Town Council Meeting – Thursday, June 17, 2021 The Barnstable Town Council Meeting on Thursday, June 17, 2021 at 7:00 PM was held in person at Barnstable Town Hall, 2nd Floor, James H. Crocker, Jr. Hearing Room, 367 Main Street, Hyannis. The public was also able to view through Live Streaming on the Town of Barnstable’s website or Comcast Channel 18. Town Council President Matthew Levesque opened last night’s Town Council Meeting by announcing with the recent legislative action by the state, meetings will be held in person during the month of June and return to remote as of July 1, 2021 for the foreseeable future. The Town Council recited the Pledge of Allegiance. Town Councilor Jennifer Cullum offered a Moment of Silence in honor of Ralph Krau who passed away recently. Mr. Krau was a long-time volunteer who served on many Town committee’s including most recently the Comprehensive Financial Advisory Committee. Picture is from the August 19, 2019 Town Council meeting when Precinct 13 Town Councilor Jen Cullum presented Deb and Ralph Krau of Hyannis with a Citation from the Town Council recognizing their volunteer efforts to improve their village and their Town. The list of their accomplishments is so long we couldn’t fit it all here. A small sample of their work includes: (for Deb) the Hyannis Water Board, Hyannis Fire Department Moderator; (for Ralph) the Comprehensive Financial Advisory Committee, the Town’s 375th Celebration Committee; and (for both) the 4th of July Parade and Hyannis Open Streets. Congratulations, Deb & Ralph! Thank you for your efforts! And to paraphrase Ralph, “we look forward to the next decade!” Next up was Public Comment which was followed by Barnstable Police Chief Matthew Sonnabend provided an update on traffic issues in the Town and then Council response to Public Comment. OLD BUSINESS began with Inspectional Services Director and Building Commissioner Brian Florence presenting Agenda Item 2021-153 Appropriation Order in the amount of $2,353,579 for the Inspectional Services Department Fiscal Year 2022 Operating Budget which was approved. DPW Director Dan Santos was joined by Town Engineer Griffin Beaudoin, Highway Division Supervisor Mike Perry, and Structures & Grounds Supervisor Joe Marshall in presenting Agenda Item 2021-154 Appropriation Order in the amount of $10,470,034 for the Public Works Department General Fund Fiscal Year 2022 Operating Budget which was approved. DPW Director Santos joined by Solid Waste Division Supervisor P.J. Kelliher presented Agenda Item 2021-155 Appropriation Order in the amount of $3,407,469 for the Solid Waste Enterprise Fund Fiscal Year 2022 Operating Budget which was approved. Town Attorney Karen Nober presented Agenda Item 2021-183 Approval of exemption from financial interest from Section 20 of G.L. c. 268A which was approved. On behalf of Town Councilor Kris Clark, Town Manager Mark Ells provided an update on the May 8th letter received from Cape Rail that says they will address the trash issues reported on at previous Town Council meetings. There will be a Special Town Council Meeting on Thursday, July 1, 2021 and the next regularly scheduled Town Council Meeting will be held on Thursday, July 15, 2021 at 7:00 PM. Town of Barnstable Statement in Response to Conservation Law Foundation Lawsuit In response to a lawsuit filed by the Conservation Law Foundation (CLF) on Wednesday, June 16, 2021, that alleges that the Town of Barnstable has failed to comply with the state regulations that apply to private septic systems, the Town has provided the following statement. The Town of Barnstable has long prided itself on its commitment to protecting the environment and the coastal waters off Cape Cod. Despite the Town’s commitment, the Conservation Law Foundation (“CLF”) has filed a lawsuit in state court alleging that the Town has failed to comply with the state regulations that apply to private septic systems. The Town faithfully administers the Massachusetts Department of Environmental Protection (MassDEP) regulations, but CLF’s lawsuit threatens to impose significant burdens on Barnstable’s residents and businesses. Specifically, CLF requests an order requiring most Barnstable property owners to pay for expensive upgrades to their fully compliant septic systems. It also seeks an order prohibiting the Town from approving most new septic systems and prohibiting the Town from accepting a “passing inspection report” for such systems. Together, these orders would effectively stop new construction utilizing fully compliant septic systems in Barnstable, and they would prevent the sale of most properties in Barnstable with a septic system. This new lawsuit follows a lawsuit that CLF filed against the Town in federal court earlier this year. In that complaint, CLF alleged that the Town’s fully permitted and compliant Water Pollution Control Facility is violating the federal Clean Water Act because treated wastewater from the plant travels through groundwater and ultimately reaches, after more than twenty years, coastal water off Cape Cod. If CLF prevails in its federal lawsuit, the Town could be subject to millions of dollars of penalties, attorney’s fees, and increased wastewater management costs. In addition, nearly every septic system on Cape Cod will be subject to the Clean Water Act, and owners of septic systems will need to obtain a federal permit or face lawsuits like CLF’s that threaten penalties totaling tens of thousands of dollars per day. The Town believes that CLF’s legal claims in these lawsuits are meritless and intends to defend against them aggressively. As Barnstable Town Manager