives. Staff could also put a resolution together for this, if the Board would like.

NEW BUSINESS

Finance Director Sue Buitenhuis presented the FY2021 Coronavirus Emergency Supplemental Funding (CESF) to the Michigan State Police has allocated additional Coronavirus Emergence Supplemental Funding (CESF) to the County Prosecutor offices for hiring contractual personnel to address coronavirus-related caseload backlog. Eligible expenses include hourly wages for the contractual employee and technology for the contractual employee to do this job. County population under 75,000 was eligible for up to $25,000 in funding. The Prosecutor’s office was requesting $24,929 in funding, which includes $21,600 in contractual expenses and $3,329 in supplies and materials.

Motion by Commissioner Newman, seconded by Commissioner Williams, to ratify the application that was required to be submitted prior to the Board of Commissioners meeting between Cheboygan County and the Michigan State Police (MSP), Grants and Community Services Division, from the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance of FY 2021 Coronavirus Emergency Supplemental Funding (CESF) in the amount of $24,929, accept the award if granted, and allow the Finance Director to make the

WHEREAS, the Northeast Michigan Council of Governments (NEMCOG) serves as the Fiscal Agent and Program Manager for the Northeast Michigan Community Corrections Advisory Board (NMCCAB), and

WHEREAS, this County is a member of either the NEMCCAB strongly desires to continue to participate with Community Correction’s Programs and Services, and

WHEREAS, NEMCOG has worked with the OCC to develop a Community Corrections FY 2022 Grant Application for the NEMCCAB, and

WHEREAS, the FY 2022 Community Corrections Grant Application has been prepared by NEMCOG in the amount $309,355 for Community Corrections Programs and Services in the counties of: Alcona, Alpena, Cheboygan, Crawford and Otsego, and

WHEREAS, the Northeast Michigan Community Corrections Advisory Board, has approved this Grant Application, and recommends its approval by the member counties,

THEREFORE BE IT RESOLVED, that Cheboygan County hereby approves the Northeast Michigan Community Corrections Advisory Board’s, FY 2022 Grant Application prepared by NEMCOG for Community Corrections funding in the annual amount of $309,355 for Programs and Services.

Administrator Jeff Lawson presented the Prosecutor’s Office – Westlaw Agreement Michigan Rules of Court. This was a three-year agreement for one copy of the Michigan Rules of Court-State, 2021 ed. for the Prosecutor’s Office use at a financial impact of $168 per year.

Also Invoice No. 57586 in the amount of $158.50 for maintenance on the Marina copy machine.

Sheriff Dale Clarmont presented the 2021 Salary and Wage Resolution – Non-Union General Employees #20-14 – Amendment #6 – Reclassification Sheriff’s Department/Emergency Management. This amendment would change the number of positions for Detective Lieutenant – Level 1 from one (1) to two (2), as outlined in Sheriff Clarmont’s OEM Annual Update and Reorganization memo.

Motion by Commissioner Sangster, seconded by Commissioner Williams, to adopt Amendment #6 to the 2021 Salary and Wage Resolution – Non-Union General Employee #20-14 to be effective May 12, 2021, authorize the Chair to sign, and authorize the Finance Director to prepare the budget amendment. Finance Director Sue Buitenhuis presented the County-Wide Central Services Indirect Cost Plan and Monthly IV-D Billings. The consulting services agreement with MGT of America Consulting, LLC for monthly Title IV-D billings for the Friend of the Court and the Prosecutor’s office expire September 30, 2021. The contract to prepare the county-wide central services indirect cost plan will expire in 2022. MGT has been providing these professional services for the past nine (9) years and both the FOC office and the Prosecutor’s office have been satisfied with their services and desire to continue with their consulting agreement. A four- year agreement has been provided by MGT for the monthly billing services at a cost of $7,000 annually for the FOC offices and $7,000 annually for the Prosecutor’s office, and an additional $1.40 per timesheet processed for the automated time log processing service. A three-year agreement for the Indirect Cost Plan has been provided at a cost of $7,300 per year for the next three (3) years. Staff was recommending awarding the multi-year agreement to MGT of America, Inc.

Finance Director Sue Buitenhuis presented the Purchasing Policy Revision – Sole Vendor Listing 300-2A. The changes included adding Thermo Scientific – True Narc handheld chemical analyzers and Tip of the Mitt Services, LLC – Drug Court Services.

BOARD MATTER FOR DISCUSSION

Commissioner Sangster questioned about the County Building generators. Administrator Lawson commented that the County Building had a power outage on Tuesday, May 4, 2021. The original portion of the building was originally built in 1968 that had full power. The additional areas including this section and also the Sheriff’s office really only had emergency backup power, which were only lights and not computer systems. He attended a meeting and discussion was held on the need to boost the generator strength. Staff would be talking to their electrician to see if they could re-allocate some breakers for the short term. Then staff would have to get some prices to upgrade that generator, basically, to run all this portion of the building and the Sheriff’s office. In the Sheriff’s Department new wing, there was a generator that handled everything that was required in that wing. Load tests have been done on both generators, but they want to run a drill this summer. Staff was able to get back online that day, but if it was an extended outage they couldn’t have operated. There were defiantly some improvements needed based on this discovery.

Commissioner Newman attended a Fair Board meeting and explained that Cheboygan County was going to have a 2021 Cheboygan County Fair unless something drastic changed. Staff addressed the number of citizens that could attend to not exceed 1,000 on site and the Fair would have to put together a fairness plan. This would identify the procedures that the Fair would take to secure protocol. The Fair contract would also have to be looked at. Commissioner Newman stated that the Fair Board would be meeting and having further discussion with District No. 4 Health Department to give them some direction and overview.

Commissioner Matelski commented that she was very impressed with the City of Cheboygan garbage pickup last weekend at the fairgrounds. There was a tremendous amount of things that had been collected.

CITIZENS COMMENTS

Joe Klein, citizen of Benton Township commented that this was a puppet sock (white sock was put over his right hand), which was old, worn out, tired and it only seemed to him as the puppeteer or maybe in this case a Lansing puppet. Nothing will be resolved on its own. This was a puppet sock (grey sock was put over his right hand) with grey hair who listens to its master, who cares for it, washes it and uses it. It goes up, it goes down, it goes back, but most importantly it goes forward. It chooses the audience who cheers it on. These socks when they were all gone sadly can go home, be put in a drawer, dark and alone wrapped being forgotten and never hear the cheers again. He asked the Board of Commissioner to be the puppet sock that enjoys the cheers and listens to their masters. These puppet socks like him and the ones in back of the room who cheers and wants this free forensic audit.

Beth Bridgeman, citizen of the City of Cheboygan commented that she could not write anything better than history, which brings tears to her eyes every time she reads it because it was one of the most beautiful things beside the Declaration of Independence. She read Abraham Lincoln’s Gettysburg Address and stated that she felt confident in this body to uphold this after almost one year attending these Board of Commissioners meetings. Without a good vote, we have lost that government.

Randy Strom, citizen of Township thanked the Board for all of their hard work, time and energy that gets put into what they do. He asked everyone to take a glance of the northeast corner of the room - that flag. If the Board would approve the free forensic audit, we the people would feel like they were doing a better job of honoring the people who earned the flag. these machines and to have them checked out. This was to show the people that they were truly honoring and respecting the people who sacrificed their lives for this country.

Commissioner Sangster commented that he would like to take Civil Counsel Bryan Graham’s opinion under advisement and then come back and have some discussion about it. This Board was all very clear that their hands look pretty tied. He suggested developing another frontal, attack to find a better way to go about this and this also gives them some time. A lot of information was still being collected so they could learn a little more because they always want to make sure that election integrity was at the fore front.

Commissioner Warfield commented that there were a number of little individual pieces/issues that he had questions on, which needed to be looked at. If they were going to choose a battle, they should choose it wisely, they should choose to win that battle and fight it in the correct arena.

Chairperson John Wallace and Administrator Jeff Lawson presented Charles “Chum” Ostwald with an appreciation certificate for his 19+ years of loyal and dedicated service with the Cheboygan County Planning Commission. (Applause was given). Mr. Ostwald commented that during his service it bought him three (3) new trucks and one (1) new car. Administrator Lawson stated that Chum was on the Planning Commission for many-many years and he kind of made a little bit of a joke about that. As far as how much he got paid, he donated a lot of time over the years and he served the community well.

CITIZENS COMMENTS

Dale Giddings, citizen of Mentor Township and Cheboygan County Board of Canvasser commented that Brian May recently stepped down from the Canvass Board. Brian was a good man, it was a pleasure working with him and he did a lot of good service for this County.

Vince Lumetta, citizen of Beaugrand Township commented that he wanted to stand up for the clerks from all of the townships and for the County. There was a strong work ethic in this COMMITTEE OF THE WHOLE – May 25, 2021

community and those folks have certainly done that as they move forward with this process of election integrity. As a young child, his mother and the ladies in the neighborhood was one of those ladies that worked the election. Even though, they may have had different political perspectives, when they came together, they were very serious about the task they were assigned too. He wanted to be supportive of those folks because they worked very hard and was getting beat up unmercifully with everything right now. The clerks have a good process in place and this should be considered as things move forward.

William Burnell, citizen of Benton Township commented that he was not there to beat up on the County Clerks staff, but was there to air on the integrity of their voting and transparency. This was a free country and he would like to see it kept that way. He also commented that it was nice not to see masks being worn. In the State of Arizona and Georgia, they were going thru the mail in ballots to see what’s right and what’s wrong and that was what we needed here was for somebody to stand up for our country.

Beth Bridgeman, citizen of the City of Cheboygan commented that she was probably the first person into the City Clerk and the County Clerk’s offices the day after the election to say that they hadn’t seen any problems with the November Election. Nobody had heard any complaints and she thanked them for their hard work. It wasn’t until her absentee ballot, which wasn’t counted at State level that she suspected that there might be more to the story. This has never been about going after the clerks at any level. They knew that most of the problem had been conducted at levels above the clerks. An acceptable error rate was 1 in 10 million ballots, which was where they needed to start to see what had happened. The forensic audit has nothing to do with any clerk level activity. It has to do with was their access from foreign people into the election, into the voter rolls at the state level, and into everybody’s cell phones because 500,000 cell phones was hacked from the night of the election. She asked the County Clerk to review the Antrim County audit and provide a statement. This was not a personal attack on any clerk.

Joanne Cromley, citizen of the Koehler Township commented that she was hoping that the Board could help her understand why they were pursuing fraudulent election irregularities in Cheboygan County instead of questioning the honesty and reputation of the County Clerk, the nineteen (19) Township Clerks and the City Clerk. They should be thanking them for their excellent job during the 2020 elections and previous elections. They should be thanking all of the election workers that stepped up to work long hours on Election Day. From the elected officials to the elected poll workers, they should not disrespectful the work that they have done. They should take pride that the County held a clean, honest election, and one of integrity. Should the Board of Commissioners pursue an audit, they would be opening up the County to a lawsuit by Dominion who currently has multiple lawsuits in the billions. Ms. Cromley questioned whether this what they wanted for the community and can they afford the risk? The voting machines were federal-critical infrastructure and should not be turned over to an uncredited agency. If the Board of Commissioners choose such an agency, then the County would be responsible for having to pursue new voting machines for future elections at a cost in the millions. Is this how the Board of Commissioners what to spend their money? She implored each of them to think long and hard about going down that road.

Debbie Pond, citizen of the Benton Township commented that she was an active voter and had nothing but praise for the County, Townships and the City Clerks attention to handle their elections with grace, fairness and efficiently. She believed that this was the overwhelming feeling about how their local elections have been held. Last week, Cheboygan County was featured in a Washington Post newspaper story about election fraud. Needing more information, she did a FOIA request for a recording of the Election Information Sub-Committee meeting that

was referenced in the article. While listening to the meeting, she was surprised to hear about the potential plan to hand over their election machines to unknown experts, provided by Attorney Stephanie Lambert, to analyze the data software, which she offered for free. She believed that there had to be some sort of personal gains or strings attached that was best for accounting of Matt DePerno. She would like to thank the clerks for a job well done and use the money elsewhere. In the meeting, Election Source Vice President Steve DeLongchamp deemed the Election Equipment as critical infrastructure by the Federal Government just like a nuclear power plant and it cannot be turned over to an unaccredited agency or company.

Owen Goslin, citizen of the City of Cheboygan commented that he just found out about the Election Information Sub-committee by reading an article in the Washington Post. Last week, Antrim County’s lawsuit was thrown out of Court, which was the one of the last lawsuits tied to the 2020 Election. There was never any basis for the accusations of fraud in Antrim County, but a few loud voices enjoyed the media attention and thought nothing about causing division in the community for their own partisan gain. He felt that the Antrim County Clerk Cheryl Guy was a hero for standing up to the death threats that she had received and consistently working to uphold the election laws and the truth. He was dismayed that Cheboygan County was considering going down the path of Antrim County. At the last Election Sub-Committee Meeting, the Board of Commissioners hosted a downstate Lawyer Stephanie Lambert who entertained the idea of a “free” audit. Please be aware of anyone offering the County “free services”. What cost will there be for the County’s reputation as they go down that path? Who’s going to pay for the litigation fees for interfering with the November Election? Who’s going to pay for the disruption that this was going to cost? There was no credible evidence of the fraud in this County. Cheboygan County should celebrate the record number of people who came out to vote during the pandemic and also the staff of the clerks and election workers because it was a free and fair election. He worked as a poll challenger and it renewed his confidence in the election. If anyone was questioning the system, volunteer as an election worker.

Missy France, citizen of Inverness Township commented that District Court was packed and there was a ton of people on the call for today’s meeting. The sleeping giant was awoken. There was a new theme coming out where they didn’t want to have the County invest a lot of money in the election integrity issue and it sounded like they have already done some investing into it, which was one of the excuses as to why they didn’t want to push forward. Where was the attorney getting this information, what was their advice and who was leading that attorney? She wanted to remind everybody that the Board of Commissioners was here to represent the people. There were more people waking up, standing up and talking about these election integrity issues across not only the country, but across the world, which was a big deal. If they were concerned about the money being spent, they needed to focus on what was happening in the county and what the people wanted to see happen.

Al Moberly, citizen of Benton Township, commented that Cheboygan County was going down a road that he didn’t think we didn’t need to go down. There has been good election integrity since the 1700s with many changes over time. Last year, there were numerous recounts for the Presidential Election and investigations turning up very little problems and absolutely no problem that he found that affected the outcome of the elections. Cheboygan County was heavily a Republican County and it seemed like this “integrity” seemed to be within the fringe of the Republican Party. Why would these people choose Cheboygan County? If Cheboygan County was going to get on the map, he hoped that it was not for a red herring like this, which was proposed by some supposed patriots and people who were falsely concerned about their election integrity.