Mark Ells commented, “we are committed to doing everything in our power to preserve the health of the waters surrounding the Cape. That is why we enforce the state law for septic systems and why we have developed and received regulatory approval for a Comprehensive Wastewater Management Plan (CWMP) for the Town of Barnstable. The CWMP is a plan to protect our waters by reducing the amount of key nutrients like nitrogen that harm water quality in our coastal estuaries. By implementing the CWMP, Barnstable will achieve the nitrogen reduction called for in the Total Maximum Daily Load documents developed by the Massachusetts Department of Environmental Protection and approved by the federal Environmental Protection Agency for estuaries on the Cape. CLF’s demands in these twin lawsuits exceed any requirement of either state or federal law, disrupt Barnstable’s plans to implement the CWMP, and carry the potential of devastating economic impact on Barnstable’s residents and businesses.”

Sign Up for Cynobacteria Alerts The Town will be contracting with the Association to Preserve Cape Cod (APCC) to conduct routine monitoring and reporting of cyanobacteria in Barnstable’s Lakes and Ponds. This sampling will begin soon. If you are interested in receiving an email notification, when a potentially toxic bloom is identified by APCC, you must opt-in to the APCC toxic alerts. Cyanobacteria Notice

As we enter the summer season, we wanted to let you know the Town is planning to resume cyanobacteria monitoring and reporting. However, this program will have a delayed start this year due to unanticipated staff turnover. We expect the program to resume in July. Until this program is back up and running, we wanted to provide some tips to identify cyanobacteria blooms, what to do if you suspect a bloom, and who to contact. Identifying Cyanobacteria Blooms The Massachusetts Department of Public Health has provided examples of cyanobacteria blooms with scums and without scums. https://www.mass.gov/service-details/identifying-cyanobacterial-blooms-and-scums- photographs-of-blooms-and-scums How do I know if there is a harmful algal bloom in the water? Cyanobacteria can cause the water to appear slightly discolored, cloudy, or resemble pea soup or paint. They are usually blue or green but can also be brown or red. They can also give the water a bad odor. The cyanobacteria in some blooms are dispersed throughout the water, while in other blooms they are concentrated in a scum or mat, either on the surface of the water or in sediment along the shoreline. What if you Suspect a Cyanobacteria Bloom? WHEN IN DOUBT, STAY OUT! If you see a possible cyanobacteria bloom, avoid contact with the water. Town of Barnstable Introduces On-line Rental Property Registration and Short-Term Rental Complaint Hotline As we enter our summer season the Town of Barnstable would like to remind owners of rental properties that they are required to register rental units with the Town of Barnstable Health Division; this includes ALL rentals from annual to summer to short-term. The requirement to register rental properties has been in place in Barnstable since 2006. Accessory Dwelling Unit Update: Public Hearing Date Change The Town of Barnstable advertised a public hearing to consider zoning amendments allowing Accessory Dwelling Units for an in-person Town Council meeting on July 1st. On June 16th, the Governor signed a bill allowing public meetings to continue to be held remotely. In order to maximize the opportunity for public participation, the public hearing on the ADU zoning amendments has been rescheduled for July 15th and the hearing will be held remotely, via Zoom. Details for the Zoom meeting including the link and meeting ID are forthcoming and will be incorporated with all future communications. Welcome Back to Our Community Service Officers Effective Monday, June 14th, 10 Barnstable Police summer Community Service Officers (CSOs) began their duty in the Hyannis Main Street area, assisting the Community Impact Unit and the rest of the department in keeping an eye on downtown. The goal of the CSO program is to provide a visible, easily identifiable Department presence on Main Street. The CSOs act mainly as liaisons between sworn personnel and the businesses, visitors, etc., and are used to supplement the sworn presence on Main Street and surrounding areas. They are our “eyes and ears”. Make sure to stop them to say “Hello” and welcome them back when you see them! In these photos, Sergeant Eric Drifmeyer and Ptl. JetBlue Returns to Cape Cod Gateway Airport Cape Cod Gateway Airport (HYA), formerly Barnstable Municipal Airport, is excited to announce the return of JetBlue Airways for their 8th season of service. Beginning Thursday, June 17, 2021, daily flights are scheduled to arrive from New York’s John F. Kennedy International Airport (JFK) at 11:11 a.m. and depart to JFK at 11:49 a.m. EST (schedule subject to change). “We are thrilled with the return of JetBlue,” said Airport Manager Katie Servis. “This route furthers our mission to provide convenient air service for people traveling to and from the economic center of Cape Cod, Hyannis, and provides fast and easy travel for residents, visitors and business travelers.” TSA requires proper wearing of face masks, per federal law. Face masks are to be worn at all times in the terminal and on aircraft. Failure to comply will result in denial of entry to the screening areas and may result in penalties. Cape Cod Gateway Airport (HYA) is continuing to implement social distancing policies, as well as enhanced cleaning procedures throughout the airport.