Shawn Wyzlic, citizen of Mackinaw Township commented that she wanted to add her voice to those who have already spoken against this forensic audit. This was a waste of time and of money. Cheboygan County voted for former President Trump at a 2 to 1 rate and she saw no reason why the County needed this audit.

Stephen Hatt, citizen of Tuscarora Township commented that the late great Sam Rayburn served as the 43rd Speaker of the U.S. House of Representative Republican Chair famously said, “It takes a carpenter to build a barn, but any jackass can kick it down”.

Rob Ross, citizen of Benton Township commented that he worked the election in November at Benton Township. He stated that 99.9% of everybody that worked the elections and he was not speaking for them, but was speaking on their behalf were honest people and the opportunity for them to screw up were minuscule. The idea that there was some reality behind a failed election in Michigan was not only impossible, but it was so unreal that nobody in their right mind should ever entertain that idea. Workers of other political beliefs work in concert with each other.

Janet Mleczewski, citizen of Beaugrand Township commented she was there because she heard a lot of talk about money and also other things that just didn’t seem important to election integrity. This was not about the past, not about 2020, not about the parties, but it was about making sure things were straight for the future. She was sure that there was not one of them that would lay down their lives for their children or their grandchildren. She knew that there were many-many young men and women who have laid down their lives to preserve the freedom of this country and she believed that this was what they needed to do. It’s about the about the future and they need to take the risk and consider taking, whatever, risk it takes to preserve this for our children and grandchildren.

Joe Klein, citizen of Benton Township commented that they have heard a lot of quotes from the past. In 1941, Franklin Roosevelt said, “a date which will live in infamy.” But right now, there was too much fear from every different angle. He wanted this free audit for one (1) reason, the integrity of the future. We cannot change the past, but we can learn from it. He hoped that each and every one remembered the little puppet show that he put on last time he was here. It wasn’t to be entertaining, but to try to go ahead and bring home a point. If you decide to vote on this voter integrity, each of the Board of Commissioners would be looked at through the eyes of all the people as a shining star and not just a public servant.

Randy Strong, citizen of Nunda Township thanked the Board for all of the work they did. During this meeting, he heard about infrastructure and about money. In 1941, he earned about $12,500, which was his pay for the year. He slept inside most of the time when he wasn’t deployed. There was a bunch of other people including himself that would like this election integrity looked at for the future who signed similar oaths and contracts, whereby, they inconvenienced themselves not for money, but for the very concept of freedom. He commented on an audit in Arizona where some of the data was gone and he gave an example of driving down interstate I-75 and a big chunk of it was missing, the infrastructure would be broken. In an ideal utopia world, we’re all crazy. Say the auditors come in, do an audit and everything’s fine. The Board would go back to work doing whatever they were doing. This audit was for his kids and his grandkids. They just wanted to make sure that everyone’s voice was heard.

John Moore, citizen and Township Supervisor of Nunda Township commented on Resolution 2021-13 Declaring and Approving a Local State of Emergency and urged the Board to pass that because it was nice to have the option. He also commented that the Nunda Township clerk had received numerous letters concerning election integrity and she stated not to go down the rabbit

hole. She also gave an open invitation to Commissioner Warfield to come join her for the August 4, 2021 School Election and learn firsthand how elections were handled.

Theresa Ross, citizen of Burt Township commented that this whole election integrity exercise was built on a lie. She stated that she was an election worker and every clerk and election worker out there has been trained. They were dedicated to the process. The process was fair and accurate. This was a slap in the face to have a private company step in with the outcome being the goal rather than the process. It was ludicrous that our leaders including elected officials such as themselves continue to push the big lie. She suggested that every elected official be mandated to take the same training election workers take.

Louis Vallance, citizen of Grant Township commented that last week the Reconvened Committee of the Whole Meeting was in violation of the Opens Meeting Act. The County was under a Statewide and Local Emergency Resolution right now. There was no call in number for the meeting. He asked the Board of Commissioners to reconsider Thursdays, Planning Session Meeting being held at the Senior Center and put in the infrastructure needed for the call as an option or hold it at the County Building, where they had the infrastructure in place. He asked the Board to make this telephone option permanent.

David Martin, citizen of the City of Cheboygan commented that he recently heard that two (2) Commissioners have been talking about the election fraud, which they could do in their spare time. His concern was they were spending the other Commissioners time, which was tax funded. He read that there was consideration of paying for a forensic audit and he suggested if anyone wanted to do an audit, they should pay for it out of their own pockets. Let’s help the poor and struggling to survive.

Leonard Page, citizen of Grant Township commented that the challenge seems to the Dominion Voting Machine process. There were 66 Counties in the State of Michigan using this Dominion Voting Machine and he was very curious how Cheboygan County was being selected by some group for this audit. There was litigation in Wayne and Antrim County and he pointed out that Judge Elsenheimer dismissed the litigation recently in Antrim County and he made it rather clear that audit procedures were governed by state law and the state constitution, and he strongly suggested that the Commissioners may wish to consult with the County Clerk Brewster and Civil Counsel Bryan Graham as to how audit procedures should be conducted. It has been over six (6) months since the November 2020 Election and there’s still no evidence of widespread voter fraud, nor evidence of any irregularities in the Dominion count process. At some point, we have to stop this.

Betsy Gahn, citizen of Township commented that it was quite embarrassing and un-American of people that didn’t think any kind of election integrity was very important moving forward. This was something that was so important for the country, our children and our grandchildren. This was not a joke and no one was unappreciative of the election workers that worked on Election Day. We all want to work together as a community, but the people that were speaking up were also the people that have not shown up at the meetings to understand the process.

John Petkus commented that he worked the election in 2020 as an election challenger. He worked with several non-profit organizations and he actually drove around to 19 different precincts. There were a couple of things that were being missed in some of this discussion today. All of this conversation that was being done across the country, across the world had the exact goal of undermining the stakes in the election, the States, the election officials and undermining the faith in the people who oversaw these elections. He wanted to point out that

this Board had no authority to have this audit and it puts the County in jeopardy. He strongly urged the Board to speak with an election attorney.

Christopher Kress, citizen of Tuscarora Township commented that the Board had no authority to call for a recount. If they were going to recount the election, they needed to recount every person on the ballot in 2020.

Amy Naylor Joy, citizen of Mullett Township commented that she was concerned about why there was a question of doing this recount because the election was a fair and certified. If the election equipment gets turned over to somebody who was uncredited and unauthorized, they were going to have to replace everything. It seems like there was no cause and there was a significant cost to this action.

Lena Thompson, citizen of Benton Township commented that she would like to remind everybody what the history was of all of this supposed election integrity. This was just craziness when it came to putting a doubt in how we do our elections, which had nothing wrong. If you look at the counties that were targeted for the 2020 Election such as Milwaukee, Philadelphia, Atlanta, Detroit and Nevada, what do these have in common? She stated that they were largely African American majority cities or Latino majority cities. These were the only counties that they decided to target. All of these 60 different litigations in those counties were thrown out. Why were they targeting Cheboygan County, which was a 95% or 98% white County that had no issue? This election integrity was just another word for an election circus brought on by one woman.