Family Activities are planned for Hyannis 2:00 PM-8:00 PM Traditional Parades and Celebrations scheduled in Barnstable Village, Cotuit and Hyannis Port FIREWORKS IN LEWIS BAY AT DUSK Town Manager Mark Ells has announced the Town of Barnstable will work in collaboration with the Hyannis Main Street Business Improvement District (BID) and the Greater Hyannis Chamber of Commerce to host family friendly activities on Sunday, July 4th on the Hyannis Village Green and spanning across the mile-long Hyannis Main Street down to Hyannis Harbor. Residents and visitors will be delighted as they walk along Main Street and enjoy the sights. There is no annual Hyannis 4th of July parade this year. HYANNIS HARBOR & ASELTON PARK Starting at 2:00 PM the traditional Hyannis Marina Boat Parade will take place in Hyannis Harbor. Boats are invited to line up starting at 1:00 PM at the marina and the parade enters the Harbor at 2:00 PM where spectators will find interactive family activities taking place at Aselton Park from 2:00 PM-6:00 PM as they cheer on the boaters and enjoy the decorated vessels. PARKING & TRANSPORTATION PARKING – There are several municipal lots in downtown Hyannis where free parking is available for up to 6 hours. All-day permits can be purchased at www.permitvats.com. Cape Cod Regional Transit Authority (CCRTA) has hourly parking available after the first 30 minutes free at the Hyannis Transportation Center. Long term parking is also available for daily rates. CCRTA will be operating on its regular routes with a loop every 45 minutes throughout the day. Normally the service ends at 9:00 PM but service will be extended as needed to accommodate riders following the fireworks. Kalmus Beach closes at 4:00 PM and is open for handicap parking only (permit must be shown at the gate). The Town of Barnstable requires that anyone who owns, keeps, possesses or has control of a dog six months of age or older must have their pet licensed and vaccinated against rabies every year. In the interest of continued social distancing, and limiting face-to-face contact with others we have converted to a touch-free payment process for your 2021 Dog License. Please be advised that beach stickers are only available for purchase through our on-line portal www.barnstablema.viewpointcloud.com or through the mail by downloading an application from our website www.townofbarnstable.us/Departments/Recreation/Beach- Stickers While there is a 2-3 week turnaround time to process your permit, you can print and use your online purchase receipt to gain access to beach parking lots. 2020 beach parking permits will be accepted until June 25th. Parking permits will not be available to purchase in person but applications can be picked up, filled out, and left in the drop box outside of the Hyannis Youth & Community Center at 141 Basset Lane, Hyannis. Keep Active and Thrive with the BACC on Channel 18 The Barnstable Adult Community Center (BACC) and Channel 18 have teamed up to provide dedicated BACC programming hours on Comcast CH18. At that time, air travelers 18 years of age and older will need a REAL ID compliant driver’s license or identification card, or another TSA-acceptable form of identification, for domestic air travel and to enter certain federal facilities. ROAD WORK UPDATES As always please slow down and use extreme caution when traveling through the road construction areas and follow posted safety and detour signs. *NEW* National Grid New Customer Hookups Wednesday and Thursday, June 23-24, 2021 Neuco crews will install gas service on 1815 Phinney's Lane, Barnstable. Typical natural gas service installation includes marking out underground utilities within the project area, excavation of the street, laying gas main, relaying customer’s individual gas service and connecting those services to the main and installing meters. This project should take about two days to complete. Visit ngrid.com/service line to view a YouTube video explaining the replacement of the service pipe to customer homes. Operations will start promptly at 7:00 AM and run until 3:00 PM. Reduce speed, and use caution. All scheduled work is dependent on weather and/or may be impacted due to an emergency situation. *UPDATED* National Grid Gas Pipe Installation, Anchor Lane National Grid, through their contractor Fraser Engineering, is planning on replacing the Anchor Lane Regulator Station, which will include removal