ADMINISTRATOR’S REPORT

Administrator Jeff Lawson gave an update on the Marina Fuel Dock Project. The project would be starting this week.

Administrator Jeff Lawson gave an update on the Human Resource Director. The new Human Resource Director Julie Wheelock would be starting on June 11, 2021.

Administrator Jeff Lawson reported on the 4th of July Fireworks. Insurance information has been submitted for the 4th of July fireworks. Staff would be processing and reviewing what the study was as far as any protocols. On July 1st the Health Department Rules for indoors would be lifted and on June 1st all outdoor capacity limits would be lifted, so for the 4th of July this should be fine for the usage of the facility. Similarly, any parking in the parking lot area would be OK at that point in time. If something changes, staff would work with the City.

Administrator Jeff Lawson gave an update on the Open Meetings Posting. The County’s State of Emergency allows municipal units in Cheboygan County to either hold a remote meeting or not, which it doesn’t require them to do that.

OLD BUSINESS - None

NEW BUSINESS

Finance Director Sue Buitenhuis presented the U.S. Department of the Treasury Coronavirus Local Fiscal Recovery Fund. The County has been awarded approximately $4,909,567 from the U.S. Department of Treasury Coronavirus Local Fiscal Recovery Fund (the American Rescue Plan Act). The period of performance was from March 3, 2021 until December 31,

2023. Once the award was accepted, the County would receive half of the funding upfront and the remainder in approximately one (1) year. The award provides for four (4) areas in which the funding would be spent, which would be discussed at the work session on Thursday, May 27th. This request was only to accept the award so funding could be received.

Motion by Commissioner Sangster, seconded by Commissioner Tryban, to accept the $4,909,567 grant award from the U.S. Department of Treasury Coronavirus Local Fiscal Recovery Fund and authorize the Administrator to electronically accept the award terms. A roll call vote was taken. Motion carried with 7 yes, 0 no and 0 absent.

Finance Director Sue Buitenhuis presented the 2021 Budget Amendment – Fund 285: American Rescue Plan Act. The County has been awarded approximately $4,909,567 from the U.S. Department of Treasury Coronavirus Local Fiscal Recovery Fund (the American Rescue Plan Act). The funds were for multiple years and a special revenue fund was needed to be set up to appropriately track these funds.

Motion by Commissioner Newman, seconded by Commissioner Williams, to approve the budget amendment to create Fund 285: America Rescue Plan Act and raise revenue and expenditures for $4,909,567. A roll call vote was taken. Motion carried with 7 yes, 0 no and 0 absent.

Administrator Jeff Lawson presented the Fairgrounds Agreement - Cheboygan County Humane Society Garage Sale. The Cheboygan County Humane Society would like to use four (4) buildings Friday and Saturday, June 4th through June 5th for a garage sale.

Motion by Commissioner Newman, seconded by Commissioner Warfield, to approve the agreement for the Cheboygan County Humane Society Garage Sale and authorize the Chairperson to sign. A roll call vote was taken. Motion carried with 7 yes, 0 no and 0 absent.

Administrator Jeff Lawson present Resolution Declaring and Approving a Local State of Emergency within Cheboygan County. Section 3(2) of the Michigan Open Meetings Act, MCL 15.263(2) authorized a public body to meet electronically or remotely at a public meeting due to a statewide or local state of emergency. This Resolution declares and approves a “local state of emergency” within Cheboygan permitting remote meetings to be held and authorizing the implementation of Emergency Operation Plans as pandemic necessitates.

NOW , THEREFORE, BE IT DECLARED AND RESOLVED, that the Chairperson of the Cheboygan County Board of Commissioners and the Cheboygan County Board of Commissioners hereby declare and approve, respectively, pursuant to Section 10 of the Emergency Management Act, as amended, MCL 30.410, that a “local state of emergency” exists within Cheboygan County due to the continuing COVID-19 pandemic within Cheboygan County;

BE IT FURTHER RESOLVED that local resources and f unding are being utilized to the fullest possible extent, and the Emergency Operations Plan will be partially or fully implemented as this pandemic necessitates;

BOARD MATTERS FOR DISCUSSION

Commissioner Wallace commented that he gave all of the Board of Commissioners a copy of the Board Goals, which was for the Planning Session and asked them to review it. Paying attention to economic development, which was a key issue of what they were trying to revive. He announced that tomorrow at 4:30 P.M. in Charlevoix, the CCE Central Dispatch was hosting a ribbon-cutting ceremony to celebrate the new 800 MHz System for the 911. The Planning Session was scheduled for Thursday, May 27th with breakfast at the Cheboygan Senior Center starting a 9:00 a.m. and the Planning Session starting at 9:30 a.m..

CITIZENS COMMENTS

Vince Lumetta, citizen of Beaugrand Township commented that there was a group of ladies in Cheboygan and Emmet County who have started a chapter of The American Rosie the Riveters Association. If they were not familiar with them, the Rosie’s were the ladies who built the , the airplanes and the tanks during World War II. They have been going out and finding these ladies who were at least 90 years old and beyond and getting their stories to print in the local newspapers. They will be putting in a Rosie the Riveter rose garden right out in front of the County Building by the cannon with placards that people have sponsored. The chapter was still in search of the Rosie’s to get their stories out there. He was proud of his wife, Linda Rogers and the ladies for what they were doing. The Mackinaw Ice Cutter in Mackinaw City was holding a Rosie the Riveters display. Last year, there was a lady that toured the who had helped build it as part of the war effort, which was quite inspiring.

Janet Mleczewski, citizen of Beaugrand Township commented that she heard somebody was really trying to say it wasn’t legitimate to have someone outside of Dominion, checking Dominion, which to her sounded ridiculous. If she had an employee that she suspected of embezzlement, she surely wouldn’t have that employee check into the finances.

Wendy Chase, citizen of Mackinaw Township commented that she respects all of the election officials. She believed what they should be trying to do was work on ways that they could strengthen the democracy, work together and stop doing things that tear them down. The majority of Cheboygan County was Republican and everyone voted and the results were the results. This country asked the electorate to decide if President Trump should stay their President or not. The electorate voted and that was the way it was. There were multiple officials and judges saying that this was a fair election. As a country, we cannot throw elections out the window saying that they were meddled with because if those things had happened, officials would have found it. There was always going to be some fraud. This has to stop and we need to come together as the people and cannot be a divided America. If there was a reason to do an audit, then an audit should be done.

William Burnell, citizen of Benton Township commented that this was America and not China nor North Korea, so they should be able to do what they want to do and that was to open up the ballots to take a look at them.

Larry Hull, citizen of Tuscarora Township commented that he has been a resident since 1977. On December 7 1941, his father was 21 years old. He answered the call and didn’t hide. If he did hide and didn’t answer the call would the United States of America have won the war? Yes, they would have. Now we were in a situation with an entirely different type of battle field. The call has come to the Cheboygan County Board of Commissioners. DePerno’s team found unmistakable evidence of corruption in the electronic portion of Antrim County. DePerno was trying to decide, prove, or disapprove that this corruption infiltrated Cheboygan County and the other 82 counties in the State. This was just an opportunity for them to prove or disapprove what Doctor Douglas Frank was talking about.