of the existing regulator station and installation of a prefabricated 3 layer regulator station, and new gas lines that will tie into the existing 10” gas main located along the Route 28 roadway shoulder. Work will take place on the corner of Anchor Lane and Falmouth Rd (Route 28) in Cotuit. Construction is expected to last to September 1, 2021. Weather pending, construction will be on-going, Monday through Friday from 7:00 AM to 4:30 PM until completion of this phase of the project. Portions of Anchor Lane travel lanes will be restricted, and work on Falmouth Road will include temporary lane closures, which will be controlled by police details. As always, please slow down and use extreme caution when traveling through the road construction areas, and follow posted safety and detour signs. *CONTINUES* Rendezvous Lane Wastewater Pump Station Replacement Project The Town of Barnstable’s contractor, Robert B. Our Co., Inc., is under contract to complete a wastewater pump station replacement project at the intersection of Rendezvous Lane, Kent Road and Salten Point Road. The project involves a new below grade precast concrete wet well and valve vault, pumping system, control panel, standby generator and gravity sewer main to replace the existing wastewater pump station at the Town Right of Way to Barnstable Harbor at the end of Rendezvous Lane. The improvements are necessary to replace the existing pump station approaching the end of its intended service life and to relocate the new pump station above the FEMA base flood elevation. Typical work hours are 7:00 AM to 4:00 PM, with groundwater dewatering pumps and sewer bypass pumps occasionally requiring 24/7 operation. Remaining work includes installation of curbing, final paving the roadway and restoration of disturbed areas. The Town Way to Water will remain accessible via Kent Road to Salten Point Road for the duration of the project, unless otherwise noted. *UPDATED* Drainage & Pavement Improvements on Wheeler Road in Marstons Mills Drainage and pavement improvements on Wheeler Road in Marstons Mills are currently on-going and will continue during the week of June 21st, 2021. The remaining work will include the raising of structures to finished grade, final asphalt paving and restoration of all disturbed areas. Please use caution and safe speeds when traveling on Wheeler Road during construction operations. *UPDATED* Drainage Improvements on Lake Shore Drive in Marstons Mills The Towns contractor, Tasco Construction, will continue drainage improvements at five (5) locations along Head of the Pond Rd and Lake Shore Drive in Marstons Mills. The work includes installation of new drainage systems, repairs to existing drainage systems, adjustment of drainage structure castings, and restoration of any areas disturbed during construction. Normal work hours will be between 7:00 AM to 3:30 PM, Monday through Friday. Through traffic will be maintained throughout construction. Any lane closures will be supported with police details to direct traffic. Motorists are advised to seek alternate routes to avoid the construction work. *UPDATED* MassDOT Schedules Intersection Improvements at Falmouth Road (Route 28) at Osterville West Barnstable Road MassDOT Construction operations on the intersection at Falmouth Road (Route 28) at Osterville West Barnstable Road are ongoing and will continue through to June 21, 2021. The road has been redesigned to include exclusive left turn lanes and improve bicycle and pedestrian accommodation as part of the proposed safety improvement work. The work to be done consists of furnishing and installing of new traffic signal equipment at the intersection including emergency vehicle pre-emption system, bicycle and vehicles loop detectors, construction of ADA compliant wheelchair ramps, sidewalks, and driveways, box widening, pavement milling and resurfacing, new pavement markings and signs, drainage improvements, water distribution modifications, existing utility pole relocations, installation of granite curbing, loam and seeding. Work will be performed during the day, Monday through Friday 7:00 AM-3:30 PM. Nightwork is anticpated for the week of June 21st to complete the striping of the newly paved intersection. Traffic control will include all required signage, channeling devices for lane shifts and alternating one-way traffic as required. Police details/ flaggers will be used as needed.