Joe Klein, citizen of Benton Township commented that he wanted to change the narrative a little bit by saying he wanted the citizens to be confident that the voting machines have not been compromised by foreign nations or entities. We should want to prove that these machines were accurate. In the County, there was a FOIA request done, which showed 117 adjudication ballots. That means there was something wrong someplace. Benton Township showed 18 adjudicated ballots and showed that the Election Inspectors instead of being a 50 – 50 mix of the two major parties showed 3 to 1. A husband and wife team filed a FOIA request with Aloha Township with the same questions and received different answers regarding the number of adjudicated ballots.

Beth Bridgman, citizen of City of Cheboygan commented that she wanted to address the people who were anti-forensic audit, so that they could understand some of the information that has been brought to the Commissioners. She asked if anyone had any questions on what an adjudicated ballot was or the FTC guidelines when using electronic voting machines that an acceptable error rate was 1 in 10 million ballots. Cheboygan County had a total of 117. She still had not narrowed down, did her vote count? If they didn’t believe that every vote should count, then they didn’t have a democracy. They were here today simply because they needed a forum where both sides could talk to one another and be informed of the details and the information.

Missy France, citizen of Inverness Township commented that there were a lot of people putting their faith in attorneys. She googled Bar Examination – Wikipedia and read an excerpt from that. We are not practicing common law here in the United States and people were putting a lot of faith in the judicial system and were going to find out that the judicial system was corrupt.

Madelyn Naylor, citizen of Mullett Township commented that this audit was unauthorized and unacceptable and she wanted the voting machines to remain accessible to everybody.

BOARD MEMBER COMMENTS

Commissioner Williams commented that there was a long range of opinions out there. The purpose of this Election Information Sub-Committee was just to do research. The Board of Commissioner has to listen to their Civil Counsel and all they were doing was collecting information.

Commissioner Tryban commented that this was not specifically about the County Clerks, Township Clerks of City Clerks, but above the heads of all of those officials. She didn’t know where that came from, that they were going against the clerks because they do the work and they do a fine job, but she wasn’t sure at the State level. She didn’t agree with the State changing deadlines and she thought the whole problem lied with the process of the absentee ballots.

Commissioner Matelski commented that she visited the Veteran’s Memorial Park and it looked fantastic.

Sheriff Clarmont commented that the Sheriff Department’s Work Crew was up and running.

The Regular City Council meeting was called to order by Mayor Tebo via teleconference at 7:00 p.m.

Public Hearings:

• Consideration of a request from Nicholas Jarvis to vacate a portion of Second Street. o The Public Hearing was opened at 7:03 p.m. o City Manager Eustice explained that this is a portion of the Second Street right-of-way that has never been developed. Mr. Jarvis owns many lots adjacent to the Street, all lots on both sides with exception of 100 feet. o Mr. Nicholas Jarvis explained that he is in the process of cleaning up his lots. o Councilman Kwiatkowski inquired if the street would be cleaned up and maintained. o Mr. Jarvis responded that he still a ways away from cleaning up the alley. o Ms. Casey Clear commented that she lives in this neighborhood and believes the property is too wet to be developed as a road, she supports the vacation. o The Public Hearing was closed at 7:14 p.m. o Councilwoman Brandt moved to approve the request from Nicholas Jarvis to vacate a portion of Second Street between North F Street and Piret Street via Resolution, described as follows: a portion of a 56-foot street right-of -way (Second Street) in the PLAT of TURNER AND HUMPHREY’S SECOND ADDITION TO THE CITY OF CHEBOYGAN, Block No’s. 3 and 4 – bound on the north by the south right-of-way line of North “F” Street (56’), bound on the east by the west lot line of lots 1-7 of block 3 of said Plat (359’), bound on south by the north right-of-way line of Piret Street (56’), bound on the west by the east lot line of lots 8 and 10 of block 4 of said Plat (333.6’), seconded by Councilman Hocquard. A roll call vote was taken. Yes votes: Brandt, Raab, Hocquard, Tebo, and Mallory. No votes: Kwiatkowski. Motion passed. • Consideration of a Grant Application to the United States Department of Agriculture. o Chief Jones explained he was notified the City of Cheboygan is eligible for a $25,000 grant to purchase a patrol vehicle. The total cost of the patrol vehicle that the Chief Regular City Council Meeting April 27, 2021

recommends purchasing is $33,372 which includes an extended warranty. This would require a payment of $8,372 from the City’s Equipment Fund. o The Public Hearing was opened at 7:21 p.m. o Ms. Patricia Gildner commented that the purchase sounds like a good plan. o Mr. RJ Archambo commented that he supports providing first responders and police with the necessary equipment to do their jobs. o Ms. Sharen Lange commented she supports strong public safety, which is the key to developing a good community. She supports conservative spending, meeting needs within our means. o Mr. David Martin commented that it sounded like a great deal. o The Public Hearing was closed at 7:24 p.m. o Councilwoman Raab moved to approve the grant application to the United States Department of Agriculture in the amount of $25,000 to purchase a Police Patrol Vehicle, with the extended warranty in the total amount of $33,372.00, seconded by Councilman Hocquard. General Business:

• Consideration of Appointment to the City Council to Temporarily Fill Vacated City Council Seat. o Potential candidates introduced themselves, Mr. Dennis Olsen, Mr. David Martin, Mr. RJ Archambo, and Ms. Karrie White. o Councilwoman Brandt moved to temporarily appoint RJ Archambo to fill the vacated City Council seat, seconded by Councilwoman Raab. A roll call vote was taken. Yes votes: Raab, Tebo, Mallory, Brandt, and Kwiatkowski. Abstained: Hocquard. Motion passed. • Consideration to take Proposals-Annual Financial Audit o Councilman Kwiatkowski moved to approve taking proposals for the Annual Financial Audit for fiscal years ending June 30, 2021, 2022, and 2023, seconded by Councilwoman Brandt. A roll call vote was taken, motion carried unanimously. • Consideration of Donation. o Ms. Pat Rintamaki explained that they are suggesting the donated sculpture be placed in Washington Park. She has provided an approximate budget for installation including donations and in-kind donations. o Council discussed issues with liability insurance and ideas for lighting the sculpture. o Mayor Pro Tem Mallory moved to approve the donation form Cheboygan Cement Products & the Gildner family of Urn-E, seconded by Councilwoman Raab. A roll call vote was taken, motion carried unanimously. • Consideration to schedule a Public Hearing for Tuesday, May 11, 2021 for a Michigan Economic Development Corporation Community Development Block Grant Application. o City Manager Eustice explained the purpose of the grant is for water or sewer related infrastructure. The application is due May 31st with a maximum award amount of $2 million. It would be used to help offset the cost of the Wastewater Treatment Plant Improvement. o Councilwoman Raab moved to schedule a Public Hearing for Tuesday, May 11, 2021, for a Michigan Economic Development Corporation Community Development Block Grant Regular City Council Meeting April 27, 2021

Application for Water-related Infrastructure in the amount of $2 million, seconded by Councilwoman Brandt. A roll call vote was taken, motion carried unanimously. • Consideration to take bids on the 1985 GMC 7000 Series Fire Truck. o City Manager Eustice explained that Fire Chief Don Dailey is requesting permission from City Council to take bids to sell a 195 GMC 7000 Series Firetruck with a minimum bid of $2,500.00, the specs were provided. The truck was taken out of service last year when the Fire Department purchased a newer truck from the City of Petoskey. o Councilwoman Brandt moved to approve the taking of sealed bids for the 1985 GMC 7000 Series Fire Truck with a minimum bid of $2,500, seconded by Councilman Kwiatkowski. A roll call vote was taken, motion carried unanimously.

City Manager’s Report:

• City Manager Eustice explained no bids were received for the property in Benton Township. Bids will be received until May 7th for the Western Avenue project. • City Manager Eustice discussed the status of the Pier Project; they are currently in the process of getting bids and are expecting to start construction mid to late July. The project is being completed at no cost to the City but through a $300,000 grant from the DNR Land Trust and a $325,000 grant from the Great Lakes Trust. • City Manager Eustice reported the US 23 detour is scheduled to start Wednesday, April 28th. • City Manager Eustice also reported Ms. Dan Sabolsky has signed the employment agreement and is scheduled to start no later than June 1st. He is planning on visiting the week of May 7th.

Public Comments:

• Ms. Connie Rieger thanked council for accepting the donation of Urn-E. She is excited about the new City Manager Candidate. • Mr. David Martin requested an update on the Rental Registration Ordinance and inquired about the Recreation Commission Liaison. • Ms. Patricia Gildner thanked council for accepting the donation of Urn-E on behalf of the Gildner Family. • Ms. Sharen Lange thanked all the candidates and urged them to stay involved on other Board and Commissions.

Council Response to Public Comments:

• Mayor Tebo responded that the Recreation Commission Liaison would be selected between now and the next Council meeting. He thanked the candidates for applying for the open Council seat and reminded everyone that they can officially run in November. • City Manager Eustice responded that he is working on getting a meeting set up with Chief Jones and Jennifer Ostwald to review the Rental Registration Ordinance and clarify.

Committee Updates:

• Councilwoman Raab reported that the Historic Resource Commission is meeting the first Monday in May. She reported that the CCE 911 Board is still working on getting all of the towers working so there isn’t another shut down. Regular City Council Meeting April 27, 2021

• Councilwoman Brandt reported that the Housing Commission is accepting applications for rental assistance. There is funding available for emergency rent relief. Contact her or Kate Schulz. Ms. Schulz is still working on repositioning the housing. • Councilman Kwiatkowski reported that the Finance Committee met and continued the discussion of the General Fund contribution to the DDA and in kind services. The preliminary 2021-2022 was provided and reviewed. The sewer project was discussed and potential rate increases of $38/quarter for system users would be needed to cover the debt service.

Messages and Communications from Mayor and Council Members:

• Mayor Pro Tem Mallory inquired what weekend is scheduled for brush pickup. City Manager Eustice reported that brush can be put out on the street until May 7th. • Mayor Tebo inquired if the City Liability Insurance carrier and can review the City’s policies and procedures to verify that they are up to date and training is up to date. City Manager Eustice responded that he would reach out to our representative. • Councilwoman Brandt inquired when the City would be meeting with Inverness. City Manager Eustice responded that Mr. Greg Elliott is working on getting a group together to represent Inverness and they will schedule a meeting.

City Clerk’s and Treasurer’s Comments:

• Revenue and Expense by Fund as of April 30, 2021. • Clerk/Treasurer Brown reported that the election for the COPIESD millage renewal was held on May 4, 2021 with 385 voters participating. The millage renewal passed at the local level and at the County level.

City Manager’s Report:

• City Manager Eustice reported that the new City Manager, Dan Sabolsky met with staff and other community members on May 7th. Dan is still working on locating housing but plans to start on June 1, 2021. • City Manager Eustice discussed a potential monetary donation from The Woods. • City Manager Eustice reported that he would be meeting with Mr. Tom Chastain to discuss a potential donation to the city of river front property. • City Manager Eustice reported that there is currently a Coast Guard Committee with seven members to review the Coast Guard City application and requirements. • City Manager Eustice reported that the Ordinance Enforcement Committee would be meeting on Thursday May 13th to review the Rental Registration Ordinance.

• Ms. Connie Rieger thanked Council for their problem solving regarding the sale of the Western Avenue property.

Committee Updates:

• Mayor Tebo inquired if Councilman Archambo would be willing to be the liaison for the Recreation Commission. City Manager Eustice will check with City Attorney Stephen Lindsay to verify if Councilman Archambo can still serve as a commissioner on the Historic Resource Commission.

Cheboygan County Board of Commissioners Election Information Sub-Committee April 14, 2021

The Election Information Sub-Committee was called to order via telephonic and in the Commissioners Room by Chairperson Richard Sangster at 10:00 a.m.

Roll called and a quorum present.

Stephanie Lambert commented that she worked with Attorney Matthew DePerno on the Antrim County Election lawsuit and she just wanted to let the sub-committee know that she was present for this meeting.

NEW BUSINESS

Commissioner Sangster commented that there has been some discussion regarding the election process along with a bunch of information and we were trying to get to the bottom of it.

Commissioner Warfield commented that many of our citizens were concerned with the integrity of the recent election. He would like everybody to keep an open mind as we hear from a number of different people and perhaps we can insure the citizens of Cheboygan County that we have a level of integrity of at least our local election.

Beth Bridgman stated that going through the process would be helpful for everybody, but it was not just about the product. This was to show the citizens in the county how the election was run and can interface better, and to know how they can get involved in the entire election process as a volunteer to serve at the polls or a precinct delegate. Ms. Bridgman gave a power point presentation. She proposed a Mission Statement as follows: Restore Election standards that meet FEC guidelines for all future elections. In 2001, the Federal Election Commission revised performance procedures with emphasis on feedback to voters – under or overvotes; audit trails, telecommunications and broadcasting of unofficial results; internet voting; and acceptable error rates for human error, which was 1 in 250,000 and machine error was 1 in 10,000,000. With the Recount in the 2000, it was pretty much the last of the hand counted ballots where they Election Information Sub-Committee – April 14, 2021

were making the hanging chads. It was established by Mike Wendell’s video, Absolute Proof about Diebold’s Machines in 2002 that they had a weighted formula that they used for each of the different types of votes, which could change an entire election. In 2002 this was already in use by Diebold, which was later bought out by Dominion Voting Systems. She knew about election fraud issues back in 2008. The US Postal Service filed a patent for voting systems combining mail and a blockchain, which she used after requesting an absentee ballot. This would let her know where her request was at, at any given stage along the way. After the 2020 November Election, she went on www.mi.gov/vote to see if her vote had counted and it was not there. She found out later that the governor had changed some election laws and they were not going to certify the election until November 17th.

She explained how to start a FOIA request and where to find the FOIA forms on the county website. This was how anyone would find out how transparently government offices operate. Election results could also be found on the county clerk’s website.

She stated that she had been hearing from the media about a Center for Tech and Civic Life grant that was coming from a Zuckerberg owned non-profit organization. A FOIA request was sent to the City of Cheboygan regarding a grant in the amount of $5,000 from the Center for Tech and Civic Life to purchase an additional tabulator for their Absentee Voter Counting Board. This grant was offered to everybody because of the need to vote absentee due to COVID-19.

She presented the Governor failures of the November 2020 General Election as follows: 1) Lockdowns to justify mail-in ballots – legislated, Eos; 2) Withheld Federal Funds for Elections; 3) Pushed Zuckerberg CTCL Grant money as COVID Relief; and 4) Delayed certification until November 17th.

Secretary of State also had some failures such as: Register Voters-legitimate; absentee ballots – requested, legitimate; mail-in ballots – all adjudicated, no signature verification, and multiples and military ballots – all adjudicated.

Attorney Matthew DePerno’s interview video with the Gateway Pundit from Monday said that 32 different groups have been granted access to the Michigan voter role. A list of the number of registered voters was given to her by the County Clerk. If you looked at the population from the last census and the number of registered voters, Cheboygan County has a high elderly population. It was phenomenal the number of registered voters in the precincts that have an absentee voter counting board.

Attorney Matthew DePerno stated that somebody at the state level could hack into all of the computers using an algorithm or open up different registered voters without the counties even being aware that this has been done. There were a high number of spoiled ballots found for the March 4, 2020 Presidential Election. The FEC stated that the voters should know if their ballot was an undervote or overvote, but a state’s newsletter stated that voters should be instructed to place their voted ballot in the auxiliary bin of the tabulator and should never be told to wait or to come back later while the tabulator issue was addressed. After voting absentee, she contacted the City Clerk Bridget Brown to see if her absentee ballot had been tabulated and was told that it would be tabulated by 12 P.M.. She explained that Ms. Brown followed the guidelines properly.

Election Information Sub-Committee – April 14, 2021

The Dominion Voting Systems failures were as follows: 1) Use of Sharpies; 2) Adjudication from ambiguous marks ballot warning, blank ballot warning, overvote warning, misread ballot warning and crossover ballot warning - intentionally designed to create high numbers; 3) Printers – no special paper or watermarks to identify the ballots; 4) Extra tabulators; 5) Confusion – Election Source would assume all support from Government Business Systems, meet replacements and new tabulator instruction manual – September 21st; 6) Modems; 7) Software/Hacking – Antrim Forensic Audit showed uncertified software updates on October 23rd and November 5th; 8) Foreign Interference – see lindelltv.com; and 9) Propaganda – Antrim Clerk confident audit will confirm election results.

Stephanie Lambert commented that she had a full calendar today and wanted to give an update on the new evidence in the Antrim County case. Her law firm had a new forensic team do an analysis on ES&S and Dominion Election systems in Michigan and had forensic data confirming that Taiwan communicated with one of the Dominion Election Systems. She stated that these were all loose monopolies and all co-mingled. The ES&S machines all have a Verizon card in them, which makes it a telephone, and they had communications internally coming in on November 3rd to a tabulator. So given these two pieces of new forensic international communications because these were internet based machines and in Antrim County they didn’t have the entire discovery in yet. She did know that Antrim County had a proposed order for 17 external wireless modems for their Dominion machines. She offered to send their forensic team to Cheboygan County at no cost to do a forensic analysis of their election equipment.

Ms. Bridgman explained that a township board establishes one (1) tabulator as an Absentee Voter Counting Board at the cost of $5,300 to just process the mail in ballots or the absentee ballots. The directions were given on how to establish an AVCB. There were four (4) townships that had AVCB: Beaugrand, Benton Inverness and Tuscarora Township. In the November General Election, she counted up the numbers from the Canvass Board’s Presidential Candidates report (Page 3 of 170). Then there was the precinct ballot summary, which had a lot of information. The one column regarding the number of votes for Trump didn’t add up. These numbers were like 400 times more than the numbers. Other reports to compare were the canvass board results, county results, and the precinct ballot summaries to see where we were really at.

Election Integrity Objectives: 1) Voter ID required; 2) Voter signature verifications on requested absentee ballots; 3) No ballot drop boxes; 4) Hand count the next election and/or future elections; and 5) Decertify the 2020 November General Election. Matthew DePerno stated on Monday that there were 62 precincts in Wayne County that could not certify their elections. Cheboygan County would not be the only county to decertify the election given the information that was given today. One person with the right access to the software can write an algorithm that can permeate into the entire state. Michigan was one of a few hand full of states that voted straight ticket and straight ticket ballots were the easiest ballot to flip. The Republican Party created some of their own problems allowing straight ticket party voting. She would like to see the results from the 2018 election because this was when the Dominion Voting Systems was conveniently purchased. She explained that she knew enough to know that the election had to be looked at and it had to be looked at closely because no legal charges were going to fix anything at the local level. So by next week, there was going to be mounds of information.

Commissioner Sangster thanked Ms. Bridgman and stated this was a lot of information to digest.

Election Information Sub-Committee – April 14, 2021

Commissioner Warfield thanked Ms. Bridgman for all of the information that she had presented to the Board over the last 5 months and stated that she has left him with more questions since he walked into the door. He asked how it could be programmed to read the sharpies and who actually programed the machines or did it come with the software? Ms. Bridgman stated that every county had the software ability to put in their elections. Once you have the modem, anybody from around the world could hack into it and change the software. Each county were just updating information like who were the candidates. This was why Ms. Lambert stated that they found a computer in Taiwan.

Vice President Steve DeLongchamp of Election Sources addressed the Board stating that there was a lot to unpack here with this presentation and unfortunately, everyone that was online could not see any of the slides. CISA, which was the United States Department of Homeland Security Cyber Division, the Department of Justice, the FBI and just about every single authority had already come out and debunked the Antrim County debacle. All of these organizations have come up to say that there was zero tampering of the election, specifically not just with Antrim County, but in the country as a whole. The tabulators in Cheboygan County were not connected to the internet, because Cheboygan County did not purchase modems. Nor did Cheboygan County have adjudication because they never purchased that module. He gave an example of his truck which has a button for a sunroof and there’s a spot in the roof area, however, it does not have a sunroof, very similar to the configuration that Cheboygan and most other counties in Michigan have. In Michigan, we have what is called hand ballots or paper ballots. It’s the golden standard of voting in Michigan where those ballots were stubbed, numbered and accounted for. Each municipality was issued a certain number of these ballots. Each precinct has to account for the number of used ballots, voted ballots and the unvoted ballots at the end of the day and balance. If anybody believed that there was an issue with the election or their machine was not counting correctly, they still have those hand ballots, so they could go back to and hand count. In fact, the State hand counted all of Antrim County and they came up with the conclusion that those hand tallies matched the computer tallies or the machine tallies. Zero discrepancies regarding how the machines counted votes and zero discrepancies in the number of ballots issued as in the number of ballots that were counted in the hand count. He explained all of the preparation that goes into an election prior to an election to make sure that the machines count correctly, which consisted of a Preliminary Test and a Public Accuracy Test. This was a logic and accuracy test where a chart of pre-determined results was made. The ballot was marked in accordance to that chart; the ballots are run through the tabulator and test to make sure that those tabulators count correctly. Every municipality in Michigan performs these tests and then after the election there was a canvass done by the Canvass Board, audits and also risk limiting audits. In every instance, those have proven that the machines counted correctly. Every single authority has deemed that the election in Antrim County, as well as in the rest of the state in all of the Dominion Voting Systems counted correctly. Dominion Voting Systems does not do fractional voting. Professor of Computer Science and Engineering Alex Halderman from MSU also conducted a forensic test in Antrim County and he concluded that Antrim’s counts at the end of the day were correct and that the forensic audit done by ASOG was incorrect. The machines were certified by the EAC with the use of sharpie markers. Sharpie pens are not water based, which means they do not bleed or run and dry nearly instantly, and they do not smear when they’re going into the tabulator. Ink pens do not dry instantly and there were over a million different combinations of these out there. Sharpies were absolutely the standard for every voting system in the country. The way that it was set up was with no oval from front to back lines up and they do not create ambiguous marks. Ambiguous marks were something completely different. An ambiguous mark was a second change for a voter who may have dragged their pen or stuck a little pin mark inside the oval. The tabulator actually gives the voter a second chance to make sure of what the voter wants to say because there was only a

very small amount of this oval colored in in this particular race and if you want that race to be counted, please fill the oval in completely. This was born out of the hanging chad in the 2004 Florida Election where they just couldn’t determine the voter’s intent. This tries to make sure that they capture the voter’s intent right there at the tabulator, if there’s an issue. He addressed the preliminary and public accuracy testing. The State of Michigan Bureau of Elections sets forth ballot printing standards that every ballot must be printed in accordance to these standards. These were certified vendors/printers that Dominion Voting Systems or ES&S uses.

Commissioner Warfield asked Mr. DeLongchamp to expand more on the preliminary testing of the tabulators. The State of Michigan has decreed that every tabulator before an election had to have a certain number of ballots run through it in accordance to what’s called the Michigan’s promulgated rules. In these rules, it gives us all the different scenarios that a voter could vote on a ballot. They were kind of like what, when and then questions. From those questions, Election Source or the clerk creates for the municipal clerks a chart of pre-determined results that lets them know how to mark ballots. So they mark these ballots in accordance to that chart, then they run those ballots through the machine. When they print the totals, those totals need to match those pre-determined results. That way they can tell that the machine was counting correctly. Keep in mind that these machines were vetted through the EAC to have less than one misread per one million marks. This has to happen on every tabulator before every election, even on the high speed tabulators or the virtual assistant/ADA devices. Not only does a preliminary test have to be done, but also a public accuracy test has to be done where the public could come in, watch and sign off on the test as well. These ballots were then sealed with the proper paperwork. Keep in mind that Dominion or Election Source didn’t facilitate elections. Elections were conducted by municipal or city clerks.

Commissioner Warfield asked when Cheboygan County had their last hand count. Commissioner Tryban stated that in 2001, there were still a couple of small townships that were still using paper ballots. Mr. DeLongchamp stated that in 2004 was when hand counts were no longer considered legal in Michigan and these were the least accurate way to tabulate ballots.

Ms. Bridgman asked what happened if we do have a preliminary testing and somebody hacked into the software between that time and the election. Mr. DeLongchamp stated that in Michigan, they had stubbed paper ballots, which was the gold standard of voting. At any time, they could go back and hand count these paper ballots. If a municipality didn’t balance, the Canvass Board could ask them to re-tabulate. A candidate for a federal, state, county, city, township, village or school office who believes that the canvass votes cast on the office was incorrect because of fraud or error in the precinct returns may petition for a can request a recount/hand count of votes cast in the precincts involved. Also a registered elector who voted at an election at which a questions appeared on the ballot who feels that the canvass of the votes cast on the question was incorrect because of fraud or error in the precinct returns may petition for a recount of the votes cast in the precincts involved. There was a cost, but he wasn’t sure of the cost structure. Antrim County did a full hand recount and the whole State of Georgia also recounted three (3) times regarding the Dominion Voting Systems. There were zero variation from hand count to tabulator count – zero.

Missy France, citizen of Inverness Township was trying to wrap her brain around the fact that they had proven that electronic tabulators were far more accurate than any hand count, but yet they did a hand count to prove that there was zero error. So, that meant that the hand count was just as accurate. Mr. DeLongchamp explained that in Georgia, they had thousands of folks come in at great expense and over a three (3) day period they recounted the ballots. Whenever there was a discrepancy, they recounted again and found that the first time that they counted,

they were inaccurate. So, then they recounted a third time to make sure that the hand count was correct. You can see the redundancy in that and how long it would take, how many man hours and how many people were used to count and ballots. It was significant step backwards in progress.

Mr. DeLongchamp commented that Ms. Bridgman mentioned the Uniformed and Overseas Citizens Absentee Voters (UOCAVA) for the military and overseas civilian’s ballots where there must be some type of technology to be able to read these ballots better. He explained that she was putting her faith in this, but was not putting her faith into the tabulators counting correctly with all of the checks and balances that were in place in Michigan.

Randy Strong, citizen of Nunda Township commented that he listened to a really good presentation about potential problems with the voting systems. Then he listened to a really good presentation about how everything was airtight. Someone just offered an independent company free of charge to come and do a forensic audit to check and make sure that the system was working as per this system seems to be working. He didn’t understand why they would not jump upon this and get working on this tomorrow.

Joe Klein, citizen of Benton Township strongly suggested that they go ahead and secure the voting machines.

Commissioner Sangster commented that they would take this information under advisement to the full board, come back with another recommendation, and another date for the next meeting. Under Michigan Law MCL168.37a states that the county commission does not have the authority over a county clerk to determine which electronic voting system would be used. For the record, the county clerk was in control and this Board respects and stands behind her. It was important for the future of our elections, in the airing and vetting of the clerks across this country. He encouraged the citizens to vote as they move forward with this. He appreciated all the work that everyone has done. Ms. Lambert’s offer will be brought to the full Board to be discussed.

Vice Chair of the Republican Party Tammy Carlone commented that she was a candidate for the State Board of Education in 2020 and 2018. She appreciated the efforts to get to the truth because this was what we need for all people across the State of Michigan whether their Democrat or Republican. We just want to be able to trust the election results.

Motion by Commissioner Tryban, seconded by Commissioner Warfield, to adjourn to the call of the chairperson. A roll call vote was taken. Motion carried with 3 yes, 0 no and 0 absent. Meeting adjourned at 11:27 a.m.

ADMINISTRATOR’S REPORT 6-8-21

MARINA FUEL SYSTEM PROJECT: Ryba Marine has started installation of the fuel dock sheet pile at the Marina. This will continue over the next week. Footing and foundation of the fuel dock building will follow later in June/July.

COUNTY BUILDING COLUMN REPAIR: The contractor has re-scheduled the building column repair to begin this month.

HR DIRECTOR: The HR Director will be starting on June 15, 2021.

UNION NEGOTIATIONS: Union negotiations are expected to begin July.

Title: State FY 2022-2023 Title IV-D Cooperative Reimbursement Program Application - 53rd Circuit Court – Friend of the Court

Summary: The Office of Child Support (OCS) is exercising the 2 one-year extensions in the current Cooperative Reimbursement (CRP) agreement by offering budgets for FY 2022 and FY 2023. OCS reimburses the County at a rate of 66%. The proposed net budgets for FY2022 and FY 2023 are $632,044.28 for each year, with state reimbursement of $417,149.23 at 66% for each year.

Financial Impact: The financial impact to Cheboygan County remains the same as in prior years. Once the application is approved, a Contract/Agreement will follow from the State of Michigan. The State will reimburse 66% of the Friend of the Court’s expenditures to operate the program and provide the services outlined in the contract.

Recommendation: Motion to approve the submission of the 53rd Circuit Court’s Friend of the Court – Fiscal Years 2022 and 2023 extensions to the current Cooperative Reimbursement agreement, allow the Administrator or Finance Director to sign the application electronically in eGrams, accept the award if granted, and allow the Finance Director to make the necessary budget adjustments.
